Collective Labor Law as a mechanism of agency through workers representation has been challenged more than ever during recent last decades. The policies that have adjusted labor rights to new scenarios of economic policies have impacted collective bargaining structures and contents. The debates on centralization and de-centralization, workers participation, unions and workers strategies to countervail the erosion of labor rights have been part of the social agenda. Among the debates one very important one involves the study of the cases of the Basque Country and Catalonia. Their models of collective bargaining allow us to examine different strategies to achieve social goals through collective action with more successful results in the Basque case.

Using survey data from China, the author examines how migrant workers respond to violations of labor law in their workplaces. The central puzzle is why, given apparent widespread violations, some workers choose not to pursue remedies. Findings show that only 25% of surveyed workers who experience labor law violations interpret their experiences as labor rights violations. The author argues that the social nature of the employment relationship explains some of this gap: Although workers who share local identities with their employers are more likely to work without employment contracts, they are significantly less likely to interpret these conditions as a violation of their labor rights and interests. This article extends the research on grievance behavior by drawing on research from the sociology of law and immigration to understand how these subjective interpretative processes and social identities outside of the workplace influence grievance behaviors.

AbstractThe sequencing of transitions to democracy and to a market economy shaped the outcome of labor law reform and prospects for expanded labor rights in Argentina, Brazil, and Chile. Argentina and Brazil experienced democratic transitions before market economic reforms were consolidated in the 1990s. During the transition, unions obtained prolabor reforms and secured rights that were enshrined in labor law. In posttransition democratic governments, market reforms coincided with efforts to reverse earlier labor protections. Unable to block many harmful reforms, organized labor in Argentina and Brazil did conserve core interests linked to organizational survival and hence to future bargaining leverage. In Chile this sequence was reversed. Market economic policies and labor reform were consolidated under military dictatorship. During democratic transition, employers successfully resisted reforms that would expand labor rights. This produced a limited scope of organizational resources for Chilean unions and reduced prospects for future improvements.

Spain has experienced a major social transformation, which is the result of immigration. This article looks at the differences that occur in their trajectories of incorporation, taking into consideration the socioeconomic, migratory and legal variables. The results show the social stratification of the immigrant group and the differences in terms of internal inequality. Furthermore, it has been noted that while in a period of economic boom, human capital was the most important factor in explaining a rising incorporation, in the period of recession, duration of stay is the crucial variable, not so much for a rising incorporation, but to maintain the same socioeconomic status.

Abstract:The aim of this study is to bring to light the relevance of sport for the social and economic development of rural areas, and it focuses on a specific zone, the Basque rural space, which acts as a support of a more wide-ranging and profuse sports activities. ABSTRACTResilience is the capacity that the persons have in order to confront the adversities and become strengthened from the same ones. The professional in social-education is a fundamental figure in the process that will create conditions that will promote the resilience in the persons and groups they interact with. Because of this and of their own work's nature, the social educator not only must have an adequate resilience level but also they must have the tools and techniques that will allow them to educate in this topic. This statement shows a study on the resilience profile of future social educators within the Social Education students of the University of the Basque Country. In order to measure the level of resilience in this sample, an adaptation of the scale made by Walnid y Young (1993) has been used. The results obtained seem to indicate that the resilience level of the future educators is moderated and that there are no statistically significant differences in resilience regarding sex or age. On the other hand in the theoretical study, diverse and significant aspects on resilience are approached: conceptualization, history and current importance in the scientific investigation; and the educational strategies that are necessary for its promotion.RESUMENLa resiliencia es la capacidad que tienen las personas para afrontar las adversidades y salir fortalecidas de las mismas.

Drastic transformations of the social and labor sphere have led to the emergence of new health risks and sanitary and hygienic problems associated with unreliability of employment. A new socio-economic and psychological phenomenon “precarity” has emerged, which has aff ected the employment conditions of employees, so the description of the phenomenon “precarity” needs to be clarifi ed.The forms of labor employment that diff er from the typical model and worsen the employee’s situation are considered. The criteria based on which non-standard employment is considered unstable are given.Generalized types of unstable employment are identifi ed, the specifi city of which is determined by a combination of two factors: working time and the term of the contract. Unstable working conditions are possible not only in informal employment, but also in legal labor relations. Unreliability and instability of labor has an objective character and is a natural manifestation of the emerging economic and social order. The phenomenon of “precarity of employment” appears as a new determinant of the health of employees. The main feature when referring employment and labor relations to the phenomenon of “precarity” is their unreliability.Specifies the terms used: “precariat”; “precarious work”; precompact; the precariat. An essential characteristic of precarious employment is the violation of social and labor rights and lack of job security. A significant indicator of precarity is underemployment. Precarity induces the potential danger of dismissal of the employee and the resulting stress, psychosomatic disorders and pathological processes in the psyche.Precarious employment and related labor relations have become widespread. Many employees are deprived of social guarantees, including those related to labor safety, payment for holidays and temporary disability, and provision of preventive measures. Th is leads to a violation of the state of well-being, as well as the deterioration of individual and public health.

AbstractThe phenomenon of Christian recourse to non-ecclesiastical judicial systems during the first few centuries following the Muslim conquest is at the core of this paper. This phenomenon not only alludes to a reality of legal diversity but also to the social heterogeneity that has characterized Near Eastern societies long before the Arab takeover. Through the adoption of the legal-anthropological paradigm of legal pluralism and the examination of West Syrian legal sources, the paper seeks to identify the social agenda of West Syrian ecclesiastical leaders. Much of the discussion revolves around the term 'outsiders', barrāyē, and attempts to delineate the term's various meanings within the legal discourse.
