The article examines the essence and importance of linguistic expertise as an integral part of the legislative process. In particular, it has been established that in world practice, linguistic control of rulemaking is a compulsory phenomenon. However, the legal status of the linguistic expertise of the draft laws has not yet been determined in Ukraine. It has been found out that linguistic examination of draft laws involves studying the system of linguistic representation of legal concepts and categories in normative legal acts, application of basic methods of legislative style, as well as methods of complex linguistic and stylistic processing of legal texts, editorial analysis. The object of linguistic expertise is linguistic units of different levels (word, phrase, sentence, complex semantic, text). Its main task is to prevent violations of language rules in the text of the draft law. We are talking about linguistic errors in draft normative acts, semantic ambiguity, inaccuracy and ambiguity of formulations, tautology, grammatical errors, etc. It is established that the introduction of linguistic expertise of bills is an effective method of ensuring the quality of legislation. At the same time, it is emphasized that it is inappropriate to prepare draft laws on contractual, including paid basis by appropriate scientific and research institutions at the expense of penalties from those MPs who do not attend meetings of the Verkhovna Rada of Ukraine. In view of this, it is proposed to create a structural unit (committee) in the Verkhovna Rada of Ukraine, which would professionally carry out linguistic examination of bills. This structural unit should be formed in the light of positive foreign experience. In particular, it is proposed to include philologists and jurists in its composition. After all, as the foreign experience has shown, the cooperation of linguists and jurists will give an opportunity to comprehensively approach the improvement of legal language. In addition, it was stressed the need to consolidate the requirement of linguistic expertise in the content of the draft Law of Ukraine «On Laws and Legislative Activity». The article is devoted to the study of the constitutional and legal status and effectiveness of a special type of human rights bodies - collegial (collective) ombudsmen. Since the protection and protection of individual rights is the most important task facing the state bodies of any democratic state, in some of them a model of a collective ombudsman is built into the state and legal reality, which has both undoubted advantages and disadvantages inherent in any collegial body. Based on the analysis of foreign experience, it is established that the collegial ombudsman services have demonstrated sufficient stability in ensuring human rights and proved the necessity of their existence. The collegial form of the ombudsman institution contributes to the development of the main directions of the work of the service and a clear specialization of the ombudsmen, which, in turn, leads to an improvement in the quality of their work.

In world practice linguistic control of rulemaking is a binding procedure, the importance of which is axiomatic. However, in Ukraine the legal status of linguistic expertise of draft laws (LEB) is still not defined owing to political, legal and social factors. Therefore, in the article the author considers LEB in linguistic and legal aspects. Classical and modern approaches to the classification of linguistic expertise of bills, also prospects of its implementation in Ukraine are considered. The article consists of the following parts: theoretical analysis, applied aspect and law dimensions of LEB. The first part of the article gives a detailed review of scientific approaches to categorization of LEB according to various criteria. Special attention is paid to those classifications that have integral nature (taking into consideration legal and linguistic factors of examining the texts of draft laws). In the second part, particular attention is given to the author's classification of LEB in the context of the legislative procedure in Ukraine. It is requested to group linguistic examination of bills in four types: discursive, semantic, grammatical and translation examinations. The kind of errors in the texts of bills was chosen as the criterion for the classification of LEB. In the third part, Ukrainian legislation governing legal relations in the area of draft laws examination in the legislative process are overviewed, flaws of legal regulation of expert activities in the field of lawmaking are noted. It is shown that legal status of LEBs in the legislative procedure is absent and the ways to legalize LEB in Ukraine are suggested. The article is of interest to specialists in the fields of the theory of state and law, constitutional law, applied linguistics, relevant experts, as well as to justice authorities and the judicial system representatives.

In line with the rapid development of the times and the increasingly complex problems faced by the state, there has also been a development in government administration which has been marked by a shift in the paradigm of governance from Rule Governance. This situation makes the bureaucracy rigid, in an environment that is only limited to flowing the instructions or following instructions. The district government in an Asologaima District has the main task of carrying out part of the authority delegated by the district head in the fields of government, economy, and development, society, peace, and order as well as coordination.The method is sed is descriptive method. Bureaucrats as providers of public services must be able to provide quality services, the quality of service of bureaucrats to society is closely related to customer satisfaction or consumer satisfaction as the recipient of the service itself.

Аннотация. В статье анализируется качество переводов рассказов В.Шукшина, осуществленных в середине 70-х годов С. Наматбаевым. Переводоведческий анализ вывил многочисленные стилевые расхождения между оригиналом и переводом. При переводе одного из лучших рассказов Шукшина «Чудик» искажения стиля не передали психологические тонкости рассказа. При переводе рассказа «Дядя Ермолай» философский аспект рассказа выпал, так как переводчик исказил жанровую специфику. Перевод рассказа «Два письма» оказался более качественным по сравнению с предыдущими. Переводчик рассказа «Два письма» сумел приблизиться к оригиналу, расшифровать его основную тональность, воспроизвести атмосферу напряженных поисков истины героем рассказа Николаем Иванычем. Этот перевод оказался более качественно выполненным по сравнению с предыдущим рассказом «Дядя Ермолай». Причину переводческого успеха можно объяснить, прежде всего, доступностью содержания рассказа, да и сам герой не столь сложная и глубокая личность, как повествователь в рассказе о дяде Ермолае. В целом, переводы С.Наматбаева являются своеобраз- ным этапом в переводческом деле. В настоящее время необходимо более полное и глубокое восприятие творчества В.Шукшина и создания новых адекватных переводов. Ключевые слова: качество переводов, стилевые расхождения, психологические тонкости, философский аспект, этапом. Аннотация. The quality of translation of the Shukshins stories is analyzed in the Middle 70- years. By S.Namatbaev. The translation analysis had idenh hed numerous style discrepancies between the original and the translation. The psychological feature of the compasihion were not be hansfered by the translation one the bestand famous story by. V.Shukshin due to distorhion of the style. By the translation of the story “The uncle Ermolai” had full a phisichal aspect of the story, because the translator had distorted the genre specifics. The translation of the stories “Two letters” was wade more qualitative comparated with another stories. Generally, the Namatbaevs translation are a sui generis stage in the translatiobs. We need currently more total and profound perception of the creation by V.Shukshin. The create of the new adeavate translation is the main task. The head of the theory and history of Russian literature department. V. Shukshin’s stories and problems of translation them into Kyrgyz language. This article is analysed the quality of translation of V. Shukshin’s stories, which were written in 70 th with S. Namatbaev. Translation analyse deduced many stylistic variations between translated version and original. There is a misrepresentation, was not transmitted psychological subtleties of the story in translation of one of the best V. Shuk- shin’s story “Wierdo”. Metaphysical dimension is disappeared in translation of the story “Uncle Ermolai”, since translator destort the genre specificity. The translation of the story “Two letters” has been more qualitative in comparison with previous translations. In common, S. Namatbaev’s translation is a genius stage in translation. It needs more full and deep comprehension of S. Shukshin’s work and to establish new suitable translation. Objectives. The purpose of this study is to study the essence of ethical problems that arise in the field of genetic screening for prenatal diagnosis (PND) and determine possible ways to overcome them by legal means, taking into account the existing foreign experience. Materials and methods. Normative legal acts and doctrinal sources of Great Britain, Germany, Ireland, France and Switzerland are studied. Methods used: General philosophical, General scientific, private scientific, special (structural-legal, comparative-legal, formal-legal). Results. Ways to resolve ethical problems that arise or may arise in the future as a result of genetic screening for PND, which can be applied within the Russian legal system, are proposed. Conclusions. It is stated that most of the identified ethical problems are related to the lack of normative consolidation of the legal status of the fetus. It is presumed that the beginning of ethics should serve as the guide for legislation in this area. At the same time, it is emphasized that the legal regulation of genetic screening in PND should be flexible enough to optimally ensure the interests of all participants in these relationships. In addition, in this direction, it seems appropriate to refer to the experience of a number of foreign countries, whose legislation provides for fairly strict requirements in the field of PND.

This article outlines potential pros and cons of a future European regulation of proxy advisory firms, as set forth in the Commission’s Proposal for a Directive amending Directive 2007/36/EC. After summarizing criticisms concerning the proxy advisory industry, and findings regarding its de facto influence on investors’ voting conduct both in the US and in the European context, the article adverts to why the power of proxy advisors appears to be overestimated. Uncertainty on the status quo of the industry’s actual impact on key decisions in listed companies, as well as costs associated with a regulation, need to be considered for assessing the suitability of the rules drafted to ensure adequate levels of independence and quality of voting recommendations. While transparency rules may be preferred to stricter legal constraints or requirements in a first stage, possible shortcomings of the Draft Directive exist that may undermine its effectiveness. Analyzing the amendments to the Proposal adopted by the European Parliament, and the Council’s Presidency compromise text, may suggest a preferable approach as regards single rules still making their way through the European legislative process.

AbstractThe article examines the migration infrastructures and pathways through which migrants move into, through and out of irregular status in Japan and the UK and how these infrastructures uniquely shape their migrant experiences of irregularity at key stages of their migration projects.Our analysis brings together two bodies of migration scholarship, namely critical work on the social and legal production of illegality and the impact of legal violence on the lives of immigrants with precarious legal status, and on the role of migration infrastructures in shaping mobility pathways.Drawing upon in-depth qualitative interviews with irregular and precarious migrants in Japan and the UK collected over a ten-year period, this article develops a three-pronged analysis of the infrastructures of irregularity, focusing on infrastructures of entry, settlement and exit, casting a comparative light on the mechanisms that produce precarious and expendable migrant lives in relation to access to labour and labour conditions, access and quality of housing and law enforcement, and how migrants adapt, cope, resist or eventually are overpowered by them.
