The aim of this article is to anlyze the legal basis of granting coastal and island territory to indigenous people in the Province of Riau to connected with the issuance of legislation on the management of coastal areas and small islands in the provisions of regulation Number. 27/2007 and the rights of local coastal waters and small islands according to goverment regulation Number 40/1996, especially in clause of 60 starting for granting of business rights, building rights and land rights that are entirely island or bordered by the beach are governed by the goverment regulation and it’s regulation. In this article used the normative juridical methodology, the author used in this article study of references that conducted used secondary data, namely collecting data from various literature from the law, books, documents and archieves related to this issue. Thus, the analysis used by collecting data to be processed and analyzed according to the nature of the collected data, for futher presented by the analyst evaluative. This scientific writing shows that the rights of the coastal water exploitation contained in regulation Number 27/2007 abaout PWP3K is one of legal norms governing coastal, but it turns out to cause pros and cons.

ABSTRAKProblematik penelitian ini adalah : Apa dasar hukum  Peran Notaris dalam Transaksi Pengadaan Tanah Untuk Lokasi Pembangunan Komplek Perkantoran Pemerintah Kabupaten Sekadau? apa peran Notaris  Dalam Transaksi Pengadaan Tanah Untuk Lokasi Pembangunan Komplek Perkantoran Pemerintah Kabupaten Sekadau? dan apa akibat hambatan hukum atas Peran Notaris dalam Transaksi Pengadaan Tanah Untuk Lokasi Pembangunan Komplek Perkantoran Pemerintah Kabupaten Sekadau?Penelitian ini adalah dengan pendekatan yuridis-empiris yang bersumber dari pengumpulan data yang diperoleh dari data primer dan data sekunder, kemudian dianalisis dengan metode analisis kualitatif. Teknik pengumpulan data yang digunakan adalah teknik wawancara. Teknik analisis data menggunakan analisis data kualitatif.Hasil temuan peneliti menunjukkan bahwa Dasar hukum Notaris dan/atau PPAT dalam pertanahan, didasarkan pada Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris dan Peraturan Kepala Badan Pertanahan Nasional Republik Indonesia Nomor : 1 Tahun 2006 tentang Ketentuan Pelaksanaan Peraturan Pemerintah Nomor : 37 Tahun 1998 tentang Peraturan Jabatan Pejabat Pembuatan Akta Tanah. Keputusan Presiden Nomor 55 Tahun 1993 maupun Peraturan Presiden Nomor 65 Tahun 2006, peralihan hak atas tanah tersebut dapat dilakukan melalui/dihadapan Notaris dan/atau PPAT. Peran nyata keterlibatan notaris dalam pembangunan komplek kantor Pemerintah Kabupaten Sekadau adalah pembuatan Akta Notaris Nomor 9 tanggal 06 Juli 2005 tentang Surat Perjanjian Pelepasan Hak atas Tanah di antara PT Sinar Bintang Sakti dan Pemda Kabupaten Sekadau dan Pembuatan Akta Notaris No. 10 tanggal 06 Juli 2005 tentang surat Pengakuan hutang yang pada pokoknya Pemkab Sekadau mengakui mempunyai hutang kepada CHAN INDRA, dengan jaminan tanah yang telah diterima pelepasan hak atas tanah dari CHAN INDRA selaku Direktur PT. Sinar Bintang Sakti. Perdebatan Notaris berwenang untuk membuat akta yang berkaitan dengan akta-akta pertanahan mengakibatkan keraguan mengenai keabsahan terhadap akta notaris yang terdapat dalam proyek pembangunan perkantoran di Pemerintah Kabupaten Sekadau.Kata Kunci : Notaris, Pengadaan Tanah, Kabupaten Sekadau. ABSTRACTIn relation to the authority of Notary, as mentioned in UUJN Number 30 Year2004 jo Law Number 2 Year 2014, Article 15 paragraph (2) letter (f), that Notary has authority to make deed related to land.The problematic of this research is: What is the legal basis of Notary's Role in Transaction of Land Procurement For Development Site of Sekadau Regency Government Complex  what is the role of Notary In Transaction of Land Procurement For Development Site of Sekadau Regency Government Complex ?; and what are the consequences of the legal barrier to the Notary's Role in the Land Acquisition Transaction for the Location of the Sekadau Regency Government Complex ?This research is with juridical-empirical approach that comes from collecting data obtained from primary data and secondary data, then analyzed by qualitative analysis method. Data collection techniques used are interview techniques. Data analysis techniques used qualitative data analysis.The findings of the researcher indicate that the legal basis of Notary and / or PPAT in the land is based on Law Number 30 Year 2004 regarding Notary Position and Regulation of the Head of National Land Agency Number 1 Year 2006 regarding Provisions on Implementation of Government Regulation Number 37 Year 1998 on the Regulation of Officials of the Establishment of Deed of Land. Presidential Decree No. 55/1993 and Presidential Regulation No. 65/2006, the transfer of land rights can be done through / in the presence of a Notary and / or PPAT. The real role of notary involvement in the construction of the Sekadau District Government office complex is the making of Notarial Deed No. 9 dated July 6, 2005 concerning Letter of Agreement on the Release of Land Rights between PT Sinar Bintang Sakti and the Regional Government of Sekadau Regency and the Notarial Deed. 10 dated July 6, 2005, concerning letters of recognition of debt principally Pemkab Sekadau acknowledged to have a debt to CHAN INDRA, with guaranteed land that has been received the release of land rights from CHAN INDRA as Director of PT. Sinar Bintang Sakti. The debate of a Notary is authorized to make deeds relating to land deeds lead to doubts about the validity of the notarial deed contained in office building projects in the Sekadau District Government.Suggestions to lawmakers to anticipate differences in legal interpretation in the future, it is recommended that both Law No. 30 of 2004 in conjunction with Law Number 2 Year 2014 on UUJN and the Notary Profession Code of Ethics, to strengthen the explanation of legislation has been compiled.Keywords : Notary Public, Land Procurement, Sekadau District.

The sale and sale of land rights must be done in the presence of PPAT as proof that there has been a sale and purchase of a land right and then PPAT makes a Deed of Sale and Then followed by registration at the local Land Office following the location of the land. But the fact that until now there is still a sale of land rights done in the presence of the Village Head, as happened in Plana Village Somagede District Banyumas Regency. The point raised in this study is why are the people of Plana Village Somagede sub-district still there who trade land rights, not before the authorized officials, namely PPAT? and what is the legal protection for buyers of land rights that are not done in the presence of authorized officials, namely PPAT? This research uses sociological juridical approach methods, primary data, and secondary data obtained and then analyzed based on legal norms and theories namely legal protection and legal effectiveness. From the results of the research and concluded, then the Village Head must dare to refuse to buy and sell land rights in front of him and the local government policy must impose strict sanctions on the Village Head who violated it, the socialization of the Banyumas district land office must be carried out regularly so that the people trade rights on the land following the prevailing regulations and for the villagers of Plana who have been able to trade rights on the land in front of the Village Head to immediately transition the rights to the land following Article 37 paragraph (1) or paragraph (2) of Government Regulation No. 24/1997 on Land Registration.Keywords: Buy and Sell, Village Head, PPAT

The existence of small lakes, lakes, public ponds, and reservoirs for the Indonesian people is significant and has been used for various basic needs. The conditions of small lakes, lakes, public ponds and reservoirs generally show negative tendency namely pollution, silting, environmental damage and even some of them have been shifted function to land. This study aims to determine the importance of land registration for small lakes, lakes, public ponds, and reservoirs. The research method is descriptive qualitative. Data was collected through field observation for several samples and secondary data collection for several cases. Furthermore, the data are analyzed empirically by referring to the regulations and practices of the policy. The results obtained indicate that the sustainability of situ, lakes, reservoirs, and reservoirs (SDEW) is disturbed due to human activities. Land registration is one of the efforts to protect the existence of these public water areas. However, not all public water areas can be registered because of their land status. The area of ​​public water to be registered includes the surface area of ​​the water and its buffer zones. The stages of land registration for the area, lakes, reservoirs, and reservoirs are generally the same as for other land registrations. Following the registration of land for the territorial waters, the holder of land rights must actively maintain the control boundary and monitor the physical condition of the lake, reservoirs, and reservoirs from illegal exploitation efforts. In addition, the Government and Regional Governments must be able to raise community participation in maintaining territorial waters and establish cooperation with other parties related to the provisions governed by laws and regulations. This study concludes that land registration for the SDEW area is beneficial due to the improved management, monitoring, and maintenance system through the availability of accurate data and the strong legal basis.

Shrimp is a type of crustacean and is included in the marine fishery commoditywhich has important economic value and is currently hunted by fishermen and iscommonly found in coastal waters. The purpose of this study was to determine the ShrimpProduction and Seasonal Catching Pattern in the Waters of Pangkep Regency. Itsusefulness is as a foundation material in the use of shrimp resources in the waters ofPangkep Regency. Data collected consists of primary data and secondary data. Primarydata is obtained by direct observation in the field through a field survey method (visualrecall) to portray the conditions of crab resources. While secondary data was collectedfrom the relevant agencies according to the attributes that will be reviewed and recordeddata from collecting fishermen in the coastal areas and small islands of PangkepRegency. Shrimp production from trammel net and mini trawl catches in the waters of theSigeri District of Pangkep Regency in 2015 consisted of 706 tons of white shrimp anddogol shrimp 4,481 tons, while in 2016 706 tons of white shrimp and dogol shrimp 4,481tons. Analysis of the percentage of shrimp fishing season index in the waters of PangkepRegency, occurred in January, February, March and April. The highest percentage offishing season index occurs in January each year.

Religious Courts are one of the state courts with the jurisdiction to resolve civil disputes including cases of child custody for Muslims but several pros and cons have been attached to the execution or final settlement stage. This study was conducted to determine the legal basis for the execution of child custody and legal action required in a situation the child is hidden or unwilling to be under the plaintiff's care or control. It was conducted as normative legal research with a focus on the secondary data obtained from religious courts’ decisions on child custody cases. Both primary and secondary data were collected and analyzed qualitatively using legislation, case, and analysis approaches. The results showed the execution is usually basically to ensure a better future for the child. This, therefore, means it is possible to execute the decision of the religious court regarding child custody voluntarily and based on kinship.

<p align="center"> </p><p><em>As happened to the Notary Eli SatriaPilo, S.H, Mkn, who was appointed as the Notary who made the Deed of Relinquishment of Land Rights in the Land Acquisition activities for the Construction of Campus III of the State Islamic Institute (IAIN) of Padang which was located in Sungai Bangek District, Padang</em><em> </em><em>in 2010. The method used was descriptive, in which describing the applicable legislation associated with legal theory in the facts and realities about the Notary’s Responsibility in Making Deed of Land Acquisition for the construction of Campus III of IAIN Padang in Sungai</em><em> </em><em>Bangek. This study used a Normative Juridical approach, in which researching by using and processing secondary data or literature related to the</em><em> </em><em>study. The data collected were in the form of primary data obtained from the District Court of Padang, secondary data obtained from secondary legal materials and primary legal materials. Based on the study, it was found that the role of Notary Eli</em><em> </em><em>Satria</em><em> </em><em>Pilo, in the land acquisition of campus III IAIN was proven to have misused the authority resulting in violation of the Notary Ethics Code and was responsible for accepting termination disrespectfully. Furthermore, he was also shown to be committing a Criminal Corruption made based on the Deed of Relinquishment of Land Rights in the land acquisition for the construction of Campus III of IAIN Padang, so that the State incurred losses of Rp. 1</em><em>.</em><em>946</em><em>.</em><em>701</em><em>.</em><em>050 (one billion nine hundred forty-six million seven hundred one thousand and fifty rupiahs). And he was responsible for receiving and carrying out the sentence that had been handed down by the District Court of Padang, a prison sentence of 4 (four) years, and paying a fine of Rp. 200</em><em>.</em><em>000</em><em>.</em><em>000 (two hundred million rupiahs)</em><em>.</em></p><p> </p>

The article substantiates the need to use Internet monitoring as a priority source of information in countering extremism. Various approaches to understanding the defi nition of the category of «operational search», «law enforcement» monitoring of the Internet are analysed, the theoretical development of the implementation of this category in the science of operational search is investigated. The goals and subjects of law enforcement monitoring are identifi ed. The main attention is paid to the legal basis for the use of Internet monitoring in the detection and investigation of extremist crimes. In the course of the study hermeneutic, formal-logical, logical-legal and comparative-legal methods were employed, which were used both individually and collectively in the analysis of legal norms, achievements of science and practice, and development of proposals to refi ne the conduct of operational-search measures on the Internet when solving extremist crimes. The author’s defi nition of «operational-search monitoring» of the Internet is provided. Proposals have been made to improve the activities of police units when conducting monitoring of the Internet in the context of the search for relevant information to the disclosure and investigation of crimes of that category.

<p>Abstract<br />This article aims for reviewing how the settlement of compensation as the consequences of the tenure <br />of land rights unlawfully in civil law Surakarta state court verdict number 106/pdt.g/2017/PN.SKT and <br />number 103/pdt.G/2006/PN.SKT where the court’s decision has a permanent legal force. This research is <br />a juridical normative legal research. The location of this research at Notary Office and PPAT Adib Sujarwadi <br />and the State Court Surakarta Class 1A Specific. Kinds and the sources of data in this research are <br />consist of primary data and secondary data. The technique of data collection through interview and library <br />study. The analytical technique used by the author is by the method of syllogism that uses the deduction <br />mindset. Regarding the settlement of compensation due to unlawful tenure of land rights is a compensatory <br />damages, in the form of payment to the victim amounting to a loss that is actually experienced. Based on <br />the decision of the Panel of Judges. Regarding the non-granting of immaterial compensation because <br />the Plaintiff does not attach the appropriate evidence. After the verdict is declared incracht, outside the <br />court, the Defendant and the Plaintiff may hold deliberations to determine the amount of the indemnity or <br />the Plaintiff waived the indemnity obligation, but the Defendant must leave the land of the object of the <br />dispute voluntarily. Penyelesaian ganti rugi akibat penguasaan hak atas <br />tanah secara melawan hukum yaitu dengan ganti rugi kompensasi, berupa pembayaran kepada korban <br />sebesar kerugian yang benar-benar dialami. Berdasarkan keputusan Majelis Hakim. Mengenai tidak <br />dikabulkannya ganti rugi immateriil dikarenakan Penggugat tidak melampirkan bukti-bukti yang sesuai. <br />Setelah putusan dinyatakan incraht, di luar pengadilan, Tergugat dan Penggugat dapat mengadakan <br />musyawarah untuk menentukan jumlah ganti rugi atau Penggugat membebaskan kewajiban pembayaran <br />ganti rugi, namun Tergugat harus meninggalkan tanah obyek sengketa secara sukarela. Dalam hal masih <br />tetap menempati maka akan dilakukan eksekusi oleh juru sita dari Pengadilan.<br />Kata Kunci : Ganti Kerugian; Perbuatan Melawan Hukum; Penguasaan Hak Atas Tanah.</p>

Indonesia is one of the countries that has not ratified the 1951 Convention on refugees but that does not prohibit refugees from coming and getting protection in Indonesia because based on the prevailing constitution, Indonesia has the responsibility to handle refugees and carry out immigration control over them. With the existence of Government Regulation Number 125 of 2016 concerning Handling of Refugees from Abroad, immigration plays a role in collecting data, placing, monitoring, and returning refugees to their home countries or third countries. Supervision is an important action taken in dealing with refugees while in Indonesia. Refugees who have received approval from UNHCR and have special needs will be placed in the Community House. The formulation of the problem in this study is how to implement immigration control for refugees in the Jakarta Community House and what obstacles are found in conducting surveillance. The purpose of this research is to find out how the implementation of immigration control carried out on refugees in Community House Jakarta. The research method used is normative empiris, using primary and secondary data, studying and evaluating phenomena about refugees and legal norms related to refugees and immigration control obtained from literature and law, then analyzed to get conclusions. So it can be explained that the implementation of immigration control of refugees at the Jakarta Community House is carried out by means of attendance and data collection on refugee identification cards and stamps and signatures of Jakarta Rudenim officers. The obstacle to monitoring at the Community House is that there is still conflict between the refugees and the refugee's poor health condition.

This study aims to determine oceanographic characteristics such as tides, waves, and currents in Karimunjawa Coastal Waters during the 1st transitional season and to update the oceanographic database for spatial management evaluation in the region. The tidal characteristics were obtained from the least square method analysis using World Tide software based on Matlab programming language, while wave and current characteristics obtained from 2-dimensional numerical modeling using Mike 21 software on the flow model and spectral wave module. The primary data used were the significant wave height (Hs), wave peak period (Tp), and ocean current components (u and v velocity) on 13-26 May 2016 using the Sontex Argonaut XR type Acoustic Doppler Current Profiler (ADCP) equipment. Tide data were predicted for the Kemujan Islands station from 1-31 March 2020. Secondary data for additional numerical model input were obtained from ERA5-reanalysis in the form of Hs, Tp, u, and v wind velocity data for May 2020 with a temporal resolution of 20 minutes, while bathymetry data derived from GEBCO Satellite Derivated Bathymetry (SDB) data. The tide analysis results showed that Karimunjawa waters are a single daily mixed tidal type. The wave characteristic moves from east to west with high waves reached 0.9 meters and a peak period of 7 seconds. The eastern side of Karimunjawa Island, Kemujan Island, and the western area have a calmer wave. The current characteristic moves northeastward with a speed of 5-28 cm/s, which concludes that in several locations, such as the Menjangan Besar-Menjangan Kecil strait, the currents depend on the tidal conditions.
