The custody hearing is characterized by the primary objective of ensuring personal contact of the person arrested with the judge after his arrest in flagrante. The implantation appeared with reproduction existing in international treaties, such as the Pact of San José of Costa Rica, aiming at the human rights of prisoners. Conducted such an audience, by the principles of the Real Truth, Guarantee of the Ample Defense, Presumption of Innocence, Dignity of the Human Person. How to use the legal deductive method, based on the interpretation of rules, according to the literature and the topic addressed, as a general analysis. In the face of a number of reflections, it is concluded that this topic has a great influence on reducing overcrowding in the prison system, on spending on custody of prisoners, as well as on helping the prison system, stimulating alternative means available to the prisoners' others later highlighted.

<p class="resumo">Esta pesquisa tem a finalidade de analisar a produção de provas no processo arbitral, de acordo com as disposições do Código de Processo Civil brasileiro, a partir da escolha pelas partes na instituição da arbitragem. Para tanto, a produção das provas cíveis é abordada, através do método dedutivo e acervo bibliográfico, na legislação processual brasileira para posterior compreensão do cabimento destas perante o juízo arbitral, cuja busca pela verdade real passa a ter maior concretude diante da vontade das partes. Em comparação com o processo judicial, investiga-se a celeridade do procedimento probatório e as implicações na produção das provas cíveis perante a arbitragem brasileira e o funcionamento do processo arbitral. Verifica-se a possibilidade de que testemunhas técnicas imitam opinião sobre determinado assunto, baseado nos conhecimentos técnicos especializados antes da audiência de instrução no juízo arbitral, com a finalidade de reduzir o tempo, os custos do processo e também afastar eventuais surpresas no julgamento do conflito.</p><p class="resumo"><strong>Palavras-chave: </strong>Arbitragem. Resolução dos Conflitos.</p><h3>THE PRODUCTION OF EVIDENCE IN BRAZILIAN ARBITRATION</h3><div><p class="abstractCxSpFirst"><strong>Abstract: </strong>This research has the purpose of analyzing the production of evidence in the arbitration process, in accordance with the provisions of the Brazilian Civil Procedure Code, based on the choice by the parties in the arbitration institution. In order to do so, the production of civil evidence is approached, through the deductive method and bibliographic collection, in the Brazilian procedural law for later understanding of the arbitration court's jurisdiction, whose search for the real truth becomes more concrete in the face of the will of the parties. In comparison with the judicial process, the speed of the probative procedure and the implications in the production of the civil evidence before the Brazilian arbitration and the operation of the arbitration process are investigated. There is a possibility that technical witnesses imitate an opinion on a particular matter, based on specialized technical knowledge prior to the arbitration hearing, in order to reduce the time, costs of the process and also to avoid any surprises in the trial of the conflict.</p><p class="abstractCxSpLast"><strong>Keywords: </strong>Arbitration.  RESUMOO artigo analisa tema atual em face dos 30 anos da Constituição Federal brasileira, qual seja, o microchip humano, abordando aspectos técnicos, como sua formação e forma de implantação, bem como os reflexos de sua utilização para o mundo jurídico. O trabalho apresenta a existência de vulnerabilidade à Constituição Federal Brasileira de 1988 quando do uso do microchip humano, em face de dados pessoais, apontando a tendência à violação do direito à intimidade, privacidade, honra e imagem, caso os mesmos sejam comercializados ou disponibilizados sem a devida autorização do seu proprietário, demonstrando a possibilidade de responsabilização a quem causar prejuízo por infração ao princípio da dignidade da pessoa humana. O estudo utiliza o método dedutivo, com base em pesquisa bibliográfica, bem como doutrinária e legislativa, acrescida de análise de artigos jurídicos sobre o tema.Palavras chave: Microchip humano; princípio da dignidade da Pessoa Humana; sociedade da informação. ABSTRACT This paper analyzes current theme in the face of the 30 years of the Brazilian federal constitution, namely the human microchip, approaching from technical aspects, such as its formation and form of implantation, as well as the consequences of its use for the legal world. It presents the existence of vulnerability to the Brazilian Federal Constitution of 1988 when using the human microchip, in the face of personal data, pointing to the tendency to violate the right to privacy, privacy, honor and image if they are marketed or made available without the proper authorization of their owner, demonstrating the possibility of accountability to those who cause harm by breaching the principle of the dignity of the human person. Among contact sports, the practice of martial arts offers a greater risk of causing dental trauma and fractures as contact with the face is more frequent. The primary objective of the research is to evaluate the incidence of mouthguard use, and the secondary objective is to verify which type has a greater predominance and the difficulties in its use correlating to the type of mouthguard used. A documentary study was carried out with 273 athletes of different contact sports, among them: MMA, Boxing, Muay Thai, Jiu-Jitsu, and Taekwondo of the city of Campos dos Goytacazes, Rio de Janeiro, Brazil. It was concluded that the most commonly used mouthguard is PB Boils and Bites - Type II and its level of approval is poor, interfering with the athletes’ performance, mainly in relation to the breathing factor.

This current work studies the human rights violations suffered by indigenous peoples during the period of the Brazilian CivilMilitary Dictatorship. Likewise, it makes some notes about the beginning of the violations in a moment before this dark period. On this path, even before the Military Coup was launched in the year 1964 (one thousand nine hundred and sixty-four), the Indians were already experiencing constant usurpations of their rights at the expense of irresponsibilities commanded most of the time, by those who should watch over their rights lives. As will be seen, the violation and disrespect for Human Rights in the face of these peoples ended up becoming common and gaining strength mainly in the beginning of the implementation of the military regime. Negligent attempts at acculturation and "emancipation", in addition to inconsequential contacts with isolated peoples, culminated in the destruction and predatory logging of their lands. Missing processes of terribly violating demarcations of indigenous areas promoted the expulsion of countless peoples, causing the Indians to fall into a life totally surrounded by hunger, begging, alcoholism and prostitution. All in the name of the so-called “economic advance”, which aimed at building roads, in what was called “occupation of the Amazon”? As frequently stated by the authorities at the time, the Amazon rainforest was seen and understood as a “population void” by the Military Government. According to this thought idealized by the disgusting dictators and supporters, it will be observed that the cases of violations of Human Rights have been systematically “legalized”. The life, land and culture of indigenous peoples were left in the background. Depending on this brief narrative developed through documentary research, based on a hypothetical-deductive method, the intention is to rescue the martyrdoms of that time, demonstrating what actually happened to indigenous peoples during the Military Regime, in the simplest attempt to remember or even disclose to those who are unaware of this part of history. All that said, don't you forget. So that it never happens again.

Rather than being of little practical importance, the metaphysical underpinnings of a given horizon determine the character of its existential problematic. With the breakdown of classical metaphysics concomitant with the modern turn to the subjective, the existential problematic of finitude as ultimate horizon arose. According to this subjective turn, the human person can no longer engage the world as though it were in itself constituted by transcendently grounded meaning and value. Standing within this genealogical lineage, Martin Heidegger undertook a phenomenological investigation into the existential constitution of the human person which defines authenticity in terms of finitude. For the early Heidegger, human life is essentially ‘guilty’. This guilt, however, is not the traditional cognizance of one’s sinfulness, but the foundational Nichtigkeit (‘nullity’) of life and its attendant possibilities in the light of the ultimate finality of death. Authenticity, then, consists of a resolute working out of one’s life in the face of such inevitable finality. For the later Heidegger, the finite horizon of a particular epochal disclosure gifts Being to thought and determines it thereby. Authenticity in this case consists of giving oneself over to be appropriated by an event of Being. In contrast, Lonergan understands authenticity as being true to that primordial love which beckons us to intellectual probity and responsibility in working out life’s possibilities. This essay will illustrate how Lonergan’s analysis of the intentional structure of human conscious operations stands as a corrective to Heidegger’s early existential analysis of human being-in-the-world and later thought about Being. While Lonergan defines authenticity as loving openness to transcendent Being, Heidegger, because of his forgetfulness of the subject in her conscious operations, does not allow for a transcendence which stands beyond any finite horizon.

RESUMOPauta-se por reflexões circundantes a determinados princípios e valores que alicerçam ordenamentos pretensamente promovedores da pessoa humana como eixo vital de proteção e fomento, em consonância com a efetivação de direitos, em especial aqueles primordiais ao núcleo medular da personalidade e dignidade humana, na contraposição de aspectos e influências que derruem a legitimidade social de certas escolhas políticas eivadas de intenções particulares antagônicas ao melhor interesse público. Visa promover certa conscientização pela necessidade de (re)consideração de determinadas atuações político-sociais, notadamente no âmbito legislativo, para que sejam debelados obstáculos os quais se opõem ao reconhecimento e à real participação de cada pessoa na formação de elementos garantidores do livre desenvolvimento da personalidade e de uma vivência digna a todos. No que concerne ao aspecto metodológico desenvolve-se este trabalho, principalmente, pelo método dedutivo, através de pesquisa bibliográfica em escritos componentes do direito, rumo à formulação de considerações pretensamente conclusivas acerca da temática posta ao debate.PALAVRAS-CHAVEDireitos fundamentais. RESUMONeste trabalho tratamos do direito de manifestação em piquetes e da responsabilidade que possa advir desses atos em face da jurisprudência da Suprema Corte dos Estados Unidos da América. A partir da análise das principais decisões da Suprema Corte se pode concluir que, de modo geral, os participantes do piquete não respondem quando agem de forma não ilegal. Está sedimentado, no entanto, o entendimento de que o organizador do piquete responde pelos atos dos participantes. A pesquisa desenvolvida se justifica enquanto estudo comparativo e diante do pouco debate existente no Brasil a respeito do tema. Na pesquisa foi utilizado o método dedutivo, limitada à ciência dogmática do direito, com estudo de casos apreciados pelo judiciário. PALAVRAS-CHAVES: Responsabilidade; Piquete; Estados Unidos; Suprema Corte; Liberdade De Expressão. ABSTRACTIn this work we deal with the right of demonstration in pickets and the responsibility that may arise from these acts in the face of the jurisprudence of the Supreme Court of the United States of America. From the analysis of the Supreme Court's main decisions it can be concluded that, in general, the picket participants do not respond when they act in a non-illegal way. It is settled, however, the understanding that the picket organizer responds by the acts of the participants. The research developed is justified as a comparative study and in view of the little debate that exists in Brazil regarding the subject. The research presents in a practical way the impacts of the crisis of 2008 and following years in Europe and the action of the economic block, to mitigate the crisis through austerity measures, which last to date. The search for a solution to the crisis that has plagued the European Union, the possible conflict with unavailable rights and the imposed need for flexibilization of rights, especially in labour law, deserves debate. The measures put forward by the member countries of the European Union to solve the economic crisis are also partly linked to the idea of the suppression of rights. For example, we mention the reduction of working hours, an increase in the retirement age, among other fundamental precepts inherent to the dignity of the human person, which have been made more flexible during the crisis. This article discuss the legality of these flexibilities in the face of the protection of fundamental human rights and European Community law, from the point of view of international law, of the Convention OIT, ONU, which have been ratified by the various countries of Europe. Over the years, the European Union has been going through a series of crises and consequent precarious labour law, one of the most recent and relevant, the UNITED KINGDOM’s withdrawal from the European Union through so-called Brexit.

The exposure of infants and children to volatile anesthetics, such as sevoflurane, has been a topic of concern with respect to the potential risk for long term neurocognitive effects. The primary objective of this study was to determine whether the perioperative utilization of Bispectral Index (BIS) monitoring alters the sevoflurane delivery and exposure to children. This is a prospective randomized trial of two groups of healthy ambulatory day surgery patients (2 to 12 years). The patients in both groups had the BIS applied soon after the induction of general anesthesia, but only the anesthesiologists in the group randomized to BIS visible were able to see the BIS values. All of the patients received general anesthesia with sevoflurane. This study found no difference in the overall exposure to sevoflurane between both groups (mean end-tidal sevoflurane level of 1.8 in both groups, P = 084). The duration of time in the recovery room, the time to meet discharge criteria, the Pediatric Agitation Emergence Delirium (PAED) scores and the Face, Legs, Activity, Cry, Consolability (FLACC) scores were not statistically different between the groups. The application and utilization of intraoperative BIS monitoring does not alter the sevoflurane administration nor the discharge readiness nor the recovery profile in healthy ambulatory children.

Many different microscopic techniques are utilized in the development of new pharmaceuticals. For that reason, pharmaceutical companies have supported microscopy and microscopists even in the face of retrenchments in many other industries. Microscopy has the following three major uses in pharmaceutical development: 1) solid-state characterization of drug substance; 2) particle size analysis; 3) contaminant identification. Microscopy is also an important component of the study of the biological activity of drugs but that subject will not be discussed here.The analysis of the solid-state properties of new drug candidates is probably the most important and challenging subject of study for pharmaceutical microscopists.1 The primary objective of these studies is identification of the most suitable solid-state form (i.e. polymorph, solvate, hydrate) of the drug substance for development. Polarized light microscopy (PLM), thermal microscopy (TM), infrared microspectroscopy (IR), and Raman microspectroscopy (RM) are all utilized in these studies. Both PLM and TM are used to discover new polymorphs and solvates of the chemical.
