The actual problems of cadastral system used for evaluation of agricultural land

The article is about the formation of a new system of state cadastral evaluation of real estate after the coming into force the Federal Law "State Cadastral Evaluation". An analysis of the results of the first round (2018-2019) of the state cadastral evaluation carried out according to the new rules is presented in the paper by example of agricultural lands in the Central Federal District of Russia. The author proposed the scheme of the new cadastral evaluation system.

The author considers the issues of using agricultural land in the Russian Federation, which significantly affects the wellbeing of its citizens. The possibility of partial payment of works on the firstcategory lands inventory and complex cadastral works at the expense of funds received through submission of extracts from the Unified State Register of Real Estate is justified. The shortcomings of the existing system of securing rights to immovable property are reflected, which consist in the possibility of depriving their owners of the registered right in court. It is shown that protecting the rights of individuals and legal entities to land plots by the state, as well as improving the living conditions of the population in rural areas are the main directions of developing the agricultural branch and improving the living standards of rural commodity producers. Possible ways of reducing the area of unused agricultural lands are proposed.

The purpose of the research was to determine the system of measures aimed at financial provision of restoration and improvement of the fertility of the agricultural lands, which are an important part of the state strategy for the development of the Ukrainian economy agrarian sector. Characteristics of land use in European countries and Ukraine were presented. The sources of financial provision of agricultural land restoration were analyzed. The measures aimed at successful restoration of fixed assets of agrarian enterprises, in particular land resources are proposed.

The use of Czechia’s landscape was repeatedly changed, especially by political factors. After 1989, there were large-scale processes of property return, privatization and transformation of the economy and society. In 2003, before entry into EU, approximately 300,000 hectares of agricultural land were not used economically. This was evidently an impact of a tremendous fragmentation of the holdings in the early 1990s as well as large differences between the structure of owners of land and its real users (tenants). A mere 62% of arable land (and 78% of agricultural land in all), registered in the Cadastre of Real Estate (register of owners) is also included in the Land Parcel Identification System (register of users). This disharmony between the cadastral data and the state in the terrain prompted us to focus our attention on this state. We analyze the driving forces which brought it about as well as the size and regional structure of such differences.

Purpose. The aim of the article is determining the conditions of rational use of agricultural land conditions and substantiation of measures to optimize the distribution and rational use of agricultural land. Methodology of research. General scientific and special methods are used to achieve this goal: the dialectical method of scientific knowledge – to consider the essence of the rational use of land and its protection; synthesis – to clarify the relationship between the subjects of land relations; analysis – to assess the constituent elements of agricultural land; graphic – for visual display of the obtained results; abstract and logical method – for the formation of conclusions and research proposals. Findings. The state and rational use of land in the region and the state are studied. The structure of agricultural lands in Ivano-Frankivsk region and Ukraine is analysed. The main ecological and economic aspects of land tenure and land use in agriculture are described, including changes in land relations. The main reasons that caused the negative trends of rational use and protection of land in agriculture are identified. Measures have been developed for the rational use of land in the economic activity of land and its protection. Originality. Approaches to the interpretation of the concept of “rational use of land” are systematized and generalized. Measures on rational use of agricultural lands in economic activity are offered, namely: creation and realization of innovative scientific and technical programs in the field of rational use of lands and their protection; improving the regulatory framework in the field of land relations; development of a mechanism for financing programs; introduction of environmentally friendly ways of agricultural production, etc. Practical value. The expediency of studying and forming the conditions of rational use of agricultural lands is proved. The results of the study can be used by agricultural enterprises in conducting business activities. Over the past 30 years, our country has undergone many changes in the field of land legislation. Many of them were aimed at regulating land relations in the field of rural land use and were expressed in the adoption of various types of amendments and changes to laws and tightening fiscal measures for the resuscitation of unused land. However, such regulation has not led to an improvement in the use of agricultural land, and their quantitative and qualitative potential has deteriorated, which has led to inefficiency of budget funds allocated for the implementation of targeted programs in the field of agriculture. Rational use of land resources in agriculture is one of the most important tasks of land management. This article analyzes the use of land resources in the agro-industrial complex on the example of Central Federal district regions. The main indicators of production and economic activities of the regions of Central Federal district in agriculture, such as investments in agriculture, value of gross output of agriculture, yields of major agricultural crops, productivity of the main types of livestock, profitability of production agriculture, as well as indicators of the intensity of agricultural land using: the proportion of acreage in the total area of land, use of fertilizers, volume of agrochemical operations, availability of improved lands, involvement in economic turnover of previously unused land.. Weight coefficients were calculated for all indicators, groups of regions were formed for production and economic activity in the agro-industrial complex and the intensity of agricultural land use, cartograms were drawn up and proposals were made for planning land use.

Land resources are one of the most important resources in the environmental management system. This resource is necessary for almost all types of human activity: agriculture, construction, industry, mining, recreation, etc. According to the intended purpose in the Land Code of the Russian Federation, lands are divided into seven categories, differing from each other in the economic and legal regime of use. One of these categories is agricultural land. This category of land includes territories necessary for obtaining agricultural products or other purposes related to agriculture, as well as they are geographically distributed outside settlements. Lands of this category of designated purpose are characterized by a high level of anthropogenic impact (agro-preparatory processing of the territory, obtaining agricultural products, placement and grazing of livestock), which significantly affects the indicators of natural biodiversity downward. In order to study the state of land resources in the South of Russia, an analysis was made of the dynamics of changes in the area of agricultural land in the regions that are part of the Southern Federal District. The relevance of the work lies in the study of the current state of agricultural land in the South of Russia. The aim of the work was to study the dynamics of changes in the area of agricultural land in the period from 2009 to 2019. Statistical and analytical methods of geographical research were involved in the work, information was searched for on the state of lands of this category of lands in a certain period of time. In the course of the work, information was collected on the state of agricultural land in each of the regions that are part of the Southern Federal District and the features of changes in the area of land of this category were determined.

Land legislation - the Land Code of the Russian Federation, the Federal Law " Land Management", the Federal Law "Turnover of Agricultural Lands", the Federal Law "State Regulation of Agricultural Lands Fertility" proclaimed the obligation of state authorities, local governments, legal entities and individuals realize their activities with preservation of land as the most important component of the environment and a natural resource, and carry out measures for the reproduction of the fertility of agricultural lands. There are proclamations, but no effective economic, administrative mechanisms and institutions of enforcement to save productive land and soil fertility. Regulations for the environmentally safe use of separately cultivated plots of arable land, contours of hayfields and pastures with spatial identification of the boundaries of their action on the map for land management have not been established – we can see negative impacts of excessive cultivation of arable land. The proposed measures to ensure the fertility of agricultural lands are aimed not at land use with soil-saving agricultural technologies in the process of agricultural activities when growing crops (in accordance with the established regulations), but at restoration of soil fertility after depletion of agricultural land use through reclamation and other measures for agrochemical services. This article proposes to restore the compulsory land management activities in case of identification of lands with water and wind erosion and other negative impacts with the development of regulations for environmentally safe agricultural land use for each field or part of it, the contour of hayfields and pastures exposed to negative impacts of anthropogenic or natural load. It is easier to prevent than to cure.

The purpose of the paper was to diagnose farmers’ awareness of the changes introduced and the relatively greatest difficulties caused by regulations under the Act of 14 April 2016 on suspending the sale of agricultural property of the State Treasury and amending certain acts [Journal of Laws 2016, item 585]. The article also draws attention to the issue of the importance of land lease from the Agricultural Property Stock of the State Treasury. Implementation of the above objectives were based on the results of direct research carried out in the second half of 2016 among 143 farmers in the Elbląski poviat (Warmińsko-Mazurskie Voivodeship). In the vast majority (83.8%) for farmers who lease land from the Agricultural Property Stock of the State Treasury, it is significant. They confirm the operation of the holding on this form of land use. However, it is more important for them to buy such land (51.8% of farmers) than lease. The biggest obstacle in the turnover of land (53.1%) may be the need to meet a number of conditions when purchasing real estate and prohibit the sale of real estate for a period of 10 years from the date of its acquisition. Most farmers (58.7%) confirmed the effectiveness of the introduced regulations in limiting speculative trade in agricultural land.

This paper provides a critical examination of the political economy of commercial agricultural land in Ethiopia, taking a case from the peripheral State of Gambella where the Anyuaa and the Nuer ethnic groups interact. Since 2002, the government of Ethiopia has pursued a controversial investment approach that promotes large-scale investment dominated by FDI while officially denouncing the current wave of the neoliberal economic discourse. Such investment ventures in the State of Gambella have put significant agricultural lands under a long-term lease to foreign developers. The central argument of this study lies in the point that, in a political economy avenue where practices contradict official state ideology, mechanized agricultural developments face failure beyond adverse social and ecological crises. Under the guise of the political economy of development where the state takes in hand the responsibility for playing a leadership role, private developers cannot easily find a space for leverage for making productive investments. Rather, such ventures as the case of Gambella tend to institute land alienation of the rural indigenous poor who are already marginalized because of their double-peripheral positions – a manifestation of South in the South. The consequence of both inter-group relations and the environment is catastrophic. The paper concludes that the influence of (trans)national companies on indigenous communities living especially in fragile environments continues to be disconcerting whereas the conflation of the neoliberal inspiration in the peripheral regions appears to be disguising while leaving the local environment and inter-group relations at stake. Thus, the Ethiopian government should recognize the contradiction between its official ideology and the investment practices in agricultural lands overtaken by (trans)national developers.
