The settlement of criminal cases outside the court through mediation is a common phenomenon occurring in various regions of Indonesia. Penal mediation is done with the assumption that it can meet the justice and expediency, but what if viewed from the aspect of legality and legal certainty. This study aims to evaluate the settlement arrangement of penal proceeding through penal mediation and analyze the values ​​of justice, benefit and legal certainty in the settlement of criminal case through penal mediation. The study was conducted using normative/doctrinal legal research methods. This article concludes: 1) Settlement arrangement of criminal penalty through penal mediation is still limited to criminal case conducted by child. Although there are some provisions that provide for possible settlement of criminal cases outside the court, but not yet a penal mediation. Because it has not strictly regulated the mediation between the perpetrator and the victim, especially regarding the provision of compensation or compensation which is a means of diversion for the termination of prosecution and the imposition of a criminal. 2) The settlement of criminal cases through penal mediation can meet the values ​​of justice and benefit, but the limited regulation of penal mediation, the settlement of criminal cases through penal mediation is less reflect the value of legal certainty. Abstrak Penyelesaian perkara pidana di luar peradilan melalui mediasi merupakan fenomena yang umum terjadi di berbagai daerah di Indonesia. Mediasi penal dilakukan dengan anggapan dapat memenuhi tuntutan keadilan dan kemanfaatan, namun bagaimana jika dilihat dari aspek legalitas dan kepastian hukum. Penelitian ini bertujuan untuk mengevaluasi pengaturan penyelesaian perkara pidana melalui mediasi penal serta menganalisis nilai-nilai keadilan, kemanfaatan dan nilai kepastian hukum dalam penyelesaian perkara pidana melalui mediasi penal. Penelitian dilakukan dengan menggunakan metode penelitian hukum normatif atau doktrinal. Artikel ini menyimpulkan, 1) pengaturan penyelesaian perkara pidana melalui mediasi penal masih terbatas untuk perkara pidana yang dilakukan oleh anak. Meskipun beberapa ketentuan memberi kemungkinan adanya penyelesaian perkara pidana di luar pengadilan, ia belum merupakan mediasi penal; sebab belum mengatur secara tegas adanya mediasi antara pelaku dan korban, terutama terkait pemberian ganti rugi atau kompensasi yang merupakan sarana diversi untuk dihentikannya penuntutan maupun penjatuhan pidana. 2) Penyelesaian perkara pidana melalui mediasi penal dapat memenuhi nilai-nilai keadilan dan kemanfaatan, namun kurang mencerminkan nilai kepastian hukum disebabkan terbatasnya pengaturannya.

The settlement of criminal offenses with mild motives can be carried out by reasoning penal mediation called the restorative justice approach, which focuses on the direct participation of perpetrators, victims and the community. The research that use in this study is sociological legal research (social legal research). The concept of restorative justice through reasoning penal mediation in the settlement of a mildly criminal case for the indigenous people of village kuala gasib in koto gasib siak, was carried out with the intermediary of the headman. Headman as customary village heads and as government administrators have an important role in creating peace efforts in resolving disputes that occur in the community, one of which is through the settlement of criminal cases by reasoning penal mediation with the concept of restorative justice. The constraints of the concept of restorative justice through reasoning penal mediation in the settlement of mildly criminal cases for the indigenous people of village kuala gasib in koto gasib siak are: a) The absence of a special law mediation of regulation, b) Lack of facilities and infrastructure in mediating, c) Lack of mediator skills for village head to reconcile the parties to the dispute, d) There are differences of opinion among law enforcement officials about the concept of restorative justice through penal mediation

Proses pemeriksaan saksi dimulai dari penyidikan sampai pada tingkat penuntutan di pengadilan. Di tingkat penyidikan maka terlebih dahulu saksi diperiksa oleh penyidik dengan memperhatikan perlindungan terhadap saksi yaitu tanpa ancaman atau tekanan.dari pihak manapun. Kemudian saksi dapat diperiksa di tempat kediaman saksi dan saksi diperiksa tanpa disumpah. Sedangkan pada tingkat penuntutan atau pesidangan maka terlebih dahulu saksi dipanggil untuk didengar keterangannya. Penelitian ini bertujuan untuk memenuhi kebutuhan terhadap objek penulisan atau suatu karya ilmiah guna mendapatkan data-data, pokok-pokok pikiran, serta pendapat lainnya dari pakar atau media apapun, yaitu terkait pemeriksaan saksi dalam perkara pidana berdasarkan ius contitum indonesia. Dalam penelitian ini penulis menggunakan metode penelitian hukum normative.   Abstract The process of examining witnesses starts from the investigation to the level of prosecution in court. At the level of investigation, the investigator first examines witnesses by paying attention to the protection of witnesses, namely without threats or pressure from any party. Then the witness can be examined at the witness' residence and the witness can be examined without being sworn in. Meanwhile, at the level of prosecution or trial, witnesses are first called to be heard. This study aims to meet the need for the object of writing or a scientific work in order to obtain data, main ideas, and other opinions from experts or any media, which is related to the examination of witnesses in criminal cases based on ius contitum indonesia. This research the authors use normative legal research methods

Customary law is an unwritten rule that lives in the customary community of an area and will continue to live as long as the community still fulfils the customary law that was passed on to them from their ancestors before them. Settlement in criminal cases through customary law that produces results is a form of legal certainty. This study aims to determine the ideal concept in resolving criminal cases through customary courts in Merauke Papua. The method used in this study is a combination of normative legal research and empirical legal research with the reason that the author wants to examine the norms related to the problem of resolving customary criminal cases and seek direct information on the implementation of customary justice in Merauke Regency which is presented descriptively. recognition of customary courts must be stated in writing in the law on judicial power so that this institution has a clear legal basis and its decisions can be recognized so that it does not need to be tried again through national courts, criminal threats under five years must be resolved through customary courts and are final decisions   Received: 23 August 2021 / Accepted: 25 October 2021 / Published: 3 January 2022

The development of globalization in era of free market economy has caused many problems to protection of plant varieties. Therefore, it’s deemed necessary to make specific arrangements of supervision in the protection of plant varieties in Indonesia. The writing of this article aims to examine the regulatory aspects of supervision in plant varieties and the importance of regulating of supervision in plant varieties. This article uses normative legal research methods, which research the laws and regulations that have legal problems. The results of the study shows that the aspects of supervision in regulations relating to the protection of plant varieties haven’t been regulated in detail and concretely. The absence of regulations regarding the supervision, causes supervision can’t be carried out optimally, and the supervision can’t be said to be legal according to law. Supervision is very important to regulated, because it carried out with the aim of preventing the emergence of fraudulent practices such as deception, monopolistic practices, and other activities that have a negative impact on the economy in terms of protecting plant varieties. Juridical arrangements regarding supervision related to the protection of plant varieties need to be carried out to provide a foundation for the relevant agencies in carrying out their supervisory duties as well as to increase protection or provide legal certainty for parties holding the rights to protect plant varieties. In addition, it’s also to prevent fraudulent acts committed by irresponsible persons. Perkembangan globalisasi di era ekonomi pasar bebas, menimbulkan banyak problematika terkait dengan perlindungan varietas tanaman. Oleh karena itu, dipandang perlu melakukan pengaturan secara spesifik mengenai aspek pengawasan dalam perlindungan varietas tanaman di Indonesia. Penulisan artikel ini bertujuan untuk mengkaji mengenai pengaturan aspek pengawasan dalam perlindungan varietas tanaman serta arti penting pengaturan aspek pengawasan dalam perlindungan varietas tanaman di Indonesia. Adapun metode penelitian dalam penulisan artikel ini menggunakan metode penelitian hukum normatif, berupa penelitian dengan mengkaji peraturan perundang-undangan yang memiliki kaitan dengan permasalahan hukum yang terjadi. Hasil studi menunjukkan bahwa aspek pengawasan dalam peraturan perundang-undangan yang berkaitan dengan perlindungan terhadap varietas tanaman belum diatur secara mendetail dan konkrit. Ketiaadan pengaturan mengenai pengawasan terkait perlindungan varietas tanaman  menyebabkan pengawasan tidak dapat dilaksanakan secara maksimal, serta pengawasan yang dilakukan oleh instansi terkait tidak dapat dikatakan sah menurut hukum. Pengawasan pada dasarnya merupakan hal sangat penting untuk diatur, karena pengawasan dilaksanakan dengan maksud untuk mencegah timbulnya praktik kecurangan seperti penipuan, praktik monopoli, maupun kegiatan lain yang menimbulkan dampak negatif terhadap perekonomian dalam hal perlindungan varietas tanaman. Pengaturan secara yuridis mengenai pengawasan terkait perlidungan varietas tanaman perlu dilakukan untuk memberikan landasan berpijak kepada instansi terkait dalam melaksanakan tugasnya terkait pengawasan sekaligus guna meningkatkan perlindungan maupun memberikan jaminan kepastian hukum bagi pihak yang memegang hak perlindungan varietas tanaman. Selain itu juga untuk mencegah terjadinya tindakan kecurangan yang dilakukan oleh oknum-oknum yang tidak bertanggungjawab.

The aim of the study is to determine the application of Visum et Repertum as evidence for criminal acts in domestic violence. This study was empirical legal research. The location of this study was conducted in Kejaksaan Negeri Klaten. The result of the research showed that as proof of domestic violence with evidence Visum et Repertum was one of the law enforcements oriented to realize for legal certainty and protection of victims in proving the occurrence of criminal acts in domestic violence. The lack of evidence bothers the process of law enforcement, regarding requirements to determine the victim provided at least two evidence and for the judges to decide on criminal cases with valid evidence at least can be avoided by using Visum et Repertum. The obstacles to prove the evidence for criminal acts in domestic violence with Visum et Repertum includes the differences of understanding among law enforcement officials about the use of Visum et Repertum for criminal acts in domestic violence.

Based on Article 96 of Law No. 2 of 2004 concerning Industrial Relations Dispute Settlement states that in essence that if the Company is proven at the first session not to carry out its obligations under Article 155 Paragraph (3) Law No. 13 of 2003 concerning Manpower, the Judge may decide interim. In the Decision of the Industrial Relations Court Number: 181/Pdt.Sus-PHI/2016/PN.Bdg jo Decision of the Industrial Relations Court Number: 82/Pdt.Sus-PHI/2016/PN.Bdg, the Judge decides on the request for payment of process wages at interlocutory decisions and final decisions, thus raising problems, how is the legal certainty of the application for process wage payments in the Industrial Relations Court and how to prove in the request for payment of process wages in the Industrial Relations Court. This study uses normative legal research methods, which are prescriptive in nature, with methods of data collection in the form of library studies, and supported by the results of interviews with Labor Law Experts. The results of the study show that, first, legal certainty in the request for payment of process wages on interlocutory decisions must be logical and not cause doubt. Second, the evidence applied at the time of the Industrial Relations Dispute is not in accordance with the situation that occurred in practice, so that it burdens the Workers. In the decision of the Industrial Relations Court Number: 181/Pdt.Sus-PHI/2016/PN.Bdg jo Industrial Relations Decision Number: 82/Pdt.Sus-PHI/2016/PN.Bdg is not in accordance with the Laws and Regulations in Indonesia.

Human life cannot separate from social norms that become a benchmark for behavior. Social norms have validity and power applicable to legal subjects. In addition to human social norms, it is also bound by legal norms, which also have validity and power applicable to legal subjects. Types of research methods used are normative legal research focusing on positive legal norms in the form of legislation, namely by reviewing the laws and regulations governing the registration of arbitration decisions to realize legal certainty for the parties while empirically is to see the reality directly occur in the field. In such situations, it will be able to arrive at one meeting point, namely social norms with legal norms in the same position. The choice of personal priority will take only one norm in this paper called Lex superior versus Lex inferior. Norms with a superior Lex position will face with inferior Lex norms, which in turn are only one social norm that will fulfill both in the position of superior Lex and inferior Lex. Humans only choose one social norm that believed and expected to fulfill their interests and demands (material and spiritual). Consequently, logically from this position, humans will be trapped in the struggle of the superior Lex norm with Lex inferior in a continuous and alternating manner throughout their lives. Inharmonious and disharmonic interactions, often people trapped in a pattern of logical relationships that are diverse and alternating both constructive, contrarian, and sub-alternative.

Restorative justice or more precisely keadilan restoratif in the Indonesian context is based on the principle of building joint participation between perpetrators, victims, and community groups in resolving a criminal act. The problem has been that in the formulation of the laws and government regulations diversion (diversi) is carried out if a criminal act is committed by a child who is punishable by imprisonment under seven years other than that if criminal acts that were committed by a child is not a repetition of criminal acts (recidive). A research using a normative legal research method found that through legal findings or rechtsvinding (penemuan hukum), judges can formulate criminal law policies through their decisions based on mens rea. Tt is a must for judges to settle criminal cases with a child of 12-years-old age perpetrator and/or the delinguent actor is a recidive via diversion. The provisions of Indonesian criminal procedure law dicates that judges are also obliged to seek diversion towards the settlement of all criminal cases whose actions were committed by children, both those with a criminal penalty over seven years and/or recidive or those who does not included in the two categories.

Expert’s Testimony is the information of a person who has special expertise for the purpose of examination in a criminal case and must be given in court. An expert must provide information for justice, as well as possible and according to knowledge in his area of expertise. The expert's testimony from the police is still questionable on the independence and justice of the defendant, the expert must be independent and fair in giving explanation there should be no influence from internal or external parties. There are still many expert testimonies from investigators who are highly doubtful of their independence and deemed inappropriate to be made expertly by academicians, but in the Criminal Procedure Code it is not clear whether the expert's testimony from the investigator is allowed or not. Therefore the author interested in conducting research related to the validity of expert testimony from investigators. The author conducted research with normative legal research methods supported by interviews are expected to help answer the research and the source of interviewed is from the academics and practitioners. In the absence of clear rules, the expert's testimony from the investigator will be the pros and cons but if it refers to the understanding and the main purpose of expert testimony in the Criminal Procedure Code, it is unlikely that the expert's expertise is allowed because it will not be free, independent.

Auctions that use in reality many collateral objects that are not taken by the owner of the goods, the seizure of evidence related to a crime often does not take into account the effects that arise, even though legally the types of objects to be confiscated have different ways and consequences. The basic principles and legal construction of foreclosures are often not comprehensively understood by investigators, including by public prosecutors and judges, in addition to especially in relation to efforts to prove a criminal case in court. So the author conducted a study aimed at providing an alternative Decision Support System for Determining the Feasibility of Goods Auction at the Simalungun District Prosecutor's Office, in the process of this research using the PROMETHE Method (Preference Ranking Organiztion Method For Enrichment Evalution). The purpose of this study is to determine the legal certainty of the auction process and what legal efforts can be carried out by the level of auction feasibility in criminal cases. The results of the crackdown obtained in the feasibility of the auctioned goods are Honda Cs1, Honda bead, Honda bead hitam, Honda vario, Yamaha RX king.
