The main objective of this article is to substantiate the fact that historical consciousness as a form of social consciousness is full of the mythologisation of law. The main hypothesis is that only such forms of law as customary law and international law may be considered historical phenomena. Standalone in law, mainly subjective law is not actually a historical phenomenon; therefore, any historical interpretation of it leads to mythologisation. The subject of this study is the mythologisation of law, found in the content of several legal concepts and being present in correlations with basic historical concepts. The complexity of the problem posed is that the very phenomenon of history outside historical consciousness, especially in our time, is constantly subjected to serious mythologisation. The result of the study is the statement that historical legal understanding is not connected with the understanding of the nature of law and does not reveal its essence. The methodological consequence of this for legal theory is the need for concentration on the understanding of the development of law not as a historical, but only as a social process, and for the law itself – as something that exists and makes sense only in the present.

This paper explores the subject matter of legal informatics. The life-long work of the first author concerning the visualization and coding of statutes is generalized. Besides positive law and customary law, the emergence of machine law is a current topic of focus in the literature. In machine law, legal acts are posited by machines and not by humans (primarily in a situational context). The transformation of a legal act to a legal document can happen in two ways. First, it is a transformation of the legal act into explicit punctuation, for example, for announcement in the case of laws or for written execution in the case of judgments, and, second, as a trend towards electronic documents. Legal theory forms a meta-level to the law and similarly legal informatics forms a meta-level to legal information. Legal informatics in Austria is based on the work of Ota Weinberger, Ilmar Tammelo and Leo Reisinger and has been developed by Erich Schweighofer in the framework of the IRIS conferences. Legal informatics is distinguished from legal information, whereas legal logic and meta-theories appear on top of legal informatics. In terms of syntax, machine culture is characterized by formal notations. Notations of legal logic are just the beginning; the target is a technical notation, a basis for programming. Visualizations are in the middle. On the one hand, visualizations serve to understand people by breaking away from the textual; on the other hand, by emphasizing the formal they form a bridge to machines. Legal text can be translated directly into formal languages, but visualizations can facilitate this task as an intermediate methodological step. Hans-Georg Fill’s metamodeling can be seen as a metameta-level.

This chapter explores the development of the legal concepts of idiocy and imbecility over the eighteenth and nineteenth centuries, examining legal theory as well as evidence from civil court cases to reveal an ongoing conflict between libertarian resistance to state intervention in the lives of citizens, however mentally incapacitated they might be, and a belief that the state should be responsible for protecting individuals against exploitation and the corruption of bloodlines. From the late eighteenth century, French medico-legal theorists, supported by the ‘scientific’ enlightenment ideals of the French revolution, proposed a medicalised appropriation of legal decision-making over capacity. While these ideas gained some currency among a small group of British medical men working in the field of idiocy, they faced strong public and legal resistance throughout the nineteenth century on the grounds of liberty of the subject. Both legal and medical formulations of idiocy in the eighteenth and nineteenth centuries borrowed heavily from popular, ‘common-sense’ public notions about what constituted an idiot.

The subject of this research is the essential characteristic of the history of legal thought of the last two centuries, which directly pertains to the theoretical-methodological fundamentals of legal theory. In the conditions of the object-disciplinary establishment of legal science as the theory of law since the end of the XVIII century, crucial significance has acquired the orientation towards demarcation of logical-gnoseological and real-psychological aspects of legal understanding. The article analyzes the peculiarities of the corresponding theoretical-methodological opposition, which manifested in the appeals to the construction of “refined” legal concepts that exclude any real arguments of social, historical, political, or psychological nature. By the end of the XIX century, namely in the field of the philosophy of law, has escalated the competition between psychologism and anti-psychologism in law. The novelty of this research lies in determination of the new patterns of theoretical and methodological opposition of psychological and anti-psychological attitudes of legal understanding in the evolution of legal thought in contemporary history. It is demonstrated that the phenomenological approach, which claimed to provide jurisprudence with an authentic scientific methodological apparatus, reduced the problem of legal understanding, however, did not contribute to the adequate understanding of law as a complex gnoseological object. Anti-psychological classification of phenomenology cannot be acknowledged without a profound analysis of the conceptual framework that contributed to the evolution of this approach in the sphere of cognition and interpretation of law.

В современной методологии юриспруденции происходит переход от изучения состо­яний ее объекта, которыми выступают право и государство, к постижению этого объек­та в его изменениях и превращениях. Две подсистемы методологии юриспруденции, подсистема обращенная к состоянию права и государства; и подсистема обращенная к изменениям права и государства, — получают свое отображение в концептуальной форме, методологических подходах, методах, специфических понятиях. Показательны перемены в содержании методологии юриспруденции, где определяю­щее значение имеют методологические подходы, определяющие стратегию исследова­тельских поисков во взаимосвязи юриспруденции с правом и государством. Среди наи­более характерных подходов антропологический, аксиологический, цивилизационный, синергетический и герменевтический — определяют плюралистичность современной методологии и свидетельствуют о становлении новой парадигмы методологии юриспру­денции.   In modern methodology of jurisprudence there is a transition from the study the states of its object to its comprehension in changes and transformations. Hence the two subsystems of methodology of jurisprudence: subsystem facing the states of the law and the state as well as their components and aspects; and subsystem facing the changes of the law and the state in general and their constituents. These subsystems of methodology of jurisprudence receive its reflection in conceptual form, methodological approaches, methods, specific concepts. Methodology of jurisprudence should not be restricted to the methodology of legal theory. In this regard, it is an important methodological question about subject of jurisprudence. It is proposed to consider the subject of jurisprudence as complex, covering both the law and the state in their specificity, interaction and integrity. Indicative changes in the content methodology of jurisprudence are the usage of decisive importance methodological approaches that govern research strategy searches in conjunction with the law and the state. Among the most characteristic of modern development approaches: anthropological, axiological, civilization, synergistic and hermeneutic. Modern methodology of jurisprudence is pluralistic in nature alleging various approaches to the law and the state. Marked approaches allow the formation of a new paradigm methodology of jurisprudence.

The purpose of the article is to typologize terminological definitions of security, to find out the general, to identify the originality of their interpretations depending on the subject of legal regulation. The methodological basis of the study is the methods that made it possible to obtain valid conclusions, in particular, the method of comparison, through which it became possible to correlate different interpretations of the term "security"; method of hermeneutics, which allowed to elaborate texts of normative legal acts of Ukraine, method of typologization, which made it possible to create typologization groups of variants of understanding of the term "security". Scientific novelty. The article analyzes the understanding of the term "security" in various regulatory acts in force in Ukraine. Typological groups were understood to understand the term "security". Conclusions. The analysis of the legal material makes it possible to confirm that the issues of security are within the scope of both legislative regulation and various specialized by-laws. However, today there is no single conception on how to interpret security terminology. This is due both to the wide range of social relations that are the subject of legal regulation and to the relativity of the notion of security itself and the lack of coherence of views on its definition in legal acts and in the scientific literature. The multiplicity of definitions is explained by combinations of material and procedural understanding, static - dynamic, and conditioned by the peculiarities of a particular branch of legal regulation, limited ability to use methods of one or another branch, the inter-branch nature of some variations of security, etc. Separation, common and different in the definition of "security" can be used to further standardize, in fact, the regulatory legal understanding of security to more effectively implement the legal regulation of the security direction.

The topic acquires its importance from a search in the strategies of the frivolous state and its characteristics with the ability to influence the regional, and what it revealed is a turning point in how to adapt from the variables and employ them to their advantage and try to prove their existence. Thus, the problem comes in the form of a question about the possibility of the frivolous state in light of the context of various regional and international events and trends. The answer to this question stems from the main hypothesis that (the aim which the frustrating state seeks to prove is that it finds itself compelled to choose several strategies that start from the nature of its characteristics and the goals that aim at it, which are centered in the circle of its interests in the field of its struggle for the sake of its survival and area of influence).

В течение последних нескольких десятилетий проблемы терминологии привлекли внимание многих исследователей и ученых, что может объясняться растущей важностью науки в жизни людей. Развитие медицинской терминологии началось много веков назад и продолжается по сей день. Основная цель этой работы заключается в рассмотрении терминологического глоссария сердечно-сосудистой системы, созданного на основе  Nomina Anatomical 2001 года, а также в комплексном анализе перевода специализированной терминологии. Наряду с разработкой испано-русского двуязычного глоссария, мы также обратили внимание на анализ собранных данных и комментарии, которые могут предотвратить ошибки и путаницу среди переводчиков и получателей переведенной информации. Для достижения целей мы прибегли к методу анализа параллельных текстов на выбранную тему в испанском и русском языках, а также к методу визуализации, что позволило нам перевести термины из списка и гарантировать высокий уровень точности, объективности, корректности, эквивалентности и адекватности. Основной гипотезой данной статьи является то, что, несмотря на греческое и латинское происхождение большинства выбранных терминов на испанском и значительной их части в русском языке, дословный перевод представляет собой наиболее серьезную и наиболее распространенную ошибку, которую совершают переводчики медицинских текстов, что объясняется особенностями развития медицинских систем в русском и испанском языках, где каждая отрасль терминологии сосредоточилась на своих собственных эволюционных принципах.Resumen: En las últimas décadas, los problemas de la terminología han llamado la atención de muchos investigadores y científicos, lo cual se explica por la creciente importancia que adquiere la ciencia en la vida de las personas. La terminología médica empezó su formación hace siglos y sigue desarrollándose hasta el momento. El objetivo de nuestro trabajo es dar cuenta de la creación de un glosario de la terminología del sistema cardiovascular basada en la Nómina Anatómica del año 2001 y un análisis exhaustivo de la traducción de términos realizada. Además de la elaboración de un glosario bilingüe español-ruso también nos hemos centrado en el análisis de datos recogidos y comentarios que pueden prevenir errores y confusiones para los traductores y otros destinatarios. Para conseguir los objetivos propuestos hemos optado principalmente por el método de análisis de textos paralelos acerca del tema elegido en español y en ruso, así como el de la metodología de visualización, lo que nos ha permitido traducir los términos de la lista representada garantizando el máximo nivel de fidelidad, objetividad, precisión, equivalencia y adecuación. La hipótesis principal del presente artículo consiste en que, a pesar del origen griego y latín de la mayoría de los términos seleccionados en castellano y una gran parte de los términos en ruso, la traducción literal de éstos representa el error más grave y más frecuente de los traductores de los textos médicos ya que debido a las peculiaridades del desarrollo de los sistemas de lenguajes médicos en español y en ruso, la terminología de cada idioma ha seguido sus propias pautas de evolución.Abstract: During the last few decades the problems of terminology have caught the attention of many researchers and scientists which can be explained by the growing importance of science in the lives of people. Medical terminology formation began centuries ago and keeps developing nowadays. The main objective of this paper is to discuss the terminological glossary of the cardiovascular system created based on the Nomina Anatomical 2001 as well as the comprehensive analysis of specialized terminology translation. Apart from the development of the Spanish-Russian bilingual glossary, I have also focused on the analysis of data collected and comments that can prevent errors and confusion among translators and recipients of the translated information. To achieve the objectives the method of analysis of parallel texts on the subject chosen has been used in Spanish and in Russian, as well as that of visualization, which allowed us to translate the terms from the list and guarantee the highest level of fidelity, objectivity, accuracy, equivalence and adequacy. The main hypothesis of this article is that, despite the Greek and Latin origin of most of the terms selected in Spanish and a large part of the terms in Russian, their literal translation represents the most serious and most common mistake that translators in healthcare setting make due to the peculiarities of the development of medical systems in Spanish and Russian languages, where each language terminology has followed its own guidelines of evolution.

Abstract At the core of Hohfeld's contribution to legal theory is a conceptual framework for the analysis of the legal positions occupied by agents in intersubjective legal relations. Hohfeld presented a system of eight “fundamental” concepts relying on notions of opposition and correlation. Throughout the years, a number of authors have followed Hohfeld in applying the notion of opposition to analyze legal concepts. Many of these authors have accounted for Hohfeld's theory in direct analogy with the standard deontic hexagon. This paper reviews some of these accounts and extends them employing recent developments from opposition theory. In particular, we are able to extend application of opposition theory to an open conception of the law. We also account for the implications of abandoning the assumption of conflict-freedom and admitting seemingly conflicting legal positions. This enables a fuller analysis of Hohfeld's conceptual analytical framework. We also offer a novel analysis of Hohfeld's power positions.

This essay explores how early approaches in feminist aesthetics drew on concepts honed in the field of feminist legal theory, especially conceptions of oppression and equality. I argue that by importing these feminist legal concepts, many early feminist accounts of how art is political depended largely on a distinctly liberal version of politics. I offer a critique of liberal feminist aesthetics, indicating ways recent work in the field also turns toward critical feminist aesthetics as an alternative.

This chapter expounds on the Islamic perspective on freedom and human rights, and draws references from multiple Islamic thinkers on the subject. It asserts that freedom, according to the Islamic worldview, is a trust, a responsibility, an awareness of the truth, a commitment to follow it, and a dying to self for its sake. According to its literal meaning, freedom is permission and choice, or simply following one's instincts. Freedom is thus the power to choose between good and evil—a divinely appointed responsibility. Furthermore, according to the specialists in legal theory, in its ethical and legal meaning freedom means “conformity.” Freedom is to exercise responsibility in a positive way, fulfilling one's duty in in a spirit of obedience by following what is commanded and avoiding what is forbidden.
