Cyberspace is a virtual world or online world. It is an artificial world created by computers or internet enabled devices or components to communicate. It is digital platform where users interact and communicate with one another with the help of internet. The cybercrime is a rapid growing area of crime in the world. It is defined as a crime in which computers or internet enabled devices to commit an offenses which is categorized into two types such as property crimes (hacking, spamming, identity theft, fraud and copyright infringement) and crimes against the person ( child pornography, sexual abuse of children, cyber stalking, cyber bullying). Crimes in the virtual world is serious threat to the people as cybercriminals uses computer technology to access the personal and professional information or documents of person or organization for evil or malevolently reasons. The aim of the paper is to render the psychology of child predation and child pornography online in India. This paper will discuss about the different measures which should be taken to protect and educate the children about cyber bullying and cyber stalking in India. It will also highlight the legal intervention, effects on victims, punishment and preventative measures for a broad range of cybercrimes. The study will also understand the psychology behind the cybercrimes such as child sex offences and how such crimes can be prevented. The aim of the study is to discuss the role of government and policy makers for the rehabilitation of victims against cybercrimes. The paper will suggest some measures for the holistic development and security of children.

The principle of good governance is difficult and controversial. Governance opens new space which provides a concept that allows us to discuss the role of government in coping with public issues and the contribution that other players may make. It opens one’s mind to the possibility that groups in society other than government. Good governance is responsive to the present and future needs of society. Strengthening local governance can be ensured through the importation of the component of good governance at the local level. This paper intent to  examine spaces where principles of good governance are required to apply to ensure better service delivery system at Union Parishad. This paper has been followed by social survey method. The data collection technique of this study has covered quantitative technique. Union Parishad as a local self government body ensuring community participations, people can approach and communicates clearly to their representatives and regularly issuing its progress report to the people for their transparency. Besides, dealing with convicted corruption was found most effective in manner.

E-Commerce is now a new business model that is increasingly loved by the people of Indonesia. Internet support that makes business patterns loved for reasons of convenience offered. The change in the way transactions in the business world into the virtual world has given birth to various new legal problems. The action is not safe because it still has some weaknesses so this research tries to formulate and answer several problems, namely how is the mechanism and arrangement of transactions using online media and how is the protection of the interests of the parties in online transactions. The method used in this study is a normative method supported by a statutory approach and a conceptual and analytical approach. The results of this study indicate that the mechanism of buying and selling agreements using online through an intermediary or business actor where the prospective buyer must first enter the business actor's website and then have been accepted as a member of the intermediary or business actor, the next step is allowed to see the catalog of goods and then make a transaction. And legal protection for the parties including: Legal protection for merchants emphasizes payment, the merchant requires customers to make payments in full, then confirms payment, and the next step is to deliver goods that have been purchased, legal protection for customers is under warranty i.e. return or exchange of goods if the goods received are not like what was purchased and Privacy. Legal protection in online transactions is not only given by one legal aspect, but by a legal system that is able to provide simultaneous and comprehensive protection. E-Commerce atau yang disebut transaksi online dewasa ini menjadi model bisnis baru yang semakin digandrungi oleh masyarakat Indonesia. Dukungan internet yang membuat pola bisnis digandrungi karena alasan kemudahan yang ditawarkan. Adanya perubahan cara transaksi dalam dunia bisnis ke dalam dunia virtual telah melahirkan berbagai masalah hukum baru. Tindakan tersebut tidaklah aman sebab masih memiliki beberapa kelemahan sehingga penelitian ini mencoba untuk merumuskan dan menjawab beberapa permasalahan yaitu Bagaimanakah mekanisme dan pengaturan transaksi dengan menggunakan media online dan Bagaimanakah perlindungan terhadap kepentingan para pihak dalam transaksi online. Metode yang digunakan dalam penelitian ini adalah metode normatif dengan didukung oleh pendekatan perundang-undangan serta pendekatan konseptual  dan analisis. Hasil penelitian ini menunjukkan bahwa perjanjian jual beli dengan menggunakan online melalui perantara atau pelaku usaha dimana calon pembeli, pertama harus memasuki website pelaku  usaha  dan  kemudian  telah  diterima menjadi anggota perantara atau pelaku usaha, langkah selanjutnya diperkenankan melihat katalog barang serta kemudian melakukan transaksi dan perlindungan hukum untuk para pihak diantaranya: Perlindungan hukum terhadap merchant menekankan pada pembayaran, merchant mewajibkan customer untuk melaksanakan pembayaran secara lunas,  selanjutnya dilakukan konfirmasi pembayaran, dan tahap berikutnya adalah melakukan pengiriman barang-barang yang telah dibeli, Perlindungan hukum untuk customer berada pada garansi yaitu pengembalian atau penukaran barang apabila barang yang diterima tidak seperti  apa yang dibeli dan Privacy.Perlindungan hukum dalam traansaksi online tidak hanya diberikan oleh satu aspek hukum  saja melainkan oleh suatu  sistem hukum yang mampu memberikan perlindungan yang simultan dan komprehensif.

This study identifies and describes the local wisdom carried out by the coastal communities, especially the people of North Seram, Maluku in preserving the island and marine environment as well as the customary institutions in determining and guarding local wisdom of coastal communities to manage marine resources. The marine resource is started to weaken along with the development of modern technology. This paper provides contemporary phenomena regarding the weakness of customary laws and traditional institutions that regulate marine resources, including social values in the form of rituals, representing the relationship between humans and their environment. The protection of marine resources around them will be an important discussion to see the role of government and society in preserving marine and coastal resources. This study used a qualitative approach to produce descriptive explanations from reports, book reviews, and documents that describe theories and information of both past and present. The result is that the local wisdom maintained as superior cultural practices that are beneficial to human survival, especially in maintaining the sustainability and balance between humans and living objects.

Land given to and owned by people with rights provided by the UUPA is to be used and utilized. The granting and possession of land with these rights will not be meaningful if its use is limited to land as the surface of the earth. The land also has a significant role in the dynamics of development. According to the 1945 Constitution of the Republic of Indonesia NRI,  "earth and water are natural resources contained therein controlled by the state and used for the greatest prosperity of the people." This research uses a normative juridical approach that is research based on the rules / according to the law because this research focused on the use of document studies and literature or secondary data. The research specification used is descriptive-analytic, which describes the law of the land in the era of globalization based on local wisdom. The results of the study illustrate that the role of the land ruling state, which used for the prosperity of the people, is regulated under Law No. 5 of 1960 concerning Basic Regulations on Agrarian Principles (UUPA).On the other hand, the globalization of law is nothing more than a legal intervention from developed countries towards developing countries in order to adjust their laws globally. One way to address the problem of globalization of land law is to reaffirm local wisdom. In other words, they are upholding the customary provisions related to land. Example: provisions of customary land. Customary land is communal land that is jointly owned and thus does not need to be certified.Keywords: globalization, land law, local wisdomABSTRAKTanah diberikan kepada dan dipunyai oleh orang dengan hak-hak yang disediakan oleh UUPA, adalah untuk digunakan dan dimanfaatkan. Diberikannya dan dipunyainya tanah dengan hak-hak tersebut tidak akan bermakna, jika penggunaannya terbatas hanya pada tanah sebagai permukaan bumi saja. Tanah juga mempunyai peranan yang besar dalam dinamika pembangunan. Undang-undang Dasar 1945 menjelaskan bahwa “Bumi dan air dan kekayaan alam yang terkandung didalamnya dikuasai oleh negara dan dipergunakan untuk sebesar-besar kemakmuran rakyat.” Penelitian ini menggunakan pendekatan yuridis normatif yaitu penelitian yang didasarkan kepada kaidah-kaidah/menurut hukum, oleh karena penelitian ini dititik-beratkan pada penggunaan studi dokumen dan bahan pustaka atau data sekunder. Spesifikasi penelitian yang digunakan adalah deskriptif analitis yang menggambarkan tentang hukum tanah di era globalisasi berdasarkan kearifan lokal. Hasil penelitian menggambarkan bahwa peran negara penguasa tanah yang digunakan untuk kemakmuran masyarakat diatur berdasarkan Undang-undang No. 5 tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria (UUPA). Disisi lain, globalisasi hukum tak lebih sebagai intervensi hukum dari negara maju terhadap negara berkembang agar menyesuaikan hukumnya secara global. Salah satu cara menyikapi persoalan globalisasi hukum tanah ini adalah dengan menegaskan kembali kearifan lokal. Dengan kata lain, menegakkan kembali ketentuan-ketentuan adat terkait dengan tanah. Misalnya ketentuan tanah ulayat. Tanah ulayat merupakan tanah komunal milik bersama, dengan demikian tidak perlu disertifikatkan.

Commercial sexual exploitation of children is a social problem that has several categories. This issue is scattered in many countries, especially in Asian countries. Child’s commercial sexual exploitation or eksploitasi seksual komersial anak (ESKA) can ruin the future of the children who are victims, of which they are the successors of the nation. Childhood should be filled by playing and learning but changing with the dark. The role of government as the supreme authority of a country in overcoming the problem of ESKA looks not maximized. The purpose of this research is to find out the role of international organizations in addressing the ESKA problem. International organizations, in this case, are ECPAT or End Child Prostitution, child pornographic grapy, and Trafficking of Children for Sexual Purposes. How are their efforts and roles in overcoming ESKA and its cooperation with the Indonesian government, obstacles, and challenges faced? The benefits of this journal are useful in the development of International Relations, especially those involving the role of international organizations in addressing the problems of ESKA. The method used is descriptive – qualitative, where this method illustrates and analyzes the role of ECPAT as an international organization in addressing the ESKA in Indonesia (2011 – 2015).

For every Muslim, the role of civilization is identical to authentic mission as a leader as a leader in this earth, whose role is greater than leading a province or country. The participation of ulama, dai or da'wah movements in the political sphere is his right, but the missionary movement or organization must also be aware of and be aware of people or persons who want to manipulate da'wah as a vehicle for world politics. Da'wah movements or dai must be able to use various life instruments that exist today for the sake of da'wah. Ulama and the da'i who join in the organization movement or da'wah movement, must realize that they are part of the chain of struggle of the people. Now is the time for da'i or ulama to proclaim themselves from the past fetters that castrated the political life of the scholars.Bagi setiap muslim, peran peradaban identik dengan misi otentik sebagai pemimpin sebagai pemimpin dimuka bumi ini, yang perannya lebih besar dibandingkan memimpin sebuah provinsi atau negara. Keikutsertaan para ulama, dai atau gerakan dakwah dalam ranah politik merupakan haknya, akan tetapi gerakan atau organisasi dakwah juga harus menyadari serta mewaspadai terhadap orang atau oknum yang hendak memperalat dakwah sebagai kendaraan politik dunia. Gerakan dakwah ataupun para dai harus dapat menggunakan berbagai instrument kehidupan yang ada saat ini untuk kepentingan dakwah. Ulama maupun para da’i yang bergabung dalam gerakan organisasi atau gerakan dakwah, harus menyadari bahwasanya dirinya merupakan bagian dari mata rantai perjuangan umat. Kini sudah saatnya para da’i ataupun ulama dapat memproklamirkan diri dari belenggu masa lalu yang mengebiri kehidupan politik para ulama, PPP menjadi salah satu alternatif.

Online shopping has obtained very important position in the 21st century as most of the people are busy, loaded with hectic schedule. In such a situation online shopping became the easiest and most suitable mode for their shopping. This paper describes the development of an e-commerce Web site based on a virtual world that replicates a real store in order to offer a more familiar interface to the user, but overcoming the problems of reality offering a customized presentation of items to each consumer. The technology used is Java. The system architecture is based on a client/server model, where the server manages the description of the items.

It appears that child pornography distribution and child abuses on the Internet have permeated to massively multiplayer online role-playing video games (MMORPG) and 3D social networks, such as Second Life (SL), a compelling online virtual world where millions of users have registered. Although SL is intended for general entertainment in its adult (over 18) version, cases of simulated pedophilia have been reported inside SL’s virtual world, generated by some of its users, employing SL communication capabilities to trade and show child pornography images to exchange related text messages. This chapter provides a literature review on child pornography in MMORPGs and other 3D social networks including SL, as well as policy and network approaches for overcoming child abuse. A review on ethical and legal issues of dealing with child pornography and other types of child abuse in 3D social networks and MMORPGs is also addressed in this chapter.

In this chapter we discuss virtual world professionals: real world employees deployed in virtual worlds for the purpose of representing a company or organization there. We investigate the notions of belonging and community in 3D virtual worlds, and identify the ways in which “belonging” and “not belonging” are constructed and perceived, especially in relation to so-called employee avatars. We explore the dimension of social stigma in virtual worlds and discuss the utility of the separate categories of outsiders and interlopers for inhabitant characterization. Our motivation for doing so is to determine the degree to which corporate presence can be mediated through the specific mechanism of employee avatar appearance. In considering the possibility that some employee avatars may be perceived as interlopers, we propose three methods for investigating the effect of their presence in virtual worlds, called the “interloper effect.”

Pervasive computing and communications is emerging rapidly as an exciting new paradigm and discipline to provide computing and communication services all the time and everywhere. Its systems are now invading every aspect of life to the point that they are disappearing inside all sorts of appliances or can be worn unobtrusively as part of clothing and jewelry. This emergence is a natural outcome of research and technological advances in wireless networks, embedded systems, mobile computing, distributed computing, and agent technologies. At the same time, this emergence brings challenging issues to the legal framework surrounding it. As well recognized, law is a discipline that has direct relevance to human behaviour and its adjoining environment. Thus, a study of law can be a study of the living environment and the people who are in it. This surely brings difficulties for us to study the law in a future scenario such as pervasive computing environment. Attempting to forecast the future of law, technology, and human behavior is a very risky proposition. Hence, it is impossible to fully discuss topics such as “legal aspects of pervasive computing”. This chapter aims to provide a general observation of various legal issues connecting with pervasive computing technologies. To avoid a skeleton introduction piece, the main part of this chapter concentrates on three particular issues: Jurisdiction and the choice of law issue, electronic fraud issue, and the privacy issue. These three are unsettled issues in the current computing environment and believed to become more complicated and controversial in the near future with a wider adoption of ubiquitous computing technology. In the end, this chapter suggests that, to serve the future computing environment better, the legal and regulatory framework should focus on the improvement of internal monitoring of risks and vulnerabilities greater information sharing about these risks and vulnerabilities. Moreover, the role of government should focus on education and training on the care and use of these technologies and better reporting of risks and responses. A fully embedded computing environment that is safe and sound to live in will need more collaboration between individuals, commercial organizations, and the government.
