THE CONCEPT, TYPES, TASKS AND THE NEED FOR THE USE OF URGENT INVESTMENT TOOLS OF CRISIS MANAGEMENT AT ENTERPRISES

Currently, many Ukrainian enterprises are in crisis. Getting out of this situation requires the use of various types of urgent crisis management tools, among which investment instruments play an important role. The purpose of this article is to form the theoretical basis for the use of urgent investment tools of crisis management at enterprises. It was found that the urgent investment tools of crisis management in the enterprise should be understood as ways of immediate (urgent) investment actions which are aimed at eliminating or reducing the negative impact of the crisis on the economic condition of the enterprise and ensuring its further effective development. These instruments are grouped according to the following characteristics: the environment in which the relevant instruments are formed and operate, the relation to the current owners of the enterprise, the effectiveness of implementation, the duration of the effect of implementing instruments, the urgency of their implementation, the areas of investment, the objectives of application, the duration of application, the types of financial and economic crises at the enterprise, the elimination (reduction) of the negative influence of which the corresponding tools are directed at, the subject of investment. It is established that the main tasks of using investment urgent tools of anti-crisis management at the enterprises are: selection of the best types of investment urgent tools of anti-crisis management; selection of the best variant of each type of urgent investment tools of crisis management; setting deadlines for the implementation of selected types and options for urgent tools of crisis management at the enterprise; determination of the optimal amount of total investments that should be invested in the implementation of the crisis management program at the enterprise, and the corresponding to this volume of the general list of investment urgent tools of such management; identifying the best sources of investment and establishing the best structure of investment in terms of these sources.

In order to identify urgent measures of crisis management, which characterize the immediate (urgent) actions to eliminate or reduce the negative impact of crisis on the economic condition of the enterprise and ensure its further effective development, the article uses the method of simulation (provides numerical calculations for statistical samples according to a pre-formed mathematical model designed to estimate the probabilistic characteristics of the studied quantities). The procedure of simulation is developed using a mathematical model to determine the resulting indicator - the term of implementation of measures to implement urgent tools of crisis management of enterprises, which is tested in the process of implementing a series of numerical experiments. This allows for statistical and probabilistic analysis, which involves the calculation of: the average value; standard deviation; coefficient of variation; the obtained maximum and minimum values of the resulting indicator; the number of cases of using urgent measures of crisis management of enterprises; the total value of the resulting indicator (duration of implementation of measures to implement urgent tools of crisis management of enterprises); duration of implementation of crisis management measures of enterprises that cannot be classified as urgent; the probability of using urgent measures of crisis management of enterprises. Practical application of simulation modeling at industrial enterprises of the Western region of Ukraine allowed to establish the minimum and maximum term of introduction of anti-crisis management tools, number of cases (from 1 to 22) and probability of using urgent tools of anti-crisis management of enterprises, ranging from 0,8 to 22,8% etc.

Studying the historical facts of past wars and armed conflicts and natural and man-made emergencies, today in the Republic of Kazakhstan one of the most important security issues is the preparation and organization of the evacuation of the population from possible dangerous zones, taking into account the emergence of new threats to the country’s security. The paper presents an algorithm for constructing universal scales of the distribution function of opportunities by types of support and rebuilding them into subject scales using display functions. The purpose of the paper is to determine the integral indicators characterizing the possibility of accommodation of the evacuated population and the impact on resources during relocation. On the subject scales of cities and districts of the region, indicators of the possibility of relocation of a certain amount of the evacuated population by types of support and indicators characterizing the impact on the district’s resources during resettlement of a certain amount of the evacuated population are determined. It was concluded that the use of integrated indicators allows the selection of areas to accommodate the evacuated population without the use of statistical data, in conditions of incomplete and inaccurate information. The presented method does not replace traditional methods based on classical methods of territory assessment by the level of life sustenance, but also allows their reasonable combination with the experience of specialists in this field, taking into account the incompleteness, uncertainty, and inconsistency of the initial data of the study area, which does not allow the application of existing methods.

The purpose of the article is to explore the types of personnel procedures in the National Police of Ukraine on the basis of scientific developments of scholars and to carry out their classification. To achieve this goal, such methods as formal-logical, comparative analysis, system-structural and comparative-legal was used. The successful functioning the National Police of Ukraine is not possible without the proper selection of highly qualified employees, which can be ensured through the introduction of truly effective and efficient personnel procedures. The theoretical and legal approaches to the division of personnel procedures into appropriate types by different classification criteria are analyzed and summarized, in particular, depending on: a) the subject of the initiative; b) the nature of the consequences; c) the type (direction) of the activity of the authority. The personnel procedures, which are divided into ordinary and simplified, are also illustrated. The tasks of the National Police Personnel Department are given. It is stated that the achievement of effective work of the National Police bodies is not possible without further improvement of the mechanism of personnel procedures, since insufficient work with staff has a negative impact on the reform of this law enforcement agency. As a result of the study the author's classification of personnel procedures in the National Police of Ukraine was proposed, namely, according to the following criteria: 1) by the subject of the initiative of the personnel procedure; 2) by the nature of the consequences for the subject of the personnel relations; 3) by the stage of staffing; 4) by the direction of activity of the subject of personnel relations in the police force; 5) by the degree of regulation; 6) by functional purpose; 7) by tasks of staffing.

It would be best to read it for a thorough understanding of the present document.

In recent years, the outbreak of many school sports injury accidents aroused widespread public concern about liability determination of accident. Previous studies have examined the legal application of the liability principles from a law perspective, but few kinds of research attempted to analyze the progress of liability determination from the perspective of “law economics”. To fill this research gap, we introduce the evolutionary game model, as an important theoretical tool of “law economics”, to investigate how various factors influence the strategy selection of the parties, as well as examine what liability principle can effectively treat school sports injury accidents. The results indicate that the strategic selection of the subject of liability is significantly related to the accident compensation cost and the prevention cost of both parties. Moreover, we also find that both strict and proportional liability rules can play key roles in dealing with the issue of liability determination of school sports injury accidents, but the two liability rules have different effects on the strategic selection of parties. More specifically, compared to the strict liability principle, the proportional liability principle can motivate both the school and the students to adopt the active strategy of “appropriate caution” to prevent occurring sports injury accidents in schools.

The article presents the results of empirical research focused on the study of the level of communicative and personal development of preschool children. The subject of organized research activity is a communicative sphere of the person at baseline levels of ontogeny, the means and ways of its effective development. The result of the pilot study was the selection of basic parameters of the communicative development of preschool children, a diagnostic cutoff, which showed the need to develop the system of measures for optimizing the development of communicative sphere of children. The program of activities is given.

Abstract Heat treatment of a casting elements poured from silumins belongs to technological processes aimed mainly at change of their mechanical properties in solid state, inducing predetermined structural changes, which are based on precipitation processes (structural strengthening of the material), being a derivative of temperature and duration of solutioning and ageing operations. The subject-matter of this paper is the issue concerning implementation of a heat treatment process, basing on selection of dispersion hardening parameters to assure improvement of technological quality in terms of mechanical properties of a clamping element of energy network suspension, poured from hypoeutectic silumin of the LM25 brand; performed on the basis of experimental research program with use of the ATD method, serving to determination of temperature range of solutioning and ageing treatments. The heat treatment performed in laboratory conditions on a component of energy network suspension has enabled increase of the tensile strength Rm and the hardness HB with about 60-70% comparing to the casting without the heat treatment, when the casting was solutioned at temperature 520 °C for 1 hour and aged at temperature 165 °C during 3 hours.

The results of chemical analysis of natural waters from surface (river, water supply) and underground (well, well) sources are given. Water selection for analysis was carried out in a number of cities and villages of the Samara and Penza regions. The analysis was performed on the following indicators: total stiff ness, hydrogen index, calcium, magnesium, iron cations, chlorides, sulfates, hydrocarbonates, permanganate oxidability. The most common chemical indicator of water quality exceeding MPC was identifi ed. The negative impact of rigid water on the operation of boiler units and household needs is shown. Various methods of water softening are illuminated. The results of determination of water hardness before softening and after fi ltration through a layer of cationite and anionite are presented. Based on the obtained indicators, recommendations are given on the selection of softening methods for various types of boilers.

The article deals with problematic issues related to the norms of criminal procedure legislation, considering the involvement of an expert as an investigative action. Among criminal scientists and proceduralists there is no consensus on the procedural definition of forensic examination. Most of them include forensics to investigative actions. By the definition of a forensic examination, it is clear that an integral feature of a procedural action is to conduct it exclusively by officials of state bodies authorized by law to conduct criminal proceedings. These include: employees of the operational units, an investigator, a prosecutor, a judge. The subject of the examination is an expert – a person not authorized by law to conduct investigative actions. That is why, in our opinion, it is impossible to refer an examination to investigative actions. Proponents of referring a forensic examination to investigative actions most often mean it as «the appointment and conduct of a forensic examination». It is argued that actions regarding the appointment and conduct of the examination are different in nature and subjects of conduct. If we consider the stage of appointment of the examination, and for the current Criminal Procedure Code of Ukraine – the involvement of an expert, then its subject is the investigator. The subject of the examination is an expert. Considering the characteristic features of the investigative action, it can be concluded that the stage of appointment of the examination or the involvement of an expert, which scientists consider as preparatory to the examination, has all the signs inherent in an independent investigative action. It is governed by the rules of procedural law, carried out in the framework of criminal proceedings, authorized by the person. When an expert is involved, the investigator conducts certain actions, the result of which is reflected in the ruling of the investigating judge. The purpose of the examination is to obtain, research and verify evidence. Considering the involvement of an expert as a separate investigative action, we define its content, divided into generally accepted stages: preparatory, working and final. To the preparatory stage, we include such actions: the decision to conduct an examination; selection of an expert institution or a private expert; determination of the type of examination and subject of study; determining the order of appointment of examinations in relation to the same objects; timing of appointment examination. The following should be attributed to the working stage: selection of objects for examination; receipt of the decision of the investigating judge for the examination. The final stage consists of the following stages: determining the circle of persons who may be present during the examination; referrals and necessary materials to the expert institution. The subject of research is the processes of formation of man - made electromagnetic load at the enterprise under the influence of external and internal fields. The purpose of the work - to develop a modern algorithm for estimating the electromagnetic load at the enterprise and provide recommendations for the introduction of means of protection of workers without large economic losses. To  solve this goal, approaches and methods of theoretical research were used, which are based on the fundamental principles of classical physics and systems analysis. The paper shows that the development of an algorithm for estimating man -made electromagnetic load at the enterprise depends on the identification of man - made fields and determining their spatial propagation (taking into account the prediction of the effects of edge effects) is a necessary general complex for further professional shielding at the enterprise. It is concluded that the presented algorithm for estimating man-made electromagnetic load at the enterprise and the described recommendations for implementation solve the main issue - forecasting protective properties, which simplifies further selection of technical methods of protection of workers, individual workplace or sensitive electronic device or enterprise as a whole.
