ResumoTomando como ponto de partida a noção de burocracia no campo do marxismo tem-se como tema central deste artigo a apresentação e análise da legislação educacional brasileira como forma de compreensão até mesmo do lugar da História neste cenário, além do entendimento do currículo desta disciplina no ensino básico. A hipótese que se pretende sustentar aponta para a centralidade das alterações constantes em benefício dos interesses das frações burguesas que têm influência no aparelho burocrático do Estado, neste caso, no aparelho burocrático educacional, sobretudo por meio da alteração da noção de planos de Estado para planos de governo.Palavras-Chave: Educação; Ensino de História; Burocracia; Legislação. AbstractTaking as a starting point the notion of bureaucracy in the Marxism, the central theme of this article is the presentation and analysis of Brazilian educational legislation as a way of understanding the place of history in this scenario, in addition for understanding the curriculum of this discipline in basic education. The hypothesis that we intend to support points to the centrality of the constant changes in favor of the interests of the bourgeois fractions that have an influence on the bureaucratic apparatus of the State, in this case, on the educational bureaucratic apparatus, mainly by changing the notion of State plans to plans of government.Key-Words: Education; History teaching; Bureaucracy; Legislation.

Este estudo objetiva investigar de que forma os programas de Educação Ambiental apresentados à Administração Estadual de Meio Ambiente de Sergipe, em Estudos de impacto, adequam-se à legislação educacional, nomeadamente às Diretrizes Curriculares Nacionais para a Educação Ambiental. Trata-se de uma pesquisa exploratório-descritiva, de caráter qualitativo, que utilizou como procedimentos para coleta de dados o levantamento bibliográfico e o levantamento documental numa perspectiva comparada através da técnica de Análise de conteúdo. Com base no estudo realizado, verificou-se que os Programas de Educação Ambiental apresentados em Estudos de impacto propõem atividades em instituições de ensino, não restringindo seu público-alvo aos discentes; a metodologia foi estruturada sem se considerar a faixa etária dos sujeitos, bem como as Diretrizes curriculares para a Educação Ambiental e para a Educação básica. This study aims to investigate how the policies for Environmental Education sent to the State Government for Environment of Sergipe in the Impact studies are fit to the educational legislation, namely in the National curricular guidelines for Environmental Education. It is an exploratory and descriptive research of qualitative character, which used as procedures for data collection bibliographic survey and documentary survey in a comparative perspective through the technique of Content analysis. Based on the study carried out, it was verified that the policies for Environmental Education presented in the Impact studies have proposed activities in educational institutions, not restricting their target audience only to the students. Besides, the methodology was structured without considering the age group of the subjects, as well as the Curricular guidelines for Environmental Education and Basic education (an official document that normalizes this kind of education in Brazil). Este estudio tiene como objetivo investigar de qué forma los programas de Educación Ambiental presentados a la Administración Estatal del Medio Ambiente de Sergipe, en Estudios de impacto, se adecuan a la legislación educativa, en particular a las Directrices curriculares nacionales para la Educación Ambiental. Se trata de una investigación exploratória y descriptiva, de carácter cualitativo, que utilizó como procedimientos para recolección de datos el levantamiento bibliográfico y el levantamiento documental en una perspectiva comparada a través de la técnica de Análisis de Contenido. Con base en el estudio realizado, se verificó que los Programas de Educación Ambiental presentados en Estudios de impacto han propuesto actividades en instituciones de enseñanza, no restringiendo su público objetivo solamente a los discentes; además, la metodología ha sido estructurada sin considerar la franja etária (de edad) de los sujetos, así como las Directrices curriculares para la Educación Ambiental y la Educación básica (documento oficial que orienta esta área da educación en Brasil).

‘Accountability’ is one of the democratic values entrenched in the Constitution of South Africa, 1996. It is a value recognised throughout the Constitution and imposed upon the law-making organs of state, the Executive, the Judiciary and all public functionaries. This constitutional imperative is given pride of place among the other founding values: equality before the law, the rule of law and the supremacy of the Constitution. This study therefore sets out to investigate how the courts have grappled with the interpretation and application of the principle of accountability, the starting point being the relationship between accountability and judicial review. Therefore, in the exercise of its judicial review power, a court may enquire whether the failure of a public functionary to comply with a constitutional duty of accountability renders the decision made illegal, irrational or unreasonable. One of the many facets of the principle of accountability upon which this article dwells is to ascertain how the courts have deployed that expression in making the state and its agencies liable for the delictual wrongs committed against an individual in vindication of a breach of the individual’s constitutional right in the course of performing a public duty. Here, accountability and breach of public duty; the liability of the state for detaining illegal immigrants contrary to the prescripts of the law; the vicarious liability of the state for the criminal acts of the police and other law-enforcement officers (as in police rape cases and misuse of official firearms by police officers), and the liability of the state for delictual conduct in the context of public procurement are discussed. Having carefully analysed the available case law, this article concludes that no public functionary can brush aside the duty of accountability wherever it is imposed without being in breach of a vital constitutional mandate. Further, it is the constitutional duty of the courts, when called upon, to declare such act or conduct an infringement of the Constitution.

Despite the recent enactment of the Zimbabwean Constitution which provides for the right to basic education, complaints, reminiscent of a failed basic education system, have marred the education system in Zimbabwe. Notwithstanding glaring violations of the right to basic education by the government, no person has taken the government to court for failure to comply with its section 75(1)(a) constitutional obligations, and neither has the government conceded any failures or wrongdoings. Two ultimate questions arise: Does the state know what compliance with section 75(1)(a) entails? And do the citizens know the scope and content of their rights as provided for by section 75(1)(a) of the Constitution of Zimbabwe? Whilst it is progressive that the Education Act of Zimbabwe as amended in 2020 has addressed some aspects relating to section 75(1)(a) of the Constitution, it has still not provided an international law compliant scope and content of the right to basic education neither have any clarifications been provided by the courts. Using an international law approach, this article suggests what the scope and content of section 75(1)(a) might be.

This paper deals with the right to property in general terms from its source in Roman law, which is the starting point for all subsequent legal systems. As a result of this, the acquisition of property rights is handled from the historical point of view, with the inclusion of various local and international literature and studies, as well as the legal aspect devoted to the respective civil codes of the states cited in the paper.Due to such socio-economic developments, state ownership and its ownership function have changed. The state function as owner of property also changed in Macedonia's property law.The new constitutional sequence of the Republic of Macedonia since 1991 became privately owned as a dominant form of ownership, however, state ownership also exists.This process of transforming social property into state or private (dissolves), in Macedonia starts from Yugoslavia through privatization, return and denationalization measures, on which basis laws on privatization have been adopted. Because of this, there will be particularly intensive negotiations regaring the remaining state assets.

States are commonly blamed for wars, called on to apologize, held liable for debts and reparations, bound by treaties, and punished with sanctions. But what does it mean to hold a state responsible as opposed to a government, a nation, or an individual leader? Under what circumstances should we assign responsibility to states rather than individuals? This book demystifies the phenomenon of state responsibility and explains why it is a challenging yet indispensable part of modern politics. Taking Thomas Hobbes' theory of the state as a starting point, the book presents a theory of state responsibility that sheds new light on sovereign debt, historical reparations, treaty obligations, and economic sanctions. Along the way, it overturns longstanding interpretations of Hobbes' political thought, explores how new technologies will alter the practice of state responsibility as we know it, and develops new accounts of political authority, representation, and legitimacy. The book argues that Hobbes' idea of the state offers a far richer and more realistic conception of state responsibility than the theories prevalent today and demonstrates that Hobbes' Leviathan is much more than an anthropomorphic “artificial man.” The book is essential reading for political theorists, scholars of international relations, international lawyers, and philosophers. It recovers a forgotten understanding of state personality in Hobbes' thought and shows how to apply it to the world of imperfect states in which we live.

Este artigo tem como objetivo discutir a importância da utilização de impressos operários enquanto fonte para as pesquisas em história da educação, analisando alguns debates e ideias educacionais presentes em dois jornais operários de origem associativa: O Labor, da Confederação Auxiliadora dos Operários, e O Confederal, do Centro Confederativo dos Operários. As associações responsáveis pelos periódicos foram constituídas nos primeiros anos de existência de Belo Horizonte, cidade construída para sediar a nova capital do Estado de Minas Gerais. Os impressos operários, por sua vez, são entendidos em suas particularidades tendo-se em vista as suas características, os quais divulgavam algumas ideias e debates, como os referentes ao campo educacional. A partir da análise dos jornais foi apurada a existência de demandas e propostas por educação para todas as classes sociais, visto que o ensino em Belo Horizonte não era ofertado a todos, ou se era oferecido, não alcançava as classes sociais menos favorecidas.The working class press and the History of Education: an analysis of the contributions of the newspapers The Labor and The Confederal to the History of Education in the initial years of Belo Horizonte. This article aims to discuss the importance of the use of working class press as a source for research in the history of education, analyzing some debates and educational ideas present in two workers' newspapers of associative origin: The Labor, of the Auxiliary Confederation of Workers, and The Confederal, of the Confederative Center for Workers. The associations responsible for the periodicals were constituted in the first years of existence of Belo Horizonte, city built to host the new capital of the State of Minas Gerais. The working class periodicals, in turn, are understood in their particularities in view of their characteristics, which disseminated some ideas and debates, such as those concerning the educational field. From the analysis of the newspapers, the existence of demands and proposals for education for all social classes was verified, whereas the education in Belo Horizonte was not offered to all, or if it was offered, it did not reach the less favored social classes. AbstractThe Internet and especially social media are not only used for supposedly good purposes. For example, the recruitment of new members and the dissemination of ideologies of terrorism also takes place in the media. However, the fight against terrorism also makes use of the same tools. The type of these countermeasures, as well as the methods, are covered in this work. In the first part, the state of the art is summarized. The second part presents an explorative empirical study of the fight against terrorism in social media, especially on Twitter. Different, preferably characteristic forms are structured within the scope with the example of Twitter. The aim of this work is to approach this highly relevant subject with the goal of peace, safety and safety from the perspective of information systems. Moreover, it should serve following researches in this field as basis and starting point.

Objective: To evaluate the epidemiological profile and the operative complications of patients undergoing gynecological operations for benign diseases in a tertiary public hospital in the state of Roraima, Brazil. Methods: We conducted a retrospective survey through the analysis of 518 records of patients submitted to gynecological operations between January and June 2012. We included the three major operations during this period (n = 175): hysterectomy, colpoperineoplasty and suburethral sling placement. We excluded 236 cases of tubal ligation and 25 cases where it was not possible to access to medical records. Results: The mean age was 47.6 years; the education level of most patients was completed junior high (36.6%); 77% were from the State capital, 47.4% were in stable relationships and 26.3% were housewives. The majority of patients had given birth three or more times (86.6%), with previous vaginal delivery in 50.2%, and cesarean delivery, 21%. The main diagnostic indications for surgical treatment were uterine myoma (46.3%), urinary incontinence (27.4%) and genital dystopias (17.7%). We found three cases (1.7%) of high-grade intraepithelial lesions on Pap smear. The most common procedure was total hysterectomy (19.8%), 15.5% vaginally. The most common complication was wound infection (2.2%). Conclusion: Women undergoing gynecological operations due to benign disease had a mean age of 47 years, most had levels of basic education, came from the capital, were in stable relationships, predominantly housewives, multiparous and showed low operative complication rates.

The objective of this research is to know new decisions about the teaching and learning process in the context of the pandemic in the state of Amazonas, Brazil. The pandemic suspended classroom classes at more than 200 schools, causing the reorganization of pedagogical practices in distance education. The result was the applicability of the Special Regime of Non-Attendance Classes adopted by the Government of Amazonas (Aula em Casa Project). It is concluded that new directions can be taken from formal education in view of this new reality.

<p>The article analyses the importance of an active role of the state in achieving the Sustainable Development Goals. Its starting point is that despite the fact that today there is a growing recognition in the world that for the implementation of sustainable development an active role of the state and local self-governing communities is indispensable and despite the fact that in Slovenia such a role of the state in implementing sustainable development stems from its Constitution, so far, too little has been done in Slovenia to achieve the Sustainable Development Goals. The purpose of this article is to analyse theoretical arguments and the Constitution in order to show the need for an active role of the state in implementing sustainable development goals, and also to discuss basic steps to be implemented in order to achieve an active role of the state in Slovenia. In this article comparative and analytical methods were used in studying the literature and regulation. The article, based on theoretical arguments and the constitutional analysis, identifies the need for an active role of the state in implementing sustainable development goals, and proposes arguments for it and also basic steps toward an active role of the state. The discussed topic is new and this article contributes to the field some fundamental arguments for the active role of state and for the more comprehensive policy-making. The article offers theoretical and constitutional arguments to be implemented in order to transform the present role of the state from a passive one into an active role and its findings are meant to be used by policy-makers and law-makers as a significant argument to pursue more active role of the state in implementing sustainable development goals.</p>
