This article analyses the socio-cultural aspects of modern law in terms of philosophical and legal analysis and in the context of the changes that take place in the culture of the 19th-21st centuries. The objec­tive of this work is to identify the discourse of today’s cultural strategies and their reflection in law and legal culture. The article uses an arsenal of methodological tools of philosophical and legal analysis, a cultural me­thodology through which the values of modern society are revealed, as well as a methodology of historical and philosophical research. The main result of the work is to establish that modern law cannot be understood outside and regardless of its contextuality, as well as in accordance with the cultural logic and peculiarities of civilisational deve­lop­ment in the context of globalisation. The main conclusion of the article is that the emergence of post-postcapitalism and the deepening of the consumer society result in a crisis of law and its excessive bureaucratisation and formalisation. The emerging cultural logic of metamodernism refers to such concepts as “structure of feeling”, “oscillation”, “communication”, “post-truth”, “totality” in order to restore the subject-orientation of law and give anthro­pological substance to the traditional concepts of “human dignity”, “freedom” and “justice”.

The relevance of this work is substantiated by the fact that advertising as a special language of communication of modern society becomes the subject of research in different human sciences. Culturology, as complex field of humanities knowledge that encompasses sociocultural experience of the people reflected in traditions and norms, customs and laws, representations, assessments and actions, also studies various cultural phenomena. The author pursues the goal to interpret the phenomenon of popularity of advertising as a specific marker of consumer society. For achieving the set goal, analysis is conducted on the phenomenon of durability and popularity of the French show The Night of the AdEaters”. Research methodology is comprised of descriptive and systematic analysis of empirical facts in examining the role of advertising in postmodern society. Comparative method is used for drawing parallels between the works of J. Baudrillard and V. Pelevin from the perceptive of their criticism of consumer society. The author analyzes and characterizes modern consumer society, transformation of human values, and the important role allotted to advertising plays in this society. The conclusion is made that advertising becomes a part of everyday culture, impacts people’s life, contributes to formation of values system, mentality, worldview. In human mind, advertising transforms information into the image, and dictates the demands and interests, demonstrates ideals, helps formulating the goals.

ABSTRACTThis paper analyses the occurrence of surrogate advertising in Brazil and the possibility to punish those involved in its broadcast. The study of the subject is justified by the observation that such advertising technique has been used to circumvent the legal limitations to certain products. The objective of the research is to verify if the Brazilian legal system has the necessary tools to deal with the surrogate advertising and what they are. To obtain the results, it was used the legal dialectic method of approach, combined with the bibliographic method of research. It is possible to conclude that if the surrogate advertising represent misleading or abusive publicity, civil, administrative and criminal responsibility can be raised; if not, this advertisement still infringes upon the good faith, social duty and solidary duty, thus being subject to compensation. KEYWORDS: Surrogate advertising; Publicity; Accountability; Good faith. RESUMOEste artigo analisa a ocorrência de surrogate advertising no Brasil e a possibilidade de punir os envolvidos em sua transmissão. O estudo do tema é justificado pela observação de que tal técnica publicitária tem sido usada para contornar as limitações legais de certos produtos. O objetivo da pesquisa é verificar se o sistema legal brasileiro possui as ferramentas necessárias para lidar com a surrogate advertising e quais são. Para obter os resultados, utilizou-se o método de abordagem dialético jurídico, combinado com o método bibliográfico de pesquisa. É possível concluir que, se a surrogate advertising representa publicidade enganosa ou abusiva, a responsabilidade civil, administrativa e criminal pode ser aplicada; caso contrário, este anúncio ainda infringe a boa-fé objetiva, a função social e solidária, estando, portanto, sujeito a indenização. Today, worldview, spiritual and moral problems that have always been reflected in education and upbringing come to the fore in society. In this situation, there is a demand for philosophical categories. One of the priority goals of education in modern conditions is the formation of a reasonable, reflexive person who is able to analyze their actions and the actions of other people. Modern science is characterized by an understanding of the absolute value and significance of childhood in the development of the individual, which implies the need for its multilateral study. In the conditions of democratization of all spheres of life, the child ceases to be a passive object of education and training, and becomes an active carrier of their own meanings of being and the subject of world creation. One of the realities of childhood is philosophizing, so it is extremely timely to address the identification of its place and role in the world of childhood. Children's philosophizing is extremely poorly studied, although the need for its analysis is becoming more obvious. Children's philosophizing is one of the forms of philosophical reflection, which has its own qualitative specificity, on the one hand, and commonality with all other forms of philosophizing, on the other. The social relevance of the proposed research lies in the fact that children's philosophizing can be considered as an intellectual indicator of a child's socialization, since the process of reflection involves the adoption and development of culture. Modern society, in contrast to the traditional one, is ready to "accept" a philosophizing child, which means that it is necessary to determine the main characteristics and conditions of children's philosophizing.

The article analyzes the philosophical and cultural view of “doctor’s professional culture” as a result of centuries-old practice of human relations, which is characterized by constancy and passed from generation to generation. Medicine is a complex system in which an important role is played by: philosophical outlook of a doctor, philosophical culture, ecological culture, moral culture, aesthetic culture, artistic culture. We have found that within the system “doctor-patient” the degree of cultural proximity becomes a factor that influences the health or life of a patient. Thus, the following factors are important here: 1) communication that suppresses a sick person; 2) the balance of cultural and intellectual levels; 3) the cultural environment of a patient which has much more powerful impact on a patient than the medical one.At the present stage, the interdependence of professional and humanitarian training of future specialists is predominant, as a highly skilled specialist can not but become a subject of philosophizing. We outlined the sphere where the doctors present a genre variety of philosophizing (philosophical novels, apologies, dialogues, diaries, aphorisms, confessions, essays, etc.). This tradition represents the original variations in the formation of future doctor’s communicative competences, which are formed in the process of medical students’ professional training.A survey conducted among medical students made it possible to establish their professional values, which are indicators of the formation of philosophical and culturological competence. It was found out that 92% of respondents believed that a doctor should demonstrate a high level of health culture (avoid drinking and smoking habits, etc.)99% of respondents favoured a high level of personal qualities of a doctor which would allow methods and forms of medical practice to assert higher human ideals of truth, goodness and beauty that are the subject area of cultural studies and philosophy.

Migration is one of the oldest and most used strategies for overcoming negative social issues. Despite the fact that it is historically deeply rooted, environmental migration as a social phenomenon has only recently become the subject research of numerous scientific fields. However, the study of current environmental migration is characterized by a number of issues, such as absence of an adequate definition and multi-causality of environmental migration. In this paper, through conceptual framework, author analyzed two main questions: who are environmental migrants and what reasons cause environmental migration. Due to the destruction of the global environmental balance, as well as accumulated environmental disturbances, it is likely that environmental migration will increase in future and there is nowhere you cannot make more use of scientific and professional projection of the future than in demographic and environmental spheres of human life. There is no doubt that our future is unpredictable. However, the environmental factors influencing the pattern of human interaction with the environment must be taken into account when projecting future development of the modern society. Such is the context in which the complex relation among migration, change and the environment has to be studied. In order to establish the basis for controlling environmental migration caused by negative changes in the environment, it is necessary to adopt a consistent strategy instead of ad hoc activities that are being used. In this paper, author analyzed societal response for the challenges caused by environmental migration, specifically regarding actions related to governing environmental migrations.

Purpose The economic system of competitive capitalism strives toward liquid markets wherein the cost for transacting is minimized. Liquidity is mostly addressed in association with abstract markets (e.g. the securities market), but also consumer markets are determined by liquidity concerns. The purpose of this paper is to examine the shopping mall concept, developed by the architect and social reformer Victor Gruen during the early 1950s, as a form of production of capitalist space, intended to reduce transaction costs. As an auxiliary benefit, Gruen envisioned the shopping mall as a cultural and civic center in the midst of the satellite town of suburbia, the new site of urban expansion during the post-war boom decades. Design/methodology/approach The paper reviews secondary literature on the historical development of the shopping mall as a consumer space. In addition, relevant economic and social science literature is referenced. Findings The architecture, design, ornamentation and day-to-day management of the shopping mall were premised on a consumerist way of life, ultimately serving as an all-too-visual index of the triumph of competitive capitalism in the cold war era. However, Gruen’s accomplishments were gradually compromised by the interest of money-minded developers and construction industry actors, and the shopping mall arguably never fulfilled the social and cultural function that Gruen anticipated. Regardless of such outcomes, the production of capitalist space as scripted by Gruen is still determining everyday life in consumer society, making Gruen a key figure, albeit only limitedly recognized, in the history of late modern society and in the capitalist economy. Originality/value The paper emphasizes the role of Victor Gruen in the post-Second World War period, being one of the most influential practitioners and social reformers in the era. Furthermore, the paper stresses how market liquidity is a key concern in Gruen’s project to create a communal space for the American suburban population in the era of the expanding welfare state.

The subject of this research is modern celebratory culture in the context of impact of globalization processes upon festivities. The author explores a new phenomenon that emerged in the early XXI century – a “global holiday” within the framework of sociocultural transformations related to transition of humanity towards the Digital Age, and formation of the global information space. Special attention is given to the following aspects: creation of media and post-mythological global holidays of the Digital Age, and transformation of the traditional holiday into new metanational forms. The methodological foundation for studying the holidays that received the status of "global" in modern culture became the adaptation of “head page method” applied in sociological, cultural and futurological research and sociocultural monitoring, including overt observation. The conclusion is made that modern culture marks the formation of several types of global holidays that carry metanational character: the first group includes media-produced holidays associated with post-folklore and post-mythology of modern society, or represent celebratory events as award ceremonies in the field of politics, art and science; the second group includes ethnic traditional holidays that received the global status (Halloween, St. Patrick's Day, Mexican Day of the Dead, Holi “Festival of Spring”, etc.). The phenomenon of global holidays should be taken into account in creation of the national strategies of cultural policy, and the global holiday itself may become one of the "soft power" tools in the Digital Age.

The main purpose of the presented article is to reveal the potential of social psychological knowledge for the analysis of radicalisation of young people. In the introduction, the features of socialisation in the modern world are discussed. Special attention is drawn to the role of the Internet in the socialisation of adolescents and young people. It is noted that the dominance of audiovisual information contributes to the reduction of reflexivity and promotes the so-called clip thinking, which has become an integral characteristic of adolescents and young people. It is emphasized that life in the modern society is associated with a number of changes taking place simultaneously at different levels, and uncertainty has become its important feature. Extremism and radicalisation are considered as a reaction to uncertainty, a way to overcome it. The main part of the article is devoted to the analysis of models of radicalization describes in various works. Finally, perspectives of further investigation into the subject are outlined.

The aim of the article. To analyse the specificities of asset and private interest declaration by public officials and representatives of political power, as well as to suggest the author’s original differentiation of declarations of assets, income, private interests, and gifts. The subject of the study is the procedure for submitting declarations by persons entrusted with functions of the state and local self-government bodies in some countries of Western Europe. Methodology. In the article, the method of deduction and induction enabled to study the features of violating the requirements of financial control through the procedure for submitting a declaration by persons entrusted with functions of the state and local authorities. The methods of deduction and synthesis enabled to define the concept of “asset and interest declaration”, practiced in some countries of Western Europe. A comparative legal analysis enabled to study the procedure for submitting an income and expenditure declaration in some Western European countries, identifying the main types of conflict of interest and income declarations, as well as differentiating persons obliged to submit declarations. The results of the study revealed that the foreign experience of asset declaration is closely intertwined with the private interest declaration. Practical implications. In the study: first, the specificities of foreign declaration practice, according to the subjects of such declaration submission, are outlined; second, the procedures for submitting declarations of income and expenditures, as well as interests, are analysed and compared; third, the author’s perspective on the differentiation of declarations and declarants is substantiated. Relevance/originality. The comparative legal analysis enabled to study the procedure for submitting a declaration of public officials in some countries of Western Europe, empowering to form perspective areas of legislation development in this sphere.
