This study aims to explore and analyze the implementation of divorce in the Village Pakraman Kubu, Kubu Village, Bangli. This research is socio-legal research, which relies on field data as primary data. Data were extracted by interview, then processed and analyzed qualitatively. The results show that in the last ten years there have been six divorced couples and none of this has been done before the court. Divorce is done customarily for various reasons, because it is very simple, does not understand the Marriage Law, through the court hearing takes a long time and cost more. This is due to the attitude, behavior or legal culture of the people who prefer to deviate from the national marriage law and the lack of socialization from related parties. Thus the Marriage Law has not been influential in the implementation of the divorce. The conclusion is that the divorce remains customary so the marriage law has not reflected any influence on the implementation of the divorce.

But the fact that until now there is still a sale of land rights done in the presence of the Village Head, as happened in Plana Village Somagede District Banyumas Regency. This research uses sociological juridical approach methods, primary data, and secondary data obtained and then analyzed based on legal norms and theories namely legal protection and legal effectiveness. Purpose of the study: The rambu solo’ ceremony is a traditional death ceremony of the Tana Toraja regency with roots in local beliefs. However, over time, the tradition has become associated with social status and economic motives. These changes have led to many issues. This article analyses the motivations that drive the compromises that families must accept when selecting a form of rambu solo’. Methodology: This was a case study conducted in the village of Lemo in the regency of Tana Toraja. Primary data collected through in-depth interviews and observation. Informants consisted of cultural figures, religious figures, and indigenous locals with experience performing rambu solo’ — secondary data taken from existing literature about Toraja Regency. Main Findings: Results showed that compromises taken for motives of social status were irrational but comprised the most common reasoning behind rambu solo’ ceremony selection. For those families motivated by social status, choice of rambu solo’ ceremony form performed for one of two reasons: preserving their social status ascribed to them from birth (attributed status) Applications of this study: The selection of non-rapasanrambu solo’ ceremonies based on economic motives were rationally-sound but relatively rare. Avoiding wastefulness in the performing of rambu solo’ is done through simplifying the procession through shortening the storage period of the remains of the deceased before the rambu solo’ reducing the number of days of the rambu solo’ ceremony. Novelty/Originality of this study: This shows that irrational decision-making, in the context of traditional ceremonies, cannot be considered irrational; even irrational decisions can be justified and explained based on individual interpretations of rationality based on local culture. Interestingly, social status was the most common motive form selection based on economic motives were rational but less popular among the people sound choice theory

It is estimated that the judicial system will not be able to meet the increasingly complex needs of society. This estimate is based on facts in the field. Dispute resolution through courts is considered too convoluted, takes a long time, and is inefficient for businesses that emphasize efficiency and effectiveness. Besides, the court's decision does not satisfy the parties. The principle of simple, fast, low-cost justice is still only a slogan.      Answering this problem, a study is conducted using the empirical normative legal research method with a study approach based on statutory regulations, conceptual approaches, and case approaches. Types and sources of data used in this study are primary data and secondary data with data collection techniques through document study and interviews, where the data obtained will be analyzed qualitatively deductively. Based on the results of research and discussion, it was found that mediation as a solution to the settlement of cases, both in court and outside the court, is cooperative

Business opportunities in Bali are vehicle rental services, using a rental agreement to provide the vehicle for rent. According to the agreement agreed upon, the lessee must return the leased item. But in its implementation many parties violated the agreement or late returned (overtime). Problem formulation 1) What is the responsibility of the tenant if there is a default in the lease agreement of the motorized vehicle (car) in the village of Tibubeneng Canggu? 2) How is the settlement of the breach of contract carried out by the rent car to the tenant in the Village of Tibubeneng Canggu? The method in this study is a type of empirical legal research with the approach of legal sociology. This study uses primary data derived from observations and interviews obtained from 3 Rent car owners in the village of Tibubeneng Canggu. Data collection techniques used interviews, observation and inventory using qualitative analysis techniques. The responsibility of the tenant if there is a default in the lease agreement of the motorized vehicle (car) in the village of Tibubeneng Canggu in terms of overtime is in the form of compensation with payment of fines in accordance with the agreed agreement. Settlement of defaults carried out by the rent car party to the tenant in the Village of Tibubeneng Canggu is an alternative dispute resolution through negotiations between the lessee and the rent car party. In order to reduce the occurrence of defaults in the case of returning car overtime, Rent Car revisits the clauses of the agreement with the tenant, especially in the case of overtime to be made in a written agreement, as well as implementing a full payment system at the beginning so as not to incur losses. In addition, the lessee is expected to read more and comply with the contents of the agreement so that there is no negligence that causes harm to the Rent Car.

AbstractMarriage dispensation is a legal solution because most of the perpetrators of marriage dispensation are those who do not yet have formal legality to get married, so they then take the legal initiative so that marriages can be recognized. This study aims to determine the perspective of Islamic law, Marriage Law and Compilation of Islamic Law regarding marriage dispensation. The method used is qualitative with primary data sources from the Marriage Law, the Book of Fiqh and the Compilation of Islamic Law while secondary data are books, journals, magazines related to marriage dispensation. The results of this study found that Islamic law does not specifically regulate marriage dispensation because the majority of scholars only mention balig as a condition for marrying a person and do not specify a minimum age of marriage, whereas Law Number 1 of 1974 concerning Marriage and Compilation of Islamic Law strictly regulates underage marriage , i.e. must go through a court hearing mechanism to obtain a marriage dispensation permit.
