This research aims to determine the prospects of persons with disabilities protection against discriminatory behavior in Semarang. The research method is normative using the laws approach (statutory approach), and the conceptual approach (conceptual approach). Results of the study found that the government of Semarang have prospects in providing protection and fulfillment of the rights of persons with disabilitas of discriminatory behavior. Constitution of the Republic of Indonesia Act1945 does not set a specific reference on Disability, but set firmly and clearly regarding non- discrimination, equality before the law, and the right to receive equal treatment before the law throughout Indonesia.

Persons with disabilities have the right to enjoy the human rights to life, liberty, equality, security and dignity as human beings. However, due to social apathy, psychological barriers, a limited definition of “disability” entitled to the protection of the law and lack of proper data, persons with disabilities in India remain an invisible category. Although many laws set out to ensure their full and effective participation in society, they remain inadequate as they are based primarily on the discretion of the government. Also, the judiciary acts as the real protector of persons with disabilities whenever an opportunity arises, but it is not possible to approach the judiciary for every request. Unless the foundation of the law is strengthened, persons with disabilities cannot fully exercise their rights. The present research paper mentions the contemporary situation of people with disabilities with the current laws and concepts, and also the researcher believes that it is not only the law that will provide a solution to this problem, it is the change in the outlook of the society which may provide a solution to this problem. Thus, the horizons of the law should be expanded to provide a “human friendly environment” for all persons with disabilities to remove the barriers that impede their development. With timely implementation the time has come for effective legislation to protect their interests and empower their capabilities which are based on “rights–based approach” rather than charity, medical or social approach.

Zakat is a number of assets that must be issued by Muslims to be given to groups who have the right to receive, such as the poor and the like, according to those stipulated by sharia. The law of zakat is obligatory for every Muslim who has fulfilled certain conditions. The National Zakat Amil Agency (BAZNAS) is the official body and the only one formed by the government based on RI Presidential Decree No. 8 of 2001 which has duties and functions to collect and distribute zakat, infaq, and alms. The purpose of making this research is to build an android application for GIS zakat assistance map (BAZNAS) in probolinggo district. This study uses data collection methods used in this study through observation, which is collecting data obtained from existing documents or stored records, both in the form of transcript notes, books, newspapers, plunging directly to the location to take pictures, and so on. Output targets of this study are in the form of an application for collecting data on zakat assistance from an Android-based Baznas office and will be published in non-accredited national journals. The application can be used by someone who wants to send donations via Smartphone easily. As well as the results of this application, it can map the locations of recipients of Zakat and Donors according to the coordinates of points of different colors. Designation (naturalization) includes giving Indonesian citizenship status of one or a number of people from foreign nationals, or gives the status as a citizen of Indonesia or the number of people who do not have citizenship (stateless) .According to the laws of the Republic of Indonesia citizens who have dual citizenship must choose one of these citizenship so until he has only one nationality. For Indonesian citizens are treated when these approvals to those Indonesian nationals, according to Indonesian citizenship legislation that called "gain" or "select" nationality of the Republic of Indonesia will be replaced with Indonesian nationality, and which are called "retained" Dutch nationality or nationality of foreign countries or "reject" Indonesian nationality. So goes the Indonesian nationality, if it has lost the nationality Indonesia automatically all matters concerned with the rights and obligations of citizens or her country also erased or lost. The problem that will be discussed are: Does the right of repudiation in the process of selecting citizenship status lead to legal consequences for those concerned? Does repudiation rights used in the process of selecting citizenship status in Indonesia? By studying this research, it is expected to find out the point of problems in selecting indonesian citizenship.This research used qualitative. Since this method is a directed and systemic method. In addition, this research study used statute approach and conceptual approach. It is an approach which comes from views and doctrines that are developed in the science of law.The findings of this research are: first, as a result of law that is rejected, rejected state has no right to force someone to reject the offer, this happens because of self-will without intervension from other sides. Since, the status of citizenship related to the existence in getting right and obligation of someone in every action.  The second problem is repudiation right that is used in Indonesia by special naturalization. It means that the state is able to offer or give citizenship status by using it, and in this session, the citizen has right to receive or reject that offer.

The Unitary State of the Republic of Indonesia is a state of law. In accordance with Article 1 paragraph (3) of the 1945 Constitution (UUD 1945). As a state of law, Indonesia must guarantee the rights of its citizens to equality and guarantees of justice, including human rights. As stated by Salim, quoting Fredrich Julius Stahl, that the main element of a state based on law is the protection, as well as the recognition of Human Rights (HAM), and upholding dignified justice. Also in Article 28D paragraph (1) of the 1945 Constitution (UUD 1945) reads: "Everyone has the right to recognition, guarantees, protection, and fair legal certainty and equal treatment before the law". This means that the constitution itself has accommodated, the state guarantees the fulfillment of individual rights of citizens and is treated equally before the law. In a state of law, the law is used as the main shield in the movement of government, state, and society. As an effort to realize justice and the spiritual values ​​of humanity (fair and dignified), there is assistance in the form of legal services for every citizen. The existence of a dignified justice theory is a justice provided by a legal system that has spiritual and material dimensions. This theory is a theory of justice that is based on noble values ​​that are rooted in the second principle of Pancasila, "Just and Civilized Humanity" and is inspired by the first principle, "Belief in the One Supreme God".

AbstractThe aim of the research is to offer novelty regarding the constitualism of the Government Regulation in Lieu of Law regarding Covid-19 which has now become a Law. This study uses a normative research method, with a focus on solving issues (problems) based on legal principles, legal rules, as well as on recognized legal expert opinion or doctrine. Through this research, the researcher offers that the perppu which has now become a law must be declared invalid or revoked because it is unconstitutional. As is well known, the Government issued Government Regulation in Lieu of Law Number 1 of 2020 concerning State Financial Policy and Financial System Stability for Handling Pandemic Corona Virus Disease 2019 (COVID-19) and / or in the Context of Facing Threats that Endanger the National Economy and / Or Financial System Stability, on March 31, 2020 (now Law Number 2 of 2020, on May 18, 2020). In Article 27 paragraph (1), paragraph (2), and paragraph (3) it is stated that there are parties who have "privileges", namely obtaining legal immunity from all actions they take on the basis of implementing the Covid Perppu. Of course this is a problem, because as a rule of law, Indonesia must provide justice in the form of equal treatment before the law or equality before the law to society without exception. This is stated in Article 27 paragraph (1), Article 28D paragraph (1), and Article 28I paragraph (2) of the 1945 Constitution of the Republic of Indonesia. Seperti diketahui, Pemerintah mengeluarkan Peraturan Pemerintah Pengganti Undang-Undang Republik Indonesia Nomor 1 Tahun 2020 tentang Kebijakan Keuangan Negara Dan Stabilitas Sistem Keuangan Untuk Penanganan Pandemi Corona Virus Disease 2019 (COVID-19) Dan/Atau Dalam Rangka Menghadapi Ancaman Yang Membahayakan Perekonomian Nasional Dan/Atau Stabilitas Sistem Keuangan, pada tanggal 31 Maret 2020 (sekarang menjadi Undang-Undang Nomor 2 Tahun 2020, pada tanggal 18 Mei 2020). Dalam Pasal 27 ayat (1), ayat (2), dan ayat (3) disebutkan bahwa ada pihak-pihak yang mendapat “keistimewaan”, yaitu mendapat kekebalan hukum dari segala tindakan yang dilakukannya atas dasar pelaksanaan perppu covid tersebut. Tentu itu menjadi masalah, karena sebagai negara hukum, Indonesia harus memberikan keadilan berupa perlakuan yang sama didepan hukum atau equality before the law kepada masyarakat tanpa terkecuali. Hal tesebut tercantum dalam Pasal 27 ayat (1), Pasal 28D ayat (1), dan Pasal 28I ayat (2) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Sehingga, Perppu yang kini telah menjadi undang-undang tersebut bertentangan dengan Konstitusi, sehingga harus di batalkan atau dinyatakan tidak berlaku.

The end of the government of Orde Baru that tends to be more authoritharian has emerged the transformation almost in all government hierarchy. The most important transformation is in the material contains or substantive of 1945 constitution, whether material that has been erased, revised or new material. Material contain of the 1945 constitution is the result of the amendment such as the Human Right.  The regulation about human right before amendment 1945 constitution regulated as right and duty of the republic citizen in Indonesia that contains the values of human right and regulated in the article 27 to article 34. The regulation of human right after amendment of 1945 constitution regulated in article 28A to 28J.  The regulation about the human right based on the Law Number 39 Year 1999 concerning the Human Right. It explain there is no right in Indonesia that has the absolute power and unlimited. Human Right is not the right that has the absolute characteristic. In the implementation, its limited by the right, morale, security and order of other people. Because of that,  in the human right also known the existence of human right duty. Convention on the Rights of Persons with Disabilities (CRPD) has been signed by Malaysian Government on 8 April 2008. It shows the desire and commitment of the Government of Malaysia to give recognition to the rights of People with Disabilities. The aim of this article is to review the rights to work for Persons with Disabilities under the Federal Constitution and Person with Disabilities Act 2008 in Malaysia. This study will use Legal studies as research methodology and it involved two types of method which is doctrine study of the law and socio-legal studies. The studies showed that the rights to work for PWDs in Malaysia stated as generally in the Federal Constitution and the rights has been detailed in Person With Disabilities Act 2008. The existence of the right to work exclusively under the Person With Disabilities Act 2008 makes those rights not only for normal people but it is also owned by the PWDs. However, the existence of legislation alone is not enough if followed by enforcement. Thus, the improvement in the law and its implementation should be further strengthened through several proposals suggested by this article. It is to ensure the rights of the PWDs to get the job be given serious attention by the community in line with the original purpose of Persons with Disabilities Act 2008 being created.

This journal shall be entitled as " Implementation Of Public Interest Principles To Neglected Land In Indonesia".The existence of the land on earth must be beneficial both for the welfare and happiness that has it and for the people and the state. The purpose of this study is to know and understand the absolute limits of property rights to land; and want to understand the relationship between the principle of public interest in land. The method in this research is normative by using  conceptual  approach and statute approach. This journal’s preparation is done by legal research, and the approach method being used in this journal shall be used is the combination of the statute approach and the conceptual approach. The result of this research is the essence of the principle of public interest to the land is to create development based on the principle of humanity in the balance as stipulated in the 1945 Constitution of the Republic of Indonesia. The exemption of land rights is caused by public and private interest with the provision of compensation and guided by the principle of musyawarah. While the revocation of land rights is the spirit of the provisions of Article 18 of the Basic Agrarian Laws states that for the interest of the state and the state and the common interest of the people of the right to land may be revoked by compensation. The legal effort that a third party can take to exploit the state land (abandoned land) is to apply the right to the government (Provincial or Regency / City Land Office). Jurnal ini mengambil julul “Penerapan Prinsip Kepentingan Umum Terhadap Terlantar. Keberadaan atas tanah di muka bumi ini  harus bermanfaat baik bagi kesejahteraan dan kebahagiaan yang mempunyainya maupun bagi masyarakat dan negara. Tujuan dari penelitian ini ialah ingin mengetahui dan memahami batas-batas absolut dari hak milik  terhadap tanah; dan ingin memahami hubungan antara prinsip kepentingan umum atas tanah. Jurnal ini mengangkat permasalahan yang juga menjadi tujuan penulisan yaitu apa hakikat kepentingan umum atas tanah dan apa upaya hukum yang dapat dilakukan oleh pihak ketiga terhadap tanah terlantar. Penyusunan jurnal ini dilakukan dengan tipe penelitian normatif dan menggunakan pendekatan peaturan perundang-undangan dan pendekatan konsep. Hasil dari penelitian ini adalah Hakekat dari prinsip kepentingan umum terhadap tanah ialah untuk menciptakan pembangunan yang berlandaskan asas perikemanusiaan dalam keseimbangan sebagaimana diatur dalam UUD NRI tahun 1945. Pembebasan hak atas tanah disebabkan oleh kepentingan umum dan swasta dengan pemberian ganti rugi dan berpedoman pada asas musyawarah. Sedangkan pencabutan hak atas tanah merupakan semangat dari ketentuan Pasal 18 UUPA menggariskan bahwa untuk kepentingan bangsa dan negara serta kepentingan bersama (hanya untuk kepentingan umum) dari rakyat hak atas tanah dapat dicabut dengan memberikan ganti kerugian. Upaya hukum yang dapat dilakukan pihak ketiga untuk dapat memanfaatkan tanah negara (tanah terlantar) ialah melakukan permohonan hak kepada kepada pemerintah (Kantor Pertanahan Provinsi atau Kabupaten/Kota).

Social rights for people with disabiltiy need to be protected, including political rights. The operationally political rights consist the right of chce and the right to be elect. The issue arises when people with disability have to face the term of physical and spiritual requirements for president, though neither are not entirely contradiction but technically the implementation of the health physically requirement threatens people with disability to be president. The study aims to explain the legal certainty of people with disability to be president linked to physical and spiritual requirement. This research aims to know physical and spiritual rule and limitations. This research uses normative juridical methods and analysis presented descriptively. This research uses conceptual approach, legal approach, and historical approach. The conclusion of this research is that there is no certainty for people with disability to be president until the government has the implementation which is regulate and affirm people with disabilty to pass the physical health and spiritual health requirements. The arrangement of formulation physical and spritual health was conducted by medical check up by the doctors team and decision made thorough them using medical approach and missed the social approach. While there is no clarity about the limits of form capable in physically and spiritual health to be president linked to people with disabilty as the extent of spectrum of ability.
