With the nature that is so important, the soil was ranked first most potential conflict both vertical conflict (conflict between the residents and the authorities) and horizontal conflicts (conflicts among fellow citizens). Therefore a government of a country should be able to put politics pertanahannya law precisely by considering all sides of the state of society so that potential conflicts as mentioned above can be minimized. Against that government of the Republic of Indonesia after the win independence from the Dutch, trying to land reform and political building a new national land law by changing land laws in force earlier, Agrarisch Wet (Stb 1870-55) was considered not appropriate with the personality of the Indonesian nation. Hence was born the Act No. 5 of 1960 (BAL No.5 / 1960), the Law on Agrarian, hereinafter referred to as UUPA. The focus of the problem in this research is the dimension of Public Important Giving Hak Guna Usaha (HGU) Above Communal Land of Indigenous People, research conducted with secondary data are descriptive qualitative research shows the first, very important to the principle of general interest not give customary land both, would need to be established specifically about the provisions of lands which have positive implications for the public interest.Keywords: Publik Interest, HGU, Communal Land

Land given to and owned by people with rights provided by the UUPA is to be used and utilized. The granting and possession of land with these rights will not be meaningful if its use is limited to land as the surface of the earth. The land also has a significant role in the dynamics of development. According to the 1945 Constitution of the Republic of Indonesia NRI,  "earth and water are natural resources contained therein controlled by the state and used for the greatest prosperity of the people." This research uses a normative juridical approach that is research based on the rules / according to the law because this research focused on the use of document studies and literature or secondary data. The research specification used is descriptive-analytic, which describes the law of the land in the era of globalization based on local wisdom. The results of the study illustrate that the role of the land ruling state, which used for the prosperity of the people, is regulated under Law No. 5 of 1960 concerning Basic Regulations on Agrarian Principles (UUPA).On the other hand, the globalization of law is nothing more than a legal intervention from developed countries towards developing countries in order to adjust their laws globally. One way to address the problem of globalization of land law is to reaffirm local wisdom. In other words, they are upholding the customary provisions related to land. Example: provisions of customary land. Customary land is communal land that is jointly owned and thus does not need to be certified.Keywords: globalization, land law, local wisdomABSTRAKTanah diberikan kepada dan dipunyai oleh orang dengan hak-hak yang disediakan oleh UUPA, adalah untuk digunakan dan dimanfaatkan. Diberikannya dan dipunyainya tanah dengan hak-hak tersebut tidak akan bermakna, jika penggunaannya terbatas hanya pada tanah sebagai permukaan bumi saja. Tanah juga mempunyai peranan yang besar dalam dinamika pembangunan. Undang-undang Dasar 1945 menjelaskan bahwa “Bumi dan air dan kekayaan alam yang terkandung didalamnya dikuasai oleh negara dan dipergunakan untuk sebesar-besar kemakmuran rakyat.” Penelitian ini menggunakan pendekatan yuridis normatif yaitu penelitian yang didasarkan kepada kaidah-kaidah/menurut hukum, oleh karena penelitian ini dititik-beratkan pada penggunaan studi dokumen dan bahan pustaka atau data sekunder. Spesifikasi penelitian yang digunakan adalah deskriptif analitis yang menggambarkan tentang hukum tanah di era globalisasi berdasarkan kearifan lokal. Hasil penelitian menggambarkan bahwa peran negara penguasa tanah yang digunakan untuk kemakmuran masyarakat diatur berdasarkan Undang-undang No. 5 tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria (UUPA). Disisi lain, globalisasi hukum tak lebih sebagai intervensi hukum dari negara maju terhadap negara berkembang agar menyesuaikan hukumnya secara global. Salah satu cara menyikapi persoalan globalisasi hukum tanah ini adalah dengan menegaskan kembali kearifan lokal. Dengan kata lain, menegakkan kembali ketentuan-ketentuan adat terkait dengan tanah. Misalnya ketentuan tanah ulayat. Tanah ulayat merupakan tanah komunal milik bersama, dengan demikian tidak perlu disertifikatkan.

Cooperatives for Savings and Loans and Sharia Financing are microfinance institutions that collect funds from the public and distribute them to people who need these funds. The purpose of this study was to determine the financial management system of sharia financing with the murabahah contract in the Baitut Tamwil Tazakka Islamic Savings and Loan Cooperative. This research is qualitative research using interview and documentation methods and obtained primary and secondary data results. The results of this study are that the murabahah contract is one of the most dominant contracts in the Baitut Tamwil Tazakka Sharia Savings and Loan Cooperative. Among the products are funding and financing products. In non-performing financing or bad credit, it is known from Non-Performing Financing 0.4%, so to avoid this, the Saving and Loan and Sharia Financing Cooperatives use the 5C principles, namely Character, Capacity, Capital, Collateral, and Condition.

Abstract Public policy formulation as a political process is a dynamic formulation of policies involving many actors, ranging from the executive, legislative, academic, to non-governmental organizations. The purpose of this study was to find out the political process of drafting the Oil and Gas Law and determine the model for the formulation of the Oil and Gas Law in the Republic of Indonesia’s House of Representatives. This research method uses a qualitative approach, through observation, in-interview techniques and documentation of secondary data in the process of collecting data. Data analysis using the Interactive Model method by Miles & Huberman's. The results of the study indicate that the political process of drafting the Constitution of Oil and Gas takes place in the following stages: planning, drafting and discussion. Politically, the planning of the Constitution of Oil and Gas comes from several sources: (1) the bill from the President; (2) the bill from the House of Representatives; and (3) the bill from the Regional Representative Council. The long political process in the public policy formulation in the House of Representatives starts from the process of inventorying input from factions, commissions, and the public to be determined as a Legislative Body decision, then the decision is to be consulted with the Government; afterwards, the results of the consultation are reported to the Plenary Session to make the decision.

The problem that occurs is how the indigenous people of swamps interpret the lack of management territory, the loss of livelihood resources and organize themselves to seize opportunities for management rights. The problem of customary land and indigenous peoples above, the researchers felt the need to study more deeply on the Determination of Indigenous Areas and Customary Law Communities in Penyengat Village, Sungai Apit Subdistrict, Siak Regency, Based on the Minister of Home Affairs Regulation No. 52 of 2014 concerning Guidelines for the Recognition and Protection of Indigenous Peoples. This type of research is sociological, so the data source used is primary data from interviews, secondary data from libraries and tertiary data from dictionaries, media, and encyclopedias. Data collection techniques are done by observation, interviews, and literature review.

Abstract: Land Acquisition for Development in the Public Interest in Indonesia still often causes polemic, as is still often found in various mass media. The problem in the implementation of land aquisition is because the Law of the Republic of Indonesia Number 2 of 2012 concerning Land Aquisition for Development in the Public Interest, and the Presidential Regulation that follows it, has not rigidly stipulated the basis for determining the compensation value used to determine the compensation value. This research was conducted by making a comparison between ius constitutum and in concreto events in the field. Primary data in this study were obtained byinterviewing several sources in August 2017, which can be accounted for, while the secondary data were obtained byliterature studies. Based on the research, it is known that there is injustice in determining the value of compensation to the entitled parties. Seeing this, the author tried to describe the existing problems and provide solutions tailored to the situation and conditions in land aquisition in Indonesia. This was intended to actualize the value of social justice in the aquisition of land for development in the public interest in Indonesia.Intisari: Pengadaan Tanah bagi Pembangunan untuk Kepentingan Umum di Indonesia masih sering menimbulkan polemik, sebagaimana yang masih kerap ditemui dalam berbagai media massa. Permasalahan dalam pelaksanaan pengadaan tanah disebabkan karena Undang-Undang Republik Indonesia Nomor 2 Tahun 2012 tentang Pengadaan Tanah Bagi Pembangunan Untuk Kepentingan Umum, serta Peraturan Presiden yang mengikutinya belum mengatur secara rigid tentang dasar penetapan nilai ganti kerugian yang digunakan untuk menetapkan nilai ganti kerugian. Kajian ini dilakukan dengan melakukan komparisi antara ius constitutum dengan peristiwa in concreto yang ada di lapangan. Data primer dalam kajian ini diperoleh dari hasil wawancara dari beberapa narasumber pada Agustus 2017 yang dapat dipertanggungjawabkan dan data sekunder dalam kajian ini diperoleh dari studi kepustakaan. Berdasarkan penelitian diketahui bahwa terdapat ketidakadilan dalam penetapan nilai ganti kerugian terhadap pihak-pihak yang berhak. Melihat hal tersebut penulis mencoba menguraikan permasalahan yang ada dan memberikan solusi yang disesuaikan dengan situasi dan kondisi dalam pengadaan tanah di Indonesia. Hal ini dimaksudkan untuk mengaktualisasikan nilai keadilan sosial dalam pengadaan tanah bagi pembangunan untuk kepentingan umum di Indonesia

<p>As a mass media, Film seldom unrecognized as a media disseminator for messages and discourse. This condition is used by filmmakers and some interested parties as “arena” to disseminate or conduct hegemony to the public. Film General Soedirman is one example of a film that we can felt the hegemony agenda. As a historical film, the film try to build its story or narrative centrally on the figure of the Great Commander General Soedirman. Interestingly, the protrusion of General Soedirman figure is felt too much. On the contrary, the civil politicians are discribed ugly. This led to controversy and debate that is quite exciting in the national media. There is a suspicion of a large discourse, that is being rolled out by the filmmakers for the sake of a certain position within the larger narrative of the republic.<br />This article is a report of qualitative research and use critical discourse analysis of Van Dijk. The research try to dismantle the structure of the text, either micro, macro, and it‟s superstructure, thus unfolding discourse developed through the production of this film.<br />Keywords: Critical Discourse, Text Structure, and Hegemony</p>

Communal land is the identity of indigenous communities whose existence is protected by the Constitution. Customary land is not only used for the purposes of indigenous peoples, but also exploited by the outsiders. This study examines how the pattern of the legal relationship between the indigenous people and to outsiders by using socio-legal research. This study was conducted in West Sumatera by limiting the study to the four natural resource sectors, namely plantations, water resources, mining and forestry. The results of this study indicate that the legal relationships that are not obvious to trigger disputes between indigenous people and outsiders. Tanah ulayat merupakan identitas masyarakat hukum adat yang diakui dan dilindungi keberadaannya oleh UUD 1945. Tanah ulayat tidak hanya digunakan untuk keperluan masyarakat hukum adat, namun juga dimanfaatkan oleh pihak luar. Penelitian ini mengkaji bagaimana pola hubungan hukum antara masyarakat hukum adat dengan pihak luar dalam pemanfaatan tanah ulayat dengan menggunakan pendekatan yuridis empiris. Penelitian ini dilakukan di Sumatera Barat dengan membatasi kajian pada 4 (empat) sektor sumberdaya alam, yaitu perkebunan, sumberdaya air, pertambangan dan kehutanan. Hasil penelitian ini menunjukkan bahwa ketidakjelasan hubungan hukum menjadi pemicu munculnya sengketa antara masyarakat hukum adat dengan pihak luar di dalam pemanfaatan tanah ulayat.

Primary Tax Office Meulaboh (KPPP) has an important role in improving the performance of public services in terms of extension function, service, and supervision to taxpayers. If seen from the function of the Primary Tax Office Meulaboh it is helpful to the Directorate General of taxes in awaken the importance of taxes to the public. The problem in this research is how the performance of Primary Tax Office Meulaboh in increasing interest taxpayers. The purpose of this study is to determine the performance of Primary Tax Office Meulaboh in increasing interest taxpayers. The research method used in this research is qualitative research method with descriptive approach. The source of data in this study consists of primary and secondary data. Then the technique of collected data used interview, observation and documentary. The location of this study was conducted in the Primary Tax Office Meulaboh West Aceh. Based on the results of research in the discussion KPPP Meulaboh in improving performance attract taxpayers. First, productivity KPPP Meulaboh not achieve results in accordance with the vision and mission of the grounds are still no customer complaints. Second, the quality of service KPPP Meulaboh also not yet maximal, the reason there are still many queues. Third; The responsiveness of KPPP Meulaboh is not good, the responsibility of KPPP Meulaboh still not maximal in giving the requirement for the taxpayer. The purposes of this study are to determine the effect of professional skepticism, expertise, audit fee, audit risk on the auditor’s opinion, and to determine preference client as the moderating variable on the effect of professional skepticism, expertise, audit fee, and audit risk on the auditor’s opinion. It is an empirical study on the public accountant firms and the Audit Board of the Republic of Indonesia (BPK RI) Representative Office in Palembang, South Sumatra, Indonesia. This study developed associative hypotheses and tested them. The data consisted of primary data and secondary data. The population of this research was the auditors of public accountant firms and BPK RI in Palembang. Totally, 111 respondents were involved. The techniques used for collecting the data were in-depth interviews, questionnaires, and documentation. The techniques used for analyzing the data were quantitative analysis and qualitative analysis. This study indicates that professional skepticism insignificantly affects  the auditor’s opinion, expertise significantly affects the auditor’s opinion, audit fee significantly affects the auditor’s opinion, and audit risk significantly affects the auditor’s opinion. Furthermore, there is no significant relationship on the auditor’s opinion from the interaction between the client preference and professional skepticism and expertise. Meanwhile, client preference is a quasi-moderator on the influence of audit fee and audit risk on the auditor’s opinion.

This research aims to find out and to depict the public relations activities in spreading the information of E-Warong program, as well as to discover the obstacles in running the aforementioned public relations activities. A descriptive-qualitative method is used to depict and to describe the examined objects according to the real facts in the field by using interviewees as the source of data. The data is presented using primary and secondary data through in-depth interview, documentation of activities, references related to the research, and data from the internet. The data analysis procedure used is qualitative data with interactive model from Metthew B. Miles and Michael Huberman. The results show that the public relations activities performed by the public relations team of the Ministry of Social Services in spreading the information include the following steps: 1) planning and decision-making in spreading the information of the E-Warong Program; 2) informing and performing the information spreading of E-Warong Program; 3) evaluating the performed information-spreading activity of E-Warong Program. Less appropriate selection of the communication channel for target audiences can be an obstacle faced during the means of information spreading of the E-Warong Program. In the end, the information spreading activity performed by the Ministry of Social Services ran well enough even though there were some flaws in the execution.
