This article discusses the land registration as a legal construction of law in order to facing Asean economic communities The problems in this study are: (1) What is the Government's policy in solving the problem of land registration in Indonesia so that it can provide certainty for the business world in increasing domestic investment in welcoming the ASEAN Economic Community? (2) How is the implementation of state policies in land registration to provide an investment climate with legal certainty related to land issues? This research uses a normative juridical approach, by analyzing and interpreting theoretical matters concerning principles, conceptions, theories and legal norms relating to land registration. The results of the study show that the government needs to create legal certainty regarding land issues so that it can provide investment excitement for the business world in increasing domestic investment in the atmosphere of the ASEAN Economic Community. The guarantee of legal certainty to be realized in this land registration includes certainty of the status of land rights, certainty of legal subjects, and certainty of legal objects.

Abstract: In order to give the assurance of legal certainty, certainty of rights and legal protection to holders and owners of land rights, the land registration shall be carried out. However, there is still a land dispute which now become a homework for The Government. This is because the certificate which should be a strong evidentiary can not guaranteed the legal certainty for the owner, so the person who right the land can blocking the certificate of land rights at Land Office. The issuance of Regulation Minister of Agrarian Affairs and Spatial / Head of National Land Office Number 13 Year of 2017 concerning the Procedures of Block and Sita which expected to create uniformity, standardization in recording process and abolition of registration blocked, it turns out not all the rules can be implemented at The Land Office of Sleman and Bantul Regency.The result of this research shows that blocking certificate process at Sleman Land Office and Bantul Land Office have a policy that the applicant is required to pay the blocking recording fee after the blocking received. Makes a potential loss to the (PNBP) which should be owned by Land Office for faced the problem of KKPweb application which have not been able to accomodate the time period of blocking. Keywords : blocking certificate, blocking, registration blocked Intisari: Dalam rangka memberikan jaminan kepastian hukum dan kepastian hak serta perlindungan hukum kepada pemegang dan pemilik hak atas tanah, maka dilaksanakan pendaftaran tanah. Namun demikian, masih saja terjadi sengketa pertanahan yang saat ini menjadi pekerjaan rumah bagi Pemerintah. Hal ini disebabkan karena, sertipikat sebagai alat pembuktian yang kuat ternyata belum menjamin kepastian hukum pemiliknya sehingga pihak yang merasa berhak atas tanah tersebut dapat melakukan blokir sertipikat hak atas tanah di Kantor Pertanahan. Dikeluarkannya Permen ATR/Kepala Nomor 13 Tahun 2017 tentang Tata Cara Blokir dan Sita yang diharapkan bertujuan untuk mewujudkan keseragaman, standarisasi dalam pelaksanaan pencatatan dan penghapusan catatan blokir ternyata tidak semua peraturan tersebut dapat dilaksanakan di Kantor Pertanahan Kabupaten Sleman dan Bantul. Hasil penelitian menunjukan bahwa pelaksanaan pencatatan blokir di kantor pertanahan Kabupaten Sleman dan Kabupaten Bantul terdapat kebijakan yaitu pemohon diwajibkan membayar biaya pencatatan blokir setelah blokirnya diterima membuat potensial loss terhadap (PNBP) yang seharusnya didapat kantor pertanahan untuk kendala yang dihadapi yaitu Aplikasi KKPweb yang belum dapat mengakomodir jangka waktu blokir. Abstract: Complete Systematic Land Registration is a program which taken by the government in providing legal certainty in the field of land in Indonesia. PTSL activities at Sidoarjo Regency and Pasuruan Regency Land Office are carried out with third parties. Before starting the measurement, it is necessary to carry out the contradictoire delimitatie principle to ensure legal certainty of ownership of land rights. The research used a qualitative method with a descriptive approach. The data analysis carried out by compiling logically proportional statements to answer research questions. Problem analysis is carried out by making a description based on premier data and secondary data obtained through interviews and observations of implementation. The results of the research showed that the implementation of the contradictoire delimitatie principle is broadly following PP. No. 24 of 1997 and PMNA KaBPN No. 3 of 1997. The results of the study also showed that there were obstacles in the implementation of the contradictoire delimitatie principle, such as the third parties were not following technical guidelines No. 01 / JUKNIS-300/1/2018 annex 10 in the making of measurement drawings. Quality control is needed to improve the quality of work and results of third party products and minimize land problems in the future.Keywords: principle of contradictoire delimitation, third party. Intisari : Pendaftaran Tanah Sistematis Lengkap (PTSL) merupakan langkah pemerintah dalam memberikan jaminan kepastian hukum dalam bidang pertanahan di Indonesia. Kegiatan PTSL di Kantor Pertanahan Kabupaten Sidoarjo dan Kabupaten Pasuruan dilaksanakan bekerjasama dengan Pihak Ketiga yang sebelumnya melalui tahapan asas contradictoire delimitatie untuk menjamin kepastian hukum kepemilikan hak atas tanah. Metode penelitian yang digunakan adalah metode kualitatif dengan pendekatan deskriptif. Teknik analisa yang dilakukan yaitu dengan menyusun pernyataan-pernyataan proposional secara logis untuk menjawab pertanyaan penelitian. Analisa permasalahan dilakukan dengan membuat uraian berdasarkan data premier dan data sekunder yang diperoleh melalui wawancara serta observasi langsung terhadap pelaksanaan kegiatan. Hasil penelitian menunjukkan bahwa pelaksanaan asas contradictoire delimitatie secara garis besar telah sesuai dengan PP. No. 24 Tahun 1997 dan PMNA KaBPN No. 3 Tahun 1997. Dalam pelaksanaanya terdapat hambatan yakni  pembuatan Gambar Ukur oleh Pihak Ketiga tidak sesuai dengan pedoman JUKNIS No. 01/JUKNIS-300/1/2018 lampiran 10. Sehingga diperlukan pengawasan kendali mutu terkait pekerjaan dan hasil produk dari Pihak Ketiga agar kedepannya hasil pekerjaan yang dihasilkan lebih baik dan tidak menjadi permasalahan pertanahan dikemudian hari.Kata Kunci : asas contradictoire delimitatie, pihak ketiga.

<p>Since 2003 Bali Concord II that  sett up  (ASEAN Economic Community/AEC, Indonesia has been engaged in the efforts of strengthening the country especially setting forth economic policy that is condusive to achieving the country’s level of competition. The paper shall deal with challenges that Indonesia has faced in the issue. The challenges that are identified include balance of trade, dependable entrepreneurs, and rate of productivity of manpower.How has the government come up with sound economic policies? Further and deeper research into the validity of the Retroactive Principle is required in order to provide assertiveness about the arrangement of Retroactive Principles in the field of agreement law in the Indonesian legal system, especially the Building Rights Agreement in Agrarian Law and the existence of obscure legal norms in the case of the legal Notary / PPAT to the granting right of building use for a period of validity is reviewed according to the provisions of Article 28 of Regulation of Head of National Land Agency Number 2 Year 2013 concerning the Delegation of Authority of Land Rights and Land Registration Activity and by using case approach of PT. Pan Pacific Nirwana Resort. This research is a normative legal research that is derived from the existence of obscurity of legal principle and legal norm contained in the provisions of Law Number 5 Year 1960 on Basic Agrarian Law Basic (UUPA) in the provisions of Article 30 and Article 28 Regulation of Head of National Land Agency No. 2 of 2013 on the Delegation of Authority of Land Rights and Land Registration Activities. The conclusion of this research in Agrarian Law there is legal uncertainty in the concept of law building rights agreement with a period of time that is still running and the future is approved by a new regulation by the government which caused the previous agreement to occur normatively contradictory whether using retroactive or non-retroactive principle and the validity of deed Notary / PPAT in the granting of right to building to limited liability company which is still valid time is reviewed according to UUPA, Article 28 Regulation of Head of National Land Agency Number 2 Year 2013 regarding Delegation of Authority of Land Rights and Land Registration Activity and Article 1320 Privat Law and by using approach case PT. Pan Pacific Nirwana Resort is not valid. Penelitian lebih lanjut dan mendalam terhadap keberlakuan Asas Retroaktif diperlukan dalam rangka memberikan ketegasan  tentang pengaturan Asas Retroaktif [1] di bidang hukum perjanjian dalam sistem hukum Indonesia khususnya perjanjian Hak Guna Bangunan dalam Hukum Agraria serta masih adanya kekaburan norma hukum dalam hal keabsahan akte Notaris/PPAT terhadap Perseroan Terbatas dalam  pemberian Hak Guna Bangunan yang jangka waktunya masih berlaku dikaji menurut ketentuan Pasal 28 Peraturan Kepala Badan Pertanahan Nasional Nomor 2 Tahun 2013 tentang Pelimpahan Kewenangan Pemberian Hak Atas Tanah Dan Kegiatan Pendaftaran Tanah serta dengan menggunakan pendekatan kasus PT. Pan Pasific Nirwana Resort. Penelitian ini merupakan penelitian hukum normatif yakni beranjak dari adanya kekaburan asas hukum dan norma hukum yang terdapat di dalam ketentuan Undang-Undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-pokok Agraria (UUPA) dalam ketentuan Pasal 30 dan Pasal 28 Peraturan Kepala Badan Pertanahan Nasional No. 2 Tahun 2013 tentang Pelimpahan Kewenangan Pemberian Hak Atas Tanah Dan Kegiatan Pendaftaran Tanah. Kesimpulan dari penelitian ini dalam Hukum Agraria terdapat ketidakpastian hukum dalam konsep hukum perjanjian Hak Guna Bangunan dengan jangka waktu yang masih berjalan dan ke depannya di sahkan suatu peraturan baru oleh pemerintah yang menyebabkan perjanjian sebelumnya terjadi pertentangan secara normatif apakah menggunakan asas retroaktif atau non retroaktif dan keabsahan Akta Notaris/PPAT dalam Pemberian Hak Guna Bangunan terhadap Perseroan Terbatas yang jangka waktunya masih berlaku dikaji menurut UUPA, Pasal 28 Peraturan Kepala Badan Pertanahan Nasional Nomor 2 Tahun 2013 tentang Pelimpahan Kewenangan Pemberian Hak Atas Tanah Dan Kegiatan Pendaftaran Tanah jo Pasal 1320 KUH Perdata serta dengan menggunakan pendekatan kasus PT. Pan Pasific Nirwana Resort adalah tidak sah.

This research attempts to analyze the effects of the economic integration of the ASEAN Economic Community (AEC) which was implemented since 2015. The impact analyzed is focused on investments made in Indonesia, both investments made by foreign investors and domestic investors. Another thing that was also highlighted in this study was the flow of exports and imports. This was also investigated because one of the policies contained in the agreement of the ASEAN economic community was the elimination of international trade barriers. In addition to the two things above, researchers also analyzed the influence of the ASEAN economic community on the use oflabor in Indonesia. The data analyzed in this study are secondary data obtained from the relevant agencies. The method used in this study is a different sample pair test. This method is used because the research conducted is comparing the conditions of investment, export-import and use of labor in Indonesia before and after the economic integration of the ASEAN Economic Community. At the end of this study, researchers will provide recommendations to the government regarding what should be done by the government to optimize investment activities, exports and use of local labor in Indonesia.

This study is aimed to provide an evaluation of banking performance in ASEAN given the inclusion of the ASEAN Economic Community (AEC) which is associated with an increase in potential systemic risk. Some of the main findings in this study are: (a) the increase in systemic risk is influenced by the increase in risk on asset quality as seen from the increase in the percentage of non-performing loans; (b) bank liquidity has a significant positive effect on increasing systemic risk; (c) banks with large capital can exert influence over increased systemic risk (in a 90% confidence level but here we use 95% confidence level). The government is expected to be able to mitigate the increase in potential systemic risks, especially after the integration of free trade in ASEAN.

Abstract Following the agreement of the ASEAN Economic Community (AEC) in 2015, it has been approved that cooperation between ASEAN and the other five partner countries, namely China, Japan, Australia, New Zealand, and Korea, has been bound in new economic partnerships, Regional Comprehensive Economic Partnership (RCEP). The main objective of RCEP is to empower economic integrity and enhance the economic development of respective member countries. Coffee and cocoa are two of Indonesia’s important estate commodities for exports. A study focusing on coffee and cocoa agribusiness development to take advantage of RCEP was conducted in several production centers of rural areas. This paper aims to analyze the role of coffee and cocoa business in RCEP trade cooperation by: (i) understanding and analyzing trade on RCEP using RCA and RO, (ii) reviewing trade development in RCEP toward Indonesia’s coffee and cocoa performance using Gereffi analysis. This study was conducted in North Sumatra and South Sulawesi provinces. The study revealed an opportunity for coffee and cocoa to increase their market in the RCEP region but only with its high quality. Coffee and cocoa should be well prepared with significant, integrative, and comprehensive improvement. The government is suggested increasing the production and productivity of coffee and cocoa through intensive extension and closely working with the farmers.

As an implementation of welfare society, the government issued Law Number 5 of 1960 Article 19 paragraph (2) c, which provide the legal certainty of land rights for all Indonesians carried out through land registration. The land registration system adopted by Indonesia is negative land cadastre with positive tendency. The implementation of land registration provide the basis of state duty to produce land registration evidence, namely certificate, which is valid as a strong proof of rights. This certificate guarantees the correctness of physical data besides juridical data as long as it is not proven otherwise. Method: This legal research used Normative juridical method, with qualitative juridical data analysis. Results of the study: Negative land cadastre with positive tendency adopted by Indonesia currently does not guarantee legal certainty of land ownership and the community justice itself. This is indicated by the fact that there is still a phenomenon of land disputes, among the result of the issuance of overlapping. By using a legal cadastre-based domain approach, through an approach of extracting historical values of land and integrating the process of dialogue within the issuing of certificate; obtaining legal certainty and the community justice can be achieved. Conclusion: Negative land cadastre with positive tendency is still unable to manifest legal certainty of land ownership and community justice so it is appropriate that an adage states “the highest legal certainty, is the highest injustice”. Strengthening land registration system through the domain approach is an alternative option to manifest legal certainty and community justice.

In civil law, land is included in registered objects. Therefore ownership of land rights must be registered, for legal certainty. Land registration is regulated in PP No. 24 of 1997 concerning Land Registration. However, there are still many lands that have not been registered, to overcome this the government has issued a comprehensive systematic land registration program (PTSL) based on Minister of Agrarian Regulation No. 6 of 2018. The aim of this program is to provide legal certainty and legal protection for land rights owned by the community. The Complete Systematic Land Registration Program (PTSL) provides an opportunity for people who have not registered their land that is located throughout Indonesia in one village or village area. As in the Lima Puluh Kota Regency, there are still many lands that have not been registered, the people obtained them from buying and selling under their hands.The formulation of the problem in this thesis is firstly how is the land registration procedure with the basis of under-selling rights of purchase under the complete systematic land registration program (PTSL) at the fifty-city district land office ?; second, what are the obstacles in the implementation of land registration on the basis of the right to buy and sell under the complete systematic land registration program (PTSL) at the fifty-city district land office? The specification of this research is analytical descriptive, with a normative juridical approach, which is supported by an empirical juridical approach. The data used are secondary data as primary data and primary data as support, which are collected through literature studies and field studies with interview techniques. The data is then analyzed qualitatively and presented in a qualitative descriptive form. The results of the research and discussion of this thesis can be concluded that the procedure of land registration with the basis of the rights under the hand in the PTSL program in fifty cities is carried out with the stages of planning, location determination, preparation, formation and establishment of the PTSL adjudication committee and task force, counseling, physical data collection and collecting juridical data, researching juridical data for proving rights, announcing physical and juridical data and ratifying it, affirming conversion, recognizing rights and granting rights, accounting for rights, issuing certificates of land rights, documenting and submitting the results of activities and reporting.

This article reports the results of a study on how to fill the free market program of ASEAN Economic Community (AEC). Indonesia has significant demographic bonus when compared to other ASEAN countries, so that specifically Indonesia will become an easy target for economic activity (read: free market flow transactions) carried out by all members of ASEAN. Demographic bonus is an opportunity and challenge for the Indonesian people, both for those who live in cities or in the countryside. This condition will be more complicated, if the mapping potential of the population does not become a serious concern for the government and stakeholders so that the people of Indonesia will become the largest consumer for products of ASEAN countries. One of the potential populations of Indonesia is women, because they have specific skills that are able to be directed towards an income. The purpose of this study is to prepare the people of Indonesia who have the skills, especially women in entering the AEC both urban and rural communities. This study uses a qualitative method of observation, interviews and review of documents, such as books, newspapers and others.
