This chapter assesses the role of the UN Convention on the Rights of People with Disabilities (CRPD) in driving law and policy reform globally relating to the rights of people with disabilities. By ratifying the CRPD states promise to adopt proactive equality norms and provide positive supports for persons with disabilities. They are also required to involve people with disabilities in the enforcement and implementation of the CRPD. It is thus a valuable tool for those advocating for the realisation of the rights of persons with disabilities that they be treated on an equal basis with others and fully included in society. The potential of the CRPD as a tool for social policy reforms is illustrated with reference to its use to impact EU policy to accelerate the de-institutionalisation and de-segregation of persons with disabilities across the EU.

Abstract The issue of disability in indigenous peoples is closely related to the issue of full enjoyment in development and inclusive citizenship. Indigenous peoples have the potential to face discrimination and exclusion from every development from every aspect of life. This condition becomes more vulnerable if it occurs in persons with disabilities. The issue of disability in indigenous peoples, still often neglected in its environment and its own group, and even in the system of society and state. Toraja, Bali, and Maros became the representation of the research area. Based on facts and analyzes, disabilities in indigenous peoples face various layers of discrimination and violations of gender and disability status. The characteristics of indigenous peoples determine the treatment of persons with disabilities in their communities. Most noticeable is the lack of friendly service for persons with disabilities in their own societies. Therefore, people with disabilities in indigenous peoples need open opportunities to participate in customary institutions and emancipation beyond the scope of protection and the fulfillment of rights by the government.

Within the neoliberal and human rights approaches to social policy, what is the lived experience of people with disabilities? In focus groups with people with disabilities and interviews with disability stakeholders in Australia, participants were asked about their experiences and perspectives of welfare to work programs. We analyzed the data by drawing on the United Nations Convention on the Rights of Persons with Disabilities as a framework. The analysis revealed tensions between the rights and responsibilities of citizens and the government, and a disconnection between policy discourse and policy practice. The results suggest that disability rights are jeopardized unless governments take responsibility to create the policy environment for rights-based policy to be implemented; including the equalization of opportunities, providing accessible information and communication about employment, and addressing the administration and process practices that employment service providers follow.
