This paper takes the topic of religious freedom. Freedom of belief when faced with the principle of freedom of religion promoted by the declaration of human rights cause differences in public perception. The formulation of freedom of religion can be understood by choosing or embracing a religion, out of a religion and no religion is the scope of freedom of religion. This also affects the law and the provision of transitional religious sanctions contrary to the principle of religious freedom which will affect the violation of human rights. The existence of clash between two interests is the author interested in discussing it further.This research is library research (literature study), with normative approach. Data collection is done by recording, reviewing and reviewing all information obtained from primary and secondary data. After the data collection process is complete, data selection, data grouping, and description process is the compilation of data into a narrative text. Then the data is analyzed qualitatively to get the conclusion.This research produces: 1) There is a difference of opinion of scholars related to the issue of religious transition. The majority of religious scholars believe that the case of religious transition into the hudud finger. This is due to the definite and permanent form of punishment and there is no chance for the ruler to forgive him. Meanwhile, according to Hanafiyah incase this transition case of religion on takzir jarimah, the consequences of death penalty is fixed and permanent, but there is an opportunity for the ruler to forgive him and forgive him; 2) For the murder of transitional people in the shari'ah of Islam is the replacement of religion accompanied by war. The war in the Islamic Shari'ah is a major crime that includes one of the crimes that disrupt the security of the state and damage the existing system.

This research was conducted to determine status and legal consequences of village head on the village management in accordance with the provisions of the village legislation. This research approach used normative juridical approach in the sense of examining norms and rules relating to issues to be discussed. Supporting data were secondary data that is obtained from library, legislation in force, and theories that exist in the literature relating to the village. The data collection is obtained by organizing a literature study (Library Research). This research result showed that the presence village head aimed to implement village government in accordance with the provisions of the legislation in force and obtained legal certainty to the community.

Abstrak Tulisan ini bertujuan untuk mendeskripsikan pemahaman dan praktik fidyah salat bagi orang yang telah meninggal sebagai tradisi masyarakat Nahdiyyin di Indramayu. Doktrin adanya fidyah salat memang menimbulkan kontroversi yang cukup sengit di tengah masyarakat, ada yang pro dan kontra. Meski demikian, sebagian masyarakat meyakini bahwa fidyah salat merupakan ajaran Islam Ahlussunnah Waljama’ah, sebagaimana ditulis dalam kitab-kitab al-Syafi’iyyah seperti Niha>yah al-Zai>n, Tarsyi>ḥ al-Mustafi>di>n, dan Iʻa>nah al-Ṭa>libi>n. Penelitian bertujuan untuk menganalisis pemahaman masyarakat terhadap fidyah salat bagi orang meninggal dan pelaksanaan tradisi fidyah salat bagi orang meninggal yang dilakukan masyarakat Nahdliyyin di Indramayu. Penelitian ini menggunakan metode analisa kualitatif deskriptif. Adapun teknik pengumpulan datanya dilakukan dengan dua cara yaitu kepustakaan (library research) dan lapangan (field research). Studi kepustakaan dilakukan dengan menelaah kitab-kitab al-Syafi’iyyah sebagai sumber rujukan masyarakat Nahdliyyin tentang fidyah salat, dan studi lapangan dilakukan dengan cara observasi, wawancara dan dokumentasi terhadap masyarakat Indramayu. Penelitian ini menyimpulkan bahwa tradisi fidyah yang dilakukan masyarakat Indramayu dipahami sebagai suatu ih}t}iya>t} (kehati-hatian) terhadap salat yang pernah ditinggalkan oleh kerabat yang meninggal. Tradisi fidyah ini dilakukan dengan cara membolak-balikkan beras/uang dari wali kepada fakir miskin, dan sebaliknya sebanyak belasan hingga puluhan kali. Hal ini dilakukan untuk menutupi utang salat seseorang yang diasumsikan pernah meninggalkan salat selama seumur hidupnya. Abstract This paper aims to describe the understanding and practice of fidyah prayer for people who have died as a tradition of Nahdliyyin’s community in Indramayu. The doctrine of their fidyah prayer has caused a fierce controversy in the community, there are pros and cons. However, some people believe that fidyah prayer is the teaching of Islam Ahl al-Sunnah Waljama'ah, as written in the books of al-Syafi'iyyah like Nihayah al-Zain, Tarsyīḥ al-Mustafīdīn,and I'ānah al-Talibīn. The questions pursued in this study are; 1) How does the Nahdliyyin community in Indramayu against Fidyah prayers for the deceased?; 2) How do the practices of Fidyah prayers tradition being  performed by the Nahdliyyin community in Indramayu?. This study employs a descriptive qualitative metodh. The technique of data collection is done in two ways: library research and field research. Literature study is conducted by examining the books of al-Syafi'iyyah as a reference source of Nahdliyyin community about fidyah prayer, while the field studies are conducted through observation, interview and documentation to the community in Indramayu. This study concluded that fidyah prayer tradition in Indramayu community is understood as iḥṭiyāṭ (prudence) to the prayers which might abandoned by relatives who died. Fidyah tradition is done by rotating back and forth the rice / money from the family to the poor, and vice versa as many as a dozen to tens of times. This is done to cover the assumed debt of praying belong to someone who might abandoned it during his/her lifetime.

ABSTRAKJaminan terhadap hak untuk memeluk agama dan keyakinan sudah dijamin melalui konstitusi Indonesia, tapi jaminan konstitusional itu belumlah cukup. Penegakan hak untuk memeluk agama dan keyakinan masih perlu didukung dengan instrumen hukum lainnya, dan salah satunya ialah putusan pengadilan. Dalam konteks seperti itu, maka keberadaan Putusan Nomor 69/PID.B/2012/PN.SPG menarik untuk dicermati. Putusan tersebut berkaitan erat dengan isu penegakan hak untuk memeluk agama dan keyakinan di Indonesia, terutama bagi kelompok minoritas. Fokus permasalahan dalam tulisan ini akan diarahkan kepada persoalan bagaimanakah substansi Putusan Nomor 69/PID.B/2012/PN.SPG dilihat dari perspektif penegakan hak asasi manusia, khususnya hak asasi manusia untuk secara bebas (tanpa tekanan) memilih dan memeluk suatu agama dan keyakinan. Dalam melakukan analisis, penulis menggunakan metode kajian kepustakaan dengan bersandar pada data sekunder. Analisis akan dilakukan secara kualitatif dengan metode pendekatan peraturan perundang-undangan dan metode pendekatan konseptual. Kesimpulan yang didapat dari analisis ialah bahwa Putusan Nomor 69/PID.B/2012/PN.SPG cenderung masih berupaya mencapai aspek keadilan prosedural. Semangat untuk mengedepankan penegakan hak asasi manusia, khususnya hak beragama dan berkeyakinan bagi kelompok minoritas, tidak tampak dalam putusan tersebut.Kata kunci: hak beragama dan berkeyakinan, kelompok minoritas, putusan pengadilan. ABSTRACTThe rights to freedom of religion and belief has been guaranteed under the Indonesian Constitution, although it is not enough. Enforcement of the right to religion and belief still needs to be supported by other legal instruments, one of which is the court ruling. In that context, Court Decision Number 69/PID.B/2012/PN.SPG is interesting to study. Decision Number 69/PID.B/2012/PN.SPG is closely related to the issue of enforcing the right to embrace religion and belief in Indonesia, especially for minority groups. The focus of the problem in this paper leads to the question of how the substance of Court Decision Number 69/PID.B/2012/PN.SPG is viewed from the perspective of human rights enforcement, especially the rights to freedom (without pressure) of religion and belief. The method of analysis employed is literature study by relying on secondary data. The analysis is conducted qualitatively by the legislation and conceptual approach. From the analysis largely it can be concluded that Court Decision Number 69/PID.B/2012/PN.SPG still tends to grasp the aspect of procedural justice. The spirit to encourage human rights enforcement, especially religious rights for minority groups is not evident in the decision.Keywords: the right to freedom of religion and belief, minority, court decision.

  This study aims to determine the challenges of higher education learning and the implementation of independent learning during the Covid-19 pandemic. The method used in this research is literature study or library research. Literature studies are carried out by reading library sources to obtain the required data. The data sources used are secondary data, where secondary data is collected through textbooks, scientific journals, and perodical. The results showed that online learning is learning that uses an internet-based interactive model and a Learning Management System (LMS). The abilities of lecturers and students in online learning vary, some are accustomed to it, cannot be separated, there are also those who are forced and unprepared. However, the condition of the plague forces everyone to be ready to take advantage of information technology to prevent the outbreak from spreading. The Coronavirus Disease (Covid-19) pandemic has great potential to become a catalyst in the implementation of the Merdeka Learning: Merdeka Campus policy. Lecturers and students become actors in independent learning with the help of information technology. The implementation of online learning is not only dominated by State Universities (PTN), Private Universities (PTS) have also implemented online lectures well. Pandemi Coronavirus Disease (Covid-19) justru memberikan potensi besar menjadi katalis dalam implementasi kebijakan Merdeka Belajar: Kampus Merdeka. Dosen dan mahasiswa menjadi actor dalam pembelajaran secara mandiri dengan bantuan teknologi informasi. Implementasi pembelajaran daring bukan hanya didominasi Perguruan Tinggi Negeri (PTN), Perguruan Tinggi Swasta (PTS) juga telah mengimplementasikan kuliah daring dengan baik. This research aims to identify and explain matters related to academic problems,namely: first, understand the formulation of religious freedom in the Islamic religion and religiousfreedom in the formulation of the Christian religion. Second, understand the differenceand points alignment of religious freedom contained in Islam and Christianity. This study wasa qualitative research with religious knowledge as the scope of its research and literature as aplace of research (library research). The collected data is then presented descriptively by usingthe approach of sociology of religion. Sources of data in this study were classified into twogroups, namely primary data and secondary data. The data collected by using documentationand tested the validity of test data by applying confirmability (objectivity of research). Thecollected data were then analyzed with a comparative analysis and deductive models. Basedon the analysis, researchers concluded that Islam and Christianity have their own meaning ofreligious freedom. Freedom of religion in Islam and Christians when studied by the method ofcomparative religion, it will show the differences—on the basis of the law of religious freedom,the freedom of religion, and the norms of religious freedom—and side alignment in the sense—the freedom of each individual to embrace religion according to his individual—and embodiedthe goals of religious freedom is to realize the inter religious harmony.Keywords: freedom of religion; Islam; ChristianAbstrak: Penelitian ini bertujuan untuk mengetahui dan menjelaskan hal-hal yang terkaitdengan problem akademik, yaitu: pertama, memahami rumusan kebebasan beragama dalamagama Islam dan rumusan kebebasan beragama dalam agama Kristen. Penelitian kualitatif ini dengan ilmu agama sebagai ruang lingkup penelitiannya dankepustakaan sebagai tempat penelitiannya (library research). Data yang didapat kemudiandisajikan secara diskriptif dengan menggunakan pendekatan ilmu sosiologi agama. Sumberdata dalam penelitian ini diklasifikasikan ke dalam dua golongan, yaitu data primer dan datasekunder. Data-data dikumpulkan dengan menggunakan teknik dokumentasi dan diuji validitasdatanya dengan menerapkan uji confirmability (obyektivitas penelitian). Data dianalisisdengan komparatif dan deduktif. Kesimpulan, bahwa agama Islam dan Kristen memilikipemaknaan tersendiri tentang kebebasan beragama. Kebebasan beragama dalam Islam danKristen ketika dikaji dengan metode perbandingan agama, maka akan terlihat sisi perbedaan—yakni pada sisi dasar hukum kebebasan beragama, batas kebebasan beragama, dan norma kebebasanberagama—dan sisi-sisi kesejajaran yakni pada pengertian—kebebasan tiap individuuntuk memeluk agama sesuai dengan keyakinannya masing-masing—dan tujuan dari terwujudkankebebasan beragama yaitu mewujudkan kerukunan antar umat beragama.Kata Kunci: kebebasan beragama; agama Islam; agama Kristen

This research is an attempt to know the courtesy reading the Quran in the book of At-Tibyan fi Adabi Hamalatil Quran by Imam Nawawi. The question that is to be answered through this study is (1) how the courtesy to read Al-Quran in the book At-Tibyan, (2) How does the relevance of courtesy to read the Qur'an in the book of At-Tibyan in contemporary times? The research methods use library research. This study is conducted using data collection techniques by conducting observations on certain sources, seeking, studying books, articles, journals, theses or others related to this study. Data collection is divided into two sources, namely primary and secondary data. Then the data are analyzed using descriptive and contextual methods. The results show that courtesy reading the Quran in the book of At-Tibyan fi Adabi Hamalatil Quran includes: Solemn, sincere, ethical, clean and holy State, facing the Qibla, start with Ta'awudz. While the relevance of courtesy reading the Quran in the book of At-Tibyan fi Adabi Hamalatil Quran with the context of contemporary can be a solution in improving the manners of interacting with the Quran, especially in the face of today's characteristics or contemporary.

<p><em>This study aims to: increase a deeper understanding of the value of tattwa education in Tutur Parakriya. This data is obtained using a method, and this method must also be precise so that the data obtained can be accurate and support the research results. This type of research is qualitative because it is a text research or library research whose primary data source is Tutur Parakriya which has been transcribed into text / text form. Literature study and interviews are used as data collection methods and then descriptive qualitative data processing is performed. As far as researchers know, no one has researched about this papyrus, so it is only based on text / text transcripts. This research uses the concept foundation to describe the problems to be discussed, and as a scalpel uses the theory of meaning and hermeneutic theory.</em><em> </em><em>The results of Tutur Parakriya's research contain the value of tattwa education, that is advice or advice to teach Hindus to be able to get the perfection of birth and mind.</em></p>

The discussion in this research is terrorism from the perspective of Islamic criminal law (fiqih jinayah). The problem that becomes the focus of research is how terrorism is in the review of Islamic criminal law or jinnayah fiqh. Qualitative research, the source of which is library research, is the method used in research. There are two kinds of data sources in this research, namely primary and secondary data sources, while the data collection and analysis uses literature review research. The data were analyzed using the Islamic criminal law theory approach. So as a result of this research that acts of terrorism are not justified in Islamic teachings. The birth of this action is because the perpetrators have shallow thoughts or have very minimal thoughts and have political goals to harm themselves and others. They even consider this act as Jihad, even though in fact it is not a jihad but an act that brings fear to potential victims.

The right to religious freedom is generally believed to be the solution to religious intolerance and discrimination and to ensure world peace amongst world citizens. On an international level, the United Nations, through the appointment of a special rapporteur for freedom of religion and belief, has introduced a tool to monitor violations of this right. This tool is known as �the framework of communications� and is focused mainly on the relationship between governments and religions. Unfortunately, religion is not excluded from the violation of human rights within its own ranks. This article pointed out that however pure the intention of freedom of religion, no real measures are in place to address violations of human rights in minority religions. Therefore, a tool is needed to investigate and address alleged violations within minority religions.

This paper examines religious and state relations of Islamic thought perspective. This study aims to describe how the relationship between religion and state in the view of Islam. The method used in obtaining data is descriptive method through literature study. The results of the study show that among Muslim figures or thinkers such as Nurcholish Madjid and Abdur Rahman Wahid agree that there is a constructive relationship between state and religion which by revivalists separates it. Some of the indicators are: (1) Islam gives the principles of the formation of a state with the concept of khalīfah ,dawlah, or hukūmah, (2) Islam emphasizes the democratic values of truth and justice, and (3) Islam upholds Human Rights by stating that the basic rights that human beings bring ever since they are born are the right of religious freedom. Therefore, Islam essentially emphasizes the importance of human rights to be upheld in a state, because human rights are rights that should not be disturbed and deprived from the person who has the right.
