This study aims to describe and analyze the legal status of mineral mining companies' land in Central Sulawesi, and secondly to explore and/or find alternative concepts in the field of land use adopted by the community in the mining area and its surroundings. To achieve this goal, a sociological/socio legal research method will be used. Document studies are carried out through a search for legal materials; primary, secondary and tertiary to obtain some data, then field data collection was carried out in the form of observations, in-depth interviews and participatory discussions (PRA). The phenomenon of problematic mineral mining occurs in almost every region in Indonesia, including Central Sulawesi. These facts show the importance of this research to be carried out in Central Sulawesi. Mining business is carried out after obtaining a permit from the government, prior to agreement with the party who has land rights, the government has first issued a mining business permit (hereinafter abbreviated as IUP), after the IUP is issued then a settlement with the party who has land rights in order to obtain approval. Land rights are very important in this regard, so the author is of the opinion that in granting mining business permits, comprehensive and effective consultation and deliberation first need to be carried out, involving communities directly affected by mining business activities, so that land rights are guaranteed optimal

The phenomenon of inter-state marriage in Indonesia has an influence on legal actions in it, especially the issue of children born and having dual citizenship after Law Number 12 of 2006 concerning Citizenship was passed by the Government. This study aims to measure the extent to which children born from these marriages get inheritance rights with underage positions. In addition, what is the legal status based on Law Number 1 of 1974 concerning Marriage and Law Number 5 of 1960 concerning Land regarding the position of land inheritance rights. This study uses an empirical normative method, which combines legal research methods that not only view law as a prescriptive (determining) and applied scientific discipline, but also descriptive (explaining) based on the reality of legal developments in society. The results of this study indicate that children born from inter-state marriages who have dual citizenship and are still minors are entitled to land inheritance rights in the form of property rights provided that the child must choose Indonesian citizenship at the age of 18 (eighteen) years based on the laws and regulations. valid invitation.Fenomena perkawinan antar negara di Indonesia memberi pengaruh dalam perbuatan hukum di dalamnya, terutama persoalan anak yang lahir dan memiliki kewarganegaraan ganda setelah Undang-undang Nomor 12 Tahun 2006 tentang Kewarganegaraan disahkan oleh Pemerintah. Penelitian ini bertujuan untuk mengukur sejauh mana anak yang dilahirkan dari perkawinan tersebut mendapat­kan hak waris dengan kedudukan masih di bawah umur. Selain itu bagaimana status hukumnya berdasarkan Undang-undang Nomor 1 Tahun 1974 tentang Perkawinan dan Undang-undang Nomor 5 Tahun 1960 tentang Pertanahan terhadap kedudukan hak waris tanah. Penelitian ini menggunakan metode normatif empiris, yaitu melakukan penggabungan metode penelitian hukum yang tidak hanya memandang hukum sebagai disiplin ilmu yang bersifat preskriftif (menentukan) dan terapan, namun sekaligus bersifat deskriptif (memaparkan) yang didasarkan pada kenyataan perkembangan hukum di masyarakat. Hasil penelitian ini memberikan petunjuk bahwa anak yang dilahir­kan dari perkawinan antar negara yang berkewarganegaraan ganda dan masih di bawah umur berhak atas hak waris tanah berupa hak milik dengan ketentuan anak tersebut harus memilih kewarganegaraan Indonesia pada saat usianya 18 (delapan belas) tahun berdasarkan peraturan perundang-undangan yang berlaku.

The Writing of “The Synergicities of Policies and Strategies of Prevention  Terrorism’s Crime of Bali Province” are aimed to develop legal science in general and particular in the field of criminal’s law as well as knowing and studying the synergy between roles and strategies from the government, law enforcers and the community and to find, to analyze, to review and to provide legal solutions to obstacles in the effort to prevent terrorism in crime of Bali Province so it can be constructed to be an effective counter measures formulation. The method used in the achievement of the goal is approach Juridical Empirical method, namely legal research with facts approach by observation and in-depth interviews on object of research. The research was conducted on Bali Police, Kesbangpolinmas Bali, FKPT, FKUB, MUDP, and Religious figures in Bali. The results disclosed that each agency / organization / institution / individual has carried out the obligations according their tasks effectively and strive synergize the policies and strategies of prevention in terrorism. There are a few obstacles ranging from funding, facilities, quality-quantity of human resources to the constraints associated with legislation. By identifying several issues and to find the best solution for more effective prevention of acts of terrorism in synergy and sustainable.

This paper aimed to describe women and children marginalization in coal mining companies in East Kalimantan. Coal mining activities which is expected to support the national income of Indonesia, in fact, don�t give benefits to all parties, especially women and children. Local communities around the mining area are only obtained the environmental damage caused by the mining companies (in this case the mine excavation holes). This paper is expected to contribute in describing the impact of privatization by the government through ecofeminism lens.

Land registration aims to guarantee legal certainty and certainty of land rights. By holding land registration, the parties concerned can easily find out the status of the legal status of the particular land they are dealing with, their location, area and boundaries. And also as a condition for the implementation of orderly land administration. The purpose of this study is to find out the legal arrangements regarding the process of registering land rights and ownership status in order to confirm legal certainty and how to implement, constraint factors and solutions to problems that occur in the community. This research uses normative legal research methods. The normative method is writing that uses primary materials or data. In normative legal research, library materials in the form of basic data which in the study are classified as secondary data. Secondary data can include primary legal materials, secondary legal materials and tertiary legal materials. The results of the study indicate that the legal arrangements regarding the responsibilities of the Batam City National Land Agency in the process of registering land rights have been carried out well by the Batam City National Land Agency in order to realize legal certainty for the people of Batam City. However, in carrying out their duties there are still obstacles in the process of registering land rights in Batam City because of the imbalance of authority with the Batam Concession Agency as the holder of land management rights in Batam City. So, the solution is expected to have special regulations regarding this so that the process of registering land rights in Batam City can run in accordance with the laws and regulations.

<p>Abstract<br />This article aims to examine the legal aspects of the share divestment process carried out by  foreign mining companies in Indonesia and related to the obligation of the share divestment process offered to Indonesian Participants by Foreign Mining Companies according to the applicable legislation. This method of writing is legal research with a statute approach. Based on the research, the divestment arrangements in Indonesia still intersect with the non-compliance  of foreign mining companies and the uncertainty of regulations in the past, so that the divestment  process of foreign mining companies such as PT Freeport Indonesia had problems with the Government. The problem during the divestment of PT Freeport Indonesia's shares due to the incompatibility of permits granted by the Government through the Ministry of Energy and Mineral Resources to PT Freeport Indonesia was feared to provide bad influences for foreign mining companies which would later also divest.<br />Keywords: divestment; share; law; mining</p><p>Abstrak<br />Artikel ini bertujuan untuk mengkaji aspek hukum dari proses divestasi saham yang dilakukan  oleh perusahaan pertambangan asing di Indonesia dan terkait dengan kewajiban proses divestasi saham yang ditawarkan kepada Peserta Indonesia oleh Perusahaan Pertambangan Asing menurut perundang-undangan yang berlaku. Metode penulisan ini adalah legal research dengan pendekatan perundang-undangan (statute approach). Berdasarkan penelitian, pengaturan divestasi di Indonesia masih bersinggungan dengan ketidakpatuhan perusahaan pertambangan asing serta ketidaktegasan peraturan di masa lalu sehingga membuat proses divestasi perusahaan pertambangan asing seperti PT Freeport Indonesia sempat bermasalah dengan Pemerintah.. Permasalahan selama divestasi saham PT Freeport Indonesia terbentur pada ketidaksesuaian izin yang diberikan oleh Pemerintah melalui Kementerian Energi dan Sumber Daya Mineral kepada PT Freeport Indonesia dikhawatirkan dapat memberikan influensi yang buruk bagi perusahaanperusahaan pertambangan asing yang nantinya juga akan melakukan divestasi.<br />Kata kunci: divestasi; saham; hukum; pertambangan</p>

Abrasion is a natural disaster that results in the owner of the right to land losing the right to control, use or take advantage of the land, because the land is lost in part or in whole due to erosion by water. Article 27 of the Law On Agraria determines that property rights over land are destroyed if the land is destroyed. In this study, the author will analyze the legal status of property of land affected by abrasion with the formulation of the problem What is the legal status of property rights on land affected by abrasion according to Government Regulation Number 24 of 1997 concerning Land Registration and how to guarantee the protection of affected land rights abrasion. The results of this study are that the status of land rights affected by abrasion is abolished, both in the provisions of the Law On Agraria and Government Regulation Number 24 of 1997 concerning Land Registration because it is no longer compatible with physical data or juridical data as a strong evidence. The government has an obligation to provide guarantees and protection of rights to land affected by abrasion and those that have been affected by abrasion in part or in whole. On the basis of the state's right to control Article 2 of the Law On Agraria the state has the right to regulate land use, inventory, and maintenance to prevent and reduce the impact of abrasion on its citizens. The government can also provide compensation as contained in Article Number 24 of 2007 concerning Disaster Management which determines that the Government and regional governments are responsible for the implementation of disaster management.Abrasi merupakan bencana alam yang mengakibatkan pemilik hak atas tanah kehilangan hak untuk menguasai, menggunakan, atau mengambil manfaat atas tanah, karena tanah tersebut hilang sebagian atau seluruhnya akibat pengikisan oleh air. Pasal 27 UUPA menentukan hak milik atas tanah hapus, apabila tanahnya musnah. Pada penelitian ini, penulis akan menganalisa tentang status hukum hak milik atas tanah yang terkena abrasi dengan rumusan masalah Bagaimana status hukum hak milik atas tanah yang terkena abrasi menurut PP No. 24 Tahun 1997 tentang Pendaftaran Tanah  dan bagaimana jaminan perlindungan hak-hak tanah yang terdampak abrasi. Hasil dari penelitian ini adalah bahwa status hak atas tanah yang terkena abrasi adalah hapus, baik dalam ketentuan UUPA maupun PP No. 24 Tahun 1997 tentang Pendaftaran Tanah karena tidak sesuai lagi dengan data fisik maupun data yuridis sebagai alat bukti yang kuat. Pemerintah mempunyai kewajiban untuk memberikan jaminan dan perlindungan hak-hak atas tanah yang terdampak abrasi maupun yang sudah terkena abrasi baik sebagian maupun seluruh tanahnya. Atas dasar hak menguasai oleh negara Pasal 2 UUPA negara berhak mengatur peruntukan, penggunaan, persediaan,dan pemeliharaan tanah untuk mencegah dan mengurangi dampak abrasi bagi warga negaranya. Pemerintah juga dapat memberikan ganti kerugian sebagaimana yang ada di dalam UU No. 24 Tahun 2007 tentang Penanggulangan Bencana yang menentukan bahwa Pemerintah dan pemerintah daerah menjadi penanggung jawab dalam penyelenggaraan penang-gulangan bencana.

Conflicts between Governance actors are rife in the era of democracy as it is today. The purpose of this study is to analyze the problems of land conflicts faced by the community against the Bandung City Government which is in a joint coalition with PT Sartonia Agung. Those two parties had a dispute over land rights in RW 11 Tamansari to control the basis of rights for housing and the construction of Row House. The struggle of each party in the struggle for land in RW 11 Tamansari was carried out through an advocacy process with both formal and informal approaches. The Advocacy Coalition Framework in this study was used as a knife for analyzing the phenomena that occurred. The research methods used in this study were qualitative research by standing on the interpretative paradigm. The data were collected by conducting observations, in-depth interviews, and documentation relating to the outline of the research. The findings obtained from this study indicated that there was a formation of strong coalition domination by the government through aggressive and repressive behavior that raised a conflict of interest in the row house construction policy in Tamansari Subdistrict, Bandung City, which was rejected by the Coalition of the Tamansari community that was formed. The series of advocacy carried out by the Tamansari community coalition had not produced results in favor of the coalition that urged a change in the policy.

Abstract: The implementation of land registration acceleration for PTSL program in Muara Enim Regency is inhibited by the fact that most of the community had no land rights. The government issues various regulations, including Ministerial Regulation ATR/Ka.BPN No. 6 of 2018 as a regulation to ease acceleration in the implementation. The method in the present study was legal research method with judicial normative approach in studying the implementation of policy consistent with the regulation issued by the government. The research result was that the policy implementation by the Land Office of Muara Enim Regency was simplifying missing land rights by making SPPFBT statement as a replacement of land rights. There was no significant difference from the substance of land rights according to Government Regulation PP No. 24 of 1997 and Ministerial Regulation ATR/Ka.BPN No. 6 of 2018 so that replacement land rights in the form of SPPFBT statement could be interpreted as a simplifiedland rights replacement. The potential impacts were easiness to make SPPFBT without considering legal principles andprocess of acquisition of rights which could cause future dispute. Pemerintah mengeluarkan berbagai regulasi salah satunya yaitu Permen ATR/Ka.BPN No. 6 Tahun 2018 untuk mempermudah percepatan dalam pelaksanaannya. Penelitian ini bertujuan untuk mengkaji penggunaan SPPFBT sebagai dasar pengganti alas hak untuk pendaftaran tanah pada program PTSL. Metode penelitian yang digunakan adalah metode hukum dengan pendekatan yuridis normatif di dalam mengkaji penerapan kebijakan yang sesuai dengan peraturan yang dibuat oleh pemerintah. Penerapan kebijakan yang dilakukan oleh Kantor Pertanahan Kabupaten Muara Enim yaitu menyederhanakan alas hak yang tidak ada dengan pembuatan Surat Pernyataan Penguasaan Fisik Bidang Tanah (SPPFBT) sebagai pengganti alas hak. Tidak terdapat perbedaan yang signifikan terhadap substansi alas hak menurut PP No. 24 Tahun 1997 dan Permen ATR/Ka.BPN No. 6 Tahun 2018 sehingga alas hak pengganti berupa pernyataan SPPFBT dapat diartikan sebagai alas hak pengganti yang disederhanakan. Kemudahan dalam proses pembuatan SPPFBT yang tidak memperhatikan kaidah hukum dan cara perolehan hak dapat menyebabkan perkara sengketa di kemudian hari.

Complete systematic land registration is a program organized by the government, specifically the "Ministry of Agrarian Affairs and Spatial Planning or Head of the National Land Agency". with the aim of increasing the number of land registrations issuing certificates in Indonesia. This is very important, so it is hoped that the participation of the whole community in the importance of certificates and it is hoped that the National Land Agency will provide socialization about the importance of ownership of land rights. Its application is contained in the Regulation of the Minister of Agrarian Affairs and Spatial Planning or the Head of the National Land Agency of the Republic of Indonesia Number 6 of 2018 concerning Complete Systematic Land Registration. This study aimed to examine the process of implementing a complete systematic land registration and its obstacles and to examine the efforts to implement a complete systematic land registration in the village of Menanga, Rendang District, Karangasem Regency. The method used was empirical legal research. Sources of data used were primary and secondary legal data, then analyzed through interpretation and qualitative techniques. The results showed that the Implementation of Complete Systematic Land Registration in Menanga Village, Rendang District, Karangasem Regency was carried out to achieve legal certainty of land rights ownership. The implementation of this program has not been effective and has not been implemented optimally due to the low participation in the management of land certificates.

This research goals found out the regulation of the private port or terminal as own interests (TUKS) in Palu and described the cause of the owner of the private port un-comply to the port laws/regulation. This research is a normative legal research that trying to describe in general terms the facts which are found including the provisions of law in an abstract. Such observation and interviews conducted to support qualitative analysis. Regulation of the ports have been arranged by the government in the scope of national, however, in the scope of regional and local are still limited. Law number 7 of 2008 about shipping, government regulation number 61 of 2009 concerning port, decision of the minister of communication number 54 the year 2002 concerning special port meanwhile, in the scope regional and local regulation such as urban land use plan as well as coastal management of Palu. Violations of private or specific ports in their operations do they have not get permission from the directorate general of the transportation authorities. The causes occurrence or violations are such as complicated bureaucracy, regulations un-synchronize, omitted by authorities, and the illegal status of the port that was forced to operate. The recommendation that is ought to be fixed the regulation and/or controlling against port laws such special port as well special terminal.
