The existence of small lakes, lakes, public ponds, and reservoirs for the Indonesian people is significant and has been used for various basic needs. The conditions of small lakes, lakes, public ponds and reservoirs generally show negative tendency namely pollution, silting, environmental damage and even some of them have been shifted function to land. This study aims to determine the importance of land registration for small lakes, lakes, public ponds, and reservoirs. The research method is descriptive qualitative. Data was collected through field observation for several samples and secondary data collection for several cases. Furthermore, the data are analyzed empirically by referring to the regulations and practices of the policy. The results obtained indicate that the sustainability of situ, lakes, reservoirs, and reservoirs (SDEW) is disturbed due to human activities. Land registration is one of the efforts to protect the existence of these public water areas. However, not all public water areas can be registered because of their land status. The area of ​​public water to be registered includes the surface area of ​​the water and its buffer zones. The stages of land registration for the area, lakes, reservoirs, and reservoirs are generally the same as for other land registrations. Following the registration of land for the territorial waters, the holder of land rights must actively maintain the control boundary and monitor the physical condition of the lake, reservoirs, and reservoirs from illegal exploitation efforts. In addition, the Government and Regional Governments must be able to raise community participation in maintaining territorial waters and establish cooperation with other parties related to the provisions governed by laws and regulations. This study concludes that land registration for the SDEW area is beneficial due to the improved management, monitoring, and maintenance system through the availability of accurate data and the strong legal basis.

In civil law, land is included in registered objects. Therefore ownership of land rights must be registered, for legal certainty. Land registration is regulated in PP No. 24 of 1997 concerning Land Registration. However, there are still many lands that have not been registered, to overcome this the government has issued a comprehensive systematic land registration program (PTSL) based on Minister of Agrarian Regulation No. 6 of 2018. The aim of this program is to provide legal certainty and legal protection for land rights owned by the community. The Complete Systematic Land Registration Program (PTSL) provides an opportunity for people who have not registered their land that is located throughout Indonesia in one village or village area. As in the Lima Puluh Kota Regency, there are still many lands that have not been registered, the people obtained them from buying and selling under their hands.The formulation of the problem in this thesis is firstly how is the land registration procedure with the basis of under-selling rights of purchase under the complete systematic land registration program (PTSL) at the fifty-city district land office ?; second, what are the obstacles in the implementation of land registration on the basis of the right to buy and sell under the complete systematic land registration program (PTSL) at the fifty-city district land office? The specification of this research is analytical descriptive, with a normative juridical approach, which is supported by an empirical juridical approach. The data used are secondary data as primary data and primary data as support, which are collected through literature studies and field studies with interview techniques. The data is then analyzed qualitatively and presented in a qualitative descriptive form. The results of the research and discussion of this thesis can be concluded that the procedure of land registration with the basis of the rights under the hand in the PTSL program in fifty cities is carried out with the stages of planning, location determination, preparation, formation and establishment of the PTSL adjudication committee and task force, counseling, physical data collection and collecting juridical data, researching juridical data for proving rights, announcing physical and juridical data and ratifying it, affirming conversion, recognizing rights and granting rights, accounting for rights, issuing certificates of land rights, documenting and submitting the results of activities and reporting.

The birth of a complete systematic land registration program is expected to reduce the level of land problems faced by the government, especially in fulfilling land rights and accelerating the making of land certificates for the community. In this research, the formulation of the problem proposed is how is the dynamics of the community in implementing a complete systematic land registration in Blora Regency?. This study uses a sociological juridical approach to the type of analytical descriptive research. The data used for this study are primary and secondary data taken by library research methods, field research, and interviews. Based on the results of the study concluded that the dynamics of the community towards the implementation of the PTSL program by looking at the benefits of the program which has a great influence on the welfare of the community. In an effort to realize the welfare of the community, the community receiving land certificates through PTSL can be mobilized together to make various productive businesses that are expected to improve the community's economy.Keywords: Community Dynamics; Complete Systematic Land Registration; Land Office.

This journal aims to find about Ownership disputes land rights Related to land registration in Makassar city. The purpose of this study is : 1. to analyze the factors affecting the dispute over ownership of land that has been registered in Makassar. 2. to analyze how far the solutions are provided by the government in resolving ownership of land that has been registered.This research is descriptive research with empirical juridical approach method. Research method used is method by using primary and secondary data with data collecting technique that are interview and questionnaire. The population of this study are the employee office of the state land agency Makassar and public figure. Sample in this research is 30 respondents by using technique purposive sampling.The results of this study shownthat : (1). the factors affecting the dispute over ownership of land are Legal factors, law enforcement factors, facilities and infrastructure factors. (2). There are two solutions are provided by the government in resolving ownership of land, that was The national land agency facilitates to do mediation and Solutions through the judiciary, negotiations, and others Depending on the perpetrators leading in the direction of a good solution to them. Recommendation of this research is Government is expectedPlay an active role So that people did not have problems in dispute signs in the future, that is Increased administration to be more thorough in making land certificates In order to minimize the dispute. Abstract: In order to give the assurance of legal certainty, certainty of rights and legal protection to holders and owners of land rights, the land registration shall be carried out. However, there is still a land dispute which now become a homework for The Government. This is because the certificate which should be a strong evidentiary can not guaranteed the legal certainty for the owner, so the person who right the land can blocking the certificate of land rights at Land Office. The issuance of Regulation Minister of Agrarian Affairs and Spatial / Head of National Land Office Number 13 Year of 2017 concerning the Procedures of Block and Sita which expected to create uniformity, standardization in recording process and abolition of registration blocked, it turns out not all the rules can be implemented at The Land Office of Sleman and Bantul Regency.The result of this research shows that blocking certificate process at Sleman Land Office and Bantul Land Office have a policy that the applicant is required to pay the blocking recording fee after the blocking received. Makes a potential loss to the (PNBP) which should be owned by Land Office for faced the problem of KKPweb application which have not been able to accomodate the time period of blocking. Keywords : blocking certificate, blocking, registration blocked Intisari: Dalam rangka memberikan jaminan kepastian hukum dan kepastian hak serta perlindungan hukum kepada pemegang dan pemilik hak atas tanah, maka dilaksanakan pendaftaran tanah. Namun demikian, masih saja terjadi sengketa pertanahan yang saat ini menjadi pekerjaan rumah bagi Pemerintah. Hal ini disebabkan karena, sertipikat sebagai alat pembuktian yang kuat ternyata belum menjamin kepastian hukum pemiliknya sehingga pihak yang merasa berhak atas tanah tersebut dapat melakukan blokir sertipikat hak atas tanah di Kantor Pertanahan. Dikeluarkannya Permen ATR/Kepala Nomor 13 Tahun 2017 tentang Tata Cara Blokir dan Sita yang diharapkan bertujuan untuk mewujudkan keseragaman, standarisasi dalam pelaksanaan pencatatan dan penghapusan catatan blokir ternyata tidak semua peraturan tersebut dapat dilaksanakan di Kantor Pertanahan Kabupaten Sleman dan Bantul. Hasil penelitian menunjukan bahwa pelaksanaan pencatatan blokir di kantor pertanahan Kabupaten Sleman dan Kabupaten Bantul terdapat kebijakan yaitu pemohon diwajibkan membayar biaya pencatatan blokir setelah blokirnya diterima membuat potensial loss terhadap (PNBP) yang seharusnya didapat kantor pertanahan untuk kendala yang dihadapi yaitu Aplikasi KKPweb yang belum dapat mengakomodir jangka waktu blokir. Abstract: Complete Systematic Land Registration is a program which taken by the government in providing legal certainty in the field of land in Indonesia. PTSL activities at Sidoarjo Regency and Pasuruan Regency Land Office are carried out with third parties. Before starting the measurement, it is necessary to carry out the contradictoire delimitatie principle to ensure legal certainty of ownership of land rights. The research used a qualitative method with a descriptive approach. The data analysis carried out by compiling logically proportional statements to answer research questions. Problem analysis is carried out by making a description based on premier data and secondary data obtained through interviews and observations of implementation. The results of the research showed that the implementation of the contradictoire delimitatie principle is broadly following PP. No. 24 of 1997 and PMNA KaBPN No. 3 of 1997. The results of the study also showed that there were obstacles in the implementation of the contradictoire delimitatie principle, such as the third parties were not following technical guidelines No. 01 / JUKNIS-300/1/2018 annex 10 in the making of measurement drawings. Quality control is needed to improve the quality of work and results of third party products and minimize land problems in the future.Keywords: principle of contradictoire delimitation, third party. Intisari : Pendaftaran Tanah Sistematis Lengkap (PTSL) merupakan langkah pemerintah dalam memberikan jaminan kepastian hukum dalam bidang pertanahan di Indonesia. Kegiatan PTSL di Kantor Pertanahan Kabupaten Sidoarjo dan Kabupaten Pasuruan dilaksanakan bekerjasama dengan Pihak Ketiga yang sebelumnya melalui tahapan asas contradictoire delimitatie untuk menjamin kepastian hukum kepemilikan hak atas tanah. Metode penelitian yang digunakan adalah metode kualitatif dengan pendekatan deskriptif. Teknik analisa yang dilakukan yaitu dengan menyusun pernyataan-pernyataan proposional secara logis untuk menjawab pertanyaan penelitian. Analisa permasalahan dilakukan dengan membuat uraian berdasarkan data premier dan data sekunder yang diperoleh melalui wawancara serta observasi langsung terhadap pelaksanaan kegiatan. Hasil penelitian menunjukkan bahwa pelaksanaan asas contradictoire delimitatie secara garis besar telah sesuai dengan PP. No. 24 Tahun 1997 dan PMNA KaBPN No. 3 Tahun 1997. Dalam pelaksanaanya terdapat hambatan yakni  pembuatan Gambar Ukur oleh Pihak Ketiga tidak sesuai dengan pedoman JUKNIS No. 01/JUKNIS-300/1/2018 lampiran 10. Sehingga diperlukan pengawasan kendali mutu terkait pekerjaan dan hasil produk dari Pihak Ketiga agar kedepannya hasil pekerjaan yang dihasilkan lebih baik dan tidak menjadi permasalahan pertanahan dikemudian hari.Kata Kunci : asas contradictoire delimitatie, pihak ketiga.

Land is a form of gift given by God, but human has given brain to think the challenges of live like the land problems, so that the government tries to regulate it properly. The problems in this thesis are: 1) How to regulate ownership of agricultural land rights that exceeds the maximum limit based on Act No. 56 (Prp) of 1960 concerning the Determination of Agricultural Land Areas? 2) How is the action taken by the Land Office towards ownership of agricultural land rights that exceeds the maximum limit? The method used is juridical empirical, with descriptive analytical specifications. The method used in this research is an empirical juridical approach. The results of this study are: (1) The regulation of ownership of agricultural land rights that exceeds the maximum limit is based on Act No. 56 (Prp) of 1960, namely that the provisions regarding land restrictions state that the application for ownership rights as referred to in Article 4 paragraph 1 of Act No. 56 (Prp) 1960 was limited to a maximum land area of 2000 m2. 2) The steps of the Land Office in implementing Act No. 56 (Prp) of 1960, namely the need for a concept of supervision and control over control of land rights, given the various problems that often arise such as in land registration activities.

ABSTRAKProblematik penelitian ini adalah : Apa dasar hukum  Peran Notaris dalam Transaksi Pengadaan Tanah Untuk Lokasi Pembangunan Komplek Perkantoran Pemerintah Kabupaten Sekadau? apa peran Notaris  Dalam Transaksi Pengadaan Tanah Untuk Lokasi Pembangunan Komplek Perkantoran Pemerintah Kabupaten Sekadau? dan apa akibat hambatan hukum atas Peran Notaris dalam Transaksi Pengadaan Tanah Untuk Lokasi Pembangunan Komplek Perkantoran Pemerintah Kabupaten Sekadau?Penelitian ini adalah dengan pendekatan yuridis-empiris yang bersumber dari pengumpulan data yang diperoleh dari data primer dan data sekunder, kemudian dianalisis dengan metode analisis kualitatif. Teknik pengumpulan data yang digunakan adalah teknik wawancara. Teknik analisis data menggunakan analisis data kualitatif.Hasil temuan peneliti menunjukkan bahwa Dasar hukum Notaris dan/atau PPAT dalam pertanahan, didasarkan pada Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris dan Peraturan Kepala Badan Pertanahan Nasional Republik Indonesia Nomor : 1 Tahun 2006 tentang Ketentuan Pelaksanaan Peraturan Pemerintah Nomor : 37 Tahun 1998 tentang Peraturan Jabatan Pejabat Pembuatan Akta Tanah. Keputusan Presiden Nomor 55 Tahun 1993 maupun Peraturan Presiden Nomor 65 Tahun 2006, peralihan hak atas tanah tersebut dapat dilakukan melalui/dihadapan Notaris dan/atau PPAT. Peran nyata keterlibatan notaris dalam pembangunan komplek kantor Pemerintah Kabupaten Sekadau adalah pembuatan Akta Notaris Nomor 9 tanggal 06 Juli 2005 tentang Surat Perjanjian Pelepasan Hak atas Tanah di antara PT Sinar Bintang Sakti dan Pemda Kabupaten Sekadau dan Pembuatan Akta Notaris No. 10 tanggal 06 Juli 2005 tentang surat Pengakuan hutang yang pada pokoknya Pemkab Sekadau mengakui mempunyai hutang kepada CHAN INDRA, dengan jaminan tanah yang telah diterima pelepasan hak atas tanah dari CHAN INDRA selaku Direktur PT. Sinar Bintang Sakti. Perdebatan Notaris berwenang untuk membuat akta yang berkaitan dengan akta-akta pertanahan mengakibatkan keraguan mengenai keabsahan terhadap akta notaris yang terdapat dalam proyek pembangunan perkantoran di Pemerintah Kabupaten Sekadau.Kata Kunci : Notaris, Pengadaan Tanah, Kabupaten Sekadau. ABSTRACTIn relation to the authority of Notary, as mentioned in UUJN Number 30 Year2004 jo Law Number 2 Year 2014, Article 15 paragraph (2) letter (f), that Notary has authority to make deed related to land.The problematic of this research is: What is the legal basis of Notary's Role in Transaction of Land Procurement For Development Site of Sekadau Regency Government Complex  what is the role of Notary In Transaction of Land Procurement For Development Site of Sekadau Regency Government Complex ?; and what are the consequences of the legal barrier to the Notary's Role in the Land Acquisition Transaction for the Location of the Sekadau Regency Government Complex ?This research is with juridical-empirical approach that comes from collecting data obtained from primary data and secondary data, then analyzed by qualitative analysis method. Data collection techniques used are interview techniques. Data analysis techniques used qualitative data analysis.The findings of the researcher indicate that the legal basis of Notary and / or PPAT in the land is based on Law Number 30 Year 2004 regarding Notary Position and Regulation of the Head of National Land Agency Number 1 Year 2006 regarding Provisions on Implementation of Government Regulation Number 37 Year 1998 on the Regulation of Officials of the Establishment of Deed of Land. Presidential Decree No. 55/1993 and Presidential Regulation No. 65/2006, the transfer of land rights can be done through / in the presence of a Notary and / or PPAT. The real role of notary involvement in the construction of the Sekadau District Government office complex is the making of Notarial Deed No. 9 dated July 6, 2005 concerning Letter of Agreement on the Release of Land Rights between PT Sinar Bintang Sakti and the Regional Government of Sekadau Regency and the Notarial Deed. 10 dated July 6, 2005, concerning letters of recognition of debt principally Pemkab Sekadau acknowledged to have a debt to CHAN INDRA, with guaranteed land that has been received the release of land rights from CHAN INDRA as Director of PT. Sinar Bintang Sakti. The debate of a Notary is authorized to make deeds relating to land deeds lead to doubts about the validity of the notarial deed contained in office building projects in the Sekadau District Government.Suggestions to lawmakers to anticipate differences in legal interpretation in the future, it is recommended that both Law No. 30 of 2004 in conjunction with Law Number 2 Year 2014 on UUJN and the Notary Profession Code of Ethics, to strengthen the explanation of legislation has been compiled.Keywords : Notary Public, Land Procurement, Sekadau District.

Melasti beach is a tourist attraction of the beach that is just starting to develop. Melasti Beach still in development in the governance by the village of Ungasan and yet the existence of a management system. Melasti beach is located in Ungasan, South Kuta, Badung Regency, has the potentialities are wonderful and interesting to develop. The assumption behind this is based on the chosen research topic "melasti Beach Development Strategy as a tourist attraction in the village of Ungasan, South Kuta, Badung Regency. Data types and data sources that are used i.e. qualitative data, primary and secondary data. Data collection done by way of observation, unstructured interviews, study kepustakan, documentation, research instrument is the guidance interview. The analysis of the data used is descriptive qualitative data analysis with the use of tourism potential and analysis approach to SWOT analysis which clearly sets forth the findings based on the issues examined with accurate data sources. In the results of this research demonstrating that the Melasti Beach has the potential of nature is very beautiful, it also has the potential of culture as well as potential human or artificial to developed, capable of attracting tourists visit. Although still in the development phase is already visited by tourists and foreigners to the archipelago. The conclusions from the results of Shore Development Melasti is need for management systems, many still lack facilities to complement the tourist attraction due to the lack of funds and contributions from the Government is still waiting for him. The problem of the environment is a serious issue that must be addressed by the government and the community as a supervision and reporter of each of the activities of the destroyer of the environment. The pollution and environmental damage continue to increase in line with the increased industrial activity or similar substances; surely the situation needs to get the protection of the law.  The pollution or environmental damage, mostly in the context of running a commercial business and often is also the attitude of rulers and the entrepreneurs who do not run or neglecting the obligations of their obligations in the management of the environment. This research is a descriptive quantitative i.e. with provides an overview of the company that takes the environment around the enterprise. Data collection method in this investigation using bibliographical study (Library Research). The types of data used a secondary data that consists of primary legal materials and secondary legal materials. The waste is the remaining exiles who produced from real production activities in the production scale of domestic or household and production on a larger scale. Industrial waste is a remnant of the captives process of production in certain industries. Industrial waste requires the handling and managing seriously in considering the impact will greater emanate than with domestic waste. The industry is a business or management activities of raw materials or half-goods to be the end goods that have added value to get the benefits. The assembly of the business and repairing is a part of the industry also. The results of this industry do not only in the form of goods but also in the form of services.

Further and deeper research into the validity of the Retroactive Principle is required in order to provide assertiveness about the arrangement of Retroactive Principles in the field of agreement law in the Indonesian legal system, especially the Building Rights Agreement in Agrarian Law and the existence of obscure legal norms in the case of the legal Notary / PPAT to the granting right of building use for a period of validity is reviewed according to the provisions of Article 28 of Regulation of Head of National Land Agency Number 2 Year 2013 concerning the Delegation of Authority of Land Rights and Land Registration Activity and by using case approach of PT. Pan Pacific Nirwana Resort. This research is a normative legal research that is derived from the existence of obscurity of legal principle and legal norm contained in the provisions of Law Number 5 Year 1960 on Basic Agrarian Law Basic (UUPA) in the provisions of Article 30 and Article 28 Regulation of Head of National Land Agency No. 2 of 2013 on the Delegation of Authority of Land Rights and Land Registration Activities. The conclusion of this research in Agrarian Law there is legal uncertainty in the concept of law building rights agreement with a period of time that is still running and the future is approved by a new regulation by the government which caused the previous agreement to occur normatively contradictory whether using retroactive or non-retroactive principle and the validity of deed Notary / PPAT in the granting of right to building to limited liability company which is still valid time is reviewed according to UUPA, Article 28 Regulation of Head of National Land Agency Number 2 Year 2013 regarding Delegation of Authority of Land Rights and Land Registration Activity and Article 1320 Privat Law and by using approach case PT. Pan Pacific Nirwana Resort is not valid. Penelitian lebih lanjut dan mendalam terhadap keberlakuan Asas Retroaktif diperlukan dalam rangka memberikan ketegasan  tentang pengaturan Asas Retroaktif [1] di bidang hukum perjanjian dalam sistem hukum Indonesia khususnya perjanjian Hak Guna Bangunan dalam Hukum Agraria serta masih adanya kekaburan norma hukum dalam hal keabsahan akte Notaris/PPAT terhadap Perseroan Terbatas dalam  pemberian Hak Guna Bangunan yang jangka waktunya masih berlaku dikaji menurut ketentuan Pasal 28 Peraturan Kepala Badan Pertanahan Nasional Nomor 2 Tahun 2013 tentang Pelimpahan Kewenangan Pemberian Hak Atas Tanah Dan Kegiatan Pendaftaran Tanah serta dengan menggunakan pendekatan kasus PT. Pan Pasific Nirwana Resort. Penelitian ini merupakan penelitian hukum normatif yakni beranjak dari adanya kekaburan asas hukum dan norma hukum yang terdapat di dalam ketentuan Undang-Undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-pokok Agraria (UUPA) dalam ketentuan Pasal 30 dan Pasal 28 Peraturan Kepala Badan Pertanahan Nasional No. 2 Tahun 2013 tentang Pelimpahan Kewenangan Pemberian Hak Atas Tanah Dan Kegiatan Pendaftaran Tanah. Kesimpulan dari penelitian ini dalam Hukum Agraria terdapat ketidakpastian hukum dalam konsep hukum perjanjian Hak Guna Bangunan dengan jangka waktu yang masih berjalan dan ke depannya di sahkan suatu peraturan baru oleh pemerintah yang menyebabkan perjanjian sebelumnya terjadi pertentangan secara normatif apakah menggunakan asas retroaktif atau non retroaktif dan keabsahan Akta Notaris/PPAT dalam Pemberian Hak Guna Bangunan terhadap Perseroan Terbatas yang jangka waktunya masih berlaku dikaji menurut UUPA, Pasal 28 Peraturan Kepala Badan Pertanahan Nasional Nomor 2 Tahun 2013 tentang Pelimpahan Kewenangan Pemberian Hak Atas Tanah Dan Kegiatan Pendaftaran Tanah jo Pasal 1320 KUH Perdata serta dengan menggunakan pendekatan kasus PT. Pan Pasific Nirwana Resort adalah tidak sah.
