This study aims to determine the effect of Islamic bank’s activity as a zakat intermediator on profitability, efficiency, market share, and growth of Islamic banks in Indonesia. This research also analyses from the literature the possibility of zakat as the funding or financing product. The method used is the panel data method and granger causality. The Independent variable external zakat collection while the dependent variables are ROA, BOPO, Market Share, and Growth. The samples of the research are five Islamic Bank who has done the external zakat collection. The data used are quarterly data with a period from 2013 to 2020. The results of this study indicate that this divine role increase the cost of operation and in the same time decreasing the profitability. The result also stated that the intermediating activities of zakat collection is not significant to push the bank market share, profitability as well as the Bank Growth. However, although in terms of regulation bank cannot be the Amil, in the future, there is potential of zakat can push the Islamic market share and bank growth since the zakat collection, Islamic bank can offer third party funding product as the intermediation between the zakat payer and the Amil zakat whose eligible to collect zakat according to the government regulation.

ABSTRACTHajj as a great symbol of worship. Hajj is the fifth pillar of Islam which is mandatory for every Muslim who are able to da it in accordance with the legal requirement of pilgrimage. One of the legal conditions of Hajj is the capability, capable to cover the cost of the hajj and the family left behind. Panin Bank Dubai Sharia Bank was established based on the regulation of Limited Company No. 12 dated January 8, 1972 by Moeslim Dalidd, a notary in Malang. PT. Bank Panin Dubai Syariah Tbk has been legalized by the Financial Services Authority ("OJK"), in accordance with a copy of the policy of the Board of Commissioners of OJK No. Kep-29 / D.03 / 2016 on July 26, 2016.Therefore, through this research, the writer wants to understand: (1) how is the practice of applying alternative financial agreement of hajj and umrah after the implementation of regulation made by ministry of religious affair No. 24 year 2016 at Panin Bank Dubai Syariah Surabaya branch? (2) What is the analysis of Islamic law on the practice of multilateral contract alternative application in this Bank? Therefore, this study is aimed to, firstly, understand and describe the application of alternative contracts to hajj and umrah after the regulation of Ministry of Religious Affairs No. 24 of 2016 in Panin Bank Dubai Sharia branch Surabaya, and to describe the analysis of Sharia Economic Law about the practice of applying alternative contract in the bank.The method used in this research is qualitative method. The research data are taken in natural situation in Panin Bank Dubai Syariah Surabaya. The data are taken during operational hours using case study approach. Are done through interview technique with the main participant, Assistant Manager 1, and document, archive, book, sample of registration, as secondary data source. The data are analyzed through 3 (three) data deduction, display data and ended with conclusion and verification.The results of the study indicate that the Panin Bank Dubai Sharia runs in accordance with the government regulation No. 24 year 2016 "BPS BPIH is prohibited from providing direct and indirect Hajj money service" including Hajj and Umrah services using various financing products and funds saving, funds collecting in the form of deposits, savings or other forms, using multi-service financing akad wadi'ah, with the savings of hajj services with initial minimum deposit of Rp500,000,and according to customers’ ability. Keywords: hajj, umrah, wadi'ah.

This study aims to determine the effect of macroeconomics factor, third party funds and market share to profitability sharia banks industry period 2011 until 2015. The research method used is a quantitative approach. The dependent variable in this study is profitability (ROA), as well as the independent variable in this study is macroeconomics factor (inflation and gross domestic product), third party funds and market share. Sampling method in this research used a saturated sampling. The analysis technique used is multiple linier regression.Research result shows that the confidence level is 95%, macroeconomics factor (inflation and gross domestic product) and third party funds have a negative correlation to profitability (ROA). Simultaneously variables in this study a significant effect on the magnitude of the amount of profitability (ROA) sharia banks industry with 84.4% value of coefficient determination. The partially, third party funds and market share had significant effect toprofitability (ROA) sharia banks industry.

This study aims to determine the effect of Financing to Deposit Ratio, profit sharing of third party funds, overhead cost, and BI rate on Murabahah margin rate in Islamic Bank Industries in Indonesia period 2012-2017. This research use multiple linear regression analysis. There are four independent variable in this research namely Financing to Deposit Ratio, Profit Sharing Of Third Party Funds, Overhead Cost, and BI Rate. The sample in this study used a saturated sample, while data were taken from Islamic Bank Statistic issued by OJK, while BI rate taken from www.bi.go.id. The result show that Financing to Deposit Ratio and profit sharing of thirty party funds has positive and significant effect on the Murabahah margin rate. While overhead cost and BI rate has no effect on the Murabahah margin rate. All the independent variables in this research are simultaneously has significant effect on the Murabahah margin rate.Keywords: Financing to Deposit Ratio (FDR), profit sharing of third party funds, overhead cost, BI rate, Murabahah margin rate.

Abstrack The study analyzed Article 22 of Government Regulation Number 13 of 2010 concerning government policies for the exemption of waqf land certification fees according to state administrative law. The analyze focus on the reasons for the government to issue such policies in the perspective of the state administrative law. The research type of library research requires secondary data, which consists of primary, secondary and tertiary legal materials, normative juridical approaches, and qualitative data analysis. The results of the study explained that the government issued a policy of freeing the cost of waqf land certificates aimed at empowering waqf land so that its designation could be felt by the community, accelerating the legality of waqf land, protecting and securing and optimizing the benefits of waqf assets. This policy is an effort to understand waqf deeds which means worship and legal certainty. Government policy is the implementation of the function of the  state administrative law in creating a government that is clean and in accordance with the principles of good general governance, namely; the principles of legality, equality, justice, legal protection, wisdom, implementation of public interest, and acting meticulously. Key Words: State Administrative Law, Free of Cost, Endowments Land Certification Abstrak Penelitian menganalisis Pasal 22 Peraturan Peemrintah Nomor 13 Tahun 2010 tentang kebijakan pemerintah pembebasan biaya sertifikasi tanah wakaf menurut hukum administrasi negara. Menganalisis alasan pemerintah mengeluarkan kebijakan demikian dalam perspektif HAN. Jenis penelitian library research, memerlukan data sekunder, yang terdiri dari bahan hukum primer, sekunder dan tersier, pendekatannya yuridis normatif, dan analisis datanya kualitatif. Hasil penelitian menjelaskan bahwa pemerintah mengeluarkan kebijakan  membebaskan biaya sertifikat tanah wakaf bertujuan untuk memberdayakan tanah wakaf supaya peruntukannya dapat dirasakan masyarakat, percepatan legalitas tanah wakaf, melindungi dan mengamankan serta mengoptimalkan manfaat aset wakaf. Kebijakan ini adalah salah satu upaya memahami perbuatan wakaf yang bermakna ibadah dan berkepastian hukum. Kebijakan pemerintah merupakan implementasi fungsi HAN dalam menciptakan pemerintahan yang bersih dan sesuai asas pemerintahan umum yang baik, yakni; asas legalitas, kesamaan, keadilan, perlindungan hukum, kebijaksanaan, penyelenggaraan kepentingan umum, dan bertindak cermat. Kata Kunci: Hukum Administrasi Negara, Bebas Biaya, Sertifikasi Tanah Wakaf

The Malaysian Islamic financial services have developed and thrived in the competitive domestic and global financial market especially in the last three decades.  The Government has provided the industry conducive enabling environment to catalyse the industry growth and development. Islamic finance has gained prominence and been identified as the growth area in the nation’s financial sector.  The Bank Negara Malaysia Annual Report 2020 published on 3 April 2020 amongst others highlights that with an advanced regulatory framework already in place, Islamic finance is poised to play a more prominent role in the coming period, particularly in its potential to apply shariah principles to expand social finance and address market gaps in innovative ways.  With a range of innovative shariah compliant products and services, the halal financial services have gained market acceptance from both Muslims and non-Muslims alike, albeit with different levels of acceptance according to the products.  Specifically, to a certain degree it appears that the market has been more receptive of other Islamic financial services such as loans for various purposes including purchases of securities, properties, vehicles; working capital and even personal loans than the credit cards.  According to the Bank Negara Monthly Statistical Bulletin: Monthly Highlights and Statistics in September 2020, as of September 2020, Islamic banks had disbursed 35.7% or RM651.4 billion of the total loans in the banking system in September 2020.  The Islamic credit cards however have a lower market share of 10.2% or RM3.7 billion of total credit card transactions.  The slower growth pace, lower market share and performance of Islamic credit cards vis–a-vis conventional credit cards, and also compared with other Islamic financial products merit further scrutiny and analysis to help better understand the issues pertinent the growth of the Islamic credit cards. Issues such as why other Islamic loans and hire purchase products have performed better; why the slower growth of Islamic credit cards; customers and market expectation of Islamic credit cards; Islamic credit card product development and marketing strategies need to be carefully examined in order to overcome Islamic credit card growth conundrum.

While promoting the global economy and trade, ports impose serious pollution on the global ocean and atmosphere. Therefore, the development of ports is restrained by the policies and measures of governments and international organizations used to cope with climate change and environmental protection. With the development of information technology, the operation and expansion of ports is facing forms of green and intelligent reform. This research aims to link the development of green intelligent ports, government policies, and third-party organizations to find the most suitable evolutionary path for the development of green intelligent ports. This paper assumes that governments will push ports to transform into green intelligent ports from the perspective of benefiting long-term interests, that the goal of ports is to maximize their profits, and that third-party organizations will actively promote the development of green intelligent ports. Based on these assumptions, this paper has established an evolutionary game theory model of “government–port–third-party organization” regarding the development of green intelligent ports. The Jacobian matrix of the game theory system was constructed by using the replicator dynamic equation, and local stability analysis was performed to obtain the equilibrium stability point of the entire system. This research reveals the limitations of the development of green intelligent ports without government involvement and explores the ability of third-party organizations to promote the implementation of policies, confirming the role of government regulation and control in promoting the development of green intelligent ports. This paper may be helpful for the development of green intelligent ports in the future. The results show that: (1) The main factors affecting the choice of port strategy are the benefits of building a green intelligent port, the intensity of government regulation, and the quantitative influence of third-party evaluation results on the port strategy selection. (2) Government decision-making plays an important role in port transformation. If the relevant government chooses the wrong strategy, then the transformation of the port will be delayed. (3) Government regulation and control need to change with the change of the evolution stage. (4) Compared with the macro-control policies of the government, the influence of the third-party organization on the port is significantly smaller.

In recent years, China’s chemical industry has incurred frequent safety accidents which seriously impact the social environment and public safety. Traditional approaches have reached a bottleneck due to a lack of relevant professionals in the government regulation of chemical enterprise safety production. Thus, a new safety regulation mechanism should be conducted. In this paper, we constructed an evolutionary game model of chemical industry safety regulation based on limited rationality, and the influence of main parameters on the equilibrium evolution process is studied by system dynamics simulation. The results show that government regulation authorities play a leading role in the process of chemical industry safety regulation and increasing punishment will help to achieve an evolutionary stable strategy (ESS). What is more, the feasibility and effectiveness of the third-party regulation service mechanism are verified, and the market access threshold of third-party regulation service needs to be improved to stop the occurrence of rent-seeking activities in the regulatory process. In summary, the introduction of third-party regulation service entities to the chemical industry safety regulation process has far-reaching implications for promoting the healthy development of China’s chemical industry.

AbstractThis paper studied a tripartite evolutionary game of stakeholders in environmental pollution control. Most previous studies on this issue are limited to a focus on system dynamics with two-party game problems and lack a spatial analysis of strategy evolution. The parameters adopted are too few, and the influencing factors considered are too simple. The purpose of the paper is to introduce more parameters to study, which will have an important impact on the strategy choices of participants and the evolution path of the strategy over time. We construct a tripartite evolutionary game model of sewage enterprises, governments and the public. We establish a payment matrix and replicator equations as our method, and we also implement parameter simulations in MATLAB. In summary, we found that the reward and punishment mechanism plays an important role in environmental pollution control. Specifically: intensifying rewards and penalties will help encourage sewage enterprises to meet the discharge standard and the public to participate in pollution control action. However, increased rewards will reduce government's willingness to adopt incentive strategies; Government's reward for public's participation in the action must be greater than the increased cost of participation; Reducing the cost of sewage enterprise can also encourage them to implement standard emissions. The research presented in this paper further improves standard emissions and designs reasonable reward and punishment mechanism.

AbstractIslamic banking now has a legal strength by the presence of law number 21 of 2008 which is very influential for the existence of Islamic banking. Currently the market share of Islamic banking has reached 5 percent of the total national banking. Islamic banking products continue to grow over time;the funds of third-party in the period of June 2016 reached 12,185,860 trillion rupiah with financing funds of 3,027,266 trillion rupiah. This suggests that the existence of inequality especially on financing products of Islamic banks must be optimized byofferingfinancing products to all people, especially to Muslim entrepreneurs in order that they use the products to develop their business. A Muslim businessman, Sunardi Pamella, the owner of Pamella supermarket Yogyakarta has become a customer of Islamic bank and employs its products to develop her businesses. The demand on financing products of Islamic banks is still low, so that Islamic banks need to promote their products to Muslim entrepreneurs. This paper focuses on financing products of Islamic banks and the motivation of Pamella Sunardi as a businessman to usethe products. This is alibrary research and the results show that the number of loan of Islamic banking has grown 6,074 percent or higher than that ofconventional bank. Further, the number of loan is 10.127 percent in BPRS, but in Islamic business unitsis -8.234 percent. Pamella Sunardi uses financing products offered by Islamic Bank because he wants to do business based on Islamic ethics. Hal ini menunjukkan adanya ketimpangan khusunya pada produk pembiayaan di bank syariah harus lebih dioptimalkan. Bank syariah bisa menawarkan produk pembiayaan kepada semua kalangan khususnya kepada para pengusaha muslim untuk digunakan sebagi modal pengembangan usaha. Salah satu pengusaha muslim Pamella Sunardi pemilik supermarket Pamella Yogyakarta menjadi nasabah pembiayaan di bank syariah untuk mengembangkan usahanya. Adapun pertumbuhan pembiayaan di bank syariah masih sangat minim dibutuhkan upaya bagi bank syariah agar menawarkan kepada para pengusaha muslim.Batasan dalam tulisan ini difokuskan pada produk pembiayaan di bank syariah serta ketertarikan pengusaha Pamella Sunardi menggunakan produk pembiayaan di bank syariah. Tulisan ini menggunakan studi pustaka kajian dari berbagai sumber. Dalam tulisan ini menggunakan jenis penelitian kualitatif. Hasil dari tulisan ini menunjukkan bahwa jumlah rekening pembiayaan di bank syariah mengalami pertumbuhan 6,074 persen pada bank umum syariah, kemudian 10,127 persen pada BPRS, sedangakan pada unit usaha syariah turun -8,234 persen. Kemudian ketertarikan Pamella Sunardi menggunakan produk pembiayaan di Bank Syariah, pertama menerapkan etika bisnis islam pada usahanya, kedua karena pernah mengalami trauma menggunakan produk bank konvensional.Kata Kunci: Pamella Sunardi, Produk Pembiayaan, dan Bank Syariah

Perbankan syari’ah saat ini telah memiliki payung hukum yang kuat dengan hadirnya undang-undang nomor 21 tahun 2008 tentang perbankan syari’ah. Hal ini sangat berpengaruh terhadap eksistensi dari perbankan syari’ah yang semakin diminati oleh banyak kalangan.Bank syari’ah membutuhkan dana dalam menjalankan produk pembiayaannya. Deposito merupakan salah satu produk penghimpunan di bank syariah. Deposito di bank syariah terus mengalami pertumbuhan. Walaupun demikian bank syariah tetap harus meningkatkan produk deposito, untuk mencapai market share 5 persen. Untuk meningkatkan volume deposito bank syariah perlu memahami bentuk perilaku konsumsi masyarakat. Dari data yang ada kontribusi dana pihak ketiga bank syariah diberikan oleh produk deposito sebesar 71,15 persen.Penulisan ini menggunakan jenis deskriptif kualitatif, Batasan dalam tulisan ini difokuskan pada produk deposito di bank syari’ah perilaku konsumen.Tulisan ini menggunakan studi pustaka kajian dari berbagai sumber. Hasil dari tulisan ini bahwa deposito di bank syariah terus mengalami perkembangan, pada tahun 2015 pertumbuhan deposito di bank syariah mencapai 4,12 persen. Perilaku konsumsi memiliki banyak faktor dan bisa memberi pengaruh terhadap peningkatan produk deposito di bank syariah. Sehingga bank syariah perlu memahami perilaku konsumsi masyarakat dalam upaya meningkatkan potensi pengembangan produk deposito di bank syariah.potensi pengembangan produk pembiayaan mudharabah di bank syari’ah masih sangat besar.Potensi pengembangan produk deposito masih sangat besar dan sangat luas.Bank of Shariah now has a solid legal with the presence of the law number 21 in 2008 about Bank of Shariah.  This adversely affects the existence of the Shari'ah Bank that increasingly catches interest many people. Bank of Shari'ah requires funds in running financing products. Deposits are ones’ product accumulation in Islamic banks. Deposits in Islamic banks continued to grow. Nevertheless, Islamic banks still have to increase deposit products, to achieve a 5 percent market share. To increase the volume of deposits of Islamic banks need to understand the behaviors of consumption. From the available data the contribution of third party funds provided by the Islamic banks deposits amounted to 71.15 persen. This study uses a descriptive qualitative limitation. This paper is focused on products in Consumers Islamic bank deposits. This study uses literature review of various sources. The results of this paper that the deposits in Islamic banks continued to experienced growth, in 2015 the growth of deposits in Islamic banks reaches 4.12 percent. Consumer behavior has many factors and can give effect to an increase in deposit products in Islamic banks. So that Islamic banks need to understand the behavior of private consumption in order to increase the potential for product development of deposits in Bank of Shariah. The advantage of product development in Islamic bank financing is still enormous. The advantage of deposit product development is still very large and very spacious.
