يتناول هذا البحث تحديد العوامل المؤثرة والمنتجة لتجديد الأحكام في التشريع الإسلامي، وعملية الاجتهاد الموصلة إليه، وتمييزها عن العوامل غير المؤثرة، تمهيداً لضبط دعوى التجديد في التشريع الإسلامي. وتوصل الباحث إلى أن العوامل المتعلقة بالاجتهاد تتمثل في: إمكانية الخطأ عند المجتهد، واحتمالية تعدد الحق في القضية محل الحكم، أو اختلاف طرق الاجتهاد وترتيب الأدلة، أو تبدّل في الظن الغالب، ومدى الكفاءة العلمية التي أظهرها المجتهد في اجتهاده. أما العوامل المتعلقة بالحكم فهي: مدى قصد المشرع إعلامنا بالحكم أو عدمه، ومدى تغيُّر موضوع الحكم وتحوّله جوهرياً وشكلياً، التفرقة بين تغير وسائل الأحكام وتجددها، والأحكام ذاتها. وعليه فإن نسبة التغير للزمان والمكان نسبة غير حقيقية، وليس تبدل الزمان، أو اختلاف المكان سبباً لتجديد الحكم أو تغييره. This purpose of the paper is to identify factors that influence and produce new provisions in Islamic law, and the process of Ijtihad that yield Tajdid, and to distinguish these factors from non-influential factors in order to control the renewal claim in Islamic law. The researcher found that factors relating to ijtihad are: the possibility of error committed by the scholar, the possibility of having multiple rights on the issue, different ways of ijtihad arrangement of evidence, change in the prevalent conjecture, and the intellectual competence shown by the scholar. Factors related to the ruling are: the intent of the legislature to inform the ruling, the change in the subject of ruling in form and substance, the distinction between change and renewal provisions means, and the provisions themselves. Accordingly, the time and place are not the real factors in the production of tajdid and change in ruling.

The subject of the research is new tools for business financing using the initial coin offering (ICO) in the context of the development of cryptocurrencies and the blockchain technologies as their basis. The purpose of the work was to analyze the advantages and disadvantages of the ICO in comparison with traditional financial tools as well as prospects, limitations and problems of using digital financial tools. Conclusions are made in relation to possibilities, limitations and application areas of digital business financing tools, particularly in the real sector, taking into account the specifics of the Russian economy and legislation. It is shown that the main problems of using the digital financial tools are related to the economic sphere and caused by the lack of adequate approaches to evaluation of assets as well as the shortage of objective information. The problems and new tasks of corporate finance in the digital economy are defined.

This research begins with an understanding of the endemic radicalism of society, not only of the real world, but also of various online social media. This study showed that the avoidance of online radicalism can be stopped as soon as possible by accusing those influenced by the radical radicality of a secular religious approach. The methods used must be assisted in order to achieve balanced understanding (wasathiyah) under the different environmental conditions of the culture through recognizing the meaning of religion. The research tool used is primarily library work and the journal writings by Abu Rokhmad, a terrorist and radicalise specialist. The results of this study are that an approach that supports inclusive ism will avoid the awareness of radicalization through a heart-to-heart approach. This study also shows that radical actors will never cease to argue dramatically until they are able to grasp different views from Islamic law, culture, and families.Keywords: radicalism, deradicalization, multiculturalism, culture, religion, moderate.Penelitian ini berawal dari paham radikalisme yang telah mewabah di masyarakat, bukan hanya di dunia nyata, bahkan sudah menyusup di berbagai media sosial online. Penelitian ini menemukan bahwa cara menangkal radikalisme online dapat dilakukan pencegahan sedini mungkin melalui pendekatan konseling religius multikultural terhadap mereka yang terkena paham radikal radikal. Diantara teknik yang digunakan adalah melalui pemahaman tentang konsep agama juga perlu digalakkan agar memunculkan pemahaman yang moderat (wasathiyah) diberbagai keadaan lingkungan masyarakat. Metode yang digunakan untuk penelitian ini adalah library research dengan sumber utama adalah karya dan jurnal karya Abu Rokhmad seorang pakar dalam masalah terorisme dan radikalisme. Temuan penelitian ini adalah paham radikalisasi itu dapat dihentikan dengan pendekatan hati ke hati dengan mengedepankan budaya yang multikultural. Kajian ini juga membuktikan bahwa pelaku paham radikal tidak akan pernah berhenti memberikan argumen radikal kecuali mampu memahami perbedaan pendapat yang bersumber dari syariat Islam, lingkungan sosial, dan keluarga.Kata kunci: radikalisme, deradikalisasi, multikultural, budaya, agama, moderat.

AbstractThis socio-legal narrative investigates the journey from “biological” to “societal” filiation undertaken by Islamic and international law regimes in their endeavors to ensure a child's right to name and identity. Combining a discussion of filiation—a status-assigning process—with adoption and kafāla (fostering) as status-transferring mechanisms, it highlights a nuanced hierarchy relating to these processes within Muslim communities and Muslim state practices. It questions whether evolving conceptions of a child's rights to name and identity represent a paradigm shift from “no status” if born out of wedlock toward “full status” offered through national and international law and Muslim state and community practices. The article challenges the dominant (formal, legal) position within the Islamic legal traditions that nasab (filiation) is obtainable through marriage alone. Highlighting inherent plurality within the Islamic legal traditions, it demonstrates how Muslim state practice and actual practices of Muslim communities on the subject are neither uniform nor necessarily in accordance with stated doctrinal positions of the juristic schools to which they subscribe. Simultaneously, the paper challenges some exaggerated gaps between “Islamic” and “Western” conceptions of children's rights, arguing that child-centric resources in Islamic law tend to be suppressed by a “universalist” Western human-rights discourse. Tracing common threads through discourses within both legal traditions aimed at ensuring children a name and identity, it demonstrates that the rights values in the United Nations Convention on Rights of the Child resonate with preexisting values within the Islamic legal traditions.

A new type of case study, called the real-time case (RTC), was produced in the fall of 2001 and distributed via the Internet to business classes at four universities in the US and Canada. The real-time case presented the story of one company's growth and development throughout a 14-week semester. A case writer stationed full-time at the subject company published case installments weekly on the Web, allowing students to view the company-building process as it happened. The 14-week coverage of RTC enabled students to study the subject company in unprecedented depth and detail. RTC's real-time interactivity allowed students to share their analyses and best thinking with the company leadership during the company’s decision-making process.A major objective in producing the case was to heighten student engagement with the case material. To evaluate whether this objective was achieved, a survey and a focus group discussion were conducted with one of the participating MBA classes. Results from the survey and the focus group showed a high degree of engagement, plus many other benefits from the new type of case study.

In recent years there has been an increased interest in Islam and Islamic law. Islam plays a very significant role in the modern world. Close interaction between legal and religious prescriptions of Islam, the religious basis of Muslim law, Muslim character is not in doubt. The article analyses informal religiosity of Muslim peoples of the Middle Volga and Urals in the 1960-1970. This time for relations between the authorities and Islamic institutions is relatively liberal. The restoration and development of official, allowed in the Soviet Union, as well as quite nontraditional for the Soviet time Islamic practices are noted by the authorities in the Middle Volga and the Urals. The reports name such informal forms of religiosity as neo-paganism, wandering mullahs, unofficial Muslim groups, worship, places of burial of saints and Sufi sources. The authorities, the party authorities, the official Muslim clergy stopped all forms of unofficial religiosity. For the Muslim peoples Islam has often been the subject of interest as a cultural component of their traditional worldview rather than a religious system. The authors believe that the Islamic religion has moved from ethno-cultural to the personal, informal level.

Introduction: at present the reader’s audience is particularly interested in creative experiments in which the historical fate of the Russian peasantry in the «turning» eras is artistically comprehended. The article is devoted to the study of the problem-thematic range of modern Mordovian historical prose. The subject of analysis is the peculiarity of the reception of the period of collectivization and dekulakization in the story by Erzyan prose writer A. Doronin «A Wolf Ravine». Objective: to reveal the features of the artistic reconstruction of the events of the 1930s, the modeling of the relationship between a man and society in the story by A. Doronin «A Wolf Ravine».Research materials: the story by A. Doronin «A Wolf Ravine». Results and novelty of the research: the historical story « A Wolf Ravine » for the first time becomes the object of scientific understanding and is introduced into the context of Finno-Ugric literary criticism. A. Doronin artistically interprets the real events and circumstances of the resettlement of dispossessed peasants of the Volga region to the uninhabited steppes of Kazakhstan. As a result of the study, we conclude that the actualization of this problem-thematic cluster is due to the creative concept of the historical writer; the individual author’s approach to the reconstruction of historical narrative can be traced in the writer’s desire to realistically reveal the relationship of personality and society in the tragic 1930s; to analyze intentions of people and of the psychological states of the characters. Problems of a sociopolitical nature, actualized in the story, are filled with philosophical, axiological content, and lead to a multi-faceted understanding of the «man and history» problem.

Abstrak Pemberlakuan aturan mengenai kewarisan di Indonesia selama ini terjadi perdebatan antara para ahli hukum tentang status hukum Islam dan hukum adat.Berkaitan dengan permasalahan dalam hukum waris pada hukum Islam dan hukum Adat, maka perlu adanya kesesuaian bagi masyarakat yang akan mempergunakan masing-masing hukum tersebut dalam menyelesaian warisannya kepada sang ahli waris yang berhak. Ketentuan hukum Islam di Indonesia belum merupakan undang-undang (kodifikasi) haruslah sistematis dan prosedural, harus jelas siapa subyek dan obyeknya dan diundangkan oleh lembaga yang berwenang dalam negara. Rumusan masalah dalam penelitian ini adalah bagaimana perbandingan dalam pembagian waris berdasarkan pada hukum islam dan hukum adat. Metode penelitian ini menggunakan metode kualitatif dengan metode pendekatan yuridis empiris. Hasil penelitian yaitu Hukum waris Islam telah menempatkan atauran kewarisan dan hukum mengenai harta benda dengan sebaik-baiknya dan seadil-adilnya. Islam menetapkan hak milik seseorang atas harta, baik bagi laki-laki maupun perempuan seperti perpindahan hak milik dan perempuan pada waktu masih hidup atau perpindahan harta kepada ahli warisnya setelah ia meninggal dunia. Hukum waris adat berpangkal dari bentuk masyarakat dan sifat kekeluargaan yang terdapat di Indonesia menurut sistem keturunan, dan setiap sistem keturunan yang ada mempunyai kekhususan dalam hukum waris yang satu dengan yang lain berbeda-beda. Kata Kunci:Waris, Hukum Islam, Hukum Adat Abstract The enactment of the rules regarding inheritance in Indonesia has been a debate between legal experts about the status of Islamic law and customary law. In connection with problems in inheritance law in Islamic law and Customary law, it is necessary for the community to use each of these laws in complete the inheritance to the rightful heirs. The provisions of Islamic law in Indonesia are not yet laws (codification) must be systematic and procedural, it must be clear who the subject and object are and are promulgated by the authorized institutions in the country. The formulation of the problem in this study is how comparisons in inheritance distribution are based on Islamic law and customary law. This research method uses qualitative methods with an empirical juridical approach method. The results of the research, namely Islamic inheritance law has placed the inheritance and law regarding property as well as possible and as fair as fair. Islam establishes someone's property rights, both for men and women, such as the transfer of property rights and women while still alive or the transfer of property to his heirs after he dies. The subject of the study is the “legendary style” of one of the most iconic hagiographic text of the IX century “The Comprehensive Life of Constantine (Cyril) the Philosopher”. This Pannonian legend belongs to the texts of Cyril-Methodius cycle and has the description of the re-finding and transportation Saint Clement’s relics by Constantine the Philosopher from Korsun (Chersonesus) to Rome. This episode is an important part of the process of legalizing the translation of the Divine Books to the so-called Church-Slavonic language. The phrase “legendary style” was borrowed from I. Franko’s work “Saint Clement in Korsun” (Lviv, 1902–1905) and has not been explained as a term yet. The purpose and the novelty of our research is to find out how “legendary style” was formed, which techniques were needed to create this concept. The relevance of this study is due to the analyzing sources for the legend as a genre (it was formed on the base of the hagiographical texts such as Jacobus da Varagine’s "The Golden Legend", XIII century). Ideological description of historical events ("tendentious historicity"), disclosure of holiness and using the category of the miraculous were clarified as the technique of “legendary style”, using the cultural-historical method, elements of comparative, structural and phenomenological analysis. Holiness, called by J. Le Goff “the most important value of Christian society”, is a predetermined aspect in “The Comprehensive Life of Constantine (Cyril) the Philosopher” and it connected the saint’s life with the events of the New Testament. The category of the miraculous is considered from the point of mythological view: miracles regulated the universe, restored harmony and established true rules and laws. According to A. Losev, the true Christian miracle occurred when the real person dialectically synthesized with his/her inner ideal at a certain moment. “Tendentious historicity” is observed in the episode about saint relics of Pope Clement I. There are variations in the very process of re-finding the holy remains: locations, heroes and time in some stories are not the same in different texts from the so-called Cyril-Methodius cycle. It gives reasons to consider these texts ideologically involved. It is advisable to include other hagiographic texts to confirm or refute, expand or narrow the “legendary style” as a term in further research.

Armah’s The Beautyful Ones are not yet Born is a novel known for its extensive portrayal of the ills and anomalies in the Ghanaian society right after independence. The majority of studies on the novel have overwhelmingly concluded that corruption is the preoccupation of the text. This view appears skewed in many respects. This paper argues that the corpus assisted approach can contribute methodologies to support objective investigation of the subject matters of the text. This study, adopting the corpus-assisted approach in a mix of numerical data and qualitative description of Armah’s The Beautyful Ones are not yet Born, used frequencies of the occurrence of pejorative terms in the text to determine the dominant subject matters in the novel. The approach reveals that “rot” and “decay” are the most dominant motifs used, followed by “filth”, “corruption”, and “bribery”. It suggests that clusters, i.e., recurrence of words, characters’ association with the words, and context of use serve as textual cues in thematic exploration. The approach aids in revealing that the real intent of The Beautyful Ones Are Not Yet Born is that the total breakdown of the society rests on seemingly insignificant characters. The paper has implications for methodological approaches to thematic analysis of literary texts, particularly, the novel.

The development of Shīʿi jurisprudence has mostly been studied from the perspective of its relation to political authority. A handful of works that have examined the subject from a purely legal perspective, neglected the influence of Muslim societies on the evolution of Shīʿi legal theory. The paper examines the development of Shīʿi jurisprudence from a legal perspective and argues that there is an intrinsic connection between Islamic law (both Sunni and Shiʿi laws) and Muslim societies. Therefore, the changing values and expectations of society prompt changes in Islamic rulings. In this sense, the evolution of Shīʿi legal theory is no different to Sunni legal theory, and there are striking similarities between Khomeini's theory of Wilāyat al-Faqīh and the Sunni legal notion of maṣlaḥa which both aim to respond to the exigencies of the social change.
