Waqf is an Islamic institution that has its foundations in Islamic legal sources: the Qur'an and the Sunnah. The norms on which waqf rests are established through the process of creation and interpretation of Islamic law by relevant Muslim jurists who set the waqf standards. Waqf played an invaluable role in the development of Muslim society and economy in the territory of the Republic of North Macedonia. In many historical periods, when different state systems in this region were in crisis, the Waqfis took the initiative and supplemented the weaknesses and weakness of the state. This was evident in the fields of religion, education, culture, health, social, economic affairs, etc. It is well known that, under repressive measures in past sociopolitical systems, the Waqf property was confiscated, nationalized and destroyed in various ways. During the reign of the Austro-Hungarian Monarchy, the Kingdom of the SKS, the Yugoslav Kingdom and the former Socialist Federal Republic of Yugoslavia, over 95% of vacant property was confiscated, nationalized and destroyed in various ways. Throughout history, the waqf has been in the service of Muslims, always maintaining their basic charity and human purpose, their return, on the one hand, will strengthen the context of the rule of law, while on the other, it will promote the positive development of the religious educational and cultural processes of the Islamic community, and will at the service of the population and society. The maximum commitment of the Islamsle community administration in the context of reclaiming waqf property is a good example of both legal and social commitment to alleviate the injustice done to this institution in the previous system.

The author of the article analyzes the specificities of the normative control of the law, i.e. the procedure of assessing the constitutionality and legality of the law in the Republic of Serbia, with the aim of detecting historical and legal preconditions of the effective functioning of the rule of law. The historical perspective of the development of the constitutional judiciary in the Socialist Federal Republic of Yugoslavia and the Republic of Serbia, as well as the analysis of the experiences of various systems of control of constitutionality and legality, open the contextual, scientific-historical and pragmatic dimensions of understanding. The specificity of the system of normative control is reflected in its triplicity, meaning that three institutes are known that characterize different procedural possibilities (to initiate the process of assessing the constitutionality and legality of general acts). The paper is written in order to point out the dichotomy of the proposal and initiative of the procedure of the assessment of constitutionality and legality, as well as the advantages and disadvantages of the ex officio procedure. Furthermore, the author wanted to point out the essential and procedural differences between the proposal, the initiative and the constitutional complaint, especially analyzing the purpose of retaining the institute of the initiative in the light of the existence of the constitutional complaint and the fact that the initiative does not imply the automation of the initiation of proceedings. The dilemma that the article opens concerns the possibility that in the case of abolishing the initiative as an institution accessible to all, is it possible to preserve the democratic culture and the participation of citizens, furthermore is it possible to abolish the fundamental institutional values and freedoms of a legal state and the rule of law? The paper opens other issues of importance for the establishment of an effective constitutional architecture that concern: the width of the circle of authorized proposers of normative control before the Constitutional Court; the dual role of the constitutional judiciary: on the one hand protection of the Constitution, constitutionality and legality, on the other hand effective protection of human and minority rights and freedoms.

The Hyundai-inspired interpretation obliges the courts to interpret, where possible, legislation in conformity with the Constitution of the Republic of South Africa 1996. This process involves taking into account the objects and purports of an Act and interpreting its provisions in the manner that complies with the constitutional values. Essentially, it ensures that courts give preference to an interpretation of legislation that is within the parameters of the provisions of the Constitution over the one that is not. However, courts do not apply the Hyundai-inspired interpretation if it cannot be ascribed to the provision of the legislation in question or if it is not reasonably possible for them to do so. Such situations include the Hyundai-inspired interpretation that unduly strains the text, or that obliges the court to read-in too many qualifications. In these situations, the courts have to declare the legislative provision in question unconstitutional and resort to the remedy of reading- in or notional severance. The Hyundai-inspired interpretation is evidenced in quite a number of cases. However, this case note critically dissects the manner in which the Constitutional Court applied it in the case of Democratic Alliance v Speaker of the National Assembly ((CCT86/15) [2016] ZACC 8).It concludes that the manner in which the Constitutional Court applied it, in this case, is inconsistent with the manner in which the Constitutional Court applied it in the case of Abahlali Basemjondolo six years earlier. When interpreting the word “disturbance” which section 1 of the Powers Privileges and Immunities of Parliament and Provincial Legislatures Act (4 of 2004) defined as “any act which interferes with or disrupts or which is likely to interfere with or disrupt the proceedings of Parliament or a House or Committee” and which the High Court had found to be too broad that it had the effect of finding a robust and controversial debate unconstitutional, the Constitutional Court unexpectedly read in too many qualifications to the word “disturbance” in conformity with the Constitution. The reason being, the Constitutional Court, six years earlier, found the approach of reading- in too many qualifications in conformity with the Constitution to be straining the text and to be contrary to the rule of law and the principle of separation of powers in the case of Abahlali Basemjondolo.

The rule of law in the perspective of Pancasila which can be termed the law state of Indonesia or the rule of law state of Pancasila besides having the same elements as the rule of law in the rechtstaat and rule of law, also has specific elements that make the Indonesian law state different from the concept of the state generally known law. The difference locates in the values contained in the Preamble to the 1945 Constitution which contain Pancasila with the principles of the Belief in the one and only God and the absence of separation between the state and religion, the principle of deliberation in the implementation of state government power, the principle of social justice, kinship and mutual cooperation, as well as laws that serve the integrity of the unitary state of Indonesia. The Pancasila Law State concept is characterized by: (1) Close relations between religion and state (2) Stand on the one and only God (3) Freedom of religion in a positive sense (4) Atheism is not justified and communism is forbidden and (5) The principle of kinship and harmony. As for the main elements of the Republic of Indonesia Law State are: (1) Pancasila (2) MPR (3) Constitutional system (4) equality and (5) Free trial.

Article 29 paragraph 1 of the 1945 Constitution of the Republic of Indonesia states that "the State is based on the One Supreme Godhead." This means that the state has given legitimacy to Islamic law as formal law in the Indonesian constitutional system. Islamic law has a great opportunity to be formalized into regulations, because the majority of Indonesians are Muslims. Perda Syariah itself in its journey has shown significant developments. There have been 433 regional regulations issued in Indonesia since 1998, however, these regional regulations with Islamic nuances have generated pro-contra attitudes from various parties. This study uses a qualitative research method with a literature approach. The results of the study state that there are still some parties who feel that regional regulations were born only as political needs that are less effective in their implementation, and others think that sharia regulations are an effort to regulate people's behavior so that they are in accordance with living norms.Keywords: Sharia Regional Regulation; Regional Autonomy; Formalization of Islamic Law Abstrak: Pasal 29 ayat 1 Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 menyatakan bahwa “Negara berdasarkan atas Ketuhanan Yang Maha Esa.” Artinya negara telah memberikan legitimasi hukum Islam sebagai hukum formal dalam sistem ketatanegaraan Indonesia. Hukum Islam memiliki peluang yang besar untuk diformalkan menjadi peraturan, karena mayoritas bangsa Indonesia adalah pemeluk agama Islam. Perda Syariah sendiri dalam perjalanannya telah menunjukkan perkembangan yang signifikan. Telah ada 433 Perda lahir di Indonesia sejak tahun 1998, namun Perda-perda bernuansa Islam tersebut menimbulkan sikap pro-kontra dari berbagai pihak. Penelitian ini menggunakan metode penelitian kualitatif dengan pendekatan literatur. Hasil penelitian menyatakan bahwa masih ada sebagian pihak merasa bahwa Perda lahir hanya sebagai kebutuhan politik yang kurang efektif dalam pelaksanaannya, dan  sebagian lain beranggapan bahwa Perda syariah adalah sebuah upaya untuk menertibkan perilaku masyarakat agar sesuai dengan norma-norma yang hidup.Kata Kunci: Perda Syariah; Otonomi Daerah; Formalisasi Hukum Islam

<p>Dengan adanya Putusan MK No. 34/PUU-XI/2013, untuk upaya hukum luar biasa yaitu peninjauan kembali dapat dilakukan lebih dari satu kali. Putusan MK yang memperbolehkan upaya hukum luar biasa peninjauan kembali lebih dari satu kali tersebut, berkaitan dengan kepastian hukum dan keadilan. Apabila peninjauan kembali diperbolehkan lebih dari satu kali tetapi tidak ada pembatasan sampai berapa kali maka perkara tersebut tidak akan ada akhirnya, bahwa adanya asas litis finiri oportet (setiap perkara harus ada akhirnya) tidak akan terpenuhi. Beberapa permasalahan yang perlu dibahas adalah apakah dengan adanya Putusan MK No. 34/PUU-XI/2013 dapat memenuhi nilai keadilan dan kepastian hukum. Selanjutnya bagaimana pengaturan mengenai peninjauan kembali sebagai implementasi Putusan MK No. 34/PUU- XI/2013 agar asas kepastian hukum dan asas litis finiri oportet akan terpenuhi. Putusan MK No. 34/PUU- XI/2013, yang menyatakan bahwa Pasal 268 ayat (3) Undang-Undang Nomor 8 Tahun 1981 tentang Hukum Acara Pidana bertentangan dengan Undang-Undang Dasar Negara Republik Indonesia tahun 1945 dan tidak mempunyai kekuatan mengikat, dapat memenuhi kepastian hukum tanpa mengabaikan nilai keadilan. Hal ini dapat dilihat dari pihak kepentingan terpidana yang mana dengan diperbolehkannya peninjauan kembali dalam perkara pidana lebih dari satu kali, memberikan kesempatan untuk memperoleh kebenaran materiil dan keadilan sehingga dapat diperoleh kepastian hukum yang berkeadilan bagi terpidana mengenai perkara yang dihadapi. Untuk memenuhi asas litis finiri oportet, perlu dilakukan pengaturan bahwa untuk upaya hukum peninjauan kembali dalam perkara pidana dapat dilakukan dua kali, hal ini dilakukan untuk mencapai kepastian hukum yang berkeadilan. Di satu pihak peninjauan kembali dapat dilakukan lebih dari satu kali untuk mencari kebenaran materiil dan memenuhi nilai keadilan. Di lain pihak adanya pembatasan permohonan peninjauan kembali yang boleh dilakukan dua kali adalah untuk menjamin kepastian hukum, sehingga nilai kemanfaatan, keadilan dan kepastian hukum dapat terpenuhi.</p><p>With the Constitutional Court No. 34 / PUU-XI / 2013, for an extraordinary legal remedy which reconsideration can be done more than once. If allowed to review more than one time but there are no restrictions on how many times it is the case there will be no end, that the principle of litis finiri oportet (every case there should be eventually) will not be met. Some issues that need to be addressed is whether the Constitutional Court No. 34 / PUU-XI / 2013 can satisfy the value of justice and legal certainty. Furthermore, how the arrangements regarding the review of the implementation of the Constitutional Court as No. 34 / PUU-X / 2013 that the principle of legal certainty and the principle of litis finiri oportet will be met. Constitutional Court decision No. 34 / PUU-XI / 2013, which states that Article 268 paragraph (3) of Law No. 8 of 1981 on Criminal Procedure is contrary to the Constitution of the Republic of Indonesia in 1945 and has no binding force, can meet the legal certainty without ignoring the value of justice. It can be seen from the interests of the convict which the permissibility of judicial review in criminal cases more than once, providing an opportunity to acquire the material truth and justice so as to obtain legal certainty to convict justice regarding the case at hand. To meet the principle of litis finiri oportet, it is necessary that the arrangements for legal remedy reconsideration in criminal cases can be done twice, this is done to achieve a just rule of law. On the one hand, the review can be performed more than once to search for the material truth and fulfill justice values. On the other hand the restrictions on the reconsideration request should be done twice is to ensure legal certainty, so that the value of expediency, justice and the rule of law can be fulfilled.</p>

This paper addresses, from a comparative perspective, the legal position of the lay employees of religious institutions such as schools and hospitals. The legal regimes governing ‘ethos’ in the Republic of Ireland, Northern Ireland and Britain are compared. The tension which exists between the right of religious schools and hospitals to uphold their ethos in a secular society on the one hand, and the rights of their employees to privacy and personal autonomy on the other, is highlighted. It will be argued that legislative reform is required to remove uncertainty from the lives of lay employees of religious institutions who work conscientiously but fear dismissal or discrimination because an aspect of their lifestyle – usually their sexuality – is considered unorthodox by their employer. The need for a change in judicial attitudes and a lessening of deference towards the actions of religious denominations is also a theme throughout.

Abstrak: Hukum Islam di Negara Pancasila. Menurut al-Mâwardî dan Ibn Taymiyyah, konsep asal penerapan hukum Islam terletak pada kemestian adanya negara Islam. Tetapi, kenyataannya konsep negara Islam itu sendiri bervariasi dari waktu ke waktu. Maka, konsep yang final dan nyata tidaklah jelas wujudnya. Dengan kata lain, dapat dikatakan bahwa dalam praktiknya hukum Islam dapat diterapkan di manapun selaras dengan konteks sosio-kultural serta perkembangan dan kemajuan. Republik Indonesia adalah contoh yang baik bagaimana hukum Islam dapat diterapkan. Meski negara secara esensial tetap dalam kondisi sekuler, ide tentang penerapan syariah tidaklah secara ekstrem dilarang. Yang perlu dicatat adalah ide tersebut haruslah diperdebatkan dalam ranah publik, sehingga secara alamiah diketahui bahwa negara Pancasila memiliki batasnya sendiri untuk dapat mengakomodasi syariah di satu pihak, dan di pihak lain syariah sendiri merasakan keperluan adanya batasan tersebut dengan memperhatikan konteks Indonesia.Kata Kunci: Pancasila, khilâfah, sekuler, perdebatanAbstract: Islamic Law in the Pancasila State. According to al-Mâwardî and Ibn Taymiyyah the original concept of applying Islamic law lies on the existence of Islamic state. But, the concept of the Islamic state varies from time to time. Thus, the final and real concept always remains unclear. It can be said that in practical sense, Islamic law can be implemented anywhere in accordance with the socio-cultural context and its progress and development. The Republic of Indonesia is a good example of how shariah can be applied. Despite the State remaining relatively secular, in essence, the idea of the application of shariah is not strictly excluded. The study was conducted to find out Compilation of Islamic Law governing the distribution of joint property, the application of the principle of partnership and the legal considerations of judges in the Supreme Court Decision of the Republic of Indonesia on Case Number 266K/AG/2010 in terms of the Compilation of Islamic Law against husband doesn’t provide for his children and his wife. This research uses normative juridical research methods that use secondary data consisting of primary, secondary, and tertiary legal materials with descriptive analysis and data collection tools are carried out by library research supported by data obtained through field research at Bantul Religious Courts. The results of this research is known that the regulation regarding the distribution of joint property to husbands who do not provide for their children and wives is not detailed in the Compilation of Islamic Law. This partnership causes the position of husband and wife to be the same in some respects, in other respects to be different, the husband becomes the head of the family, the wife becomes the head in charge of household regulation, each has a role, position, rights, obligations, and responsibilities, all of which complement and perfect each other, every role has rights and every position has obligations, whoever has more obligations or who bears greater obligations, he is the one who has more rights than the others. The judge to resolve the conflict must be able to resolve it objectively based on the applicable law, determine the facts in the trial including the relevant facts and the choice of which legal rules will be used as the basis for resolving the case.

The Ombudsman as an external oversight body for official performance, in Fikih Siyasah (constitutionality in Islam) is included in the supervision stipulated in legislation (al-musahabah al-qomariyah). Supervision is done so that public service delivery to the community is in accordance with the rights of the community. This is done because in carrying out its duties, officials are very likely to conduct mal administration, which is bad public services that cause harm to the community. The Ombudsman is an institution authorized to resolve the mal administration issue, in which one of its products is by issuing a recommendation. Although Law No. 37 of 2018 on the Ombudsman of the Republic of Indonesia states that the recommendation is mandatory, theombudsman's recommendations have not been implemented. This is due to differences in point of view, ie on the one hand in the context of law enforcement, but on the other hand the implementation of the recommendation is considered as a means of opening the disgrace of officials. Recommendations are the last alternative of Ombudsman's efforts to resolve the mal administration case, given that a win-win solution is the goal, then mediation becomes the main effort. This is in accordance with the condition of the Muslim majority of Indonesian nation and prioritizes deliberation in resolving dispute. Therefore, it is necessary to educate the community and officials related to the implementation of the Ombudsman's recommendations in order to provide good public services for the community, which is the obligation of the government.

Subject .This article discusses the need to bring into line with the future activities of specialists the content of their preparation, the formation of a system model of higher education, which takes into account today's and prospective requirements of the labor market. Objectives. The article aims to research the labor market in four regions of the Volga Federal District of the Russian Federation: the Republic of Tatarstan, Mari El Republic, Chuvash Republic, and the Ulyanovsk oblast, as well as discuss problems and prospects of interaction of universities with enterprises and organizations of these regions. Methods. For the study, I used the methods of logical and statistical analyses, and in-depth expert survey. Results. The article analyzes the state of regional labor markets, presents the results of the expert survey of labor market representatives and heads of the regional education system, and it defines possible ways of harmonizing the interaction of universities with the labor market. Conclusions. The article notes that although the number of employed with higher education is growing, at the same time there is a shortage of highly qualified personnel in certain professions, on the one hand, and unskilled workers, on the other. Also, the article says that the universities do not prepare the necessary for the regions specialists in a number of professions or they provide a set of competencies different from the requirements of the labor market, so it is necessary to form and develop effective directions of cooperation between educational institutions and employers.
