<p>Ibn Khaldun was one of the scholars' greatest that no one doubted his dept of knowledge of Islamic religion. In the Islamic religious knowledge, he has trained by many greatest scholars since childhood moment-one of them is his father. Ibn Khaldun can also be called as a scientist who never ask and doubted the truth of Islamic law. Understanding that any observations for him, he could not be separated from the Islamic values inherent in him. Through in-depth discussion and critical of his work, will be seen in ethical view of religious that accommodate economic teachings of Islam, and other hand the human family to recognize the nature to endeavor  economic activity.</p><p>This type of research is the research library (library research), to describe something. Data collection techniques using qualitative methods as the research procedures to descriptive data. To analyze the data that was gathered using the deductive, using a philosophical approach.</p><p>Historically there is close relationship between ethics and economics, which was originally it was part of the problem of economic ethics. Ibn Khaldun's economic notion explain a multidimensional economic concepts that involving various social aspects in the context of his thinking about the al-al-basyari'amran which describes the rise and fall  of a civilization which moral decline influence in it. Ibn Khaldun's economic concept implies an economic system that requires the five components, namely Shari'ah, government , people, property, economic activity and justice, in unity.</p><p>Keywords: Interrelation, ethical, economic systems, Ibn Khaldun</p>

This article is the result of library research. The direction of this research discussion is how the Islamic religion addresses the issue of forced sexual intercourse between husband and wife. This article discusses vis a vis between maqāsid sharī'ah and Law Number 23 of 2004 concerning the Elimination of Domestic Violence. Claim of this research is the forced sexual intercourse of husband and wife according to Law Number 23 of 2004 is in line with the objectives of Islamic law (maqashid syar'iah) which is to protect tauhid/monotheism (hifd al din) men and women. The equality of relations between men and women is contained in the teachings of mu'āsharah bi al-ma'rūf (good association). Sexual violence can occur in both husband and wife. If the husband forces sexual intercourse, then it is prohibited. Vice versa, if the wife refuses to have sex without a syar'i reason, then this is also prohibited. not allowed. According to Islamic law, sexual violence can be punished with a finger of ta'zir sanction. Islam forbids acts of forced sexual intercourse as well as violence by husbands against their wives. And vice versa. Islam came with the main mission of realizing the benefit of all creatures, men and women. Islam teaches equal and equal sexual relations between husband and wife. Arah diskusi penelitian ini adalah bagaimana agama islam menyikapi  isu pemaksaan hubungan seksual suami istri. Artikel ini mendiskusikan vis  a vis antara maqāsid sharī’ah dan Undang-Undang Nomor 23 Tahun 2004 Tentang Penghapusan Kekerasan Dalam Rumah Tangga. Klaim penelitian ini adalah bahwa pemaksaan hubungan seksual suami istri menurut Undang-Undang Nomor 23 Tahun 2004 selaras dengan tujuan syariat islam (maqashid syar’iah) yaitu melindungi ketauhidan (hifd al dīn) laki-laki dan perempuan. Kesetaraan relasi laki-laki dan perempuan tertuang dalam ajaran mu’āsharah bi al-ma’rūf. Kekerasan seksual dapat terjadi pada istri maupun suami. Jika suami memaksa hubungan seksual, maka itu dilarang. Demikian pula sebaliknya, jika istri menolak berhubungan tanpa alasan yang syar’i, maka ini juga dilarang. tidak diperbolehkan. Menurut hukum Islam, kekerasan seksual dapat dipidana dengan sanksi jarimah ta’zir. Islam melarang tindakan pemaksaan hubungan seksual juga kekerasan yang dilakukan suami atas istri.dan juga sebaliknya. Islam datang dengan misi pokok mewujudkan kemaslahatan bagi seluruh makhluk, laki-laki maupun perempuan. Islam mengajarkan relasi seksual suami–istri yang sejajar dan setara. This research aims to depict Tan Malaka’s socialist economic thought related to the issues on the production of concept.  This is qualitative research using library research method to gather the data on Tan Malaka’s thought on the concept of production. This study shows that the concept of the balance of production and consumption, the country's economic independence and the concept of labor costs in line with the concept of Islamic economics. While from the arrangement of land as a factor of production, Tan Malaka gradually wants to eliminate individual ownership of the means of production. This is not in line with Islamic economic concept where individual ownership of the means of production and production factors permitted as long as not contrary to Islamic law.

Economic activities oriented to the Islamic Economic system are increasingly widespread invarious countries, including Indonesia. Speaking of Islamic Economic theory, it cannot be separated fromthe thoughts of figures who have contributed to the foundation and principles of Islamic economics. IbnKhaldun is one of the greatest scholars who have made a significant contribution to economic development.This figure cannot be separated from the Islamic values. Through deep and critical discussion of his work,it will be seen in the ethical view of religion that accommodates the teachings of Islamic economics, andthe other side of the human family to recognize nature to pursue economic activities.This type of researchis library research. Data were analyzed through a philosophical approach and described deductively. Thisstudy aims to reveal the contribution of Ibn Khaldun’s thoughts on the development of Islamic Economicslike market mechanisms, profits, division of labor and international trade, public finance, state wealthstandards, the concept of money and welfare the community.

The formulation of the theory of hajah in Islamic law has basically gained a place as a methodology in the study of Islamic law. However, this theory of hajah has not received much response from Muslim thinkers and some are still questioning its legality basis. Specifically, this research outlines the formulation of Muslim thinkers' perspectives and their legality basis through library research. With a philosophical approach to the proposal of al-fiqh, this study describes the ideas, terminology, formulation and legality of hajah as one of the methodologies in Islamic law. This research yielded findings; Hujjahan hajah as the basis for the application of Islamic law relies on the sources and general arguments of the verses that show difficulties for everyone and beyond the capacity of the conditions in general. The formulation of hajah from the perspective of Muslim thinkers has various types based on their classification. This is because hajah is not only one kind or one kind.

Abstract Khilafah cut off after the Ottoman Caliphate so that is no longer found of the Islamic government in the modern era. Then al-Afghani and M. Abduh reappeared the khilafah to the expression of wahdat al-Islamiyah which idea’s Rashid Ridha turned to a new term into Pan Islamism. This study is a literature study (library research) where the source data obtained from books of khilafah and Islamic government thinkers. Data were analyzed using critical interpretation analysis methods from Khomeini and al-Juwaini's thoughts including data reduction, data exposure, and conclusion. Based on the accumulation of theory among others Al-Mawdudi made it possible to divert Islamic rule to democracy. Hasan al-Banna socialized the return system of the khilafah. Ibn Khaldun hinted that the breaking of the Caliphate signifies that every state has a final period of government so that the caliphate system will not be permanent until the state fell in the territorial nations. Iqbal criticizes Islam not nationalism and even imperialism but the commonwealth nations without racial and demarcation. Al-Shatibi maintains the spirit of the maqashid shari'ah in the Islamic government. Imam Khomeini switched to the wilayat al-faqih. Ibn Taymiyya states that the complexity of establishing the Islamic Government is as complex as determining Islamic scholars. Al-Juwaini offers a solution to the concept of ghiyatsi namely the government that emphasizes the shari'ah that continues to be discussed in searching for the best format. The modern era is certainly running the Islamic Government only through the government of the spiritual republic by not lifting ahlu zimmah (non Muslim), ahlu kitab, munafiq (hipocrit), zindiq (orientalist), dayyus, musyrik (idolatry), dahriyyun (atheis), ashab'ah (naturalist) become government leaders. Preferred leaders who have be ahl muruwwah (authority) ie people who have previous life records in a measurable and open goodness in the public space for executive, legislative and judicial candidates performed fit and proper test by people who have the same religious knowledge with the fuqaha. Keywords: Khilafah, Islam, Government, and Spiritual Republic   Abstrak Khilafah terputus pasca Khalifah Utsmaniyah sehingga hampir tidak ditemukan lagi bentuk Pemerintahan Islam di era modern. Kemudian al-Afghani dan M. Abduh merekonstruksi khilafah kepada Wahdat al-Islamiyah yang kemudian Rashid Ridha mengalihkan ke istilah baru menjadi Pan Islamisme. Kajian ini dilakukan melalui studi kepustakaan di mana sumber datanya diperoleh dari buku dan kitab dari pemikir khilafah dan pemerintahan Islam. Data dianalisis dengan menggunakan metode analisis interpretasi kritis dari pemikiran Khomeini dan al-Juwaini meliputi reduksi data, pemaparan data dan penarikan kesimpulan. Akumulasi teori pemerintahan Islam dari beberapa intelektual Islam diantaranya Al-Maududi memungkinkan pergeseran pemerintahan Islam ke demokrasi. Hasan al-Banna mengajak mensosialisasikan pengembalian sistem khilafah. Ibnu Khaldun mengisyaratkan terputusnya khilafah menandakan setiap negara memiliki masa akhir pemerintahan menyebabkan sistem khilafah tidak akan permanen hingga terbentuk negara dalam territorial bangsa-bangsa. Iqbal mengkritisi Islam bukan nasionalisme bahkan imperialisme melainkan bangsa-bangsa persemakmuran tanpa rasial dan demarkasi. Al-Shatibi mempertahankan adanya ruh maqashid syari‘ah dalam pemerintahan Islam. Imam Khomeini beralih berpedoman kepada wilayah al-faqih. Ibnu Taimiyah menyatakan bahwa dharurat mendirikan Pemerintahan Islam sebagaimana dharurat menentukan ahli Islam. Al-Juwaini menawarkan solusi kepada konsep ghiyatsi yakni pemerintahan yang mementingkan syari‘at yang terus didiskusikan dalam mencari format yang terbaik. Era modern kepastian menjalankan Pemerintahan Islam hanya melalui pemerintahan republik spiritual dengan tidak menjadikan ahlu zimmah (non muslim), ahlu kitab, munafiq, musyrik, dahriyyun (atheis), ashab’ah (naturalis) menjadi pemimpin pemerintahan. Pemimpin diutamakan yang mempunyai ahl muruwwah (kewibawaan) yakni orang yang memiliki catatan hidup sebelumnya dalam kebaikan yang terukur dan terbuka di ruang publik bagi kandidat eksekutif, legislatif dan yudikatif dilakukan fit and proper test oleh orang yang memiliki religius yang sama ilmunya dengan fuqaha. Studies on maqasid al-shari�ah have been widely written and reviewed by researchers of Islamic law. Some have written about the maqasid al-shari�ah�s concept, the figures� thought, and its application to various Islamic law and social issues. As a new study, maqasid al-shari�ah is widely studied in the context of renewing Islamic law, however little discuss about history of maqasid al-shari�ah and relations with usul al-fiqh. Because historically, the birth of maqasid al-shari�ah can�t be separated from development of usul al-fiqh through the scholars usul al-fiqh. As well as in terms of methodology, maqasid al-shari�ah have a close relationship with method istinba? al-�hkam in usul al-fiqh,� as qiyas,� maslahah al-mursalah, al-�ari�ah �and istihsan. While in terms of application, maqasid al-shari�ah together with usul al-fiqh namely departing from the proposition of naqli (revelation) and �aqli (reason) which is global and analyzes various opinions in deciding Islamic law. It�s just that usul al-fiqh is dominated by linguistic aspects, meanwhile the maqasid al-shari�ah emphasizes the divine aspect behind the law.� That�s why to see relationships among maqasid al-shari�ah and usul al-fiqh, this research uses library research method or literature review by researching the main sources which discusses about relations maqasid al-shari�ah and usul al-fiqh in terms of historical, methodological and applicative.

This research aims to identify and explain matters related to academic problems,namely: first, understand the formulation of religious freedom in the Islamic religion and religiousfreedom in the formulation of the Christian religion. Second, understand the differenceand points alignment of religious freedom contained in Islam and Christianity. This study wasa qualitative research with religious knowledge as the scope of its research and literature as aplace of research (library research). The collected data is then presented descriptively by usingthe approach of sociology of religion. Sources of data in this study were classified into twogroups, namely primary data and secondary data. The data collected by using documentationand tested the validity of test data by applying confirmability (objectivity of research). Thecollected data were then analyzed with a comparative analysis and deductive models. Basedon the analysis, researchers concluded that Islam and Christianity have their own meaning ofreligious freedom. Freedom of religion in Islam and Christians when studied by the method ofcomparative religion, it will show the differences—on the basis of the law of religious freedom,the freedom of religion, and the norms of religious freedom—and side alignment in the sense—the freedom of each individual to embrace religion according to his individual—and embodiedthe goals of religious freedom is to realize the inter religious harmony.Keywords: freedom of religion; Islam; ChristianAbstrak: Penelitian ini bertujuan untuk mengetahui dan menjelaskan hal-hal yang terkaitdengan problem akademik, yaitu: pertama, memahami rumusan kebebasan beragama dalamagama Islam dan rumusan kebebasan beragama dalam agama Kristen. Kedua, memahami letakperbedaan dan poin kesejajaran kebebasan beragama yang terdapat dalam dalam Islam danKristen. Penelitian kualitatif ini dengan ilmu agama sebagai ruang lingkup penelitiannya dankepustakaan sebagai tempat penelitiannya (library research). Data yang didapat kemudiandisajikan secara diskriptif dengan menggunakan pendekatan ilmu sosiologi agama. Sumberdata dalam penelitian ini diklasifikasikan ke dalam dua golongan, yaitu data primer dan datasekunder. Data-data dikumpulkan dengan menggunakan teknik dokumentasi dan diuji validitasdatanya dengan menerapkan uji confirmability (obyektivitas penelitian). Data dianalisisdengan komparatif dan deduktif. Kesimpulan, bahwa agama Islam dan Kristen memilikipemaknaan tersendiri tentang kebebasan beragama. Kebebasan beragama dalam Islam danKristen ketika dikaji dengan metode perbandingan agama, maka akan terlihat sisi perbedaan—yakni pada sisi dasar hukum kebebasan beragama, batas kebebasan beragama, dan norma kebebasanberagama—dan sisi-sisi kesejajaran yakni pada pengertian—kebebasan tiap individuuntuk memeluk agama sesuai dengan keyakinannya masing-masing—dan tujuan dari terwujudkankebebasan beragama yaitu mewujudkan kerukunan antar umat beragama.Kata Kunci: kebebasan beragama; agama Islam; agama Kristen

This article aims at describing the obseroance of wasiat wajibah (compulsory bequeathment) in the Islamic court of Banten, analyzing the provision of the substitute heir and adopted children in the Compilation of  Islamic Law (KHI). In addition, the ideal laws to manage the innheritance rules in Indonesia. This article is library research by using doctrinal approach and using case study and survey methods. The data was, then, analyzed by using analytical descriptive and analytical correlative methods. The result showed that the observance of wasiat wajibah in the Islamic court of  Banten employed by judges is by using the Mawali Hazairin’s Doctrine. The criteria of the adoption of substitute heir and adopted children in the KHI is the attempts of Ulama and many judgees junst in giving legal justice and certainty to the society.   Key Words: Islamic Inheritance Law, Compilation of Islamic Law, Islamic court of  Banten

Majority of the indigenous people who are the original inhabitants in Malaysia inhibit the remote area of tropical forest which is rich in natural resources. Their lives are separated from the outside community due to several factors such as geography, low literacy, negative perceptions of the surrounding community, and the closed-door attitude of the indigenous people. Consistent preaching activities have changed the faith of the indigenous people from animism orientation towards believing in the Oneness of God. The practice of Islam as a way of life in the lives of indigenous peoples is found to be difficult to practice because the fiqh approach presented to them does not celebrate their local condition. In this regard, this study will examine the socio-cultural isolation of indigenous peoples and their impact on the interpretation of Islamic law. To achieve this objective, the researchers have applied the library research method by referring to the literatures related to the discussion of Islamic scholars in various disciplines of fiqh and usūl al-fiqh. The research found that there is rukhsah and taysir approach given to isolated people as well as with local background to facilitate the religious affairs of the indigenous people. Abstrak Majoriti masyarakat Orang Asli yang merupakan penduduk asal di semenanjung Malaysia mendiami kawasan pedalaman di hutan hujan tropika yang kaya dengan khazanah alam. Kehidupan mereka terasing daripada masyarakat luar disebabkan beberapa faktor seperti geografi, kadar literasi yang rendah, pandangan negatif masyarakat sekitar dan sikap tertutup masyarakat Orang Asli. Gerakan dakwah yang dijalankan secara konsisten telah membawa perubahan kepercayaan sebahagian masyarakat Orang Asli daripada berorientasikan animisme kepada mempercayai Tuhan yang Esa. Pengamalan Islam sebagai cara hidup dalam kehidupan masyarakat Orang Asli didapati agak sukar untuk dipraktikkan lantaran pendekatan fiqh yang disampaikan kepada mereka tidak meraikan suasana setempat mereka. Sehubungan itu, kajian ini akan meneliti keadaan isolasi sosio-budaya masyarakat Orang Asli dan kesannya terhadap pentafsiran hukum Islam. Bagi mencapai objektif tersebut, pengkaji menggunakan kajian kepustakaan sepenuhnya dengan menelusuri literatur berkaitan dengan perbincangan sarjana Islam dalam pelbagai disiplin ilmu fiqh dan usul fiqh. Hasil kajian mendapati terdapat rukhsah dan pendekatan taysir diberikan kepada mereka yang hidup terasing serta berlatar belakang budaya setempat bagi memudahkan urusan keagamaan masyarakat Orang Asli.

This paper is discusion the polygamy is still a controversial problem, although much discussed and examined. The difference of opinion among scholars make this problem continues to potentially raises the agree and disagree. Even though it has been regulated in Act Number 1 of 1974 concerning marriage and the compilation of Islamic law (KHI), this does not necessarily make the problem of polygamy is complete. Not a few perpetrators of polygamy choose married under the hand or by sirri. This research uses qualitative approach by implementing thematic interpretation method (maudhu'i) to obtain a comprehensive understanding about polygamy in the Qur'an. The Data obtained through the study of a library research by sharing the data that comes from the various verse of the Qur'an, hadith, book fiqh, research results, books and the news in various media outlets in order to complete the interpretation of the verses of polygamy. Based on the results of this research it is known that the verses of the Qur'an gives a very tight restrictions for those who want to in polygamy. Justice that the conditions of polygamy is not only were quantitative but also qualitative research. In the context of historical-socio, the command of polygamy is intended as a form of the solution to avoid injustice to orphans women. Even if polygamy still want to do, should the husband marrying the widows who have lighten the orphan.
