<p>This study investigated the marriage has human values to fulfill the instincts of human life. In the community of Tobati tribes, marriage has been arranged based on its customary traditions that have been agreed upon for generations. It focused on exploring the form of the marriage tradition of the repentant tribal people and how Islamic law analyzes the similarities and differences. The researcher applied descriptive qualitative design to explore the objectives of this study then analyzed by Miles Huberman’s theory. The findings show that there are several steps in the marriage process, namely: <em>first</em>, propose (ask in marriage); <em>second</em>, waiting for a period (waiting for a decision from the woman’s family); <em>third</em>, giving the application, and the last, the procession of the marriage. These four stages, there are similar to the stages of marriage according to Islamic law, but there is a very significant difference, namely the obligation to deliver the application after obtaining approval to carry out the wedding procession.</p>

This article aims to examine the thoughts of Imam al-Syatibi on maqāşid al-sharīah and its actualizations in modern life. The method used is qualitative, while the data analysis technique used is content analysis to analyze the substance of maqāşid al-sharīah. It is then correlated with the context of current human life. The results of the study show that the theory of maqāşid al-sharīah initiated by Imam al-Syatibi has presented sharīah in its elastic face. Maqāşid al-sharīah has transformed Islamic theory into universal human values, such as benefit, justice, and equality in Muslims' lives in the world. This can be seen at least in two ways: first, maqāşid al-sharīah as a developing Islamic law method. The development of the theory of maqāşid al-sharīah has inspired the philosophy of Islamic laws. It becomes the basis of thinking and analysis, which is fundamental to Islamic legal thinking in this globalization era and dynamic social changes. Second, maqāşid al-sharīah in building sharīa economics; maqāşid al-sharīah's theory occupies a very central and vital position in formulating a sharīah economic development methodology. In the context of sharīah economics, the purpose of maqāşid al-sharīah is to safeguard human benefits. A Muslim is encouraged to produce and consume goods/services, of course, within valuable considerations.Artikel ini bertujuan mengkaji pemikiran Imam al-Syatibi tentang maqāşid al-sharīah dan aktualisasinya dalam kehidupan modern. Metode yang digunakan adalah kualitatif, sedangkan analisis data yang digunakan adalah content analysis yakni sebagai sebuah upaya menganalisis substansi pemikiran maqāşid al-sharīah, kemudian dikorelasikan dengan konteks kehidupan masyarakat sekarang. Hasil penelitian menunjukkan bahwa teori maqāşid al-sharīah yang digagas oleh Imam al-Syatibi telah menghadirkan shariah dalam wajahnya yang elastis. Maqāşid al-sharīah telah mentransformasikan teori-teori shariah ke dalam nilai-nilai kemanusiaan universal, seperti kemaslahatan, keadilan dan kesetaraan dalam kehidupan umat Islam. Hal ini setidaknya bisa dilihat dalam dua hal: pertama, maqāşid al-sharīah sebagai metode pengembangan hukum Islam. Pengembangan teori-teori maqashid al-shariah mengilhami filsafat hukum Islam dan menjadi pangkal berpikir serta analisis yang pokok untuk pengembangan pemikiran hukum Islam pada era globalisasi dan perubahan sosial sekarang ini. Kedua, maqāşid al-sharīah dalam membangun ekonomi shariah. Teori maqāşid al-sharīah menempati posisi yang sangat sentral dan vital dalam merumuskan metodologi pengembangan ekonomi shariah. Dalam konteks ekonomi shariah, tujuan maqāşid al-sharīah adalah menjaga kemaslahatan manusia. Seorang muslim didorong untuk memproduksi dan mengkonsumsi barang/jasa tentu dengan pertimbangan kemaslahatan.

This article aims to explore the principles of humanity in Islamic International Law, which include humanitarian principles in peace situation and in time of war and assess their suitability with current international law. To achieve this purpose, this article uses historical assessment methods and textual interpretations to study a string of historical events as well as analyze sources of text from the Quran, hadiths and other legal documents. The principles of humanity outlined in this paper are an important aspect of organizing relationships between humans either in peace or during the war. In fact, the Islamic Law of the Quran, the hadiths and actions of the Prophet ﷺ throughout history has always elevated human dignity and human values. The results show that Islamic International Law through its humanitarian principles contributes significantly to the regulation of human life in line with the development of international law. In light of the sentiment expressed by some of the international community that Islam is a terrorist religion, the humanitarian principles outlined in this article are expected to repel the allegations and thus formulate a set of ideas that will support and improve the implementation of existing international law

This study used Palmer’s (1986) theory to analyzed Modality and Halliday (2008) to analyze the meaning of modality. Relating to the statements above, this study was proposed to answer two articulated research problems, namely; (1) what are the types of modality found in Emma Watson and Michael Kimmel’s Speech Texts? And (2) To what extent do Emma Watson and Michael Kimmel’s Speech Texts show similarities and differences, if any, in their use of types of modality? This study employs a descriptive qualitative design. The data were all of the speech by Emma Watson and Michael Kimmel’s Speech Texts that contain modality. In terms of types of modality, 30 data of modality were found. The data are classified into two types of modality: Epistemic modality consists of 10 data; judgments (5 data) and modifications (5 data). Deontic modality consists of 20 data; directives (3 data), modifications (4 data), subjectivity (5 data), imperatives (3 data), commissives (2 data), and volitives (3 data). Moreover, in terms of similarities and differences, the data are classified into two terms similarities and differences. We found 11 data of similarities and differences in types of modality: In terms of similarities in types of epistemic modality (3 data) and similarities in types of deontic modality (2 data). <p><em>This study aims to describe the intertextuality relationship between the novel Pasung Jiwa by Okky Madasari and Calabai by Pepi Al-Bayqunie. The type of research is descriptive qualitative approach using content analysis. Data are collected by inventorying events that are similarities and differences, specifications on the characters, settings, plots, and themes of both text. The research results indicate that there are similar themes on the two novels, the theme of self actualization in addition with the theme of family and friendship. The same characterization are also used by both author, masculine figures with feminine soul characters. The difference between the two novels lies on the plot and setting. Pasung Jiwa uses progressive plot and Calabai uses a flash-back plot.. Okky Madasari takes Java Island as the background in the novel Pasung Jiwa, while the novel Calabai, Pepi Al-Bayqunie using the setting of Sulawesi Island. The basis of the similarity of theme and characterization supported by the similirity of events in the story shows the existence of intertextual relationship between the two novels. As a previously published work, the novel Pasung Jiwa by Okky Madasari is a hipogram and novel Calabai by Pepi A-Bayqunie as a transformational text. On the theme and characterization, the transformation of Calabai forward the hypogram, while in the plot and setting deviates his hypogram, Pasung Jiwa.</em></p><p>Penelitian ini bertujuan untuk mendeskripsikan hubungan intertekstualitas antara novel Pasung Jiwa karya Okky Madasari dan novel Calabai karya Pepi Al-Bayqunie. Jenis penelitian ini adalah deskriptif kualitatif dengan pendekatan konten analisis. Data dikumpulkan dengan menginventariskan peristiwa yang merupakan persamaan dan perbedaan, spesifikasi pada tokoh, latar, alur, dan tema dari kedua teks. Hasil penelitian ini menunjukkan bahwa terdapat kesamaan tema pada kedua novel, yaitu tema aktualisasi diri, ditambah dengan tema keluarga dan persahabatan. Penokohan yang sama juga digunakan oleh kedua penulis, yaitu tokoh maskulin dengan karakter jiwa feminin. Perbedaan kedua novel terletak pada alur dan latar. Pasung Jiwa menggunakan alur maju dan Calabai menggunakan alur campuran. Latar dalam novel Pasung Jiwa, Okky Madasari mengambil latar Pulau Jawa, sedangkan novel Calabai, Pepi Al-Bayqunie menggunakan latar Pulau Sulawesi. Dasar kesamaan tema dan penokohan didukung kesamaan peristiwa-peristiwa dalam cerita menunjukkan adanya hubungan intertekstual antara kedua novel. Sebagai karya yang terbit terlebih dahulu menjadikan novel Pasung Jiwa karya Okky Madasari adalah hipogram dan novel Calabai karya Pepi Al-Bayqunie sebagai teks transformasi. Pada tema dan penokohan, transformasi Calabai meneruskan hipogram, sedangkan pada alur dan latar menyimpangi hipogramnya, Pasung Jiwa.</p>

AbstractThe present article focuses on the function of mythic journeys with regard to the problem of death and the transience of human life in two selected Mesopotamian literary sources: the Gilgamesh-Epic IX–XI and the Descent of Ishtar to the Underworld. The selected texts are analysed and compared from the perspective of a functionalist definition of religious symbol systems, with particular attention to the transformation involved in travelling through different cosmic regions. The structure of the journey, the characterisation of the different regions visited by the protagonist, and the changes provoked by the mythic travel evince similarities and differences in the strategies employed to produce a religious orientation dealing with the ineluctable limits of life.

Abortion is an act of killing to life which is forbidden in Islam. Abortion gives rise to differences of view among past and contemporary scholars on its enabling and prohibition. So, this study is to examine the views of scholars and laws in Indonesia and Malaysia related to abortion and its impact on inheritance ownership. This situation affects the inheritance of property to the mother from the aborted baby. The method of this study is qualitative descriptive. The approach of this research method is descriptive of content through literature. Books, journals, newspaper clippings, and legal regulations are the premier references to this study. This study finds that there are similarities and differences between sharia law and the rules applied in Indonesia and Malaysia. In terms of similarities, Islamic law and the laws in Indonesia and Malaysia provide for the prohibition of abortion. But, in certain circumstances, the fetus can be aborted for certain reasons, such as harming the mother or for medical reasons. In addition, this study found differences in punishment for women who had an abortion for no valid reason. Therefore, this study reveals the harmonization of Islamic law with the laws conducted in Indonesia and Malaysia. So, this study recommends forming a better in-depth study of efforts to harmonize the larger Islamic law to the rules regulated in Muslim countries.

Color in human life has a very important role. With color, humans can identify something that appears in front of them. There is a strong relationship between color and one’s emotions that can even cause a feeling that is unique to a person. Karo bridal jewelry uses gold as a whole, from bracelets, necklaces to earrings worn by the bride and groom. This study focuses on the role of gold in Karo bridal jewelry in influencing the perception of the bride and groom in living a new household. The method used in this research is descriptive qualitative with data collection techniques in the form of observation, interviews and documentation. The results showed that the perception of the gold color in the Karo people, especially the bride and groom, had a very deep meaning, namely the value of responsibility, the value of hard work, the value of honesty and the value of prosperity expected in domestic life. The perception of value that arises from the gold color of jewelry reflects that both the bride and the extended family must be able to become role models who have luxurious and effective symbols such as gold.ABSTRAK Warna di dalam kehidupan manusia memiliki peranan yang sangat penting. Dengan warna manusia dapat mengidentifikasi sesuatu yang tampak dihadapannya. Terdapat keterkaitan kuat antara warna dengan emosi seseorang yang bahkan dapat menimbulkan suatu perasaan yang khas dari diri seseorang. Perhiasan pengantin Karo menggunakan warna emas secara keseluruhan mulai dari gelang, kalung sampai dengan anting yang dikenakan oleh kedua pengantin. Penelitian ini memfokuskan peran warna emas pada perhiasan pengantin Karo dalam mempengaruhi persepsi pengantin dalam menjalani rumah tangga yang baru. Metode yang digunakan dalam penelitian ini adalah deskriptif kualitatif dengan teknik pengumpulan data berupa observasi, wawancara dan dokumentasi. Hasil penelitian menunjukkan persepsi warna emas pada masyarakar Karo khususnya kedua pengantin memiliki arti yang sangat dalam yaitu nilai tanggung jawab, nilai kerja keras, nilai kejujuran serta nilai kemakmuran yang diharapkan dalam kehidupan rumah tangga. Persepsi nilai yang timbul dari warna emas perhiasan mencerminkan kedua pengantin dan keluarga besar harus mampu menjadi panutan yang memiliki simbol mewah dan tepat guna seperti emas. Kata Kunci : Emas; Perhiasan; Pengantin Karo

COVID-19 pandemic has influenced every aspect of human life including Education and Mental Health of the learners. Thus, the present study was aimed at assessing the status of online learning and mental health of online learners and to investigate the relationship between the two variables. The descriptive survey method was adopted for the present study and the collected data analysed quantitatively. For collection of the data two self-made tools were used namely Status of Online Learning Scale for Learners and Mental Health Assessment Scale for Learners. The tools were administered on 140 students. The tabulated data was analysed through the Mean, Standard Deviation, correlation and t test. The results revealed that learners are moderately active in online learning. Mental health of the online learners is moderately stable. Online learning is negatively affecting the mental health of the online learners and there was no significant difference found between the mental health of online learners in terms of the gender and the locality.

ISLAM is the religion that emphases on the overall human life. It covers all aspects of the physical body, the soul or the spirit, the emotion and the intellect. The Almighty Allah has stated that, True believers those who, if we give them power in the land, establish regular prayer and give zakat, enjoin the right and forbid wrong. That So, we can highlight from these directives of the holy Quran that the religious responsibilities of the Muslim rulers are that they protect the Divine bounds; defend the religion and invite the people to Allah by means of argument and good advice. A ruler is a trustee of the people and vicegerent of Allah. The ruler of a Muslim state has, among other things, to enjoin what is right and forbid what is wrong. What could be right and wrong has been clearly identified in the Quran and sunnah. Some of the acts and behaviors identified which can be promoted more appropriately through positive measures like counselling, motivation, preaching, guidance, creation of appropriate environment, and other similar measures. The most effective of these measures could, however, be what is called exemplifying. It would mean that the ruler should do himself what is right and refrain from doing what is wrong and thereby set an example. Leading by exemplifying has deep psychological and substantial effect on others to follow and emulate. Therefore, the Seerah of the prophet PBUH is the best source for us in this regard. However, it encompasses the efforts made to develop human-being or individual who is pure of heart, pure in mind and pure in deeds where he can function as a member of society, who is civilized and has a high self-esteem. An individual’s awareness towards one’s responsibilities and a high self-esteem can bring for a peaceful and harmonious nation. Thus, the establishment of the Islamic society base on the voice of development together with material values and humanity. Because of which, the role of leaders of Islamic society must be proactive in plotting the path of educational system of the nation based on piety and faith. As for the obligations of ruler in the light of Seerah, I shall refer to the principles which Al-Mawridi r.a has discussed: The preservation of the Faith, true to its origin and in keeping with the consensus of those who participated in the founding of the Ummah, Defense of the Realm. He must carry out the Hadd punishments to ensure the limits prescribed by Allah and so that the rights of general public shall be protected. The other responsibilities are implementation of the principles of Islamic Law, governing disputes, The active propagation of the Faith, The collection of various taxes required by the Shariah, The provision of financial assistance and the assessment of claims against the Treasury, To be solicitous of the public confidence, and to consider fully the council of his advisors in their areas of responsibility, To actively oversee all aspects of government, and to keep himself well and widely informed. This paper thus discusses on the responsibilities of a ruler from the Seerah perspective.

Like the limits of crime, crimes against human life and body are also very dangerous in terms of their effects, so the Qur'an has fixed their punishment for them. Islamic law has set specific punishments for it, and it does not allow any kind of crime to be reduced. These crimes have schakled the very basis of society and they have to be dealt with severely. The basic elements of society are the need to protect the structures on which the lives and deaths of society depend. These crimes can be basically divided into two types: 1.Crimes against human beings (e.g. murder) 2.Crimes against the human body. There is a long way to go around, and in the meantime, this kind of research is needed, the seriousness of which is far greater than the rest of researches. This article examined the crimes against humanity in the light of Islamic law.
