AbstractThe management of the former PNPM-MPd funds does not yet have a legal umbrella, both laws, and regulations in other forms. Based on this, the authors see that there are legal problems, namely a legal vacuum (vacuum of Recht) regarding the management of former PNPM-MPd funds so that they have the potential to cause state financial losses (corruption). This paper includes normative juridical research with a statue approach and a conceptual approach. The results showed that the management of former PNPM-MPd funds was not explicitly regulated in statutory regulations. The potential for the occurrence of criminal acts of corruption to be exposed, as evidenced by the existence of criminal acts of corruption regarding the abuse of authority, resulting in losses to state finances. So that it takes legal politics to formulate the management of former PNPM-MPd funds so as not to harm state finances (the occurrence of criminal acts of corruption).Keywords: Political Law; Former Fund of the National Program for Rural Community Empowerment; Criminal Acts of Corruption.AbstrakPengelolaan eks dana PNPM-MPd belum memiliki payung hukum baik undang-undang maupun peraturan dalam bentuk yang lainnya. Berdasarkan hal tersebut, penulis melihat terdapat permasalahan hukum yaitu kekosongan hukum (vacuum of recht) mengenai pengaturan pengelolaan eks dana PNPM-MPd sehingga berpotensi untuk menimbulkan kerugian keuangan negara (tindak pidana korupsi). Makalah ini termasuk penelitian yuridis normatif dengan pendekatan peraturan perundang-undangan (statue approach), dan pendekatan konseptual (conseptual approach). Hasil penelitian menunjukkan bahwa pengelolaan eks dana PNPM-MPd tidak diatur secara eksplisit di dalam peraturan perundang-undangan. Potensi terjadinya tindak pidana korupsi menjadi terbuka, terbukti dengan adanya tindak pidana korupsi mengenai penyalahgunaan kewenangan sehingga menimbulkan kerugian keuangan negara. Sehingga diperlukan politik hukum untuk melakukan formulasi pengelolaan eks dana PNPM-MPd agar tidak merugikan keuangan negara (terjadinya tindak pidana korupsi).Kata Kunci: Politik hukum; Eks Dana Program Nasional Pemberdayaan Masyarakat Perdesaan; Tindak Pidana Korupsi.

AbstractPornography has become a material for sale and purchase transactions. Pornographic transactions on the internet have many processes , so that there are many laws and regulations that can be applied. This creates legal uncertainty. The formulation of the problem in this research is the qualification of criminal acts related to pornography selling and buying transactions on the internet media and the accountability of criminals in selling and buying pornography on the internet media. The research method used is legal research through a conceptual approach and a statutory approach to assess existing legal problems. The results of this study show that the sale and purchase of pornography via the internet can be applied to the ITE and pornography laws. Then the responsibility depends on the evidence in the process of proving in court what the form of pornography is.Keywords: Criminal Liability; Transactions; Buying and Selling; Pornography; Internet.AbstrakPornografi sudah menjadi bahan yang di transaksi jualbelikan. Transaksi pornografi di media internet memiliki banyak proses seperti penawaran, kesepakatan, penyerahan barang, dan pembayaran sehingga terdapat banyak peraturan perundang-undangan yang dapat diterapkan. Hal ini membuat ketidak pastian hukum. Rumusan masalah dalam penelitian ini adalah Kualifikasi tindak pidana terkait transaksi jualbeli pornografi di media internet dan pertanggungjawaban pelaku tindak pidana dalam transaksi jualbeli pornografi di media internet. Metode penelitian yang digunakan adalah legal research dengan melalui pendekatan konseptual dan pendekatan peraturan perundang-undangan untuk mengkaji permasalahan hukum yang ada. Hasil dari penelitian tersebut diketahui bahwa transaksi jualbeli pornografi melalui internet dapat diterapkan Undang-Undang ITE dan Pornografi. kemudian pertanggungjawabannya tergantung dari pembuktian dalam proses pembuktian di dalam persidangan apakah bentuk dari pornografi tersebut.Kata Kunci: Pertanggungjawaban Pidana; Transaksi; Jual Beli, Pornografi; Internet.

Indonesia has a poverty problem. The National Program for Independent Rural Community Empowerment is one of the strategies for community empowerment in an effort to accelerate poverty reduction. The SPP (Savings and Loans for Women) program is one of the programs from PNPM-MP that makes women or housewives the target of empowerment. The purpose of implementing the SPP (Savings and Loans for Women) program is to reduce poverty through capital loans for women accompanied by empowerment. This study aims to find out how the implementation of the National Program for Independent Rural Community Empowerment, in particular the implementation of the SPP (Savings and Loans for Women) Program in the study in Ompu Raja Hutapea Timur Village, Laguboti District, Toba Samosir Regency, about what aspects influence the community in participating in the program, how the flow implementation, as well as the obstacles encountered in the ongoing implementation of the program and their solutions.The research method used in this study is a qualitative research method. The research informants were the perpetrators of the National Program for Independent Rural Community Empowerment in Ompu Raja Hutapea Timur Village, namely the Village Head, TPK Chair, Village Community Empowerment Cadre, Person in Charge of Operational Activities, UPK Chair, and several group members who were participants of the SPP program. Data collection techniques were carried out through in-depth interviews and then the results were analyzed qualitatively. From the results of research conducted in the village of Ompu Raja Hutapea east regarding the implementation of the National Program for Independent Rural Community Empowerment, especially the SPP activity program, community participation is more dominated by the economic aspect. The lack of routine meetings for community empowerment by the government also results in obstacles such as delays in loan repayments. However, the community stated that they felt helped by the implementation of the SPP program.

Program nasional pemberdayaan masyarakat mandiri kelautan dan perikanan pada sektor perikanan diwujudkan dalam bentuk pengembangan usaha mina pedesaan. Program penanggulangan kemiskinan melalui pemberdayaan masyarakat kelautan dan perikanan seringkali tidak tepat sasaran dan tidak memperhitungkan keberlanjutan program sehingga kemiskinan tidak berkurang bahkan semakin bertambah. Pengembangan Usaha Mina Perdesaan (PUMP) merupakan salah satu program Kementerian Kelautan dan Perikanan (KKP) ditujukan untuk menanggulangi kasus kemiskinan pada kelompok masyarakat tertentu. Tujuan penelitian ini adalah untuk menganalisis pelaksanaan Pengembangan Usaha Mina Perdesaan (PUMP) pada kelompok masyarakat pengolah dan pemasar hasil perikanan di Kota Banda Aceh, mengetahui respon masyarakat terhadap Pengembangan Usaha Mina Perdesaan Pengolahan dan Pemasaran Hasil Perikanan (PUMP P2HP), dan mengidentifikasi faktor-faktor yang mempengaruhi pelaksanaan program tersebut. Penelitian ini menggunakan pendekatan kualitatif dan pengumpulan data dilakukan melalui wawancara, observasi dan desk study. Pengambilan sampel ditentukan secara purposive dengan responden anggota kelompok pengolah dan pemasar hasil perikanan (POKLAHSAR) penerima program. Metode analisis data dilakukan secara deskriptif. Hasil penelitian menunjukkan bahwa pelaksanaan PUMP P2HP di setiap tahapannya secara normatif memang telah terlaksana dan terdapat kesesuaian antara ketentuan pedoman program dengan pelaksanaannya di masyarakat. Namun demikian, dalam hal pelaksanaannya sebagai sebuah program pemberdayaan, secara substansi masih jauh dari tujuan yang diharapkan. Hal ini didukung dengan analisis mengenai respon masyarakat terhadap pelaksanaan program, baik itu mengenai keberlanjutan program, keterlibatan dalam program, manfaat program, dan konflik selama pelaksanaan program. Faktor-faktor dominan yang dapat menghambat pelaksanaan program ini secara keseluruhan perlu dilakukan perubahan dan perbaikan. Faktor yang menjadi penghambat dan penunjang keberhasilan program yaitu kesesuaian lokasi, pemberian peralatan yang menunjang produksi, dan ketepatan calon penerima bantuan. Rekomendasi kebijakan untuk perbaikan pelaksanaan program bantuan langsung tunai (BLT) di masa depan yaitu (1) Penyederhanaan dalam prosedural kegiatan program, (2) Ketepatan pemilihan calon penerima, (3) Pelatihan dan pendampingan kepada para calon penerima maupun penerima bantuan, dan (4) Evaluasi terhadap program bantuan untuk pengembangan usaha dan kemandirian penerima bantuan secara berkelanjutan. (Implementation of The National Program for Marine and Fisheries Community Empowerment in The Fisheries Processing Business : A Case Study in Banda Aceh City)Fish business development in the village level is considered as the natural program for marine and fisheries community empowerment. Poverty reduction programs through marine and fisheries community empowerment are does not effective and take into account the sustainability of the program so that poverty can not be reduced even increasing. National program of marine and fisheries in the fish processing business are considered one of the MMAF program intended to eliminate poverty in a certain society. The aims of this study was to analyze implementation of PUMP P2HP, particularly in Banda Aceh City, identify the public response to the PUMP P2HP, and identify factors that affect the implementation of the program. This research used a qualitative approach and data collection through interview, observation and desk study. Sample was determined using purposive sampling with respondents “kelompok pengolah dan pemasar” (POKLAHSAR) members participating in the program. The method of data analysis was carried out descriptively. Results show that the implementation of PUMP P2HP in each stage have indeed been implemented as in the guidelines on the implementation of programs in the community. However, in terms of its implementation as a policy of empowerment, it is still far from the expected goals. This is supported by an analysis of the public response to the implementation of the program, in relation to the sustainability of program, the participation in program, the benefits of program, and conflict occurred during implementation of the program. The dominant factors that can support and prevent the implementation of the program as a whole, that the implementation procedures should be be changed and improved. Inhibitory and supporting factor for success of the program were namely the suitability of the location, provision of equipment to support the production, and the accuracy of the prospective beneficiaries. Policy recommendations to improve implementation of the programs of direct cash assistance (BLT) in the future were identified as follows: (1) simplification of the program process, (2) accuracy in selecting candidates (3) training and assistance to the recipients and beneficiaries, and (4) evaluation of the programs for business development and self-reliance of beneficiaries sustainable manner.

Batik artwork has been known for hundreds of years and has become part of the culture of Indonesian society. Some batik motifs in Indonesia have philosophical values and are part of traditional traditional ceremony activities. Along with the times, the creativity of batik artists has become varied even though ancient traditional motifs are still mass produced and used as inspiration. This research examines the legal protection for traditional batik in order to avoid the abuse of rights by certain parties who merely exploit it in order to benefit from the existence of traditional batik works. The formulation of the problem that will be examined in this research is whether traditional batik gets legal protection under the copyright regime in Indonesia? Are there any legal safeguards at the international level for traditional Indonesian batik works? In answering this problem formulation will use a conceptual approach and a statutory approach. This research is a legal research that will examine existing legal concepts and related legal rules in solving legal problems related to the protection of traditional batik.

<div class="WordSection1"><p align="center"><strong>Abstract</strong></p><p><em>Th</em><em>e idea of regulating of governor’s authority as representative of central government to the regency/ town government after the amendment of 1945 constitution is aimed at answering two legal problems. They are: (1) How is the regulation of the authority of governor as representative of central government after the amendment of 1945 constitution, (2) How is the idea governor as the representative of government. In order to answer such a questions the research   conducted by using legal/normative research. The approach that used is statue approach and conceptual approach. The regulating of governor’s authority as representative of central government as stipulated in Art. 32 of Act No.32 year of 2004 do not have firm validity in 1945 Constitution. Such the authority of governor is conducted as the implementation of principle of de-concentration, while such a principle does not clearly formulated in 1945 constitution. Besides it does not have constitution’s validity, the regulating of governor’s authority in Act No.32, 2004 does not have clear concept since on one hand such authority is attribution, an on one hand that authority is a delegation and even in practice it is a mandate. According of Unitary state’s point of view the authority of governor as direct representative of central government  after the amendment of 1945 constitution should be in delegation form. Therefore it is not directly enumerated in Act regarding the Local government (attribution).The president that would transfer that authority in government regulation (pp). The delegation of authority to the governor should cover the affair of general government in province, so it is not just limited to a certain affair.Besides in conducting the authority, the governor as representative of central government needs certain organ that assist the governor in performing his authority and as the organ of central government.</em></p><p><strong><em>Key word: </em></strong><em>The idea, governor’s authority, government’s representat, unitary state.</em></p><p align="center"><strong>Abstrak</strong></p><p>Gagasan penaturan kewenangan gubernur sebagai wakil pemerintah terhadap kabupaten/ kota setelah perubahan Undang-Undang Dasar 1945 bertujuan menjawab 2(dua) problem hukum, yakni :   (1) Bagaimana pengaturan kewenangan gubernur sebagai wakil pemerintah setelah perubahan UUD 1945, dan (2) Bagaimana gagasan kewenangan gubernur sebagai wakil pemerintah. Untuk menemukan jawaban pertanyaan yang muncul dilakukan penelitian hukum normatif dengan pendekatan perundang-undangan (<em>statute approach</em>) dan pendekatan konseptual (<em>conceptual approach</em>). Pengaturan kewenangan gubernur sebagai wakil pemerintah dalam Pasal 38 UU No. 32/2004 tidak memiliki validasi yang tegas dalam UUD 1945.Kewenangan gubernur tersebut dilakukan dalam rangka pelaksanaan asas dekonsentrasi, sementara asas dekonsentrasi tidak dirumuskan secara tegas dalam UUD 1945.Selain tidak memiliki validasi konsitusi, pengaturan kewenangan gubernur dalam UU No. 32/2004 tidak jelas konsepnya karena satu sisi kewenangan tersebut berupa atribusi, pada bagian lain berupa delegasi dan bahkan dalam praktek berupa mandat. Menurut sudut pandang sistem negara kesatuan (<em>unitary state</em>) kewenangan gubernur sebagai wakil pemerintah langsung setelah perubahan UUD 1945 haruslah berupa delegasi kewenangan.Jadi tidak ditegaskan (dirinci) langsung dalam UU mengenai pemerintahan daerah (atribusi). Presiden yang akan melimpahkan kewenangan tersebut nantinya dalam Peraturan Pemerintah. Pelimpahan kewenangan kepada gubernur tersebut ruanglingkupnya haruslah mencakup urusan pemerintahan umum di provinsi jadi tidak dibatasi pada urusan tertentu saja.Selain itu dalam menjalankan kewenangan gubernur sebagai wakil pemerintah perlu organ tertentu yang membatu gubernur dalam menjalankan kewenangannya dan merupakan organ pemerintah.</p><p><strong>Key word: </strong>Gagasan<strong>, </strong>Kewenangan Gubernur, Wakil Pemerintah, Negara Kesatuan.</p></div>

The purpose of this research is to reviewe and analyze the extent to which the applicable laws and regulations in Indonesia regulate the use of signatures change by the partys in making notary deeds and to review and analyze the legal consequences of the use of signatures change by the partys in making a notary deed. This research is a normative legal research, using two types of approaches, namely the statute approach and the conceptual approach. The results of this study show that there are various causes of changing signatures of party, but the laws and regulations that apply in Indonesia do not have articles that govern this. The validity of a signature is seen based on the acknowledgment to justify the person affixing the signature. A different or change signature is justified by law insofar as the signer affixing his signature confirms that it is his signature, so that the legal consequences of such notary deeds are still valid to be used as evidence of authentic writing that has the power of perfect proof law. Tujuan dari dilakukannya penelitian ini adalah untuk mengkaji dan menganalisis mengenai sejauh mana peraturan perundang-undangan yang berlaku di Indonesia mengatur mengenai penggunaan tanda tangan berubah-ubah oleh penghadap di dalam pembuatan akta notaris dan untuk mengkaji dan menganalisis mengenai akibat hukum dari digunakannya tanda tangan berubah-ubah oleh penghadap di dalam pembuatan akta notaris. Penelitian ini merupakan penelitian hukum normatif, dengan menggunakan dua jenis pendekatan yaitu pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian ini menunjukkan bahwa ada berbagai penyebab terjadinya tanda tangan yang berubah-ubah dari penghadap, namun peraturan perundang-undangan yang berlaku di Indonesia tidak terdapat pasal yang mengatur mengenai hal tersebut. Keabsahan dari suatu tanda tangan adalah dilihat berdasarkan adanya pengakuan untuk membenarkan dari orang yang membubuhkan tanda tangan. Tanda tangan yang berbeda atau berubah-ubah dibenarkan oleh hukum sepanjang penghadap yang membubuhkan tanda tangannya tersebut membenarkan bahwa itu adalah tanda tangannya, sehingga akibat hukum terhadap akta notaris yang demikian adalah tetap sah untuk digunakan sebagai alat bukti tulisan otentik yang memiliki kekuatan hukum pembuktian sempurna.

Zakat The main purpose of zakat in Islam is the distribution of welfare evenly to all people. On the other hand, the management and distribution of zakat carried out with proper and right governance also has positive implications for community empowerment, including changes in healthy behavior. Lembaga Amil Zakat Harapan Duafa (LAZ Harfa) is one of Zakah Institute which has a community empowerment program with specific activities on changing healthy living behavior in a number of sub-districts in Pandeglang Regency. For the sake of the success of the program, in addition to using donation funds, assistance and third party cooperation, LAZ Harfa also utilizes a portion of the zakat funds they manage. This descriptive qualitative research aims to find out about the management of zakat funds for a change in healthy living behavior programs, and the implementation of their use. The practical implications are expected to be a model for zakat management in making zakat distribution programs that are right on target. The research objectives were to analyzed the family food security and its factors of the participants in the community empowerment program at rural area. The research design was crossectional study and the data collection technique used a survey method toward 300 families, and their specification were 140 families from the National Program of Community Empowerment (PNPM), 107 families from The Keluarga Harapan Program (PKH), 31 families from the Raksa Desa Program and 22 families from The Business Development Program of Rural Agribusiness (PUAP). The highest percentage (52.0%) of the family categorized into food vulnerable and as many as 37.3 percent was insecure category. It was found 10.7 percent families categorized into secure category. Base on the program, more than a half families of PKH group (50.5%) and PUAP (63.6%) are insecure category. Food vulnerable category is in PNPM group (60.0%) and Raksa Desa group (61.3%). The highest percentage (15.0%) thar categorized into secure category is in PNPM group. The factors which influence significantly toward the family food security are the income per capita, the family size and the asset.
