In this article, the author suggestively points to the importance of understanding the concept of nation and the state in the context of the European philosophical thought and practice regarding the nation and the state. Although the occasion is about the Bosniak/Bosnian nation and the Bosnian state, the author’s reflections are applicable to all groups similar to the Bosniak/Bosnain nation, as well as to all the states similar to the Bosnian state. The basic premise of this article is that the idea of a universal nationality, culture and civilisation does not oppose or negate the particular feeling or the subjective experience of either the nationality or the state. The membership of European Union does not detract the right for any nation in Europe of the right to cultivate and develop its national culture as well as its particular state consciousness. In fact, in the extent of which every nation and every state in Europe has an active awareness of its national and cultural specific value, gives Europe, indeed – the European Union strong and important role in the global community. Hence, the Bosniaks/Bosnians, both as a nation and a state (nation) have no need to withdraw, but rather have the historical opportunity to feature their specific Bosnian culture and Bosnian state as a richness worthy of appreciation, not only in Europe, but also in the world.

The missing person issue has recently become the issue of the world, especially after the Malaysian Airlines MH370 tragedy a few years ago. In Islam, the missing person is known as ‘Al-Mafqud’. One of the largest issue is how the management of missing person’s properties which can also affect country and their heirs. Management of missing person’s properties is different as compared to management of inheritance properties. Uncertain status of person’s life or death creates the conflict and their property needs to be frozen due to law constraints either in Malaysia civil or syariah law. This phenomenon raises many issues and problems that become increasingly critical and extremely difficult to resolve. Besides, if the muslim’s properties do not develop, it can cause detrimental effect to the muslim community. In Islam, the wastage of wealth resource is highly discouraged because it will cause significant impact to the Muslims. Moreover, if the property is used wisely, it will give a positive impact to the society, economy and education. On that matter, in 1982 National Fatwa Committee has already given the decree that the government has the right to acquire or use any form of property that is not used for public interest. But until now, no effective measures have been taken by the government to ensure that these issues can be dealt with properly. Hence, this research addresses the management of missing person’s properties in the Maqasid Syariah dimensions.

Abstract. The Islamic education, Islamic boarding schools and madrasas, have made a very significant contribution to the implementation of education and social reform. Through the teaching process, in which the kyai as the main figure and the use of the ‘yellow book’, traditional Islamic ideas colored the early days of growing awareness as a nation and a State. When the New Order government carried out the development and modernization of society, there was a revival of a Muslim group called the “new middle class santri”, which took place in line with the modernization that occurred in the traditional Islamic educational institutions of the pesantren. Then in the era of democratization, the world of Islamic education experienced growth and development in various religious institutions and styles. Most of the pesantren are still committed to maintaining a moderate religious style, recognized as the foundation for the development of civil society and the formation of a ‘distinctive’, friendly, moderate, and tolerant social-political identity of Indonesian society. The Muslim character is different from other regions, especially the Middle East which is the axis of the Islamic world. However, a small proportion of pesantren are thought to promote the growth of religious chauvinism, teach a ‘narrow’ interpretation of Islam and provide a framework of thought and action in responding to socio-political change which often takes the form of a ‘jihad’. This article tries to explore the contribution of Islamic education to social change in the Indonesian Muslim community. Abstark.
