Female prisoners actually have 15 trials to attend or 4 months in duration. However, most of them do not have adequate understanding concerning this legal process. Thus, this study is conducted as a field research by using qualitative approach. This study tends to describe the law enforcement and the legal awareness of female prisoners in correctional institution in Ponorogo. Moreover, how the coaching process given by the prison officers is conducted is another matter to be discussed. The result of this study presented that mostly, female prisoners are sentenced for 3-9 months in prison, but it turns out to be 1-3 months due to imprisonment. Had the verdict is responsibly announced and conducted, it will be appropriate. However, the fact is that the law enforcer, i.e. judge, police officer, prosecutor, and prison officer ask for some money from the female prisoners. This action, of course is breaking the law. After being sentenced, female prisoners actually realized that they are guilty. In this case, the coaching process in correctional institution in Ponorogo has conducted in a good way. However, the coaching process is not gradually conducted when the prisoners are released.

Lamanya Napi wanita untuk mengikuti persidangan sebanyak 15 kali / 4 bulan, dan pada umumnya Napi wanita tersebut banyak yang tidak paham hukum. Jenis penelitian ini merupakan penelitian lapangan (field research) sedangkan metode yang digunakan dalam penelitian ini adalah metode kualitatif. Penelitian ini akan membahas bagaimana penegakan hukum dan kesadaran hukum narapidana wanita di Lapas Ponorogo dan bagaimana proses pembinaan dari petugas lapas terhadap narapidana wanita di Lapas Ponorogo. Hasil dari penelitian ini bahwa  hukuman yang diberikan Napi wanita berkisar 3 bulan – 9 bulan kurungan penjara, setelah dipotong masa tahanan menjadi 1-3 bulan masa tahanan. Putusan hukuman yang diberikan oleh hakim dan diterapkan di lapas Ponorogo akan sesuai apabila diterapkan sesuai kenyataan. Namun apabila penegak hukum yang terdiri dari hakim, polisi, jaksa, dan petugas lapas meminta sejumlah uang tertentu kepada narapidana wanita hal ini tidak diperbolehkan dan melanggar hukum. Setelah di penjara barulah napi wanita sadar akan kejahatannya. Proses pembinaan di lapas Ponorogo sudah berjalan secara baik, hanya saja proses pembinaan tersebut belum sampai pendampingan sampai keluarnya narapidana.  The length of time for female prisoners to take a part in the trial is 15 times / 4 months, and in general there are many female prisoners who do not understand the law. This type of research is a field research (field research), the method used in this study using a qualitative research approach. This study will discuss how law enforcement and legal awareness of female prisoners in Ponorogo prison and how the process of coaching from prison officers to female prisoners in Ponorogo prison. The results of this study that the sentences given by female prisoners ranged from 3 months to 9 months in prison, after being detained the prison period was 1-3 months in prison. The verdict given by the judge and applied to the Ponorogo prison will be appropriate if applied according to reality. However, if law enforcers consisting of judges, police, prosecutors, and prison officers request a certain amount of money to female prisoners this is not permitted and breaks the law. After being imprisoned, women prisoners are aware of their evil. The process of coaching in the Ponorogo prison has been going well, except that the coaching process has not reached assistance until the release of inmates.

The position of advocates (lawyers) as a law advisors in any process of investigation must be central, in terms of that they must place themselves as the representatives of the suspect to get the an appropriate rights. It is mistaken that an advocate acts from the side of attorney as general prosecutor.  In the course of law enforcement, it has been fairly set up either the roles of attorney representing the victim or the demanded person, the suspect. During the process of investigation, the investigator (attorney or police officer) is standing for the victim, nevertheless the suspects are represented by an advocate as their law advisor. In the level of prosecution, the victim must be put up with an attorney as the general prosecutor; the advocate, as the law advisor, represents the suspect.

In Ukraine, there are qualitative changes in the reform of law enforcement agencies in order to more effectively ensure the rule of law in the country, protect human rights and freedoms and increase public confidence in these bodies. Undoubtedly, it is important to create a National Police, which plays an important role in the domestic law enforcement system. Since the first days of its operation, the police have received support from citizens, who argue with various sociological surveys, because this law enforcement agency is open enough in its activity, there is contact with the population. The article is devoted to the activity of a component of the domestic law enforcement system – the National Police. The National Police of Ukraine (police) is a central executive body that serves society by ensuring the protection of human rights and freedoms, combating crime, maintaining public safety and order. This topic is very relevant, as the police are a relatively new subject in the law enforcement system and are on their way. The scientific article investigates which regulatory acts regulate the activity of this law enforcement agency, the structure, main tasks of the police are found out on the basis of the current legislation. The structure of the National Police is quite complex and due to the shortcomings in the legislation, there are problems concerning the interaction between the units. The publication examines the procedure for appointing persons to the post of a police officer and identifies the main problems of selecting candidates to the ranks of the National Police. The importance of introducing in the Law of Ukraine “On National Police” the task of the police is emphasized – to provide within the limits specified by the law services for assistance to persons who, for personal, economic, social reasons or due to emergency situations, need such assistance. Some of the shortcomings of the Law of Ukraine “On the National Police” have been identified and suggestions for improvement of this legal action have been proposed. This study aims to analyze: first, the practice of transferring funds between banks through the Flip application, second, the fiqh muamalah analysis of interbank transfer transactions through the Flip application. The research method used in this research is field research with a qualitative approach. The results of this study indicate that: First, the practice of transferring funds between banks through the Flip application has been properly implemented using a wakalah contract, the mechanism used for transferring funds is by filling in transfer request data, transferring a nominal amount that you want to send plus a unique code to the account. Flip bank is the same as the user's bank, the user does not object to the addition of a unique code, the user is willing to add a unique code because the nominal unique code is smaller than conventional administration fees. Second, the fiqh muamalah analysis related to the law of interbank fund transfer transactions is permissible because it has avoided usury, maisir, gharar, tadlis transactions and there are benefits to ease transfer transactions between different banks.

AbstractThe reality in the society of equality before the law and the protection of the law can�t easily be realized. Differences in ability, both economically and intellectually, make it difficult for justice seekers to access justice. Discrimination often occurs against marginalized communities, ranging from rule-making, implementation, to law enforcement. Therefore, we are motivated to do the devotion by providing socialization, counseling, consultation and assistance for residents of Kuningan Regency in this case the citizens of the IIA Kuningan class correctional institution who want to seek justice. this activity received a very good response, not only for the assisted citizens, but also for the officers and employees in charge. The material given in the form of film screenings about legal aid made by BPHN and the Ministry of Justice and Human Rights of Indonesia, as well as discussion material prepared by the Community Service Team. The expected outcome of this devotion is the opening of access to legal guarantees for the disadvantaged and marginalized, so that the basic principle of the law State of equality before the law is fulfilled.Keywords: Legal Aid, Establishment, EqualityAbstrakKenyataan di masyarakat persamaan di hadapan hukum dan perlindungan hukum tidak dengan mudah dapat terwujud. Diskriminasi sering terjadi terhadap masyarakat marginal, mulai dari pembuatan aturan hukum, pelaksanaan, sampai dengan penegakan hukum. Oleh karena itu, kami tergerak untuk melakukan pengabdian dengan memberikan sosialisasi, penyuluhan, konsultasi dan pendampingan bagi warga masyarakat Kabupaten Kuningan dalam hal ini warga binaan lembaga pemasyarakatan kelas IIA Kuningan yang ingin mencari keadilan. kegiatan ini mendapat respon yang sangat baik, tidak saja bagi warga binaan, tetapi juga bagi aparat dan pegawai yang bertugas. Materi yang diberikan berupa pemutaran film tentang bantuan hukum yang dibuat oleh BPHN dan Kementerian Hukum dan HAM RI, juga materi diskusi yang disiapkan oleh Tim Pengabdian Masyarakat. Luaran yang diharapkan dari pengabdian ini adalah terbukanya akses terhadap jaminan hukum bagi masyarakat tidak mampu dan terpinggirkan, sehingga prinsip dasar Negara hukum yaitu equality before the law terpenuhi.Kata kunci : Bantuan Hukum, Warga Binaan, Persamaan

Objective: This article aims to discuss the enforcement of customary law in North Maluku, the deliberation value in the BMA Sultanate of Ternate, and the implementation of customary criminal sanctions by the Badan Musyawarah Adat.Methodology: The methodology used in this study was legal research conducted in a non-doctrinal qualitative approach. In this study, the law is not only conceptualized as all the principles and rules that regulate human life in society but also includes institutions and processes that actualize the validity of these rules in society.Findings: Law enforcement of fisheries crimes is based on the provisions of Indonesian Law No. 45 of 2009 concerning Fisheries. Criminal provisions are regulated by Articles 84 to 104. One of them is about sinking the ship used to commit fishing crimes. Sanctions given to the fish theft (illegal fishing) perpetrators in territorial waters that have been determined by the local customary head are 1) warning; (2) monetary charges according to the agreement of the local customary community; and (3) boat (pajeko in Ternate) or motorboat seized by the sultanate to be used by the community through profit sharing.Utility: Customary Institute of Ternate Sultanate in 2018 has decided on three cases in the Kao bay area concerning fish catching. Besides the traditional law enforcement that is implemented by the Sultanate, North Maluku recognizes Sasi Customs (Adat Sasi), which is regulation of tradition that limits people for catching fish or taking other sources in a certain type and particular period. Thus, the ecological balance is still maintained.Novelty/Originality: The concept of transcendental law enforcement is substantially in line with the values in the Segulaha tradition that has been applied for a long time in North Maluku. Anti-corruption efforts solely through the prosecution of corruption , whereas the present moment awareness need everyone to obey the law of corruption .The perpetrators of corruption in Samarinda always hide behind the policies and provisions contained in the legislation governing the authority of an agency or official , so as though everything is a discretionary authority .This type of research used in this paper is an empirical legal research methods with qualitative approach to analyze the data that refers to the rules and regulations perudang . So as to obtain an overview of the impact of corruption in public life , analyze and formulate on law enforcement corruption , and to analyze the factors that affect the law enforcement corruption in the city of Samarinda

Control of unlicensed tour guides is the authority of the Bali provincial government through Civil service police Unit (Satpol PP) as a form of oversight of all regional regulations, especially regional guide regulations. SatPol PP is granted the authority to supervise by the government and cooperate with court police and tourism institutions in the law enforcement system. This study discusses the authority of the Bali Provincial Government in supervising unlicensed tour guides and sanctions against unlicensed tour guides. The method used to achieve these goals is the empirical legal research method, which is to conduct field research through interviews and taking notice of the existing phenomena in society related to the problems being studied. The results of the data analysis show that the government is provided the authority by statutory regulations through Law Number 10 of 009 concerning Tourism and Regional Regulation of the Province of Bali Number 5 of 2016 concerning Tour Guides. Supervision is carried out through preventive and repressive measures and is in the law enforcement system. Sanctions are applied to tour guides who are not licensed by imposing sanctions in the form of fines through court proceedings and tour guides who commit violations will be subject to tourism violations in the form of fines. The implementation is carried out through the secrets of the tour guides when carrying out their duties in each tourism area in Bali. Guiding secrets are executed through the control function in each working area.

The importance of education applies to all children, including children who undergo legal process. It is suitable for the main purpose of Correctional Institution which is to return the prisoners back in the middle of a better society, but in the reality the feedback is not as people expected. The purpose of this study is to find out the objective conditions for the fulfillment of children's rights in the field of education in the prisons IIA of Balikpapan City. The study belongs to empirical legal research that data is collected by some literature books which are related to the material has being studied, and interviews with student prisoners and the officers, then the data is inserted into descriptive qualitative. Analysis is done by legislation approach combined with sociological approach. The results of this study indicate that the fulfillment of the children education rights in prisons IIA of Balikpapan city is weak and less effective, the weakness has found either in juridical normative or empirical/sociological. The weakness includes formal rules where there are no regulations governing education in prisons; there is still lack of facilities factors; third, community factors that have not been aware to assist the fulfillment of education at Penitentiary institution; and cultural factors that the community has which is difficult to re-accept the correctional students into society, while the factors that play a role in the fulfillment of government and penitentiary officers in this case referred to  law enforcement. Penting nya pendidikan berlaku bagi semua anak-anak tidak terkecuali bagi anak-anak yang menjalani proses hukum. Hal ini selaras dengan tujuan utama dari lembaga pemasyarakatan yaitu agar dapat kembali  nya anak didik pemasyarakatan ketengah kehidupan masyarakat yang lebih baik. Tetapi pada kenyataannya kembalinya warga binaan pemasyarakatan tidak menjadikannya lebih baik. Tujuan studi ini untuk mengetahui kondisi objektif pemenuhan hak anak dibidang pendidikan pada lembaga pemasyarakatan kelas IIA Kota Balikpapan. Penelitian ini termasuk kedalam penelitian hukum empiris. Data penelitian dikumpulkan dengan cara studi pustaka yaitu buku-buku literatur yang berkaitan dengan materi yang diteliti dan wawancara dengan anak didik pemasyarakatan dan petugas lembaga pemasyarakatan, kemudian data tersebut dimasukkan secara deskriptif kualitatif. Analisis dilakukan dengan pendekatan perundang-undangan dipadukan dengan pendekatan sosiologis. Hasil studi ini menunjukkan bahwa pemenuhan hak anak di bidang pendidikan pada lembaga pemasyarakatan kelas IIA kota Balikpapan adalah lemah dan kurang efektif, kelamahan itu baik secara yuridis normatif dan empiris/sosiologis. Kelemahan itu mencakup belum adanya peraturan yang mengatur tentang hak atas pendidikan dilembaga pemasyarakatan; kurang nya faktor sarana atau fasilitas; faktor masyarakat yang belum ada kesadaran untuk membantu dalam pemenuhan pendidikan pada lembaga pemasyarakatan; dan faktor budaya yang dimiliki masyarakat yang sulit untuk menerima kembali anak didik pemasyarakatan ke dalam lingkungan masyarakat; sedangkan faktor-faktor yang berperan dalam pemenuhan yaitu pemerintah dan petugas lembaga pemasyarakatan dalam hal ini disebut sebagai penegak hukum.

The case of former Jakarta governor Basuki Tjahaya Purnama began when he spoke in Kepu-lauan Seribu on September 27, 2016, quoting a verse of the Holy Qur'an that was deemed to have no relevance to the purpose of his arrival which became the basis of the allegation on de-famation against religion as defined in Article 156a of the Criminal Code. As a follow-up of the case, the legal process for the report is conducted and immediately becomes the focus of community concentration. However, in the case of law enforcement process is considered to have some peculiarities and deviate from the principle or principle of criminal procedural law. This is what makes this case interesting to investigate further by using seve-ral instruments related legislation, such as Law No. 8 of 1981 About Criminal Procedure Law. The paper is discussed using the normative juridical approach that focuses on reviewing violations of the principle or principle of criminal procedural law in the law enforcement of religion defama-tion by Basuki Tjahaya Purnama. In the future it is hoped that the negligence of application of the principle or principle of criminal procedure does not happen again. Keywords: defamation of religion, criminal procedural law, law enforcement ABSTRAK Kasus Mantan Gubernur DKI Jakarta Basuki Tjahaya Purnama diawali saat ia berbicara di Kepulauan Seribu pada tanggal 27 September 2016 dan mengutip salah satu ayat Kitab Suci Al Qur’an yang dianggap tidak memiliki relevansi dengan tujuan kedatangannya, sehingga hal tersebut dijadikan dasar laporan atas dugaan tindak pidana penistaan terhadap agama sebagaimana yang dirumuskan dalam Pasal 156a Kitab Undang-Undang Hukum Pidana. Sebagai bentuk tindak lanjut dari kasus tersebut, maka proses hukum untuk laporan tersebut dilakukan dan langsung menjadi fokus konsentrasi masyarakat. Namun dalam hal proses penegakan hukumnya dinilai memiliki beberapa ke-janggalan dan menyimpang dari asas atau prinsip hukum acara pidana. Hal inilah yang membuat kasus ini menarik untuk diteliti lebih lanjut dengan menggunakan beberapa instrumen peraturan perundang-undangan yang terkait, diantaranya adalah Undang-Undang Nomor 8 Tahun 1981 Tentang Hukum Acara Pidana. Pembahasan dalam tulisan ini dilakukan dengan menggunakan metode pendekatan yuridis normatif yang fokus menelaah pelanggaran terhadap asas atau prinsip hukum acara pidana di dalam penegakan hukum kasus penistaan agama oleh Basuki Tjahaya Purnama. Sehingga dikemudian hari diharapkan kelalaian penerapan asas atau prinsip hukum acara pidana tidak terulang lagi. Kata Kunci: penistaan agama; hukum acara pidana; penegakan hukum
