Marriage is one of the laws that apply to all the creatures of Allah are dead. Sirit is carry off a woman by force, deceit sense, even violence to marry. Problematic is that Sirit is not in accordance with the concept of marriage in Islam is that her marriage was valid if it meets the requirements of marriage is one of the conditions is the willingness between two potential partner, which may mean that that marriage should not be forced to either party. The formulation of the problem are (1) the factors behind the occurrence of Sirit?, (2) How is the operational / implementation and impact Sirit ?, and (3) How Sirit Lampung ethnic communities in the Perspective of Islamic Family Law. Objective: (1) Knowing the factors that cause Sirit in Lampung ethnic society, (2) Explain the operational/ implementation Sirit and the impact Sirit, (3) Analyze Sirit Lampung ethnic society in the perspective of the Islamic Family Law.  Data collection methods used was interviews and documentation. Data analysis method used is qualitative method. Based on the analysisof, it was concluded that the factors that caused the most dominant Sirit is a lack of awareness of self or less of its sturdywalls of faith to comply with religious law and customary law, economic factors, and self-controlfactor(liver). Sirit is done by means of deceit, coercion and even violence and some aresexually abused. Sirit can not be justified because Islam does not teachsuch things, as explained in Firman of Allah and the Hadis is the Hadis is more concerned with the right of a woman to decide a case which is about the marriage of their own. If viewed from the eyes of urf' the tradition Sirit is customary imperfect, that is not in accordance with the texts of Personality 'so that this tradition must be rejected or abandoned. Perkawinan merupakan salah satu sunnatullah yang berlaku untuk semua makhluk Allah SWT yang bernyawa.  Sirit adalah membawa lari perempuan dengan cara paksa, akal tipu daya, bahkan kekerasan untuk dinikahi.  Problematika nya, bahwa sirit tidak sesuai dengan konsep perkawinan dalam Islam menyebutkan sahnya pernikahan jika memenuhi syarat-syarat perkawinan yaitu adanya kerelaan antara dua calon pasangan. Permasalahan yang dibahas yaitu tradisi sirit masyarakat suku Lampung Perspektif Hukum Keluarga Islam. Tujuan (1) Mengetahui faktor-faktor yang menyebabkan terjadinya sirit  masyarakat suku Lampung, (2) Menjelaskan operasional/pelaksanaan sirit dan dampak sirit, (3)Menganalisis  sirit masyarakat suku Lampung dalam perspektif Hukum Keluarga Islam.  Metode pengumpulan data berupa wawancara dan dokumentasi.  Metode analisis data menggunakan metode kualitatif. Berdasarkan hasil analisis disimpulkan Faktor-faktor yang menyebabkan terjadinya sirit yaitu kurangnya kesadaran diri atau kurang kokoh nya tembok keimanan  untuk mentaati hukum agama dan hukum adat, faktor ekonomi, dan faktor pengendalian diri (hati).  Sirit  dilakukan dengan cara tipu daya, paksaan bahkan dengan kekerasan serta ada juga yang mengalami pelecehan seksual.  Sirit tidak dibenarkan dalam Islam, sebagaimana diterangkan dalam Firman Allah SWT dan hadis yaitu dalam hadis lebih mementingkan hak seorang perempuan dalam memutuskan sesuatu yaitu mengenai pernikahan mereka sendiri.  Jika dilihat dari urf’, tradisi sirit merupakan adat yang fasid, tidak sesuai dengan nash-nash syara’ sehingga tradisi ini wajib ditolak atau ditinggalkan.

Malaysia is a Muslim country consisting of thirteen States and Federal Territories (Kuala Lumpur, Labuan and Putrajaya). In principal, the official madhhab that is practised  in Malaysia is Shafi’i Madhhab and this becomes common to all Malaysians even though it is not officially registered in the identification card of a Malaysian. Accordingly, in many religious affairs and practices, the society is based upon the principles or fiqh al-Shafi’i. Nevertheless, views of other Sunni madhhab is freely practiced by all Malaysians. Furthermore, the codification on Islamic law in the State Enactments in all States in Malaysia is based upon four Sunni schools of law. It follows that the Islamic law in Malaysia is not purely based on the Shafi’i madhhab and in many occasions adopted the view of Hanafi school depending on the adaptability of the opinion to the society. This article deals with the application of fiqh al-Hanafi under the Islamic Family Law (Federal Territories) Act 1984. Analysis will extend to the practices in the Malaysian Syariah Court when dealing with cases involving Muslims and the most appropriate view of the madhhab that is to be adopted by the Syariah Court in order to solve a particular issue. The study employs the qualitative method of study where it only involves library research. It is believed that this research will be beneficial to all who seek knowledge and useful to all researchers, academicians, legal practitioners, students and scholars.

Budaya merupakan salah satu tantangan utama yang ditemukan dalam menerjemahkan bahasa Inggris ke dalam bahasa Indonesia. Penelitian ini bertujuan untuk mengetahui dampak indeks budaya terhadap terjemahan Novel Eclipse karya Stephenie Meyer. Penelitian ini menggunakan metode kualitatif dan pendekatan semiotik dalam penerjemahan. Terdapat 30 data yang diambil dari novel Eclipse dan terjemahannya dalam bahasa Indonesia dengan teknik. Hasil penelitian ini menunjukkan bahwa (1) indeks budaya yang digunakan oleh penerjemah sebagai cara untuk mempertahankan budaya sumber itu sendiri memiliki dampak besar pada bahasa target. Ada beberapa terjemahan yang tidak dapat diterima dalam bahasa target karena maknanya tidak tersedia dalam bahasa Indonesia, indeks budaya lainnya diterima dalam bahasa target karena ada persamaan arti yang sesuai dengan bahasa sumber; (2) sebagai cara untuk menyelesaikan masalah dalam menerjemahkan budaya, penerjemah menggunakan prosedur transferensi dan naturalisasi. Terdapat 87% menggunakan prosedur transferensi dan 13% menggunakan naturalisasi. Simpulan umum dari penelitian ini menunjukkan bahwa beberapa strategi penerjemahan tersebut tidak akurat di dalam bahasa sasaran sehingga penerjemah perlu mempertimbangkan pemilihan prosedur yang tepat sehingga terjemahan yang dihasilkan dapat diterima dalam bahasa sasaran. Culture is one of the main important challenges found in translating English into Indonesian language. This research aims to know the impact of cultural index on translation of Eclipse Novel by Stephenie Meyer. This research uses qualitative method and semiotic approach in translation. There are 30 data taken from Eclipse novel and its translation in Indonesian language. The results of this study show that (1) cultural index which used by translator as a way to defend the source culture and source language (henceforth SL) itself has a great impact on target language (henceforth TL). There are some translations which cannot be accepted in target language because the meaning is not available in Indonesian language, the other cultural index are accepted in TL as there are equivalence meaning that correspondence the SL; (2) as a way to solve the problem in translating culture, the translator uses transference and naturalization procedure. There are about 87% used transference procedure and 13% used naturalization. The general conclusion of this study shows that some of these strategies are not accurate in the target language so translators need to consider the selection of the right procedure so that the resulting translation can be accepted in the target language.

Abstract: The one of the crucial issues in the Islamic family law in Indonesia is the issue of gender equity including tug of love. It is caused by historical and empirical of Islamic family law which still put unequal status and unequal roles between men and women. That Islamic family law is law that has become the positive law or has become law and regulation in Indonesia. This article will discuss about the provision of tug of love dispute in Islamic family law in Indonesia, and the renewal of provision of tug of love dispute from a gender justice perspective. Based on the review and analysis can be concluded that the provision of tug of love dispute in Islamic family law in Indonesia (particularly Article 105 and 156 KHI) is not gender equitable and should be revised by adding the aspect of morality, aspect of health, the ability to educate and the ability to take care of children as the main parameter in determining the right parent who will possess the custody of the children.Abstrak: Salah satu persoalan krusial dalam hukum keluarga di Indonesia yang perlu mendapat pembaharuan dewasa ini adalah persoalan keadilan jender dalam hukum keluarga, termasuk hak asuh anak. Hal ini dikarenakan kenyataan historis-empiris hukum keluarga masih menempatkan status dan peran yang tidak setara antara laki-laki dan perempuan. Hukum keluarga yang dimaksud adalah hukum keluarga yang sudah menjadi hukum positif atau menjadi peraturan perundang-undangan di Indonesia. Artikel ini akan membahas tentang bagaimana ketentuan sengketa hak asuh anak dalam hukum keluarga Islam di Indonesia, serta bagaimana pembaruan ketentuan sengketa hak asuh anak dalam perspektif keadilan jender. Berdasarkan kajian artikel ini, dapat disimpulkan; Pertama, ketentuan hukum tentang sengketa hak asuh anak yang diatur dalam pasal 105 dan 156 KHI tidak responsif jender. Kedua, aspek moralitas, kesehatan dan kemampuan mendidik dan memelihara anak tidak bisa dimonopoli oleh jenis kelamin tertentu akan tetapi semua aspek tersebut sama-sama bisa dimiliki baik oleh kaum perempuan (ibu) maupun oleh kaum laki-laki (bapak).

The enactment of Islamic law during colonialism was marked by the thought of Sayyid Usman, a historical figure who had a great interest in the study of Islamic law in Indonesia during the Dutch East Indies colonization. As a scholar, he has special attention to the continuity of Islamic law in Indonesia, especially regarding Islamic family law, which at that time had been widely practiced by people to replace customary law. In addition, he also contributed a lot of thoughts in the context of enforcing Islamic law by organizing religious justice institutions and compiling Islamic family law. Formally the institutions of religious justice, especially in Java and Madura, were only formed by the Dutch East Indies government in 1882, through the Staatsblad 1882 No. 152. This formation is at once a measure of the reorganization of religious justice institutions, namely by establishing new religious courts in addition to each landraad (the same court) with the same legal area, on average as large as the district. It's just that if before the religious court was independent, then with this reorganization the power to carry out the verdict was handed over to landraad. K.F. Holle, L.W.C. Van den Berg, and Snouck Hurgronje, these three Dutch people were very influential in the birth of the theory of the enactment of Islamic law in Indonesia, L.W.C. Van den Berg is one of the initiators of the theory of receptio in complexu, which states that "for Muslims full Islamic law applies because he has embraced Islam even though there are still deviations in its implementation. Next to L.W.C. Van den Berg carries the theory of receptio in complexu, and Snouck Hurgronje as the originator of receptie theory, which states that for indigenous people basically customary law applies, and Islamic law applies to indigenous people if Islamic legal norms have been accepted by society as customary law.

Nikahal-khitbah or popularly known as nikah gantung became a choice of a handful of teenagers especially among university students in Malaysia due to financial constraints and educational reason. Such type of wedding practice raises a number of questions related to juristic issues. This is because the practice of Nikahal-khitbah involves establishing some limitation of rights that violate the purpose or intent of marriage. Among others, the spouses agree to defer some of their rights such as declining the right of nafaqah and the right of sexual intercourse which are against the original purpose (muqtada aqd) of marriage contract. This paper aims to study the opinions of jurists (FuqahÉ’) regarding such limitation or agreement in marriage contract and their validity according to the Islamic Family Law in Malaysia. This paper relies on analytical study in discussing the opinions of the Fuqaha’ and understanding the legal texts of the law related to the matter. This study found that marriage practice through nikah al-khitbah is valid according to the majority views of FuqahÉ’. Islamic family laws in Malaysia do not deny the validity of such marriage practices although there are some legal effects on the limitation of marriage rights.           Keywords: Agreement in marriage contract, nikah al-khitbah, permission by the wali, Islamic Family Law in Malaysia. Abstrak Nikah al-khitbah atau lebih dikenali dengan nikah gantung menjadi pilihan segelintir remaja terutamanya di kalangan pelajar universiti di Malaysia atas faktor kekangan kewangan serta pelajaran. Amalan pernikahan ini menimbulkan beberapa pertanyaan berkaitan hukum fiqh. Ini adalah kerana di dalam amalan pernikahan secara nikah al-khitbah melibatkan penetapan beberapa syarat tertentu yang menyalahi maksud serta tujuan pernikahan. Antaranya, pasangan suami isteri bersetuju untuk melepaskan hak mereka terhadap pasangan mereka, iaitu hak mendapat nafaqah dan hak melakukan hubungan kelamin, yang mana ianya bercanggah dengan matlamat asal atau muqtada akad nikah. Objektif kertas kerja ini adalah untuk mengkaji pandangan para Fuqaha’ terhadap pensyaratan atau perjanjian sebegitu di dalam akad nikah dan keterikatannya menurut Undang-Undang Keluarga Islam di Malaysia. Kertas kerja ini menggunakan kaedah analis di dalam membincangkan pandangan Fuqaha’ dan di dalam memahami peruntukan undang-undang berkaitan dengan perkara tersebut. Kajian ini mendapati bahawa amalan perkahwinan secara nikah al-khitbah adalah sah menurut pandangan majoriti FuqahÉ’. Undang-Undang Keluarga Islam di Malaysia tidak menafikan kesahan amalan pernikahan tersebut walaupun terdapat beberapa kesan undang-undang terhadap syarat yang ditetapkan.            Kata Kunci: Pensyaratan di dalam akad nikah, nikah al-khitbah, izin wali, Undang-Undang Keluarga Islam di Malaysia.

The purpose of this study is to find out how the role of the community and community lawsuits according to Law No. 23 of 1997 concerning Environmental Management. The research method used in this study is a qualitative method. While the approach uses the normative juridical approach. The type of data used is primary data and secondary data. Data collection methods by interview and documentation. The process of community participation must be open to the public, community participation will affect the credibility and accountability of the relevant institutions. By documenting the actions of this State decision, it is expected to be able to provide satisfactory means if the public and the court will examine the considerations that have been taken when making the decision. The right of community claim can be filed through NGOs if there are similarities in facts or events and the legal basis and types of claims between group representatives and group members. As for environmental organizations, they can file a lawsuit if they meet the requirements, among others in the form of legal entities, confirm in their articles of association that the organization was established for the purpose of preservation of environmental functions, and have carried out concrete activities with a statute of at least 2 years

The authority based on martial law or the state of emergency is accustomed to issuing legislation that works to prevent the judiciary from considering its actions that are in implementation of the customary law, and that is either during the establishment of exceptional circumstances or after its expiry meaning that it prevents individuals from resorting to the judiciary to challenge their exceptional authority Authorized to it according to the texts governing the exceptional circumstances (). The most dangerous thing that the legislative or executive authority usually does regarding a state of emergency is what it issues from laws or instructions called the laws of inclusive (laws of lifting responsibility) even though the correctness of its name in estimating some of them should be the laws of exemptions from implications (). This is because this immunization according to these laws will inevitably lead to the inability of any victim to resort to the judiciary, in the event that those who implement martial law or the state of emergency exceed their competences entrusted to them under exceptional circumstances. The Raising the Liability Law or the Implications Law is defined as legislation whose purpose is to legitimize actions that were at the time of their unlawful act, and to exempt the persons who are subject to them from the responsibility of assaulting the law, and this is what Jordan and other countries followed like France and Egypt, and that was in times of declaring martial law and a state Emergency. The methods of immunization vary and its extent varies, it may be partially preventing the appeal of cancellation or requesting the suspension of the implementation of the administrative decision only, so individuals are permitted to even seek compensation for the damage caused by the immune decision, and it may be totally, thus giving the administrative decision total immunity, whether in terms of cancellation or suspension of execution or Compensation, and it may be an absolute immunization, as it stipulates that the decision may not be appealed in any way of appeal before any judicial or administrative authority, and the immunization may be proportional, that is, with regard to preventing the appeal of the decision before the judiciary with the assignment of jurisdiction in relation to it to an administrative authority or committee, In terms of the immunization tool, it may be either by a law issued by the legislative authority, and this is the overwhelming majority, and it may be inferior to the law, such as regular systems such as customary management instructions in Jordan .   In this paper, I will discuss the position of the judiciary in Jordan and the comparative judiciary regarding these legislations. This research aimed to explain the online video, ‘Sexy Killers’, to build a way of thinking in society. The problem of this research limited to the role of online video in conveying messages that could build positivity in the community. It had a focus on how much the impact of online video could affect the way of thinking in society by using online video ‘Sexy Killers’ and looked at the responses of the audience’s comments after receiving the message contained in this video. The method used in the research was a qualitative method documentation that the researcher would document any opinion in column comments by giving the right impression that had obtained positive (build) and negative. The results of this research are the video “Sexy Killers” has succeeded in design online video recommendations that can build a way of thinking in a society that has a positive impact.

Section 73 of Islamic Family Law (Selangor) Enactment 2003 provides that it is the duty of the paternal family to provide maintenance to the children in the event of the father’s death, missing in action or suffers from any disabilities. However, the efficiency of this provision depends on the understanding and application by the courts and the person who is said to be liable under ‘hukum syarak’. Currently there is not many studies conducted on the efficiency of this provision in solving cases where there is a failure to provide maintenance to children in the circumstances stated above. This study analyses the application of section 73 of Islamic Family Law (Selangor) Enactment 2003 with the aim of looking into the efficiency of this section in solving the issue children’s maintenance. The study adopts a qualitative method that involves doctrinal study, arm-researcher approach and semi-structured interviews. The provision, scope and jurisdiction of section 73 of Islamic Family Law (Selangor) Enactment 2003 is analysed in detail. The semi-structured interview delves into the current practice of the court in the Federal Territories where the views of selected respondents ranging from the judges in the Shariah courts in the Federal Territories, Shariah law practitioner, and academics. This study finds that the existing laws are somewhat insufficient in addressing issues of child maintenance and lack of awareness on the claimant (mother and children) on the responsibility of the extended family. The study proposed some recommendations for some reforms of the current law and practice.

AbstrakBerangkat dari Nawa Cita ketiga yaitu “membangun Indonesia dari pinggiran dengan memperkuat daerah-daerah dan desa dalam kerangka Negara Kesatuan Republik Indonesia” dan kesadaran untuk melaksanakan amanat Undang-Undang Nomor 6 Tahun 2014 tentang Desa. Tujuan penelitian ini untuk mengetahui pengakuan hak atas asal usul masyarakat desa serta melihat peta keragaman kesiapan kelembagaan desa dan fisibilitas mengenai pengelolaan dana desa, dengan menggunakan metode kualitatif. Dari data lapangan dapat disimpulkan bahwa Undang-Undang No.6 Tahun 2014 tentang Desa berupaya mengkoreksi kesalahan-kesalahan Negara dalam mengatur desa dan masyarakat hukum adat. Undang-Undang desa ingin mengembalikan hak asal usul yang melekat pada desa adat untuk mengurus kehidupan masyarakat hukum adat dan pengurusan wilayah masyarakat hukum adatnya (hak ulayat). Negara perlu memberikan sarana dan prasarana kepada setiap lembaga adat agar lembaga adat dalam mengelola masyarakat adat serta adat istiadatnya dapat berjalan dengan baik. Untuk itu, perlu ada payung hukum untuk menampung keistimewaan desa adat dibeberapa daerah. Selain itu juga, perlu diatur secara khusus didalam peraturan perundang-undangan mengenai penetapan anggaran khusus terhadap lembaga-lembaga adat, sehingga lambat laun keberadaan lembaga adat ini tidak akan hilang.Kata kunci: Revitalisasi, Pemerintahan Desa, Sumatera Barat.AbstractBased on the third Nawa Cita it is “to build Indonesia by strengthening areas and villages within the framework of The Unitary State of the Republic of Indonesia” and awareness to implement the Act No. 6 2014 about Village. The purpose of this research is to know the recognition of the origin of rural community rights and to look at the map of the diversity of Village institutional readiness and feasibility on the village funds management, by using the qualitative method. From the data the field we can conclude that the act of no.6 year 2014 village about trying to emend state mistakes in regulating village and community adat law.The act of village want to restore the right of the origin of attached to customary village to take care of the lives of the customary law and management of the region of law community custom (unalienated rights). The state needs to give of facilities and infrastructure to every customary institutions that create a conducive customary in managing indigenous people as well as customary to take place. For that, there should be a legal framework for accommodate village customary privileges of several regions .It is also, needs to be regulated specifically in the legislation regarding the stipulation of a special budget against customary institutions, so which gradually customary the existence of this institution will be lost.Keywords: Revitalization, Village Administration, West Sumatra
