This article discuss about case study on how Indonesian Football Association (Indonesian FA) give their respond to do the Public Information Disclosure. Indonesian FA than express their objection to the demand. Indonesian FA choose as the object in this case, as a representative of non-governmental public organization. This article use Indonesian FA statement related to the Public Information Disclosure, that posted on official website www.pssi.org. Then I use frame analysis Robert N.Entman model as a analytical tool to the statement. The results show that there are two factors that cause Indonesian FA objection. First is structural factor that came from the Indonesian Public Disclosure Act and Act related to the management of football federation. The second is cultural factor that non-governmental public organization in Indonesia, in general, not accustomed to public disclosure obligation.  Tulisan ini mengambil studi kasus bagaimana Persatuan Sepakbola Seluruh Indonesia merespon tuntutan untuk Keterbukaan Informasi Publik. Keputusan Komisi Informasi Pusat (KI Pusat) bahwa PSSI harus menerapkan praktek Keterbukaan Informasi Publik mendapatkan keberatan dari pihak PSSI. Permasalahan pun berbuntut panjang hingga sampai di persidangan tingkat Mahkamah Agung. PSSI dipilih sebagai objek penelitian guna mengkaji bagaimana badan publik non-pemerintah memahami Keterbkaan Informasi Publik. Data dalam tulisan ini menggunakan pernyataan-pernyataan yang disampaikan PSSI melalui website www.pssi.org berkaitan dengan keputusan KI Pusat. Pernyataan tersebut kemudian dianalisis menggunakan framing model Robert N.Entman. Analisis menunjukkan terdapat kendala struktural dan kultural. Faktor struktural datang dari peraturan yang berkaitan dengan PSSI dan peraturan di UU KIP itu sendiri. Sedangkan faktor kultural berkaitan dengan kondisi badan publik non-pemerintah yang tidak terbiasa menghadapi tuntutan keterbukaan informasi.

Abstract:This study aims to describe the application of Law Number 14 of 2008 concerning Public Information Openness at the State Islamic Higher Education (PTKIN) with a case study of the Syarif Hidayatullah State Islamic University in Jakarta. UIN Syarif Hidayatullah Jakarta was chosen because among PTKIN throughout Indonesia, only UIN Jakarta has an Information and Documentation Management Officer (PPID). The research method used is action research by observing public bodies in the field of education namely UIN Jakarta by mapping public information services by PPID based on KMA Number 200 of 2012 concerning Information and Documentation Management Officials (PPID). Based on the research conducted it is known that PPID as the manager of public information services has not been optimal in providing public information services according to the mandate of Law Number 14/2018. The contributing factors are: First, the leaders at the level of the Bureau, Section, and Subbag many who do not know the obligations and urgency of the public body that must have a PPID to carry out public information management and services. Secondly, the incomplete list of public information that has been displayed on the UIN Jakarta website includes its supporting documents. Third, there is no infrastructure support, funds, adequate information officers so that the performance of the PPID can run simultaneously and continuously, given the PPID task is an additional task.Keywords: PPID, Public Information Disclosure, PTKIN. AbstrakPenelitian ini bertujuan mendeskripsikan penerapan Undang-Undang Nomor 14 Tahun 2008 tentang Keterbukaan Informasi Publik di Perguruan Tinggi Agama Islam Negeri (PTKIN) dengan studi kasus UIN Syarif Hidayatullah Jakarta. UIN Syarif Hidayatullah Jakarta dipilih karena diantara PTKIN seluruh Indonesia, baru UIN Jakarta yang telah memiliki Pejabat Pengelola Informasi dan Dokumentasi (PPID). Metode penelitian yang digunakan action research dengan melakukan observasi badan publik bidang pendidikan yakni UIN Jakarta dengan memetakan layanan informasi publik oleh PPID berdasarkan KMA Nomor 200 tahun 2012 tentang Pejabat Pengelola Informasi dan Dokumentasi (PPID). Berdasarkan penelitian yang dilakukan diketahui bahwa dari PPID sebagai pengelola layanan informasi publik belum optimal dalam memberikan layanan informasi publik sesuai amanat UU Nomor 14/2018. Faktor penyebabnya adalah: Pertama, para pimpinan pada level Biro, Bagian, dan Subbag banyak yang belum mengetahui kewajiban dan urgensi badan publik yang harus memiliki PPID untuk melakukan pengelolan dan pelayanan informasi publik. Kedua, belum lengkapnya Daftar Informasi Publik yang telah ditampilkan di website UIN Jakarta termasuk dokumen-dokumen pendukungnya. Ketiga, belum adanya dukungan prasarana, dana, petugas informasi yang memadai sehingga kinerja PPID dapat berjalan secara simultan dan kontinyu, mengingat tugas PPID adalah tugas tambahan.Kata Kunci: PPID, Keterbukaan informasi Publik, PTKIN.

The ability of the government to provide the availability of information with a variety of infrastructure and adequate content, accompanied by an attitude of openness and adequate mechanisms and procedures will facilitate the public to contribute or participate positively. The provision of information in the government is carried out by Public Information Management Officers (PPID) in each Public Agency. This research was conducted to find out how the understanding of PPID in the West Sumatra Province Tourism Office towards public information disclosure, knowing the meaning of information applicants and knowing the meaning of public information openness by the PPID in the West Sumatra Province Tourism Office. The method used in this study is a qualitative method with a phenomenological approach. The results showed that the understanding of PPID in the West Sumatra Province Tourism Office towards public information disclosure is quite good. The PPID is able to take responsibility for the mandate of Law Number 14 Year 2008 on Public Disclosure of information, which is responsible for storing, documenting and providing public information by supplying public information data available at the West Sumatra Province Tourism Office to the PPID in West Sumatra Province Government. The meaning of information applicants for PPID in the Tourism Office of West Sumatra Province is as a party that must be served and has the right to obtain public information because they are guaranteed by the Public Disclosure of information Law. While the meaning of public information disclosure for PPID in the West Sumatra Province Tourism Office is the guarantee for the public to get information from public agencies. At present the development of technology and information has reached a very rapid level. Technology and information are used as a service media in the government environment which is also known as e-Government, one of which is the service of public information disclosure. The central government through Law No. 14 of 2008 concerning Openness of Public Information, encourages all Public Agencies including the Sleman Regency Government to make transparency in the administration of the state by utilizing information technology. This research is a qualitative descriptive study which aims to describe the reality that occurs. The object of research in this study is the official website of the Information and Documentation Management Officer (PPID) of Sleman Regency with the domain https://ppid.slemankab.go.id then the Sleman Regency Communication and Informatics Office as the organizer of the public information disclosure program. The data collection technique itself is carried out by means of interviews, documentation studies, and field observations (observations). After collecting and presenting data, then the data will be reduced first then analyzed and concluded. From the results of the study, in general the researchers concluded that the Sleman Regency PPID website had reached the level of qualification to become a quality website, however there were still some improvements and evaluations that had to be done by the relevant agencies in order to be better, namely (i) the website was still being assessed as a one-way service (ii) There are still many OPDs that are not ready to implement PPID (iii) data and information are still not updated (iv) lack of responsiveness of services in requests for information.

The many cases of corruption that have come to light, among other scandals, have led the public to lose faith in the management of public institutions. In order to regain confidence, the government needs to inform its citizens of all its actions. Public information should be accessible and controlled by means of a regulatory framework. The aim of this chapter is to analyze the transparency achieved and the progress still needed to be made by Dominican Republic municipalities with regards to complying with the requirements of the law on public information management. The chapter discusses the voluntary transparency achieved and factors that affect the implementation of information policies. The results highlight deficiencies in certain areas of online public information disclosure. The population size, economic capacity and electoral turnout are all factors that affect the online dissemination of public information by local governments in the Dominican Republic.

Purpose The tenuous financial viability of many of Georgia’s rural hospitals has driven increased scrutiny of the hospital authorities (HAs) that own and govern them. HAs are a type of “special district” established in state law to allow for specialization of function, while evading statutes that can limit local government borrowing and multi-year contracts. The paper aims to discuss this issue. Design/methodology/approach This paper uses a case example to introduce transparency and accountability in one local Georgia hospital and expands to include a descriptive analysis of transparency measures in 29 rural Georgia HAs. Findings Findings indicate that, like many other special districts in Georgia and the USA, Georgia’s rural HAs often act more like private entities than the public organizations they are. The lack of transparency demonstrated in this sector limits access to public information and reduces opportunities for citizen engagement, a necessary component of representative institutions. Research limitations/implications This case study is limited to Georgia HAs; however, the data support the lack of accountability and transparency found in many special district governments. Originality/value The lack of transparency in all of the organizations reviewed in this study demonstrates blurred lines between between public matters and private interests and raises questions of transparency, a key value in democracies.

This retrospective case study of merger efficiencies focuses on the 1996 merger of two large, U.S. rail networks. Information on the public record permits some evaluation of pre-merger efficiency claims, and the weighing of those claims against regulatory and antitrust standards. Access to additional public and non-public information also permits at least a preliminary determination that a number of the claimed efficiencies were plausibly merger-specific and actually realized post-merger. This is contrary to skepticism expressed about merger efficiency claims, both generally and with respect to this particular rail merger, and thereby illustrates the value of doing retrospective studies of merger outcomes.

District office is one of the government agencies. This office certainly produces documents in every administrative process and policy. The document management provides a good solution for each document in order to be accessed and used by users. The improper document management causes difficulty to find the needed documents. Moreover, the document is very difficult to access because it is only kept by certain people for various reasons. Besides, the document is also public rights that should be accessed by many people. An Act number14 in 2008 on Public Information Disclosure indicates that the document is a certain entity to reduce a public dispute so that it is mandatory matter that must be done. Under this condition, it is expected that the document must be stored in the websitebased application to allow all parties to easily access the document stored.

This article examined the problem to reduce divorces outside the court. The Malaysian government has established sanctions for the perpetrators. This research was conducted employing a case study approach with descriptive-analysis method. The results showed that the implementation of divorce sanctions outside the Syariah Subordinate Court of Selangor was less effective in reducing divorces. The high number of divorce cases were found in the country of Selangor, increasing by 71.8% of cases from 2012 to 2017. However, the cases in the West Gombak Syariah Subordinate Court has decreased slightly between 2015 and 2017, indicated by only a few cases were registered. Two factors influenced the implementation of divorce sanctions outside the Syariah Subordinate Court. First, the Selangor Islamic Family Law has regulated the divorce law outside the court in a detailed and clear. Still, the socialization for the public was lacking, and the society took this rule seriously so that the sanction implementation for divorce cases outside the court became a legal solution. Second, the high number of divorce cases found outside the court required a legal policy to impose a legal sanction on the perpetrators. Abstrak: Artikel ini mengkaji masalah untuk mengurangi talak di luar Mahkamah, pemerintah Malaysia telah menetapkan sanksi bagi pelaku. Penelitian ini dilakukan dengan pendekatan studi kasus dengan metode deskriptif-analisis. Hasil penelitian menunjukkan bahwa: Pelaksanaan sanksi talak di luar Mahkamah Rendah Syariah Selangor masih kurang efektif dalam mengurangi perceraian. Kasus perceraian ditemukan cukup banyak di negeri Selangor sebanyak 71.8% kasus meningkat dari tegang waktu tahun 2012 hingga 2017 namun kisaran kasus di Mahkamah Rendah Syariah Gombak Barat agak sudah sedikit menurun dari tahun 2015 hingga 2017 hanya ditemukan beberapa kasus yang terdaftar. Faktor-faktor yang mempengaruhi pelaksanaan sanksi talak di luar Mahkamah Rendah Syariah Selangor ada dua. Pertama, Enakmen Hukum Keluarga Islam Negeri Selangor telah diatur hukum perceraian di luar mahkamah secara rinci dan jelas, namun masyarakat masih kurang sosialisasi dan mengambil berat terhadap aturan ini sehingga penerapan sanksi atas kasus talak di luar mahkamah muncul sebagai solusi hukumnya. Kedua, banyaknya temuan kasus talak di luar mahkamah mengharuskan adanya kebijakan hukum berupa penjatuhan sanksi hukum bagi pelakunya. Kata Kunci: Efektivitas, Sanksi, Talak, Luar Mahkamah

A confidentiality clause is a clause in investor-state contracts which is in the operative part of the contract to guarantee adequate protection of the trade secrets of the contracting parties. This article argues that there is a need to change the current practice where investor-state contracts in Indonesia utilizes broadly defined confidentiality clauses as a means to protect trade secrets in international business transactions. This is because a broadly defined confidentiality clause is contradictory to the provisions of the Act on Public Information Disclosure (APID). APID is aimed mainly at providing public information disclosure. The public information includes public contracts, such as investor-state contracts. Therefore, a new model of the confidentiality clause is needed for the protection of trade secrets as intended by the Act on Trade Secrets (ATS) and contract law as well as public information disclosure as intended by APID. This article employs doctrinal legal research. The research utilized, primary, secondary, and tertiary legal authorities. The primary legal material intensively used in this article consists of mandatory-primary legal authorities, in the form of statutes and contracts. The contracts used are the investor-state contracts of Aceh Province, Indonesia. The finding shows that a new model of the confidentiality clause can be created by accommodating both the interest of the state for providing public information disclosure based on APID and the interest of investors for the protection of trade secrets based on ATS and contract law. Investor-state contracts are a specific type of contract which has specific characteristics that apply to both private law and public law. They are different from purely international commercial contracts which only apply private law. Investor-state contract drafters need to be aware of this difference and provide a more balanced confidentiality clause in the contracts.

Abstract (English)The purpose of this study was to determine the extent to which the implementation of the Law on Public Information Disclosure No. 14/2008 at the Communication and Information Office of Baubau City. The method uses the Merilee S. Grindle Policy Implementation model, which implements it is very supportive of the content of the policy (Content of Policy) and the context of its implementation (Context of policy) and in its implementation, it has been running optimally but there are still some problems that cause disputes over public information. Other research results show that the Baubau City Communication and Informatics Office has been very good at providing public information services that have been previously requested by the community. The applicant's lack of understanding regarding the Law on Public Information Disclosure made the Office have to provide as detailed an explanation as possible about the Law. Pemahaman yang kurang dari pemohon informasi mengenai UU Keterbukaan Informasi Publik membuat Dinas tersebut harus memberikan penjelasan yang sedetail mungkin mengenai UU tersebut. Pemahaman pegawai Dinas Komunikasi dan Informasi Kota Baubau mengenai UU Keterbukaan Informasi Publik sudah cukup baik, namun ada menjadikan permohonan terhadap suatu informasi dibuat berbelit-belit serta menjadikan kurang diterima oleh masyarakat. Kata Kunci: Pelayanan Publik; Pemerintah; Sistem Informasi Publik; Teknologi Informasi dan Komunikasi;  Masyarakat
