Risk Assessment of Competitive Procurement on Alabama Highway Projects with Texas Comparisions

Public agencies generally let construction contracts to the lowest responsible, responsive bidder. In following this practice, agencies recognize there are higher risks of cost growth in awarding to either unusually low bids or to certain “claim-conscious” bidders. Despite this awareness, there are few documented studies supporting or quantifying the presence of these perceived competitive procurement risks. This research undertakes that specific task. First, bids and bidders on a sample of Alabama highway projects are grouped into risk categories by information available at the project bid opening—well in advance of any potential contract award— and without considering actual project performance data. Second, the cost growth experiences of these projects are statistically analyzed based upon these risk groupings. The results indicate that cost growth on Alabama highway projects is significantly more likely when projects are awarded to unusually low bids or to certain bidder types. A similar study performed earlier on Texas highway projects provides nearly identical results. This type of analysis and the derived information can be used by public agencies to amend the procurement process and objectively disqualify unusually low bids or questionable bidders without abandoning competitive procurement principles.

This research aims to diagnose and identify the causes of claims and disputes between the contractor and the employer, also review the methods used to resolve disputes in construction contracts. In order to achieve the goal of the research, scientific methodology is followed to collect information and data on the subject of claims and disputes in construction projects in Iraq through personal interviews and questionnaire form. The most important results in this research are: the price schedule contract as a kind of competitive contracts is the most important and guarantee for the completion of minimum level of claims and disputes with relative importance of (84.1), compared with the (cost plus a percentage of the cost contract) as a kind of negotiating contracts is the most relative importance of (79.6), and the turnkey contract as a kind of special contracts is the most relative importance of (74.2). The  contractor and  his agents are one of the most influence sources in occurring claims and disputes in construction contracts with relative importance of (77.4) followed by the contract documents with relative importance of (74.2) and then the employer with relative importance of (73.2). In addition to the long period of litigation and the multiplicity of veto grades are most negative when contractual disputes have resolved by it, and with relative importance of (86), followed by the large number of issues and lack of efficiency and specialty of Judges with relative importance (78.4). Finally, the direct negotiation method (relative importance of 77) is one of the most friendly settlement ways favored by conflicted parties, while the resolution of disputes and claims board (relative importance of 10) occupied the last rank in the friendly settlement ways.

Survey results indicate that while the public sector lags behind the private sector, public agencies are beginning to match the cost containment efforts of private employers. While initiation of these efforts represents considerable recent progress, their tangible benefits are not yet apparent.

On the basis of defining the concept of rural highway project performance, the necessity of the project performance evaluation of rural highway is analyzed. According to the theories of government's public function, fiduciary responsibilities accountability and public finance, the relation between rural highway and public finance are made researches on. Furthermore,with the application of the demand level theory of Maslow, the interrelationship among objects of the rural highway project performance evaluation is made an analysis of, and on top of that, combined with SWOT analysis method, the demand and goal of rural highway project performance evaluation are put forward.

An increasing number of state highway agencies (SHAs) are using A (cost) + B (time cost) bidding ( A + B bidding) for highway construction. The A + B bidding concept is designed to shorten the total contract time by allowing each contractor to bid the number of days in which the work can be accomplished, in addition to the traditional cost bid. The SHA is then presented with the problem of determining a reasonable range of contract time submitted by the bidders. Most SHAs do not currently restrict the range of B. However, several problems may arise from an unrestricted range of B. First, if no minimum is set for B, a bidder may inflate the cost bid and submit an unreasonably low B, using the excess cost bid to cover the disincentives charged for exceeding the time bid. Second, if no maximum is set for B, then a bidder with a high B and a low-cost bid may be awarded the job and make an unreasonable amount of money from incentive payments. This study develops a quantified model of the price-time bidding contract. A construction cost-versus-time curve is developed from Florida Department of Transportation (DOT) data. The contractor’s price-versus-time curve is then combined with the road-user cost to determine the optimum lower limit to be set on B. Finally, several projects completed by the Florida DOT will be used to illustrate this model.

Background: Since 1991, US tuberculosis (TB) rates have declined, including among health care personnel (HCP). Non–US born persons accounted for approximately two-thirds of cases. Serial TB testing has limitations in populations at low risk; it is expensive and labor intensive. Method: We moved a large hospital system from facility-level risk stratification to an individual risk model to guide TB screening based on Tuberculosis Screening, Testing, and Treatment of US Health Care Personnel: Recommendations from the National Tuberculosis Controllers Association and CDC, 2019. This process included individual TB risk assessment, symptom evaluation, TB testing for M. tuberculosis infection (by either IGRA or TST) for HCP without documented evidence of prior LTBI or TB disease, with an additional workup for TB disease for HCP with positive test results or symptoms compatible with TB disease. In addition, employees with specific job codes deemed high risk were required to undergo TB screening. Result: In 2018, this hospital system of ~10,000 employees screened 7,556 HCP for TB at a cost of $348,625. In 2019, the cost of the T Spot test increased from $45 to $100 and the cost of screening 5,754 HCP through October 31, 2019, was $543,057. In 2020, it is anticipated that 755 HCP will be screened, saving the hospital an estimated minimum of $467,557. The labor burden associated with employee health personnel will fall from ~629.66 hours to 62.91 hours. The labor burden associated with pulling HCPs from the bedside to be screened will be reduced from 629.66 hours to 62.91 hours as well. Conclusion: Adoption of the individual risk assessment model for TB screening based on Tuberculosis Screening, Testing, and Treatment of US Health Care Personnel: Recommendations from the National Tuberculosis Controllers Association and CDC, 2019 will greatly reduce financial and labor burdens in healthcare settings when implemented.Funding: NoneDisclosures: None

Utility accommodation policies nationwide contain requirements for the accommodation, location, installation, relocation, and maintenance of utility facilities on the state right-of-way. The policies normally cover basic requirements, making it necessary to use additional specifications and special provisions to handle situations not covered by the policies. Frequently, because of the lack of standard utility installation construction specifications at transportation agencies, many different versions of special specifications and special provisions exist. Closely related to the need to standardize construction specifications for utility installations is the need to standardize methodologies and procedures for determining the cost of utility relocation. This lack of standardization translates into difficulties such as how to verify the validity of the cost data submitted for reimbursement and how to prepare adequately for audits and other internal and external inquiries. This paper summarizes the work completed to develop a prototype framework of construction specification requirements for utility installations, with a focus on water, sanitary sewer, and communication specifications. The specification framework includes five groups of specifications: earth work, pipes and boxes, appurtenances, other, and general (including specifications such as mobilization and traffic control, which highway construction contracts typically include but are also relevant to the utility relocation process). The framework uses tables that summarize the main characteristics of proposed new and modified standard specifications and includes a listing of pay items, subsidiary items, and corresponding measurement units. The framework also includes specification requirements.

WBS (Work Breakdown Structure) plays an important role in every construction project. WBS is a hierarchy of decreasing scope of work to become the smallest level called a work package, making it easier in the process of project management and control. The current problem is that many contractors in Indonesia, both large and small contractors, do not understand the importance of using WBS in a construction project. This causes project performance to be less than optimal, especially on cost and time performance. Currently, WBS standards have been developed for building projects. In this study will look at the cost and time performance of the project from the use of WBS standard building. The sample used in this study are projects that have applied the use of project standards. The projects include Building X, Lecture Building Y, and Sports Facility Building Z. The method used in this study is the EVM (Earn Value Method) approach, collecting data using questionnaires. The results showed that using the WBS standard had an effect on cost and time performance. Good cost and time performance is shown in the Building X and Lecture Y buildings. While the cost and time performance of the Z Sports Facility Building tends to be unstable. This is because the work items that exist in the WBS standard are not in accordance with the project conditions, so it is necessary to adjust work items.

Assessment and management of risk constitute the subject of many researches. Nevertheless, many more specific factors are applicable during the implementation of innovative technological projects. On the article identified risk factors, which have been supplemented, systematized and assigned to the individual risk categories. The risk assessment methods for R&D projects have been analysed, as well as the risk sheets have been developed for the R&D project through the use of dotProject application. Also shown that networking and clustering is a change for fruitful cooperation within difference EU projects, which create trust between business and sciences and reduce the risk.
