<p align="center"><strong><em>Abstract</em></strong></p><p><em>This article tries to discuss the implementation of e-court in general criminal cases. In fact, Perma Number 1 Year 2019 does not include criminal cases. This is because Perma Number 1 of 2019 only allows general civil, family civil, state administrative, and military administrative matters. However, with the corona virus outbreak making the implementation of criminal cases into an online trial, this has a positive impact in the form of a breakthrough for the litigation world due to the existence of e-court, it can be predicted to decrease costs for the trial, but on the other hand there are weaknesses, namely not yet arranged e court for criminal cases. To find a way out, the authors recommend implementing progressive law to fill the legal vacuum while waiting for a positive law that accommodates the implementation of e-court</em></p><p><strong><em>Keywords</em></strong><strong>: </strong><em>E-court, General Criminal Case, Progressive Law</em></p><p align="center"><strong>Abstrak</strong></p><p>Artikel ini mencoba untuk membahas mengenai pelaksaan <em>e-court</em> dalam perkara pidana umum. Sejatinya, dalam Perma Nomor 1 Tahun 2019 tidak mengikutsertakan perkara pidana. Hal ini dikarenakan Perma Nomor 1 Tahun 2019 hanya memperbolehkan perkara perdata umum, perdata keluarga, tata usaha negara, tata usaha militer. Namun dengan adanya wabah virus korona membuat pelaksaan perkara pidana menjadi sidang secara online, hal ini membawa dampak positif berupa terobosan untuk dunia litigasi dikarenakan dengan adanya <em>e-court</em> maka dapat diprediksikan menurunnya biaya untuk persidangan, namun dilain sisi terdapat kelemahan, yaitu belum diaturnya pelaksanaan <em>e-court</em> untuk perkara pidana. Untuk mencari jalan keluarnya maka penulis menganjurkan diterapkannya hukum progresif untuk mengisi kekosongan hukum sambil menunggu adanya sebuah hukum positif yang mengakomodasi pelaksanaan <em>e-court</em>.</p><p><strong>Kata Kunci: </strong><em>E-court</em>, Perkara Pidana Umum, Hukum Progresif</p>

The covid-19 resulted in broad range of spread throughout the world in which India has also became a prey of it and in this situation the means of media is extensively inϑluencing the mentality of the people. Media always played a role of loop between society and sources of information. In this epidemic also media is playing a vital role in shaping the reaction in ϑirst place for both good and ill by providing important facts regarding symptoms of Corona virus, preventive measures against the virus and also how to deal with any suspect of disease to overcome covid-19. On the other hand, there are endless people who spread endless rumours overs social media and are adversely affecting life of people but we always count on media because they provide us with valuable answers to our questions, facts and everything in need. Media always remains on top of the line when it comes to stop the out spread of rumours which are surely dangerous kind of information for society. So on our side we should react fairly and maturely to handle the situation to keep it in the favour of humanity and help government not only to ϑight this pandemic but also the info emic.

تناولت هذه الورقة فلسفة العقوبة في الشريعة الإسلامية، وفلسفتها في القانون الوضعي، وتمت الموازنة بين الفلسفتين، وخلص العرض والموازنة إلى نتائج ملخصها أن مسألة عصمة الشريعة وسموها تعد علامة فارقة بين الشريعة الإسلامية والقانون الوضعي، هذه العلامة نتج عنها فروق كثيرة أولها أن العقوبة في التشريع الوضعي تكون تابعةً للهدف، فالهدف يوضع أولاً ثم تصاغ على ضوئه العقوبة، ولذلك كلما ظهرت مدرسةٌ جديدةٌ تؤسس لفكرٍ جديدٍ ظهر اختلافٌ في التشريع العقابي. بينما النظام العقابي الإسلامي ثابتٌ ومعصوم، وقد وُجدت الحاجة إلى معرفة أهدافه وفلسفته ليتسنى السير على مقتضاها فيما يستجد من وقائع، وأن سمو فلسفة العقوبة في الشريعة الإسلامية ينبع من سمو مصدرها، فواضع هذه العقوبات هو خالق البشر. بينما العقوبة في القانون الوضعي تعتمد في فلسفتها على خبرة واضعيها، وهي خبرة محدودة وأحكامها نسبية، لذا كان تطبيق العقوبات الشرعية أجدر حتى وإن لم يُدرَك كنه هذه العقوبات وفلسفتها. الكلمات الرئيسية: فلسفة العقوبة، القانون الإسلامي، القانون الوضعي، التشريع العقابي.******************************In this paper light is shed on the philosophy of punishment in Islamic and positive laws and a comparison between them is accomplished. In brief, the conclusion of the exposition and comparison is that issue of infallibility of SharÊ‘ah and its nobleness are the distinguishing marks between Islamic and positive laws. This led to further differences. The first difference is that the punishment in positive laws is in accordance with the stipulated goal, that is, the goal is set first and then the punishment is formulated in that light. That is why whenever any new school of thought appears based on some ideology, differences emerge in punitive legislation. Islamic penal system is, however, immutable and infallible. There is a need to know its objectives and wisdom so as to in order to tackle new emerging issues. The nobility of the philosophy of punishment in Islamic law stems from the nobility of its source and that is no one but the Creator of human beings. The punishment in the positive law, on the other hand, relies on the philosophy that is based on the experiences of the authors of these laws. And these experiences are limited and their rulings are relativistic. Applying Islamic legal punishments are, therefore, more legitimate, even though their essence and philosophy are not fully grasped.Key words: Philosophy of Punishment, Islamic Law, Positive Law, Punitive Legislation.

This paper provides an empirical assessment of the relationship between banking origins and the supply of credit in Ivory Coast. The analysis focuses on 14 banks composed of local banks, African banks and foreign banks outside Africa. The study covers the period from 2000 to 2016. Using the panel data approach, we show that local banks positively influence the supply of credit unlike foreign and African banks. Foreign banks, on the other hand, have a negative influence on the supply of credit in Ivory Coast. In addition, the results highlight the positive impact of growth and market share on the supply of credit to the private sector. On the other hand, the size of banks and the inflation rate are unfavourable to the supply of credit in Ivory Coast. The study suggests that local banks should be strengthened so that they can provide more financing to the Ivorian economy.

В статье рассматриваются методики в расследовании уголовных дел, касающихся должностных преступлений коррупционной направленности и преступлений против личности, совершаемых по мотиву национальной ненависти или вражды. Выявлены и предлагаются к обсуждению как общие аспекты, способствующие раскрытию вышеуказанных категорий преступлений с одной стороны, так и особенности, связанные с их спецификой – с другой стороны. Также авторами предложены новые методологические особенности для раскрытия и расследования указанных категорий дел, помогающие предварительному следствию успешно справляться с поставленными задачами. Within the conduct of the study, the research adopted the TAM (Technology Acceptance) theory as the basis for identifying the factors that influence the customers to perform transactions through online sites. Furthermore, within the study as well the researcher would like to adopt the TPB (Theory Planned Behaviour) as the support of TAM theory in predicting the online consumer behaviours within the online sites. On the other hand, in the data analysis the researcher has run by using the PLS 3.0. In the same time, survey by means of questionnaire distribution carried out toward the respondents who used to perform transactions through online sites. Finally,  this research found that visualization, online review and trust have positive impact on purchase intention smartphone of consumer  through You Tube Channel

Purpose Good medical practice, evidence-based medicine (EBM) and clinical practice guidelines (CPG) have been recurring subjects in the scientific literature. EBM advocates argue that good medical practice should be guided by evidence-based CPG. On the other hand, critical authors of EBM methodology argue that various interests undermine the quality of evidence and reliability of CPG recommendations. The purpose of this paper is to evaluate patient related outcomes of CPG implementation, in light of EBM critics. Design/methodology/approach The authors opted for a rapid literature review. Findings There are few studies evaluating the effectiveness of CPG in patient-related outcomes. The systematic reviews found are not conclusive, although they suggest a positive impact of CPGs in relevant outcomes. Research limitations/implications This work was not a systematic review of literature, which is its main limitation. On the other hand, arguments from EBM and CPG critics were considered, and thus it can enlighten health institutions to recognize the caveats and to establish policies toward care improvement. Originality/value The paper is the first of its kind to discuss, based on the published literature, next steps toward better health practice, while acknowledging the caveats of this process.

Judicial practice in Indonesia, judging from the decisions of criminal cases, generally judges give legal considerations only to prove the elements of a criminal offense. In contrast, the determination of the crime is not objectively considered, and most are merely considerations of incriminating and mitigating matters. On the other hand, the judge has absolute authority in imposing a crime; the judge's freedom is guaranteed by law. The supreme power of judges who are used freely without objective measures has the potential to produce corrupt decisions and injustices. Criminal objectives must be aligned with legal goals, namely to realize penalties that guarantee legal certainty, justice, and expediency. Ideally, good sentences reflect the three purposes of the law.

This research investigates the effect of crowdfunding on entrepreneurship. The population of the study includes Jordanian entrepreneurs, (200) questionnaires were distributed among 200 Jordanian entrepreneurs; the (200) questionnaires were all collected. The researcher used the quantitative research methods in the form of simple liner regression and multi regression. The study confirms that there is a positive impact of crowdfunding on entrepreneurship in general as well as entrepreneurs’ freedom of innovation and value of creation. In addition, it was realized that out of the four investigated crowdfunding methods:  reward, pre-purchasing, donation, equity and lending, the pre-purchasing method has the most positive influence on entrepreneurship freedom of innovation and value of creation. On the other hand, reward, equity, and lending did not contribute any significant effect on entrepreneurship’s value of creation and freedom of innovation compared to the latter two. Furthermore, both crowdfunding processes of all-or- nothing and keep-it-all have significant effect on entrepreneurship with the latter process having a more significant effect than the former.  This study confirmed the positive effect of crowdfunding methods and processes on Jordanian entrepreneurship in term of value of creation and freedom of innovation.

Social development is the only timeless and ubiquitous ideology. Conflicts and disagreements, on an individual and collective level, are immanent in the human species. Conflicts of interests and values are universal and in constant process of development. Communication, basically, can have three modes at least: constructive, destructive and indifferent. However, even, thinking about prosperity, indifference can be recognized as destruction. The key of any progress can only be constructive communication as opposed to destruction, or lack of interest. Constructive ratio, among other things, includes confronting positions and critical analysis. A critic may be creative only when able to achieve the objective, or desired changes. On the other hand, destructive criticism can not lead to a solution but, in opposite, provokes, destabilizes, increases resistance and emphasizes the detachment. Communication, therefore, is not a provocation, but refined design to implicate "expectations", and do not "require". Finally, it is very difficult to cooperate or have a positive impact on those who feel they are being attacked, insulted or humiliated. The only thing that can cause such feelings are: counter-aggression, aggression or withdrawal. Partnership coexist together with: reciprocity, taking into account, a common control, as well as many positive and negative constructs. There are many destructive forms of communication, from passivity and passive aggression to aggression, moved aggression, arrogance and other diverse instrumental behavior, in one word, manipulation. As opposite, constructive communication styles, require a direct relationship, concrete, accurate and clear messages. An open mind implies flexibility, moderation, tolerance, timeliness and also the developed awareness of political, cultural and social implications of the context. Therefore, bilaterally99, in the communication that obtains positive development trends in all relevant domains, is the same as constructive100. On the other hand, the development requires an effective and permanent incentives, as well as the continuing commitment to reforms, sustainable solutions and improvement of good neighborly relations, regional cooperation and stability. A constructive relationship is a prerequisite for creating and improving bilateral cooperation. Developing construct of bipolar structure, implies two basic processes: understanding, formulation, sublimation and protecting common interests and needs, and then promotion of understanding, values, cooperation and mutual respect.

Abstract While we know that women's presence in the legislature positively impacts how citizens view the institution, little is known about the impact of women's presence on the legitimacy of high courts. We argue that despite differences in public expectations for courts, women's presence on the high court does impact citizen perceptions of legitimacy. However, this effect is dependent on both the level and the type of bias held by citizens. That is, when a person feels hostile bias toward women, the bias disrupts the potential legitimacy that the court could gain. On the other hand, we argue that benevolent sexism does not trigger any change in how citizens view the high court in a democracy. Using evidence from an experiment, we find that the presence of women on the high court has a strong positive impact on citizen perceptions of court legitimacy, though not among those with hostile gender bias.
