Penelitian bertujuan untuk mengathui Efektivitas Peraturan Komisi Pemilihan Umum Nomor 15 Tahun 2018 Tentang Norma, Standar, Prosedur, Kebutuhan Pengadaan Dan Pendistribusian, Perlengkapan Penyelenggaraan Pemilihan Umum, pada Pemilu Serentak Tahun 2019 di Provinsi Sulawesi Selatan. Tipe penelitian yang digunakan yakni perpaduan tipe penelitian hukum normatif (doktrinal) dan tipe penelitian hukum empiris (nondoktrinal). Hasil Penelitian yakni: Bahwa pelaksanaan Peraturan Komisi Pemilihan Umum Nomor 15 Tahun 2018  Tentang Norma, Standar, Prosedur, Kebutuhan Pengadaan Dan Pendistribusian, Perlengkapan Penyelenggaraan Pemilihan Umum, pada Pemilu Serentak Tahun 2019 di Provinsi Sulawesi Selatan, belum terlaksana secara efektif. Adapun faktor-faktor yang berpengaruh terhadap pelaksanaan Peraturan Komisi Pemilihan Umum Nomor 15 Tahun 2018, yakni faktor substansi Hukum, struktur hukum, budaya hukum, kesadaran hukum masyarakat dan faktor sarana dan prasarana. This study aims to determine the effectiveness of Election Commission Regulation Number 15 of 2018 concerning Norms, Standards, Procedures, Procurement and Distribution Needs, Equipment for Conducting General Elections, in 2019 Concurrent Elections in South Sulawesi Province. The type of research used is a combination of normative (doctrinal) legal research and empirical (nondoctrinal) legal research types. Research Results namely: That the implementation of Election Commission Regulation Number 15 of 2018 Concerning Norms, Standards, Procedures, Procurement and Distribution Needs, Equipment for Conducting General Elections, in the 2019 Concurrent Elections in South Sulawesi Province, has not been implemented effectively. The factors that influence the implementation of the Election Commission Regulation Number 15 Year 2018, namely the substance of the Law, legal structure, legal culture, legal awareness of the community and factors of facilities and infrastructure.

<p>Abstract<br />The purpose aims to find out the form of legal protection to the parties and the problematic that facing  by Financial Services Authority to provide effort of legal protection for the parties in the service of equity crowdfunding. This legal research is a descriptive empirical law research. The research location is  Financial Services Authority Surakarta. The research types and source of data include primary and  secondary data with using by a qualitative analysis technique. A failed general election will result in a re-election and will certainly require additional budget. The purpose of this research is to find out the mechanism for the implementation of the re-election and to analyze the use of the State Revenue and Expenditure Budget in the implementation of the re-election. The research method used is normative legal research with a statutory approach and a conceptual approach. The results of this study indicate that the mechanism for implementing the re-election is a dispute over the results of the disputed General Election, by presidential candidates and members of the legislative candidates through the Constitutional Court decision. The mechanism for the provision of funds from the State Revenue and Expenditure Budget in the implementation of the re-General Election is the submission of additional costs by the General Election Commission to the Budget Institution and the Budget Department to revise the budget for the implementation of General Elections that are undergoing re-election.

In welcoming 2019 concurrent general elections, the General Election Commission issued PKPU No. 20 of 2018, one of which banned former convicts of corruption from becoming legislative candidates on the grounds that corruption is an extraordinary offense that is commonly practiced by legislators both individually and in congregation. The regulation is stated in Article 4 paragraph (3) PKPU No. 20 of 2018 concerning Nominations for Members of DPR, Provincial DPRD and Regency / City DPRD. However, the regulation was canceled with the issuance of Supreme Court decision No. 46 P / HUM / 2018. Based on this, the limitation of the problem of this research is how to measure the aspects of the legal objectives behind the decision No. 46 P / HUM / 2018 which are more pro-corrupt so that they can understand the judge's decidendi ratio in canceling the prohibition of ex-convicts from becoming legislators. This type of research is normative legal research with a statutory approach and conceptual approach. The theoretical basis in the presentation of research results is the theory of legal goals by Gustav Radbruch namely justice, certainty and usefulness which is compared with Islamic law. The results of this study indicate that the Supreme Court's consideration overturned PKPU No. 20 of 2018 because it is considered contrary to Article 240 of Law No. 7 of 2017 concerning General Elections and Article 12 of Law No. 12 of 2011 concerning Formation of Laws and Regulations. The Supreme Court's considerations in the a quo ruling contain the three legal objectives. However, it is more inclined to legal certainty, so it does not reflect the value of justice that lives in the community. The cause of not achieving the values of justice that live in the community in the a quo decision is because the basis for testing the regulation is Law No. 7 of 2017 concerning General Elections does not prohibit such matters, even though the nomination rules on the executive body namely the President and Vice President require that they do not have a bad track record. Likewise when viewed from Islamic law which requires legislative candidates called ahlul ahli wal aqdi must have a fair way which means having integrity and a good image in the society.

Abstract In the hands of some Muslims who make religion an ideology, sharia must be realized in real life in society through political instruments that can provide force. However, in their struggle, some of them use only one interpretation and one model, so it is difficult to be compromised. Base on assumption that there is more than one model, this research aims to formulate :1) some models of transformation of Islamic law into national law, 2) the problems 3) alternative concepts of solutions, and 4) the impact of any policy taken by the state. This research is a kind of non-doctrinal qualitative legal research. Data was obtained from the books or literature and it is analyzed to see the correlation between legal substance, legal structure and legal culture. This study concluded that without being Islamic state, there many models that can be used by Indonesian Muslims in transforming or practicing sharia.   Keywords: Islamic state, politics, religion, secular state

Penelitian ini bertujuan untuk mengkaji dan menganalisis dan memahami mengenai Pelaksanaan Kerjasama kemitraan antara Kantor Wilayah Kementerian Hukum dan Hak Asasi Manusia Sulawesi Selatan dengan Organisasi Bantuan Hukum dalam pemberian bantuan hukum bagi masyarakat miskin atau tidak mampu  di wilayah provinsi Sulawesi Selatan. Untuk mengetahui kendala yang dihadapi Organisasi Bantuan Hukum dalam Pelaksanaan bantuan hukum bagi masyarakat miskin atau tidak mampu. Penelitian hukum ini adalah penelitian hukum empiris, yang mengkaji mengenai bantuan hukum bagi masyarakat miskin demi terselenggaranya proses hukum yang adil di Makassar. Untuk mendapatkan hasil penelitian yang dapat dipertanggung jawabkan maka penelitian ini mengambil data dari Kantor Kanwil Wilayah Kementerian Hukum dan HAM Sulawesi Selatan, Rutan Kelas I Makassar dan LBH Makassar merupakan lokasi penelitian yang akan digunakan peneliti untuk mandapatkan bebrapa data terkait bantuan hukum di makassar pada khususnya. Pelaksanaan Program Kerjasama antara Kantor Wilayah Kementerian Hukum dan Hak Asasi Manusia Sulawesi Selatan dengan Organisasi Bantuan Hukum dalam pemberian bantuan hukum bagi masyarakat miskin di wilayah Sulawesi Selatan sudah berjalan dengan baik namun masih kurang efektif karena dalam pelaksanaannya masih ditemukan Organisasi Bantuan Hukum yang melaksanakan tugasnya namun tidak sesuai standar pemberian bantuan hukum. This research aims to study, analyze, and understand the implementation of partnership cooperation between the Regional Office of the Ministry of Law and Human Rights of South Sulawesi and the Legal Aid Organization in providing legal assistance for the poor or underprivileged in the province of South Sulawesi. This is to find out the obstacles faced by legal aid organizations in implementing legal aid for the poor or underprivileged. This legal research is an empirical legal research, which examines legal assistance for the poor for the sake of implementing a fair legal process in Makassar. To obtain accountable research results, this study collects data from the Regional Office of the Ministry of Law and Human Rights of South Sulawesi, Prison Class I Makassar and LBH Makassar as research locations to obtain some data related to legal aid in Makassar particularly. The implementation of the Cooperation Program between the Regional Office of the Ministry of Law and Human Rights of South Sulawesi and the Legal Aid Organization in providing legal assistance to the poor in the South Sulawesi region has been running well but this is still ineffective because in its implementation there are still legal aid organizations that do not comply with the standards of legal assistance when carrying out their duties.

Ditenggarai lemahnya penegakan hukum terhadap pelanggaran politik uang yang terjadi pada Pemilu 2019 menjadi isu yang mengemuka, termasuk di Kabupaten Polewali Mandar. Peran pengawasan, penegakan dan penindakan, sebagaimana yang diatur dalam Undang-undang Nomor Nomor 7 tahun 2017 tentang Pemilihan Umum dan Peraturan Bawaslu Peraturan Bawaslu Nomor 31 Tahun 2018 tentang Sentra Penegakan Hukum Terpadu (Gakkumdu) memuat sejumlah ketentuan yang mengatur mekanisme dan tata cara penegakan hukum terhadap pelanggaran politik uang tersebut. Metode yang digunakan dalam penelitian ini adalah, penelitian empiris yang mengkaji regulasi atau peraturan perundang-undangan dalam praktik penegakan hukum terhadap dugaan pelanggaran politik uang pada penyelenggaraan Pemilu Tahun 2019. Kesimpulan penelitian menunjukkan bahwa, terdapat 3 (tiga) kasus dugaan pelanggaran politik uang pada Pemilu Tahun 2019 di Kabupaten Polewali Mandar yang semestinya melewati 9 (sembilan) tahapan dalam kenyataannya hanya sampai pada tahapan ketiga yakni, rapat pleno pengawas Pemilu. Hal itu dikarenakan adanya ketidak sepahaman di dalam tim Sentra Gakkumdu dengan Bawaslu Kabupaten Polewali Mandar. Adapun kendala dalam penengakan hukum terhadap dugaan pidana politik uang sangat terkait dengan struktur hukum, substansi hukum dan budaya hukum sebagaimana fakta dan temuan lapangan. Karenanya, penelitian ini merekomendasikan, ke depan pidana Pemilu tidak lagi ditangani oleh Bawaslu, tetapi dimasukkan sebagai pidana umum. Dan jika sentra Gakkumdu tetap dipertahankan keberadaannya, hendaknya diberi kewenangan tambahan yakni, melakukan penahanan terhadap terduga pelaku politik uang, agar tidak terbuka ruang mengkodisikan saksi dugaan politik uang. Termasuk pentingnya pembentukan peradilan khusus Pemilu agar perbedaan pandangan atas kasus dugaan politik uang dapat diminimalisir. The indication of the weak law enforcement against money politics violations that occurred in the 2019 Election has become an emerging issue, including in Polewali Mandar Regency. The role of supervision and enforcement, as regulated in Law Number 7 of 2017 concerning General Elections and Bawaslu Regulation Number 31 of 2018 concerning Sentra Penegakan Hukum Terpadu (Gakkumdu) contains a number of provisions governing the mechanisms and procedures for law enforcement against such violations of money politics. The method used in this research is empirical research that examines regulations or statutory regulations in law enforcement practices against suspected violations of money politics at the 2019 Election. The research conclusion shows that, there were 3 (three) cases of alleged violations of money politics in the 2019 Election in Polewali Mandar Regency which should have passed 9 (nine) stages but in reality only reached the third stage, namely, the Election supervisor plenary meeting. It was due to the lack of Understanding on the Sentra Gakkumdu with Bawaslu Polewali Mandar. The obstacles in law enforcement against allegations of money politics crime are closely related to the legal structure, legal substance and legal culture as well as facts and field findings. Therefore, this research recommends that in the future election crimes will no longer be handled by Bawaslu, but be included as general crimes. And if the Sentra Gakkumdu is maintained, it should be given additional authority, namely, detaining suspected money politics actors, so that there is no room to codify witnesses for alleged money politics. This includes the importance of establishing a special election court so that differences in views on suspected cases of money politics can be minimized.

Moral crime or moral harassment and sexual harassment are two forms of violation of morality which are not only a national legal problem of a country, but already a legal problem of all countries in the world or a global problem. The research method used by the author is a type of normative legal research with the legislation approach and concept approach. The goal to be achieved is to realize optimal legal protection for child victims of sexual abuse, which has many problems. The results showed that legal protection for child victims of sexual abuse was carried out by providing legal assistance and rehabilitation. The implementation of legal protection is still constrained by the substance of the law; legal structure, legal culture, facilities and infrastructure. A clear and comprehensive regulation on the protection of children which in essence aims to provide guarantees and protect their rights so that they can live, grow, develop and participate, optimally, and obtain protection from violence and discrimination.Keywords : Legal Protection, Children, Sexual Harassment

Election or local election is a way of channeling the rights of every principle community, which means that the right to vote and vote is contained in his constitutional rights as citizens. In article 28 letter D of the Republic of Indonesia Republic of 1945 which reads that "every citizen has the right to have the same opportunity in government". The sound contained in the article contains the understanding that the State guarantees each of its citizens to obtain the rights to sit in government either as People's Representatives, regents, Mayors, Governors, or even become a President. The method used in this study is normative juridical legal research which uses a statutory approach. The issue raised by the author is How the Human Rights Perspective of Legislative Candidates in Organizing Elections and How Comparative Legal Arrangements for Former Legislative Candidates Examined From Law Number 7 of 2017 Concerning General Elections With Regulation of the Election Commission Number 20 of 2018 Regarding Nominating Members Regional Representative Council, Provincial Regional Representative Council, Regency / City Representative Council. In terms of the implementation of elections need to be held honestly, fairly and democratically based on the spirit of Democracy that has been carried out so far so as to create leaders and representatives of the people who side with their people. Speaking of Human Rights, everyone has the same rights before the State and applies to former corruption convicts who have or have the same political rights as other citizens guaranteed by the constitution.

Intellectual Property Rights (IPR) is one of movable objects that can be represented according to waqf regulation (Undang-Undang No. 41 Tahun 2004 Tentang Wakaf). The previous regulations did not mention IPR as waqf object. IPR becomes waqf object because there is a shift of  paradigm on productive waqf. However, the waqf regulation (Undang-Undang No. 41 Tahun 2004 Tentang Wakaf) has many juridical problems. For example, there is no specific explanation about IPR waqf as well as money waqf. Besides, the IPR practice is very rare due to unclear forms of IPR waqf. Juridical problems on IPR waqf are related to legal substance, legal structure and legal culture. On legal substance, there is no clear explanation and mechanism of IPR waqf. On legal structure, there is no clear explanations about who can be the wakif or nazir on IPR waqf. On legal culture, many people are still unfamiliar with intangible waqf object (the conventional waqf object is land). Therefore, the acceptance of an intangible object such as IPR as a waqf object is very low.

The most important part in a Book of Criminal Law (Penal Code) is a prison, because the prison contains rules about the size and implementation of the criminal. The position of life imprisonment in the national criminal justice system is still considered relevant as a means of crime prevention, it can be seen from the number of offenses punishable with life imprisonment. However, life imprisonment is considered contrary to the penal system. This study aims to investigate the implementation of life imprisonment, weaknesses, and the solution in the future. The approach used in the study is a non-doctrinal legal research with socio-legal research types (Juridical Sociological).The results of research studies show that life imprisonment is contrary to prison system, and life imprisonment become an obstacle to fostering convicts back into society. Bill Criminal Code of September 2019 can be used as a solution to life imprisonment change in the future. Presented advice, in order to be disseminated to the application of the criminal purpose of the Criminal Code of Prison adopted in the future, so that the public and experts no longer make the criminal as a form of retaliation.Keywords: Reconstruction; Crime; Prison; Life Imprisonment; System; Corrections.
