Referring to the provision of Article 66 Paragraph (1) of Law Number 2 Year 2014, Assembly Honor Notary is authorized to approve the calling of a Notary by law enforcement. The authority of the Assembly Honor Notary is to replace the authority of the Regional Notary Supervisory Board in the case of giving approval to the calling of a Notary by law enforcement as stated in Article 66 Paragraph (1) of Law Number 30 Year 2004, which has been abolished by the Constitutional Court of the Republic of Indonesia through the Decision of the Constitutional Court of the Republic of Indonesia Number 49 / PUU-X / 2012 because it is contradictory to the 1945 Constitution of the State of the Republic of Indonesia. After the enactment of Law Number 2 Year 2014 the authority is reappeared and delegated to the Assembly Honor Notary. The research is empirical juridical research using primary law material, secondary law material, and tertiary legal material. After all the data collected then arranged systematically then analyzed qualitatively, and presented descriptively.The conclusion of this research is that the exercise of the authority of the Assembly Honor Notary in giving approval to the calling of a Notary by law enforcement has been done accordingly in accordance with the provisions of the prevailing laws and regulations and should continue to run as a safeguard against the Notary. A common obstruction is the difficulty of bringing together members of the Assembly Honor Notary when conducting an examination hearing. Related to that, there must be a commitment from each member of the Assembly Honor Notary to be able to perform his / her duties and obligations as a member of the Assembly Honor Notary.Key Words: Authority, Assembly Honor Notary, Calling a Notary.

ABSTRAKKetentuan Pasal 4 dan Pasal 16 ayat (1) huruf f Undang-Undang Jabatan Notaris mewajibkan notaris untuk menjaga kerahasiaan segala sesuatu mengenai akta yang dibuatnya dan segala keterangan yang diperoleh guna pembuatan akta sesuai dengan sumpah janji jabatan kecuali undang-undang menentukan lain. Kemungkinan terhadap pelanggaran kewajiban tersebut berdasarkan Pasal 16 ayat (11) Undang-Undang Jabatan Notaris, seorang notaris dapat dikenai sanksi berupa teguran lisan sampai dengan pemberhentian dengan tidak hormat. Terlebih lagi dengan adanya putusan Mahkamah Konstitusi Republik Indonesia dengan Nomor: 49/PUU–X/2012 memutuskan telah meniadakan atau mengakhiri kewenangan Majelis Pengawas Daerah (MPD) yang tercantum dalam Pasal 66 ayat (1) UUJN membuat notaris seakan-akan tidak ada perlindungan hukum bagi notaris dalam menjalankan tugas jabatannya. Ikatan Notaris Indonesia (INI) harus berusaha menjalankan peranan pembinaan dan perlindungan meningkatkan pengetahuan, kemampuan dan keterampilan para notaris. Demikian juga menjalin hubungan dengan para penegak hukum lainnya, agar penegak hukum lainnya yang ada hubungan dengan notaris dapat memahami kedudukan notaris sesuai UUJN.Berangkat dari pemikiran inilah kewajiban ingkar notaris masih tetap dipertahankan oleh pembuat undang-undang dalam revisi Undang-Undang Jabatan Notaris Tahun 2014 yang merupakan konfigurasi kekuatan perlindungan terhadap profesi dan jabatan notaris dari sisi politik.Kata Kunci : Jabatan Notaris, Hak Ingkar, Perlindungan Hukum.ABSTRACTThe provisions of Article 4 and Article 16 paragraph (1) sub-paragraph f of the Notary's Office Law require a notary to maintain the confidentiality of all matters concerning the deeds it has made and all the information obtained for the deed in accordance with the oath of pledge of office except the law otherwise. The possibility of breach of such obligation under Article 16 paragraph (11) of Notary Law Regulation, a notary public may be subject to sanctions in the form of oral reprimands until dismissal with disrespect. Moreover, with the decision of the Constitutional Court of the Republic of Indonesia with the number : 49 /PUU-X/2012 deciding to have canceled or terminated the authority of the Regional Supervisory Board (MPD) listed in Article 66 paragraph (1) UUJN made a notary as if there was no legal protection for a notary in performing duties. The Indonesian Notary Bond (INI) should endeavor to undertake the role of guidance and protection to increase the knowledge, abilities and skills of the notaries. Likewise establish relationships with other law enforcers, so that other law enforcement who has relationship with the notary can understand the position of notary under the UUJN.Departing from this thought the obligation of notarization is still maintained by the lawmakers in the revision of the Law Regulation of Position Notary on Year 2014 which is the configuration of the strength of the protection of the profession and the notary's position from the political side.Keyword : Position of Notary, Right of Remedy, Legal Protection.

<p>Undang-Undang Nomor 17 Tahun 2014 tentang Majelis Permusyawaratan Rakyat, Dewan Perwakilan Rakyat, Dewan Perwakilan Daerah, Dan Dewan Perwakilan Rakyat Daerah (UU MD3) pasca putusan Mahkamah Konstitusi (MK) dinilai memiliki problem substantif/materil akibat materi muatannya bertentangan dengan Undang-Undang Negara Republik Indonesia Tahun 1945 (UUD NRI 1945), yang mengakibatkan kerugian konstitusional terhadap Dewan Perwakilan Daerah (DPD), meliputi dikuranginya kewenangan DPD untuk dapat mengajukan (Rancangan Undang-Undang) RUU, dikuranginya kewenangan DPD untuk membahas RUU dan dikuranginya kewenangan DPD dalam kedudukannya sebagai lembaga perwakilan daerah. Hal ini menunjukan bahwa pembentukan UU MD3 nyata-nyata tidak menghormati putusan MK yang diberi mandat UUD NRI 1945 sebagai lembaga penafsir dan penjaga konstitusi, dengan tidak menghormati, mematuhi, dan melaksanakan putusan MK ini menunjukkan ketidakpatuhan terhadap putusan lembaga negara yang telah ditunjuk konstitusi untuk mengawal kemurnian pelaksanaan konstitusi. Penelitian ini menggunakan metode normatif menggunakan pendekatan perundang-undangan ( statute approach ), pendekatan konsep ( conceptual approach ), dan pendekatan historis ( historical approach ). Ketidaktaatan penyusunan UU MD3 pada putusan MK merupakan pengingkaran UUD NRI 1945 dan perkembangan ini merupakan langkah mundur reformasi. Pembentuk Undang-Undang, dalam hal ini, Dewan Perwakilan Rakyat (DPR) dan Presiden harus segera melakukan perubahan UU Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-undangan dengan berpijak pada rambu-rambu konstitusional Putusan MK Nomor 92/PUU-X/2012.</p><p>Law Number 17 Year 2014 on the People’s Consultative Assembly, House of Representatives, Regional Representatives Council, and the Regional House of Representatives (MD3 Law) after the decision of the Constitutional Court (MK) is considered to have a substantive problem due to the substance that is contrary to the 1945 Constitution of the Republic of Indonesia (the 1945 Constitution), which resulted in the constitutional loss of Regional Representatives Council (DPD), including the reduction of DPD authority to propose draft bills, to discuss draft bills and the reduction in its authority as the regional representative institution. This shows that the drafting of MD3 Law is obviously not respecting the decision of the Court that is mandated by the 1945 Constitution as the interpreter and guardian institution of the constitutional, by not respecting, obeying and implementing MK’s decision which indicates non-compliance with the decision of the state institution that has been designated to guard the purity of the constitution implementation of the constitution. This study uses normative method with statute approach, conceptual approach and a historical approach. The noncompliance of the drafting of MD3 Law towards the MK’s decision is a denial of MK and this development is a step back of Reformation. The legislators, in this case, the House of Representatives (DPR) and the President should immediately amend the Law Number 12 Year 2011 on the Establishment of Laws and Regulations based on the MK’s Decision No. 92/PUU-X/2012. </p>

AbstractThe basic principles of the state in order to be operational must be spelled out in relation to the pattern of power between state institutions, Implementation of the explanation of relations is done through the constitution, the attitude for need of Indonesian citizens to understand in full and complete about the various relationships between state institutions in the perspective of the UUD NRI 1945 Constitution of the Republic of Indonesia. The purpose of this study is to know how the background or history of the Constitution. to know and analyze how the relation of state institutions today, and how the practice of institutional arrangements in the current era of reform., after being conducted four times the amendment of the Constitution. This research method used normative juridical. The result of this research is the natural implementation of law enforcement power, for example, even though it is determined that the power to make law is owned by DPR, but in its implementation requires cooperation with the co legislator, that is the President and the DPD (for the design of certain laws), a provision of law which has obtained the approval of the DPR and the President and has been ratified and make the law can say no legal force binding the Constitutional Court (MK), if declared contradictory to the� Constitution.� This shows a very serious problem with regard to the relation of state institutions after the amendment (post-reform). so the conclusion is that if the arrangement of relation of state institution fails to do, it will result in the weakening of the state system which is based on the principles of democracy, state law and constitutionalism. Implementasi penjabaran relasi itu di lakukan melalui konstitusi. Bahkan, perlunya sikap warga negara Indonesia (WNI) memahami secara utuh dan lengkap mengenai berbagai relasi antar lembaga negara dalam perspektif UUD NRI 1945. Tujuan dari penelitian ini adalah untuk mengetahui bagaimana latar belakang atau sejarah perubahan UUD NRI 1945, untuk mengetahui dan menganalisis bagaimana relasi lembaga negara saat ini, setelah dilakukan empat kali perubahan UUD NRI 1945 serta untuk mengetahui dan� menganalisis bagaimana praktek penataan kelembagaan di era� roformasi sekarang ini. Metode penelitian ini mneggunakan yuridis normative dengan alat pengumpul data melalui studi kepustakaan dan untuk menganalisnya menggunakan deskriptif analisis. Hasil penelitian ini adalah alam pelaksanaan kekuasaan pembuatan undang-undang misalnya, walaupun ditentukan kekuasaan membuat undang-undang duni�liki oleh DPR, namun dalam pelaksanaannya membutuhkan kerja sama dengan colegislator, yaitu Presiden dan DPD (untuk rancangan un�dang-undang tertentu), bahkan suatu ketentuan undang-undang yang telah mendapatkan persetujuan bersama DPR dan Presiden serta te�lah disahkan dan diundangkan pun dapat dinyatakan tidak mempunyai kekuatan hukum mengikat oleh Mahkamah Konsitusi (MK) jika dinyatakan bertentangan de�ngan UUD 1945. Hal ini menunjukkan persoalan yang sangat serius berkenaan dengan relasi lembaga negara setelah amandemen (pasca reformasi). Kesimpulan yaitu jika penataan relasi lembaga negara gagal dilakukan, maka akan berakibat pada makin melemahnya sistem ketatanegaraan yang di dasarkan pada prinsip-prinsip demokrasi, negara hukum, dan konstitusionalisme. On 17.03.2020, the Parliament declared a state of emergency on the entire territory of the Republic of Moldova for the period March 17 - May 15, 2020. By the same Decision, the Parliament delegated the Commission for Exceptional Situations with the right to implement a series of measures to overcome the epidemiological situation in the country. However, in the conditions of a functioning Parliament and despite the clear and exhaustive texts of the Constitution, the Commission for Exceptional Situations amended during the state of emergency the Contravention Code, which is an organic law. The amendments specifically concerned the procedure and terms for examining infringement cases brought in connection with non-compliance with the measures adopted by the Commission for Exceptional Situations and the Extraordinary Commission for Public Health. In the conditions in which an organic law can be modified only by the Parliament, it is obvious the unconstitutionality, at least partial, of the Disposition no. 4 of 24.03.2020 of the Commission for Exceptional Situations, but unfortunately, the Constitutional Court is not mandated with the right to submit to constitutional review the normative acts adopted by the Commission for Exceptional Situations. Under these conditions, the state is obliged to identify solutions in order not to allow an authority to adopt unconstitutional normative acts that cannot be subject to constitutional review.

The existence of State-Owned enterprises (SOE) as one of Indonesia’s legal entities, whereby the State owns part of all of the capital of the company has presented several legal issues. The BUMN Act that has become the basis for establishing State-Owned enterprises has become its own independent legal subject and separates itself from the wealth of the State and has adhered to the provisions of the Company Law Act so that the capital that is presented by the State to the corporation remains as the capital of the SOE and not form the State. However, existing legislations regarding State funds places the funds for SOE as being part of the State budget. This ambiguity in the status of BUMN Funds is not only found in legislations but also in two different constitutional court decisions that presents inconsistencies towards law enforcers. This clear distinction is crucial in the practice of law enforcement in Indonesia.

he Constitutional Council of France is a body of constitutional control established by the Constitution of 1958. The ConstitutionalCouncil is not the only body that carries out the control over constitutionality. The peculiarity of constitutional control in France consistsin the fact that it has a dual nature and goes beyond well-known models of constitutional control. The constitutionality of acts, issuedby the Parliament, is considered by the Constitutional Council, and after the executive bodies do that, it is passed on to the State Council.Despite the fact that the Constitutional Council is not nominated by a court, its decisions, by their essence, are judicial acts and,likewise the decisions of the Constitutional Court of Ukraine, are endowed with the property of binding force. They are obligatory forall administrative and judicial bodies and are not subjected to revision (the Paragraph 3 of the Article 62 of the French Constitution).However, it should be taken into account that in addition to binding decisions, the Constitutional Council “expresses opinions” that areadvisory in their nature.In addition to carrying out constitutional control, the Constitutional Council has a number of other functions, such as political,advisory and acts as a court to assess the results of elections of deputies to the National Assembly and the Senate, and elections of thePresident of the Republic. Perhaps that is why the Constitutional Council classifies its decisions due to the types of its own powers.Herewith, the noted specific peculiarities are denoted by the Constitutional Council with the help of fixed letter combinations, which are included in the numbers of decision: REF, enacted on referendum issues; ORGA, enacted on issues of the organization of the Cons -titutional Council, etc.Since, despite all the diversity of functions of the Constitutional Council of France, therefore, its main purpose remains the cons -titutional control. Therefore, using the criterion of powers, under which decisions are made, in terms of initial graduation one shouldpoint out the decisions on issues, which are connected with providing compliance of the Constitution with regulatory acts (assuring thepriority of the Constitution), and decisions passed while carrying out other powers.Decisions of the Constitutional Council outstand with being formal and brief. A decision can take literally a few paragraphs. Themost frequently, the Constitutional Council merely refers to a constitutional norm or is limited to the phrase “these provisions do notcontradict the Constitution”, giving guidance and justifying its position in the least.

Legislation is one of the legal products issued by the state government component. In this case, the laws and regulations include the Constitution of the Republic of Indonesia year 1945, the Decree of the People's Consultative Assembly, The Law / Regulation of the Government In lieu of Laws, Government Regulations, Presidential Regulations, and Local Regulations. As for its application, the rules have levels in the arrangement, where there are sections that explain macro and its derivatives that are narrowing down to the implementing regulations. The levels of the rules must be complete because each of them has its own function.  Meanwhile, in this journal, there will be a discussion on the phenomenon of legal vacancies in the case study of Government Regulation of the Republic of Indonesia Number 51 of 2020 related to the Period of Extending Passports to 10 Years, where in the issuance of government regulations have not been included implementing regulations that will regulate how the implementation of government regulations in the field.

Notary is a position or ordinary we call as general officials appointed by the State and work to serve the public interest. Not only that, a notary also in carrying out its duties and authority must comply fully with the prevailing laws and regulations in Indonesia. Each position certainly has an ethics in the profession which is called a code of ethics, as well as a notary who has a code of ethics in his profession. But out there masi no notaries who violate the code of ethics as mentioned in the law, In accordance with the title of the author of the adopted method of research used is the normative research method supported by interviews that are expected to help answer the problems of this study. The authors conducted interviews with the supervisory board, notaries, and legal experts. In this case the notary has been declared guilty by the Regional Supervisory Board (MPD) and will proceed the case to the level of sanction by the Regional Supervisory Board (MPW) and after receiving the sanction it will proceed to the next level of Central Assembly (MPP) to be sanctioned which has been granted by the level of the Regional Supervisory Board (MPW).

Freedom of political expression has not been fully guaranteed in the Indonesian legal system. One of the most prominent in the legal debate is the matter of treason (makar) charges against political expressions of self-determination. In the case of Papua, many Papuans have been detained, criminalised, and even killed because of their political expression. Interestingly, the Constitutional Court, through its decision Number 7/PUU-XV/2017, provided guidance in its ‘ratio decidendi’ argument, specifically the interpretation of treason phrases in the Criminal Code. Interpretation is given by the Constitutional Court after seeing the reality that law enforcement has been arbitrarily abused by the application of the treason article. This is contrary to the freedom of association, opinion and expression, as guaranteed in the 1945 Constitution of the Republic of Indonesia. This article discusses how the application of the phrase treason in law enforcement, especially in connection with the conviction of many Papuans after the Surabaya anti-racism rallies in September 2019. A number of district court decisions on dozens of convicted Papuans show that the legal system that guarantees freedom of political expression has not changed much and law enforcement in fact emphasises the position of racial discrimination and is far below the standard of human rights law. Abstrak Kebebasan ekspresi politik belum sepenuhnya dijamin dalam sistem hukum Indonesia. Salah satu yang paling mengemuka dalam perdebatan hukum adalah soal tuduhan makar terhadap ekspresi politik menentukan nasib sendiri. Dalam kasus Papua, tidak sedikit jumlah warga Papua yang ditahan, dikriminalkan, hingga tewas terbunuh karena soal ekspresi politiknya. Menariknya, Mahkamah Konstitusi melalui putusannya Nomor 7/PUU-XV/2017 memberikan panduan dalam argumen ratio decidendinya, khusus interpretasi frasa makar dalam Kitab-Undang-Undang Hukum Pidana. Penafsiran diberikan oleh Mahkamah Konstitusi setelah melihat realitas penegakan hukum telah banyak disalahgunakan penerapan pasal makar. Hal demikian bertentangan dengan kebebasan berkumpul, berpendapat dan berekspresi, sebagaimana dijamin dalam Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Artikel ini membahas bagaimana penerapan frasa makar dalam penegakan hukumnya, khususnya berkaitan dengan dipidananya banyak warga Papua setelah aksi anti rasisme Surabaya pada September 2019. Sejumlah putusan pengadilan negeri atas puluhan warga Papua yang dipidana tersebut memperlihatkan sistem hukum yang menjamin kebebasan ekspresi politik tidak banyak berubah dan penegakan hukum justru menegaskan posisi diskriminasi rasial serta jauh dari standar hukum hak asasi manusia.

The establishment of the Regional Representative Council of the Republic of Indonesia so called Dewan Perwakilan Daerah (DPD-RI) at least has two objectives. The first is to enhance justice for the people in the region. Secondly, to expanding and increasing the participation of local communities in national life. The process to form this state institution is done by amending the 3rd amendment of the 1945 Constitution of the Republic Indonesia. However, in doing that  amendment there was an internal conflict within the body of DPD-RI involving the old and the new leaders of this institution last year. The length of leadership tenure which was initially made 5 years was amended to became 2.5 years. The different length of leadership tenure was then canceled by the Supreme Court and it was decided to be the same as other institution such as The People’s Consultative Assembly and The House of Representative in that the leadership tenure should be in accordance with the electoral cycle of 5 years. However, although the regulation of DPD-RI has been canceled, the Supreme Court keeps sending its representative to guide the oath of position of the new DPD-RI leadership. The only regulation that has been introduced by the state was regulation toward conflict between state institutions and this conflict can merely be resolved by the Constitutional Court. Therefore, there is an urgent need for the state to seek solution to solve this problem to prevent the same thing happened to other state institution in the future.
