<p class="Default" align="center"><strong>ABSTRAK</strong></p><p>Penelitian ini bertujuan untuk membahas mengenai Tanda Tangan Elektronik dalam penyelenggaraan E-Government guna Mewujudkan pelayanan publik yang efisien untuk mengetahui bagaimanakah sistem dan problematika penggunaan tanda tangan elektronik pejabat publik dalam penyelenggaraan e-government. Metode yang digunakan dalam penelitian ini adalah metode penelitian normatif dengan sifat preskriptif. Pendekatan dalam penelitian ini yaitu pendekatan perundang-undangan dan konseptual. Bahan hukum yang digunakan dalam penelitian ini yaitu bahan hukum primer terdiri dari perundang-undangan dan bahan hukum sekunder yang diperoleh melalui bahan kepustakaan. Teknik analisis data menggunakan logika deduktif. Hasil dari penelitian ini menunjukkan bahwa Penerapan teknologi informasi e-government dalam hal ini penggunaan tanda tangan elektronik akan membawa pemerintahan menjadi lebih efisien dan efektif dalam hal pelayanan publik serta proses administrasi dan komunikasi internal. Terdapat dua permasalahan hukum pokok dalam penggunaan tanda tangan elektronik oleh pejabat publik yakni mengenai kekuatan hukum tanda tangan elektronik dan keamanan tanda tangan elektronik itu sendiri dari pemalsuan.</p><p>Kata Kunci : Tanda Tangan Elektronik, E-government, Pelayanan Publik, Efisien.<strong></strong></p><p class="Default" align="center"><strong>ABSTRACT</strong></p><p>This study aims to discuss Electronic Signatures in the implementation of E-Government in order to realize efficient public services to find out how the system and the problems of using electronic signatures of public officials in the implementation of e-government. The method used in this research is a normative research method with a prescriptive nature. The approach in this research is the statutory and conceptual approach. The legal materials used in this study are primary legal materials consisting of legislation and secondary legal materials obtained through library materials. The data analysis technique uses deductive logic. The results of this study indicate that the application of e-government information technology in this case the use of electronic signatures will bring the government to be more efficient and effective in terms of public services as well as administrative processes and internal communications. There are two main legal problems in the use of electronic signatures by public officials, namely regarding the legal power of electronic signatures and the security of the electronic signature itself from forgery.</p><p><em>Keywords</em><em> </em><em>:</em><strong><em> </em></strong>Electronic Signature, E-government, Public Service, Efficient<em></em></p>

ABSTRACTSupervise the government as the provider of public services to carry out their duties and authorities under applicable regulations. Large-Scale Social Restrictions are restrictions on certain activities in an area suspected of being infected with Corona Virus Disease 2019 (COVID-19), which causes the quality of public services to be disrupted. The Ombudsman has the task of supervising the implementation of shared services organized by state or government officials and private or individual bodies assigned the task of providing services according to minimum service standards as a benchmark for service delivery and assessing the quality of services to the community. The research method used is normative juridical research with a conceptual approach (Statute Approach).The results of this study are large-scale social restriction policies through the Mayor of Tarakan Regulation Number 17 of 2020, restrictions on activities outside the house such as the implementation of learning at schools and/or other educational institutions, Work From Home (WFH), religious movements in houses of worship, activities in public places, social and cultural activities and Mandatory rapid tests for those using Sea and Air transportation modes, and providing social assistance to communities affected by COVID-19. Ombudsman's supervision of public services during the COVID-19 pandemic in Tarakan City, namely by conducting coordination and control and cooperation with state and private officials as well as community or individual organizations, opening an Online Complaint Post for COVID-19 Affected Persons. Also, conduct unannounced checks to improve public services in the City of Tarakan. Based on the supervision, the receipt of reports on suspicion of maladministration and the Ombudsman's investigation results are subject to examination. Suppose it is proven that it has committed maladministration in public services, the Ombudsman of the Republic of Indonesia can take corrective action and provide recommendations/suggestions to state administrators to improve the quality of public services. Keywords: Surveillance; Ombudsman; Public Service; COVID-19 Pandemic

This study examined the supervision of public services as stipulated in Law 25 of 2009, namely regarding public services and Law 23 of 2014 concerning regional government. Supervision carried out in the law is to give authority to each of the existing institutions or institutions, causing overlapping existing authority. Giving authority to officials will give birth to the rights and obligations to achieve the goals and intentions specified in the legislation. The rise of corruption cases occurs because of the weakness of existing supervision of government administration, especially in public services. In this case corruption will foster public distrust of public services. The form of maladministration carried out by public service providers is always associated with behavior in services performed by public officials and the norms of behavior of officials in public services. In addition, these problems are also caused by the opportunities and authority given to be abused and the low quality of public services in various service sectors. Supervision of public services can provide certainty about the public services provided by the government whether it has been running according to targets and objectives and is a way to find out as early as possible maladministration that might occur so that effective and accountable government can be realized.

The provision of state services in electronic form today is one of the innovative directions of development of mechanisms for implementing the functions of state bodies. This was made possible by the improvement of information technology and the use of electronic signatures to give legal significance to documents in electronic form. The article raises the legal and technical issues of using electronic signatures in the practice of providing public services to the Pension Fund of the Russian Federation in electronic form.In the first part of the article, based on an analysis of federal regulatory legal acts in the field of public services and the use of electronic signatures, it is concluded about the types of electronic signatures used in the provision of public services in electronic form, as well as by what means the applicant can check the availability and validity of the electronic signature on received documents as a result of the provision of services.The second part analyzes the use of electronic signatures in the provision of two selective government services of the Pension Fund of the Russian Federation (informing insured persons about the status of their individual personal accounts in the compulsory pension insurance system and informing citizens about the category of citizens of pre-retirement age) through the Unified portal of public services and the personal account of the insured Pension Fund of the Russian Federation website. The author verifies the validity of electronic signatures on documents obtained as a result of an experiment using the services of the Unified Portal of State Services and a commercial accredited Certification Authority.

This study aims to analyze the validity of the Motor Vehicle Owner's Book sale and purchase agreement on the Facebook application in relation to the principle of freedom of contract and to analyze the legal consequences of the Motor Vehicle Owner's Book sale and purchase agreement on the Facebook application which is expected to be a benchmark for how it should be regulated regarding selling and buy this Motor Vehicle Owner's Book in the future. This study uses a normative legal research method with a statutory approach and a conceptual approach. The legal materials used are sources of primary legal materials, sources of secondary legal materials and sources of tertiary legal materials. The technique of collecting legal materials used is an argumentative technique and descriptive analysis technique. The results of the research show that the sale and purchase agreement for a Motor Vehicle Owner's Book without a vehicle is a valid agreement as long as the agreement meets the legal requirements of an agreement set out in Article 1320 of the Civil Code. The legal consequence of this agreement is that it can be canceled if it does not meet the subjective requirements and is null and void if the objective conditions are not met. In the BPKB sale and purchase agreement without a vehicle, it is clear that if the objective conditions are not met, then the agreement is null and void or the existence of the agreement is deemed not to exist from the start. Studi ini bertujuan ini untuk menganalisis keabsahan perjanjian jual beli Buku Pemilik Kendaraan Bermotor pada aplikasi Facebook dikaitkan dengan asas kebebasan berkontrak serta menganalisis akibat hukum dari adanya perjanjian jual beli Buku Pemilik Kendaraan Bermotor pada aplikasi Facebook yang diharapkan akan menjadi tolak ukur mengenai bagaimana seharusnya diatur mengenai jual beli Buku Pemilik Kendaraan Bermotor ini di masa mendatang. Studi ini menggunakan metode penelitian hukum normatif dengan pendekatan   perundang-undangan  dan    pendekatan  konsep. Bahan  hukum  yang digunakan  adalah  sumber  bahan  hukum  primer,  sumber  bahan hukum   sekunder   dan   sumber   bahan   hukum tersier. Teknik pengumpulan bahan hukum yang digunakan adalah  teknik argumentative serta teknik analisis deskriptif.  Hasil dari penelitian menunjukan bahwa perjanjian jual beli Buku Pemilik Kendaraan Bermotor tanpa disertai kendaraan merupakan perjanjian yang sah sepanjang perjanjian tersebut memenuhi syarat sahnya sebuah perjanjian yang tertuang di dalam Pasal 1320 Kitab Undang-Undang Hukum Perdata. Akibat hukum dari adanya perjanjian ini yaitu dapat dibatalkan apabila tidak memenuhi syarat subyektif dan batal demi hukum apabila syarat obyektifnya tidak terpenuhi. Dalam perjanjian jual beli BPKB tanpa kendaraan sudah jelas apabila syarat obyektifnya tidak terpenuhi maka perjanjian tersebut batal demi hukum atau keberadaan perjanjian tersebut sejak awal dianggap tidak ada.

The establishment of the Bankruptcy Law aims to overcome the difficulties of the business world in terms of debt and receivables in continuing their activities. However, in practice the PKPU and Bankruptcy institutions are used as a means of resolving ordinary civil disputes, this is due to Article 225 paragraph (3) and (5) in conjunction with Article 222 paragraph (1) and (2). The purpose of this study is to analyze the ratio legis for debtors in relation to the ratio legis Article 225 paragraph (3) and paragraph (5) associated with the purpose of establishing Bankruptcy and Suspension Of Debt Payment Obligations (UUK-PKPU). This research is normative legal research with a statute approach, the case approach, historical approach, comparative approach, and the conceptual approach. The legal materials used are primary, secondary, and tertiary. The analysis technique uses legal logic, legal interpretation teleologically, hermeneutics, grammatically, and systematically. The results of the study indicate that the ratio legis regarding PKPU as regulated in Article 225 paragraph (3) and paragraph (5) has a vague norm when it comes to the purpose of establishing UUK-PKPU, that PKPU is a means for debtors so that debtors can restructure their debts. So that no rights are given to debtors who are not present at the PKPU session resulting in no legal protection for the debtor to defend himself by conveying the reasons for the debtor's absence.

Narcotics crime in society (especially in Indonesia) shows an increasing trend both quantitatively and qualitatively with widespread victims, especially among children, adolescents, and the younger generation in general. Based on this, the government must increase efforts to prevent and eradicate narcotics crimes by any means, whether reforming the Narcotics Law, imposing strict sanctions and so on. The purpose of this research is to find out how the legal ratio of the Special Minimum Limit Regulation in the Law on Narcotics. This research is normative legal research with a conceptual approach and a philosophical approach. The legal materials used are primary and secondary with the technique of analyzing legal materials using the interpretation method. The results of the study indicate that the Ratio legis regulation specific minimum criminal provisions in the three laws studied, namely: the Narcotics Law and the Supreme Court Circular Number 03 of 2015, is intended to prevent disparities in the sentencing of crimes by judges. The regulation of types of criminal sanctions in legislation is one of the functions of the State to protect legal interests, in the form of life, property and dignity. The regulation of criminal sanctions is one of the criminal policy systems that can be seen from several aspects, namely the criminal system, namely: types of sanctions, alternative and cumulative forms of sanctions and their duration, namely the maximum-minimum of the punishment threatened.

The “electronic government” movement has swept across most countries in the last decade. This movement represents a new paradigm for public services. As we know, traditional public services may be improved in many ways by the Internet. According to the literature reviewed, we found many studies were only focused on how to technically establish Web sites that allow citizens appropriate access to government information. However, few studies paid attention to the relationship management among the different e-government stakeholders. Therefore, the objective of this chapter is to integrate the relationship management among the three groups of stakeholders: the government itself, its citizens and employees. In this chapter, we will examine the literature regarding to the underlying rationale of a successful e-government. Also, an evaluation system for the usability of government Web sites that support relationship management among citizens, government employees and public services are developed and empirically tested.

Public services as the basic needs of the community in the form of service activities facilitated by the state are considered not optimal and effective. One of the implementations of public services, especially in terms of the implementation of democracy is in the holding of elections through conventional mechanisms facilitated by the state through the General Election Commission. There are several problems in its implementation such as high levels of fraud, human error, and budget. Based on these problems, it has implications for the damage to the principle of election and the decline in the level of community satisfaction with the implementation of elections. Considering that Indonesia has entered the era of revolution 4.0, public service reform is needed in order to effectively establish election principles. The purpose of this paper is to find out the mechanism and problem of organizing elections as one form of public service in Indonesia. The theoretical foundation that we use is good and clean governance which is a fundamental principle in the administration of public and election services. Thus, the writer uses the juridical normative research method, through a case approach, comparative approach and conceptual approach. Therefore, the authors initiated the concept of e-voting in elections as an effective and efficient solution in rebuilding people's trust in the government in terms of public services. Salah satu implementasi pelayanan publik terutama dalam hal pelaksanaan demokrasi yaitu dalam penyelenggaraan pemilu melalui mekanisme konvensional yang difasilitasi negara melalui Komisi Pemilihan Umum. Terdapat beberapa problematika dalam penyelenggaraannya seperti tingginya tingkat kecurangan, human error, dan pendanaan yang tinggi. Berdasarkan permasalahan tersebut berimplikasi kepada pencederaan asas pemilu dan turunnya tingkat kepuasan masyarakat terhadap pelaksanaan pemilu. Mengingat Indonesia telah memasuki era revolusi 4.0 diperlukan reformasi pelayanan publik agar terciptanya asas-asas pemilu secara efektif. Tujuan dari penulisan ini adalah untuk mengetahui mekanisme dan problematika penyelenggaraan pemilu sebagai salah satu bentuk pelayanan publik di Indonesia. Landasan teori yang penulis gunakan yaitu good and clean governance yang merupakan asas fundamental dalam penyelenggaraan pelayanan publik maupun pemilu. Dengan demikian penulis memakai metode penelitian normative yuridis, melalui pendekatan kasus (case approach), pendekatan komparasi (comparation approach) dan pendekatan konsep (conceptual approach). Oleh karena itu penulis menggagas konsep e-voting dalam pemilu sebagai solusi yang efektif dan efisien dalam membangun kembali kepercayaan masyarakat kepada pemerintah dalam hal pelayanan publik. Maka berdasarkan penelitian ini dapat disimpulkan bahwa dewasa ini pelayanan publik dalam penyelenggaraan pemilu dinilai belum mampu berjalan dengan baik, sehingga menyebabkan tingkat kepuasan masyarakat terhadap penyelenggaraan pemilu menurun. Sehingga penulis merekomendasikan untuk merubah penyelenggaraan pemilu secara konvensional menjadi e-voting dan merevisi Undang-undang Nomor 7 Tahun 2017 tentang Pemilihan Umum.Kata Kunci: Pelayanan Publik, Pemilu, Revolusi Industri 4.0, e-voting

Corruption is committed by state officials, law enforcement and other related parties. Various efforts have been made by the government in preventing and eradicating corruption in Indonesia, but the efforts that have been made have not yet gotten optimal results. The fundamental weakness in eradicating corruption in Indonesia is the formulation of the main criminal sanctions in the form of criminal threats that are facultative, uncertain or must be. So that the corruptors are never deterred or afraid. In the future, the legislators need to reformulate the provisions of Article 2 paragraph (2) of the Republic of Indonesia Law Number 31 of 1999 as amended to Law of the Republic of Indonesia Number 20 of 2001 concerning Eradication of Corruption. Various criminal law policies still need to be carried out by the state in order to eradicate corruption to achieve the expected results. This type of research in this paper uses the type of normative legal research. The type of approach is in the form of a legal approach related to corruption. There are two legal materials used, namely primary legal materials and secondary legal materials, with legal material collection techniques used in the form of library studies. The analysis technique used is descriptive, interpretation, evaluation and argumentative techniques. The research in this paper intends and aims to examine and analyze the facts and phenomena of corruption that are stated in specific legislation concerning criminal sanctions (capital punishment) for corruptors in Indonesia. Moreover, corruption is qualified as an extraordinary crime so it needs extraordinary handling as well.

The enactment of electronic signatures, especially at the General Meeting of Share-holders (GMS) and responses to legal actions from electronic signatures in the deed of Decision of the General Meeting of Shareholders in a Limited Liability Company, will be confronted by the progress of the era and the legality of the deed. This research method is classified as normative research, the approach method is descriptive analytical. This study shows that the regulation of electronic signatures on the deed of the Statement of Shareholders' Meeting Resolutions is the development of the form of legal evidence. For this reason, the form of evidence is made in the form of electronic information or electronic documents. The effect of the signing if it is done through electronic media, namely the result of the GMS decision has a legal impact on the status of ratification in the law. If the GMS has an electronic signature so that the legality of the legal action is recognized, the government and especially the legislators make legal rules to regulate with certainty the validity of the results of the GMS electronically, so that legal certainty is formed.
