Civil Servants (PNS) are prohibited from providing support to candidates for President and Vice President by engaging in campaign activities because this is a violation and can be severely disciplined. The purpose of writing this scientific paper is to determine the effectiveness of severe disciplinary penalties according to employment law, and to know the process of severe disciplinary penalties for Civil Servants (PNS). The author uses normative legal research methods with data collection techniques with literature study of legal materials through internet media. The data obtained in this legal research were analyzed using qualitative methods which were presented descriptively which would later obtain meanings and conclusions to answer the problem. The conclusions from the writing of this scientific work are: (1) The absence of effectiveness of severe disciplinary penalties according to the employment law which now applies to Civil Servants (PNS) because in reality, lawlessness continues to occur among Civil Servants (PNS) even though it has been given severe disciplinary punishment so that there must be firmer law enforcement that should be regulated in the employment law; (2) The process of severe disciplinary punishment for Civil Servants (PNS), among others: (a). Civil servants who commit disciplinary violations are examined by the Examining Team consisting of elements of supervision, staffing and direct superiors; (b). LHP is reported in a hierarchical way to officials who have the authority to punish; (c). Preparation and Issuance of Decree for the Dismissal of PNS Discipline by Officials who have the authority to punish; (d). After the issuance of the Decree, then the PNS Discipline SK is handed over to the concerned / Family / through electronic media (Postmark).

The writing of this scientific paper examines the lack of legal awareness of the community about sexual violence. This scientific work arose because the author saw that there were still many cases of sexual violence even though there were rules governing the acts of sexual violence. And this scientific work aims to tell the public what factors influence the act of sexual violence still arise and what efforts can be made by the community and law enforcement officials such as the police for this problem and is expected to eliminate the emergence of new sexual violence. The study sample was victims of sexual violence or sexual harassment in the Jakarta Bara police station. Data collection is carried out by interviewing 15 West Jakarta District Police Polres. And also conduct literature studies by looking for sources related to sexual violence. The results of this study suggest that the factors that often underlie the occurrence of sexual violence is a love factor where if the victim refuses to serve the perpetrators things will arise that are undesirable and there are false facts from the recognition of the average perpetrator who was interrogated by the police

Permasalahan dalam penelitian ini, pertama: makna Pasal 2 ayat (1) dan Pasal 3 UU No. 31 Tahun 1999 pra dan pasca dikeluarkannya Putusan Mahkamah Konstitusi No. 25/PUU-XIV/2016. Kedua, penerapan Pasal 2 ayat (1) dan Pasal 3 UU No. 31 Tahun 1999 pra Putusan Mahkamah Konstitusi No. 25/PUU-XIV/2016. Ketiga, efek dikeluarkannya putusan Mahkamah Konstitusi tersebut dalam meminimalisir kriminalisasi perbuatan pegawai negeri sipil atau pejabat publik. Penelitian ini merupakan penelitian hukum dengan pendekatan yuridis normatif. Sebagai penelitian kualitatif maka data yang dipergunakan merupakan data sekunder yang terdiri dari data hukum primer, sekunder dan tertier yang diperoleh dari studi kepustakaan. Hasil penelitian menunjukkan bahwa putusan mahkamah konstitusi tersebut telah mengubah rumusan delik dari formil menjadi materiil yang menjadikan makna pasal tersebut semakin menjauh dari makna awalnya. Pada akhirnya, keluarnya putusan mahkamah konstitusi tersebut tidak dapat memecahkan permasalahan hukum yang telah ada sebelumnya bahkan putusan tersebut berpotensi menimbulkan permasalahan baru yang dapat menghambat proses penegakan hukum dalam pemberantasan tindak pidana korupsi di Indonesia.The problems on this research are, first: the meaning of Article 2 paragraph (1) and Article 3 UU No. 31 Year 1999 before and after Constitutional Court Decision Number 25/PUU-XIV/2016. Second, the application of Article 2 paragraph (1) and Article 3 UU No. 31 Year 1999 before Constitutional Court Decision Number 25/ PUU-XIV/2016. Third, the effects of Constitutional Court Decision in minimizing criminal actions conducted by civil servants and public officials. This research is a legal research using normative legal approach. As qualitative research, this research uses secondary data consist of primary, secondary, tertiary legal data collected from literature study. The results show that the constitutional court decision has changed the formulation of the offense from formal to material which makes the meaning of the article different from its original meaning. At last, the constitutional court deciasion could not solve the existing legal problem, but contrary it potentially creates a new problem which obstructs law enforcement process in combating corruption in Indonesia.

Tujuan penulisan karya ilmiah ini adalah untuk mengkaji pengaturan terkait kepemilikan tanah di Indonesia oleh orang asing melalui perjanjian nominee dan upaya penegakan hukumnya. Metode penelitian yang digunakan ialah metode penelitian hukum normatif dengan menggunakan pendekatan peraturan perundang-undangan dan konseptual. Hasil dari penulisan karya ilmiah ini ialah penegakan hukum terhadap praktek kepemilikan tanah oleh orang asing melalui perjanjian nominee dapat dilakukan oleh kejaksaan selaku organ negara yang mewakili kepentingan publik, baik melalui sarana perdata maupun pidana. Hal ini perlu dilakukan guna melindungi tanah Indonesia dimiliki oleh orang asing dan guna mendukung upaya negara mewujudkan tugas konstitusionalnya, yakni menguasai tanah bagi sebesar-besarnya kesejahteraan rakyat tanpa harus memberikan ketidakadilan bagi Warga Negara Asing. The purpose of writing this scientific paper is to examine regulations related to land ownership in Indonesia by foreigners through nominee agreements and law enforcement efforts. The research method used is normative legal research methods using statute and conceptual approaches. The result of writing this scientific paper is that law enforcement against the practice of land ownership by foreigners through nominee agreements can be carried out by the prosecutor as the state organ representing the public interest, both through civil and criminal means. This needs to be done in order to protect Indonesian land owned by foreigners and to support the state's efforts to realize its constitutional duties, namely to control the land for the maximum welfare of the people without having to give injustice to foreign citizens.

<p>Abstract</p><p>This article explains the problem, firstly about the causal factors cause of the child sues the parent. Secondly, regarding law enforcement efforts against Article 46 of Law Number 1 Year 1974 on Mariage to prevent children from suing parents. This research is normative legal research is descriptive. The type of data used is secondary data, data collection techniques used is literature study, further technical analysis used is the nature of descriptive data analysis. The results of the research indicate that the factors causing the child to sue the parent is the existence of problems in the family and the provisions of the Article related to the obligation of the child to the parents has not provided assertiveness that the child who sues the parent is a violation of these provisions. The law enforcement effort against Article 46 of Law Number 1 Year 1974 regarding Marriage to prevent children from suing parents is done by settling family problems through deliberation  or through mediation and formulation of continued legal policy as the elaboration of such provisions.</p><p>Keywords: Sues Paren; Child Obligation; Law Enforcement.</p><p> </p><p>Abstrak</p><p>Artikel ini menjelaskan permasalahan, pertama tentang faktor penyebab anak menggugat orangtua. Kedua, tentang upaya penegakan hukum terhadap Pasal 46 Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan untuk mencegah anak menggugat orangtua. Penelitian ini adalah penelitian hukum normatif bersifat deskriptif. Jenis data yang digunakan adalah data sekunder, teknik pengumpulan data yang digunakan adalah studi kepustakaan, selanjutnya teknis analisis yang digunakan adalah sifat analisis data deskriptif. Hasil Penelitian menunjukkan bahwa faktor penyebab anak menggugat orangtua adalah adanya permasalahan dalam keluarga dan ketentuan pasal terkait kewajiban anak  kepada orangtua belum memberikan ketegasan bahwa anak yang menggugat orangtua merupakan pelanggaran terhadap ketentuan tersebut. Upaya penegakan hukum terhadap Pasal 46 Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan untuk mencegah anak menggugat orangtua dilakukan dengan penyelesaian permasalahan keluarga melalui musyawarah atau melalui mediasi dan perumusan kebijakan hukum lanjutan sebagai penjabaran ketentuan tersebut.</p><p>Kata kunci: Menggugat Orangtua; Kewajiban Anak; Penegakan Hukum.</p>

This research was conducted with the aim to know the influence of each variable of electronic media mix consisting of Television media, Radio and internet media significantly to increase participation of BPJS Employment of Makassar Branch, and to know the effect simultaneously or simultaneously variable of electronic media of television media, media radio and internet media to increase participation BPJS Employment Makassar Branch. This study uses questionnaires, literature study and interviews with quality assay data analysis techniques, classical assumption test, multiple linear regression analysis and hypothesis testing. The results of the study found that electronic media consisting of: television media, radio media and internet media have a significant influence on the increase of membership BPJS Employment Branch of Makassar. So the first hypothesis can be accepted. Based on the result of simultaneous test, it is obtained the value of Fcount = 398.637 with the significance of 0.000 with the negligence level of 0.05, so it can be said that the television media, radio media and internet media together influence the increase of membership BPJS Employment Makassar Branch. So the second hypothesis proposed can be accepted and proven true

The article is devoted to the procedural procedure for the seizure of electronic media, taking into account the general rules for the production of investigative actions. The problems of regulating the production of investigative actions, within which it is possible to seize electronic media and law enforcement practice on this issue, are subjected to a detailed study and analysis. It also formulated conclusions and proposals for amendments aimed at eliminating insufficiently clear regulation of legislation and improving law enforcement practice. The main goal of the scientific work is to form a correct understanding of the determination of the grounds and the procedural procedure for the seizure of electronic media of information in the course of investigative actions in compliance with the requirements of the criminal procedure law. For this, some scientific ideas on this issue have been analyzed, the provisions of the criminal procedure law in terms of general rules for the production of investigative actions and other provisions of the law related to the procedure for the seizure of electronic media have been studied in detail, law enforcement practice has been studied. We used formal logical, descriptive, comparative legal methods and the method of interpreting legal norms. The result of the scientific research is conclusions and proposals on the features of the seizure of electronic media in criminal cases in the field of entrepreneurial activity, on the participation of a specialist and attesting witnesses in the seizure or copying of information from electronic media.

The verdict obtained by JES is Article 406 Paragraph (1) Jo Article 55 Paragraph (1) The 1 Criminal Code, Article 14 letter a of the Criminal Code is a trial decision to JES. Judge considerations put forward justice on the basis of the principle of social function. This is because JES did so to bring material across the victim area by unlawful means (vandalism) in the area of ​​land owned by the victim's witness. The formulation of the problem of this study is, how the judge consideration ensnare the perpetrator of destruction by considering the principle of soial function. The research of this scientific paper, the type of normative legal research, the problem approach is the case approach, which studies the application of norms or rules of law conducted in legal practice. The data used are secondary data, and use grammatical interpretation. From the research it can be seen that the judge is very consider the principle of social function, so this decision not only gives a deterrent effect to JES but also gives affirmation of justice for humanity. With the approach of the principle of social function it is expected that the judge in giving the decision must be neutral and see the facts submitted in the court with care and in its activeness in the trial the judge should accentuate his soul as law enforcement.

<p>In legal field, especially related to judicial field of judiciary, efforts to reform criminal law to and to overcome justice and certainty are done incessantly which means that law enforcement efforts need to be effected. Some situations and conditions may reduce judicial image if the law enforcement is lacking or not being noticed at all. The existence of cases through legal, research, academic thinking, as well as opinion of legal practitioners have varied the existence of judiciary images. Therefore, this research is specifically aimed to know, describe, and at the same time analyze the rights of defendants (offenders of rights) based on contempt of court.</p><p>The method used in this study is qualitative research prioritizing quality and primary and secondary data types. The primary data are taken empirically from the field and the secondary data are taken from literature study, documentation, determination of respondents by purposive sampling in which the interviewee is a judge.</p><p>The results show that, in practice, the rights of defendants are protected in accordance to the applicable provisions as well as the contempt of court issue. Due to the subjective perception of community in the course of trial, it is essentially needed to immediately draw up the Contempt of Court Law.</p><p>Keywords: Law Enforcement, Offenders’ Rights, Contempt of Court, Penal Reform</p>

Immigration officers while implementing their functions as well as state gatekeepers have a very important role in the situation of the spread of the covid-19 virus in the world. Immigration has four functions of immigration, namely service, security, law enforcement, and facilitator for state development. In a scientific paper with the theme of analysis of law enforcement and immigration control with case studies of the entry of Chinese nationals in the midst of the COVID-19 pandemic. where law enforcement and supervision of people during the current pandemic is very risky because it will have a number of differences where in this difficult time or in the New Normal adaptation period in Indonesia, immigration can actually develop and adjust in law enforcement both Indonesian citizens and foreigners. The government itself, in collaboration with the Directorate General of Immigration, provides new regulations and policies relating to the implementation of the main duties and functions of immigration, including including law. This scientific work aims to provide an explanation regarding immigration law enforcement and the supervision of foreigners carried out during the Covid-19 pandemic, and is also based on Indonesian government policies, especially immigration in preventing the spread of Covid-19.

AbstractStarting from the outbreak of the Corona Virus pandemic (Covid-19) in the early 2020s including in Indonesia, humanity was shaken with a variety of panic. To cope with the Covid-19 pandemic outbreak, the Government of Indonesia established a public health emergency status and adopted a Large Scale Social Restrictions (LSSL) policy. However, this health law enforcement issues a new polemic for the society, for Indonesian Muslims who cannot worship in congregation in mosques or other places of worship. The purpose of this study is to analyze the LSSL Policy that implemented by the government from the perspective of al-Maqashid asy-Syar’iyyah. This research is a legal research with literature study method and normative juridical research. Thus, the legal material related to the LSSL policy imposed by the Government of Indonesia. Based on the results of the study showed that there are some differences and their consequences, but the theory of al-Maqashid asy-Syar’iyyah LSSL policy is one of the best choices in the framework of overcoming the Covid-19 pandemic outbreak in Indonesia.Keywords: Health Law, LSSL, Pandemic outbreak, Covid-19, Maqashid Syar’iyyah. AbstrakBeranjak dari mewabahnya pandemi Virus Corona (Covid-19) pada awal tahun 2020 termasuk di Indonesia, membuat umat manusia digoncang dengan berbagai kepanikan. Untuk menanggulangi wabah pandemi Covid-19, Pemerintah Indonesia menetapkan status kedaruratan kesehatan masyarakat dan memberlakukan kebijakan Pembatasan Sosial Berskalaa Besar (PSBB). Namun penegakan hukum kesehatan ini mengakibatkan polemik baru bagi masyarakat, terutama bagi kaum muslimin Indonesia yang tidak bisa beribadah secara berjamaah di masjid atau tempat ibadah lainnya. Tujuan penelitian ini untuk menganalisa kebijakan PSBB yang diterapkan Pemerintah dari sudut pandang al-Maqashid asy-Syar’iyyah. Penelitian ini merupakan penelitian hukum dengan metode studi kepustakaan dan dengan pendekatan yuridis normatif. Dengan demikian, yang menjadi bahan hukum adalah regulasi terkait kebijakan PSBB yang diberlakukan oleh Pemerintah Indonesia. Adapun hasil penelitian menunjukan bahwa meskipun memiliki berbagai dampak dan konsekuensinya, namun secara teori al-Maqashid asy-Syar’iyyah kebijakan PSBB merupakan salah satu pilihan terbaik dalam rangka penanggulangan wabah pandemi Covid-19 di Indonesia.Kata Kunci: Hukum Kesehatan, PSBB, Wabah Pandemi, Covid-19, al-Maqashid asy-Syar’iyyah.
