<p><em>West Kalimantan Province, as one of provinces in Indonesia which has specific geographical condition is bordering with East Malaysia through official Cross-Border Post between Entikong and Tebedu, Badau and Lubuk Antu, Aruk and Biawak, and no less than fifty path ways (not official) can be passed to get in and get out to and from East Malaysia region. This geographical encouraged trafficking improvement to abroad with various modes. In fact, trafficking was affected by many factors, including stigma, poverty, lack of education, family resilience, and other factors, where women and children are the victim. The aim of this research to reveal how is the legal protection for the victim. Although there were many studies had been done about it, but the focus of this research is the obstacles face to give legal protection for the victims of trafficking in West Kalimantan border, where the top of the problem is victims role, sometimes they don’t realize that they are the victims, so legal protection effort as stipulated in Trafficking Rules was not optimal. Through socio-legal research found an interesting thing, the lack of victim realized they were victims who have to get legal protection, so complicated a legal assistant for legal effort. Beside of that, trafficking as transnational crime and organized, it is complicated for legal enforcement, because of trafficking perpetrators are in the state border cross.</em><em> </em><em>The abstract contains: research objectives, implementation methods, analysis techniques and activity results. Research in connection with jurnal writing thesis takes the theme the protection of the law against companies factor in billing accounts receivable factoring transactions. Problems studied involves two things; the first what factors the company’s legal position as a buyer on receivables in factoring and financing institution both what form of legal protection that can be given to companies factor of a possible failure of the trade receivables collection. This includes research conducted legal research categories, namely normative legal research literature or legal research based on secondary data. The approach used is the approach ot the laws and facts approach. Next to for further analysis techniques use the description legal interpretation techniques based argumentative theory, principles, and concepts relevan laws. The results showed that the company,s legal position as a purchaser of  factoring receivables is very weak and vulnerable than risk the possibility of failure of collection of accounts receivable due to non fulfillment of the achievements by the customer. In this context there is no guarantee of  legal protection for the company for the payment or refund factor its receivables in full. The next from legal protection that can be given to the factor as a buyer of receivables is; a) apply the type of recourse factoring in the factoring agreement with the burden of responsibility is on the client in case of failure of collection of accounts receivable, b) implement a system of personal/corporate guarantees, and c) apply the prudential banking principles

The Covid-19 pandemic has had the worst impact, namely the increased vulnerability of children to become victims of violence. The Covid-19 pandemic has stimulated an increase in cases of violence against children, so in this case a legal protection is needed to fulfill the rights obtained for every child. The purposes of this study are to reveal legal arrangements in an effort to prevent violence against children during the COVID-19 pandemic as well as legal protection for children who experience violence during the COVID-19 pandemic. The research method used in this research is normative legal research with a statutory approach. The technique of collecting legal materials used in this research is the study of documents or library materials. The sources of legal materials used are primary and secondary sources of legal materials. The data analysis techniques were analyzed qualitatively and presented descriptively. The results of the study revealed that the government's efforts to prevent violence against children during the Covid-19 Pandemic were pursued through preventive legal protection with the aim of preventing violations before the occurrence of violations and repressive legal protection in the form of sanctions such as fines, imprisonment, and additional penalties given if a dispute has occurred or has occurred. a violation is committed. All parties, both families and the government, should try to protect children from all acts of violence.

Children are the next generation of the nation's future ideals asset as human resources for future national development, but today there are so many children who got violence in their lives. This research aims to analyzes the responsibilities of the government and contribution of Pusat Pelayanan Terpadu Pemberdayaan Perempuan dan Anak related to the provision of protection against acts of violence. this research is normative legal research by conducting a study of rules, doctrines, and also legal principles. Secondary data collection was carried out using the library study method with various legal materials analyzed descriptively by the method of the statute and conceptual approach. This research shows that the government has provided legal protection for rights related to violence in the form of legal products in the form of Undang-Undang No.39 Tahun 1999 tentang Hak Asasi Manusia and Undang-Undang No 35 Tahun 2014 tentang Perlindungan Anak. In addition to through legal products, the government also provides protection to children through the Komisi Perlindungan Anak Indonesia land Komisi Perlindungan Anak Indonesia Daerah and Pusat Pelayanan Terpadu Pemberdayaan Perempuan dan Anak as a service center that empowers women and children in various fields such as development, providing protection for women and children against various forms of discrimination, trafficking in persons, and acts of violence. Anak merupakan generasi muda penerus cita-cita perjuangan bangsa sekaligus modal sumber daya manusia bagi pembangunan nasional ke depannya, Namun dewasa ini terjadi begitu banyak anak yang mengalami tindak kekerasan dalam kehidupannya. Tulisan ini bertujuan untuk menganalisis tanggung jawab pemerintah dan kontribusi Pusat Pelayanan Terpadu Pemberdayaan Perempuan dan Anak terkait dengan pemberian perlindungan terhadap tindak kekerasan. Jenis penelitian yang digunakan adalah metode hukum normatif dengan melakukan kajian terhadap aturan, doktrin dan juga prinsip hukum. Pengumpulan data sekunder dilakukan dengan menggunakan metode studi kepustakaan dengan berbagai bahan hukum yang dianalisis secara deskriptif dengan metode pendekatan peraturan perundang-undangan dan konseptual.  Tulisan ini menunjukkan, Pemerintah telah memberikan perlindungan hukum terkait dengan tindak kekerasan dalam bentuk produk hukum berupa Undang-UndanglNo.39ltahunl1999 tentang Hak Asasi Manusia dan Undang-UndangMNoM35 TahunN2014 tentang Perlindungan Anak. Selain melalui produk hukum, pemerintah juga memberikan perlindungan kepada anak melalui Komisi Perlindungan Anak Indonesia dan Komisi Perlindungan Anak Indonesia Daerah serta Pusat Pelayanan Terpadu Pemberdayaan Perempuan dan Anak sebagai pusat pelayanan yang melakukan pemberdayaan terhadap perempuan dan anak dalam berbagai bidang seperti pembangunan, pemberian perlindungan bagi perempuan dan anak terhadap berbagai bentuk diskriminasi, perdagangan orang, dan tindak kekerasan.

This study aims to describe how the role of LBH APIK Banten in providing legal protection for the society. Qualitative descriptive was used in this study. A Director, an Advocate, Management of LBH APIK Banten, and society who had been assisted in handling their cases by LBH APIK Banten were employed as the subjects of this research. Interviews, an observation, and documentation were used as data collection technique. Data reduction, data presentation, and drawing conclusions were employed to analyze the data of this research. Data validity was done by technical triangulation, source triangulation, and member check. The results revealed  that there was an active role from LBH APIK Banten in providing legal protection for the society including public services, social education, orderly legal improvement, and legal reform. So far, LBH APIK Banten has been provided legal protection for society who had violence against women and children by helping and handling their cases until they got a verdict. In carrying out its role in providing legal protection to underprivileged people, there were  obstacles definitely, where the cases handled by LBH APIK Banten were specific such a handling special cases of violence against women and children who had domestic violence, sexual harassment, abuse, rape, and children abuse. Surely, it was rarely reported by someone who had violence such as abuse, rape, domestic violence, etc in Banten. Therefore, there were slightly cases handled by LBH APIK because of the limited disposition of LBH APIK that handling specific cases of women and children then the lack of Human Resources and funds until very slightly in doing an activity, hampered by Legal Enforcement Officials (APH) and the lack of openness’ client in telling the cases’ chronology to the LBH APIK Banten.

<p>Abstract<br />This article aims to find out the position and legal protection of holders of land title certificates as a material guarantee. This normative legal research is prescriptive and applied. The types and sources of material for this study include primary legal materials and secondary legal materials. Data collection techniques used are literature studies or document studies. Data analysis techniques are carried out by examining research from literature studies or secondary data studies. The results of this study explain that the position of Land Rights as collateral is regulated in the Basic Agrarian Law which states that land rights can be used as collateral for debt by encumbering Mortgage Rights. Land rights that can be used as Mortgage Rights objects must fulfill two elements, namely, must be registered with the Land Office and according to their nature must be transferable. Creditors have a strong position against collateral objects. Legal protection for the holder of the land rights certificate as a material guarantee if the debtor defaults, the creditor has the right to sell collateral for repayment of the receivables regulated in the Mortgage Right Act. The Mortgage Rights Act is a manifestation of the objectives of the Basic Agrarian Law in providing and guaranteeing legal certainty and legal protection in preventive and repressive forms.<br />Keywords: Collateral; Mortgage Right; Legal Protection; Land Right</p><p>Abstrak<br />Artikel ini bertujuan untuk mengetahui kedudukan dan perlindungan hukum terhadap pemegang sertifikat hak atas tanah sebagai suatu jaminan kebendaan. Penelitian hukum normatif ini bersifat preskriptif dan terapan. Jenis dan sumber bahan penelitian ini meliputi bahan hukum primer dan bahan hukum sekunder. Teknik pengumpulan data yang digunakan yaitu studi kepustakaan atau studi dokumen. Teknik analisis data dilakukan dengan cara mengkaji penelitian dari studi kepustakaan atau studi data sekunder. Hasil penelitian ini menjelaskan bahwa kedudukan Hak Atas Tanah sebagai jaminan diatur dalam UU Pokok Agraria yang menyatakan bahwa hak atas tanah dapat dijadikan jaminan utang dengan dibebani Hak Tanggungan. Hak Atas tanah yang dapat dijadikan obyek Hak Tanggungan harus memenuhi dua unsur yaitu, wajib didaftarkan pada Kantor Pertanahan dan menurut sifatnya harus dapat dipindah tangankan. Kreditur memiliki kedudukan yang kuat terhadap benda jaminan. Perlindungan hukum terhadap pemegang sertifikat hak atas tanah sebagai suatu jaminan kebendaan apabila debitur wanprestasi, kreditur berhak menjual benda jaminan untuk pelunasan piutangnya yang diatur dalam UU Hak Tanggungan. UU Hak Tanggungan merupakan wujud dari tujuan UU Pokok Agraria dalam memberikan dan jaminan kepastian hukum dan perlindungan hukum dalam bentuk preventif dan represif. <br />Kata Kunci: Jaminan; Hak Tanggungan; Perlindungan Hukum; Hak Atas Tanah</p>

The research aims at studying the policy of the Regional Government in protecting the victims of human trafficking, especially females and children. This legal research is based on an empirical study at Regional Police (POLDA), P2TP2A, and Social Services office in Jambi Province. The Law Number 35/2014 on the Amendment of The Law Number 23/2002 on Child Protection provides a greater portion for the Regional Government to take active roles in providing child protection and Presidential Regulation Number 69/2008 about Task Force Prevention and Handling the Criminal Act of Trafficking Victim. Using analysis of descriptive qualitative, it is learned that the handling of the women and children as victims of trafficking remain partially. The responsible institutions have not well-coordinated because a task force as commissioned by Presidential Regulation number 69/2008. The results show that Jambi Province has passed Jambi Province Regional Regulation Number 2/2015 on Prevention and Handling of Human Trafficking towards Females and Children. However, the study also shows that the regulation has not been applied by related parties since Governor’s regulation as implementing regulation is inexistent.

The e-commerce industry in Indonesia is growing rapidly amidst the slowdown in the country's economy. Moreover, most of the e-commerce business players in Indonesia are small, micro, and medium scale (SME). Consumers in e-commerce transactions have a greater risk of loss than business actors or merchants. In other words, consumer rights in e-commerce transactions are very vulnerable, so that consumers in e-commerce transactions are in a very weak bargaining position. The importance of a country regulating legal protection for consumers is generally based on considerations of its actuality and urgency. Legal regulations for e-commerce transactions are designed to create the level of certainty needed in business transactions and to protect consumers in e-commerce transactions in order to support the growth of the digital economy in Indonesia. Current legal protection regulations for consumers in Indonesia have not been able to protect consumers in cross-border e-commerce transactions. In e-commerce transactions, there are no national borders. The consumer protection laws of each country, such as those of Indonesia, are not sufficiently helpful because e-commerce operates across borders. This type of research is normative legal research that uses statutory regulations.

Penyalahgunaan narkotika saat ini tidak hanya dilakukan oleh orang dewasa, tetapi penyalahgunaan narkotika juga dilakukan oleh anak-anak yang masih di bawah umur. Jenis penelitian ini adalah penelitian hukum sosiologis yang membahas mengenai keterkaitan antara hukum dengan masyarakat. Perlindungan hukum terhadap anak dalam penyalahgunaan narkotika berdasarkan Undang-Undang Nomor 35 Tahun 2009 tentang Nakotika di Pekanbaru belum tercapai karena masih ada anak yang melakukan penyalahgunaan narkotika. Hambatan-hambatan dalam perlindungan hukum terhadap anak dalam penyalahgunaan narkotika berdasarkan Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika di Pekanbaru adalah belum sepenuhnya dilakukan diversi terhadap anak pelaku penyalahgunaan narkotika, belum memberikan perlindungan hukum dan memberi hak-hak anak dikarenakan fasilitas yang belum memadai. Upaya untuk mengatasi hambatan-hambatan dalam mengatasi perlindungan hukum terhadap anak dalam penyalahgunaan narkotika berdasarkan Undang-Undang Nomor 35 Tahun 2009 tentang narkotika di Pekanbaru memaksimalkan kinerja jumlah personil yang terbatas, memaksimalkan sarana dan prasarana dari P2TP2A (Pusat pelayanan Terpadu Pemberdayaan Perempuan dan Anak). Abstract Narcotics abuse is currently not only done by adults, but narcotics abuse is also carried out by children who are still underage. This type of research is a sociological legal research that discusses the relationship between law and society. Legal protection for children in narcotics abuse based on Law Number 35 of 2009 concerning Narcotics in Pekanbaru has not been achieved because there are still children who abuse narcotics. The obstacles in the legal protection of children in narcotics abuse based on Law Number 35 of 2009 concerning Narcotics in Pekanbaru are that diversion has not been fully carried out against children who abuse narcotics, has not provided legal protection and provided children's rights due to inadequate facilities. Efforts to overcome obstacles in overcoming legal protection for children in narcotics abuse based on Law Number 35 of 2009 concerning narcotics in Pekanbaru maximize the performance of a limited number of personnel, maximizing the facilities and infrastructure of P2TP2A (Integrated Service Center for the Empowerment of Women and Children).

The emergence of the corona virus in early 2020 has had a serious impact on the life of both state and society. Consequently, every country in the world imposes restrictions on mobility to various other countries and even locks down their country from outside residents. This policy has been implemented since the stipulation of Covid as a pandemic by WHO in March, 2020. Indonesia is one of the countries that is concerned about preventing the spread of Covid-19 through the stipulation of Presidential Decree No. 11 of 2020 concerning the Determination of Public Health Emergencies against Corona Virus Disease 2019 (on March 31, 2020). One area in Indonesia that is considered potential for the spread of the corona virus is the border area, West Kalimantan is one of them. This study was only carried out in Entikong and Jagoi Babang. The data collection methods used were in-depth interviews and observations. Meanwhile, the data analysis method is done qualitatively. The results showed that the Covid-19 pandemic had implications on dereasing volume of cross-border migration due to temporary closure Pasar Serikin in Malaysia territory. It was also found that quite a number of border residents have switched jobs, lost their jobs spontaneously and some have even been forced to engage in drug trafficking through the border of Indonesia, Malaysia. Besides, people income decreased drastically. While on education, there was steadly changes on learning methods, teacher and student are practiced both offline and online. <p>Abstract<br />This article writing aims to study the bitcoin buying and selling transactions that are facilitated  by the Indodax website according to the rule of law in Indonesia and protection for those who conduct bitcoin buying and selling transactions in Indonesia.This legal research is normative  legal research that acts prescriptively and applied. Request submitted to the user. The technique  of obtaining legal material used uses basic materials, secondary legal materials, and tertiary legal materials. Legal materials analysis techniques draw conclusions from a debate that draws general attention to the concrete problems needed.Bitcoin buying and selling transactions facilitated by the first Indodax website are in accordance with the principles of agreement and the legal requirements contained in the Civil Code, the first in accordance with Law No. 11 of 2008 concerning Information and Electronic Transactions and Government Regulations Number 82 of 2012 concerning the Implementation of Systems and Electronic Transactions, and the third in accordance with Law Number 8 of 1999 concerning Consumer Protection. With the issuance of the Commodity Futures Trading Regulatory Agency Regulation No. 5 of 2019 concerning the Technical Provisions for the Implementation of the Physical Market of Crypto Assets (Crypto Assets) on the Futures Exchange, the bitcoin buying and selling transaction has been approved and supported by law in Indonesia. Regulations on how to buy bitcoin, the requirements for establishing the physical market for crypto assets or exchanges, and the procedure for disputing approval. Legal protection of bitcoin buying and selling transactions is divided into several aspects of privacy, the intensity of legal subjects, object transactions, and the responsibility of the parties.<br />Keywords : bitcoin;  buy and sell;  indodax</p><p>Abstrak<br />Artikel ini bertujuan untuk mengetahui keabsahan perjanjian transaksi jual beli bitcoin yang difasilitasi website Indodax menurut kaidah hukum di indonesia dan perlindungan bagi para pihak yang melakukan transaksi jual beli bitcoin di indonesia. Penelitian hukum ini merupakan penelitian hukum normatif yang bersifat preskriptif dan terapan. Pendekatan yang penulis gunakan adalah pendekatan perundang-undangan. Teknik pengumpulan bahan hukum yang penulis gunakan yakni dengan cara pengumpulan bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Teknik analisis bahan hukum dilakukan secara deduktif yakni menarik kesimpulan dari suatu permasalahan yang bersifat umum terhadap permasalah konkret yang dihadapi.Transaksi jual beli bitcoin yang difasilitasi website Indodax yang pertama telah sesuai dengan asas-asas perjanjian dan syarat sah perjanjian yang terkandung dalam Kitab UndangUndang Hukum Perdata, yang kedua telah sesuai dengan Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik serta Peraturan Pemerintah Nomor 82 Tahun 2012 tentang Penyelenggaraan Sistem dan Transaksi Elektronik, dan yang ketiga adalah telah sesuai dengan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Dengan dikeluarkannya Peraturan Badan Pengawas Perdagangan Berjangka Komoditi Nomor 5 Tahun 2019 tentang Ketentuan Teknis Penyelenggaraan Pasar Fisik Aset Kripto (Crypto Asset) di Bursa Berjangka, maka transaksi jual beli bitcoin sudah resmi diakui dan mempunyai dasar hukum di indonesia. Peraturan ini memuat berbagai hal tentang tata cara jual beli bitcoin, persyaratan pendirian pasar fisik aset kripto atau exchange, dan prosedur penyelesaian sengketa. Perlindungan hukum transaksi jual beli bitcoin dibagi dalam beberapa aspek meliputi privasi, otentisitas subjek hukum, objek transaksi, dan tanggung jawab para pihak.<br />Kata kunci: bitcoin;  jual beli;  indodax</p>
