Kafā’ah is a marriage law that has relatively little attention from Islamic jurists. This is because kafā’ah is less adaptable to changes in people's lives. Because kafā’ah is identical with the Arab cultural heritage before Islam. But factually this kafā’ah is still a legacy in the books of the fuqaha'. This research is focused on revealing the relevance of the concept of the kafā’ah of the fuqaha' with the changing times of the modern era. As well as how to contextualize the concept of kafā’ah in this modern era so that it truly becomes a path to family harmony. In uncovering the problem, the double movement theory or Fadzlurrahman dual interpretation is used, in which this interpretation becomes the knife of analysis by revealing how the current condition of the kafā’ah is then drawn to the kafā’ah of the past and how the response of the Qur'an and the Sunnah. Then the moral values of the Qur'an and the Sunnah are taken using reasoning ratios so that conclusions can be drawn in accordance with current needs. The conclusion of this research is that the concept of kafā’ah in the book of fiqh is not relevant to the needs of this modern era, where kafā’ah in the modern era is more interpreted in terms of equality and ability (competence) to get married, which is different from the kafā’ah of the past which is more nuanced feudalistic.

Shannon Dawdy has presented us with a provocative dialogue on the question ‘is archaeology useful?’ In it, she forecasts a rather bleak future for our field, raising doubts about whether archaeology should be useful and whether it is ‘threatened with its own end-time’. Woven throughout her paper are major concerns about the use of archaeology for nationalistic ends and heritage projects which she deems fulfil the needs of archaeologists rather than those of the public they serve. In the final section of her paper, when she asks, ‘can archaeology save the world?’, Dawdy recommends that we reorient our research ‘away from reconstructions of the past and towards problems of the present’ (p. 140). In my contribution to this dialogue, I introduce an issue that reflects on cultural heritage, antiquities and artefact preservation, which, though they may seem antithetical, are closely aligned with Dawdy's concerns. As a prehistorian with a focus on the third millennium B.C. in the Near East and South Asia, I consider these issues to be the ‘big stories’ that have emerged in the early years of this third millennium, and those that speak directly to the usefulness of archaeology. Of course, it is not the only thing we do, but it is ‘useful’.

This paper focuses on traditional transport as a form of cultural heritage in Central Europe, looking at the modes of transport that are still viable today as a part of people’s lives and livelihoods, as well as strategies to ensure their survival. The importance of preserving the original purpose of traditional transport modes, as well as their acquisition of new functions in the modern era, are examined in the context of the sustainability and viability of cultural heritage. The article also highlights crucial role of promoting the visibility of cultural phenomena to the public in encouraging their protection and ongoing sustainability. It also draws attention to some less positive examples of how forms of traditional transport are currently presented, examining approaches that may lead to the alteration of traditions and the construction of distorted images of cultural heritage. In the conclusion, I propose distinguishing between forms of traditional transport that continue to maintain people’s livelihoods or generate entertainment, and forms which are merely reconstructions of traditional phenomena, intended only as imitations to recall the past

The aims of this research were to find out about the process of Pekande – Kandea tradition and values moral are in Pekande -  Kandea tradition in Buton history. This research used qualitative descriptive that could give an explanation about the process and moral values moral about Pekande – Kandea tradition. The result of this research should that the process of Pekande – Kandea has uniqueness and moral values moral that have a connection with heroism and togetherness. And this tradition one and only that exist also still running every year in Buton Island.  The conclusion of this research is Pekande - kandea is a cultural heritage that is a nation that contains a variety of ideas knowledge of customs and behavior of the community in the past. Pekande – Kande tradition happened two times but in a different eras. This tradition also has a relationship with the Tolandona knight’s struggle who wants to return sovereignty Sultanate of Buton.

This paper seeks to elaborate on the textual interpretation of Q.S Muhammad verse 4 and Q.S at Taubah verse 5. These two verses are often employed by the extremist Muslim groups to legitimize their destructive acts carried out on groups considered as being infidels and as such lawfully killed. The interpretation was conducted using the double movement hermeneutics methodology offered by Fazlur Rahman. After reinterpretation, the two verses contain moral values, namely the war ordered by God must be reactive, fulfill the ethics of "violence" and be the last solution. Broadly speaking, the warfare commanded in the Qur'an aims to establish a benefit for humanity on the face of the earth by eliminating every crime that exists. These two verses in the contemporary socio-historical context in Indonesia can be implemented as a basis for combating the issue of hoaxes and destructive acts of extremist Muslim groups. Because both are crimes and have negative implications for the people good and even able to threaten the unity of mankind.

AbstractThe present paper is involved with the Pedagogical faculties’ students’ critique on the current educational system as it has been altered after 1981. The research was carried out utilizing both quantitative and qualitative tools. Students-voters participated in the interviews whereas active voters were difficult to be located to meet the research requirements. The dynamics of the specific political party is based on a popular profile in terms of standpoints related to economic, social and political issues. The research findings depict the students’ strong wish for a change of the curricula and a turn towards History and Religion as well as an elevation of the Greek historic events, as the History books that have been written and taught at schools over the past years contributed to the downgrading of the Greek national and cultural identity. There is also a students’ strong belief that globalization and the immigrants’ presence in Greece have functioned in a negative way against the Greek ideal. Therefore, an overall change of the educational content could open the path towards the reconstruction of the moral values and the Greek national identity.

The article deals with the problem of collecting, preserving and researching the disappeared names of localities in the subjects of the Russian Federation, which for centuries have become an integral part of the historical and cultural heritage of the peoples of our country. The author believes that only a comprehensive analysis of the past oikonyms in nominational, lexical-semantic, historical-cultural, historical-ethnographic, local history aspects will restore the linguistic and cultural systems of different time periods in different microareals of the Russian Federation. The author comes to the conclusion that in order to preserve the historical memory of the disappeared names of geographical objects, local researchers need the support of regional state authorities and local self-government.

Abstract The article examines the conquest of the County of Tripoli by the Mamelukes in 1289, and the reaction of various Middle Eastern ethnoreligious groups to this event. Along with the Monophysite perspective (the Syriac chronicle of Bar Hebraeus’ Continuator and the work of the Coptic historian Mufaddal ibn Abi-l-Fadail), and the propagandist texts of Muslim Arabic panegyric poets, we will pay special attention to the historical memory of the Orthodox (Melkite) and Maronite communities of northern Lebanon. The contemporary of these events — the Orthodox author Suleiman al-Ashluhi, a native of one of the villages of the Akkar Plateau — laments the fall of Tripoli in his rhymed eulogy. It is noteworthy that this author belongs to the rural Melkite subculture, which — in spite of its conservative character — was capable of producing original literature. Suleiman al-Ashluhi’s work was forsaken by the following generations of Melkites; his poem was only preserved in Maronite manuscripts. Maronite historical memory is just as fragmented. The father of the Modern Era Maronite historiography — Gabriel ibn al-Qilaʿî († 1516) only had fragmentary information on the history of his people in the 13th century: local chronicles and the heroic epos that glorified the Maronite struggle against the Muslim lords that tried to conquer Mount Lebanon. Gabriel’s depiction of the past is not only biased and subject to aims of religious polemics, but also factually inaccurate. Nevertheless, the texts of Suleiman al-Ashluhi and Gabriel ibn al-Qilaʿî give us the opportunity to draw conclusions on the worldview, educational level, political orientation and peculiar traits of the historical memory of various Christian communities of Mount Lebanon.

AbstractCultural heritage can offer tangible and intangible traces of the past. A past that shapes cultural identity, but also a past from which one sometimes wishes to detach oneself and which nevertheless needs to be remembered, even commemorated. These themes of memory, history and oblivion are examined by the philosopher Paul Ricoeur in his work La mémoire, l’histoire, l’oubli (2000). Inspired by these ideas, this paper analyses how they are closely linked to cultural heritage. Heritage serves as a support for memory, even if it can be mishandled, which in turn can affect heritage policies. Memory and heritage can be abused as a result of wounds from the past or for reasons of ideological manipulation or because of a political will to force people to remember. Furthermore, heritage, as a vehicule of memory, contributes to historical knowledge, but can remain marked by a certain form of subjectivism during the heritage and conservation operation, for which heritage professionals (representatives of the public authority or other experts) are responsible. Yet, the responsibility for conserving cultural heritage also implies the need to avoid any loss of heritage, and to fight against oblivion. Nonetheless, this struggle cannot become totalitarian, nor can it deprive the community of a sometimes salutary oblivion to its own identity construction. These theoretical and philosophical concepts shall be examined in the light of legal discourse, and in particular in Belgian legislation regarding cultural heritage. It is clear that the shift from monument to heritage broadens the legal scope and consequently raises the question of who gets to decide what is considered heritage according to the law, and whether there is something such as a collective human right to cultural heritage. Nonetheless, this broadening of the legislation extends the State intervention into cultural heritage, which in turn entails certain risks, as will be analysed with Belgium’s colonial heritage.

Fingerprints play a central role in any field where person identification is required. In forensics and biometrics, three-dimensional fingerprint-based imaging technologies, and corresponding recognition methods, have been vastly investigated. In cultural heritage, preliminary studies provide evidence that the three-dimensional impressions left on objects from the past (ancient fingerprints) are of paramount relevance to understand the socio-cultural systems of former societies, to possibly identify a single producer of multiple potteries, and to authenticate the artist of a sculpture. These findings suggest that the study of ancient fingerprints can be further investigated and open new avenues of research. However, the potential for capturing and analyzing ancient fingerprints is still largely unexplored in the context of cultural heritage research. In fact, most of the existing studies have focused on plane fingerprint representations and commercial software for image processing. Our aim is to outline the opportunities and challenges of digital fingerprint recognition in answering a range of questions in cultural heritage research. Therefore, we summarize the fingerprint-based imaging technologies, reconstruction methods, and analyses used in biometrics that could be beneficial to the study of ancient fingerprints in cultural heritage. In addition, we analyze the works conducted on ancient fingerprints from potteries and ceramic/fired clay sculptures. We conclude with a discussion on the open challenges and future works that could initiate novel strategies for ancient fingerprint acquisition, digitization, and processing within the cultural heritage community.

The purpose of this study is to explore traditional moral values in Japanese society that are able to survive and be implemented in everyday life in the modern era. In addition, it is able to shape the distinctive character of the Japanese, including the role of women who contribute to maintaining traditional moral values. This research is a qualitative research field of philosophy with the object of formal values and the material object is the development of women's position in Japanese society. The results achieved in the study: Japanese women played an important role in the history of the struggle until Japan achieved prosperity and glory until now. This is based on the reason that Japanese women are able to maintain and preserve traditional moral values that still exist through early education in the family environment. These values can shape the character of children from an early age in the family. A family with character brings logical consequences to the life of a community with character so that it affects the culture as a whole.
