The article deals with some issues related to the conception of space/territory in medieval Islam. At the turn of XX–XXI centuries within the framework of various humanitarian disci-plines has been widely discussed a new understanding of space which came to be realized as a heterogeneous social and cultural phenomenon, reflecting political, legal and social norms spe-cific to a particular culture. At the first centuries of the history of Islam there appeared the idea of two geo-religious regions: Dar al-Islam ("Territory of Islam") and Dar al-Harb (Territory of war) or otherwise Dar al-Kufr ("Territory of unbelief"). On the one hand, these concepts reflect the real boundaries of the Muslim / non-Muslim world and the criteria by which those belonging to it were determined, and at the same time it contains an indication of certain non-spatial cultur-al symbols, categories and values. Special attention here is paid to the history of the origin and evolution of the concepts Dar al-Islam / Dar al-Harb (both in sunni and shi‘ite traditions) repre-sented in the foundational texts of Islam, medieval Arabic dictionaries, travelogues, and essays on Islamic law (fiqh).

This article explores the dynamics of the modernization of Islamic law using the sociological approach. The legal theory used is the history of modern law as a comparative Islamic law in the Muslim world related to its influence in Indonesia. The author associates the sociological jurisprudence with the dynamics of modernization of Islamic law in the Muslim world including Indonesia. The sociological jurisprudence is applied in the study of marriage law issues that still need efforts to modernize the law, because these problems continue to develop and the legal position must always be dynamic in responding to sociological problems that always live in society. Various theoretical influences in the sociology of law and also the sociological jurisprudence have a wider impact on the sociology of Islamic law. This effort to modernize Islamic law is part of the development of modernization theory in the sociology of law, which synergizes integratively between law and society and society and law proportionally. This article seeks to apply the sociology of law in general and the sociological jurisprudence in particular about family law with the case of sociological problems of Islamic law in Muslim societies such as Turkey, Egypt, and Indonesia.

This study would serve as sequel to the views of the Imami theologian Hisham bin al-hakam on Jalil al-Kalam and Daqiq al-Kalam by explaining the theological views of Zurarah bin Aʻyun, Abu Jaʻfar al-Ahwal, al-Fadl ibn Shazan and Banu Nubakht; it will focus on their known writings, explicating their available theological views as far as possible, on the basis of Sunni and Shi’ite sources in the context of the history of theology. The objective behind that is to explain the theological trends that emerged in the history of the Twelver Imamite community, their connections; this would, first of all, provide knowledge of the intellectual foundations of the Twelver theology, which reached its pinnacle at the hands of the theologians of the fifth century AH beginning with Shaykh al-Mufid bin Muhammad bin al-Nuʻman al-ʻAkbari al-Baghdadi. Secondly, this study would provide an understanding of the relational basis between the Twelver and the Mutazilite theological thought. I think that it is the result of a mutual cross-fertilization on the one hand, while on the other since they both derive from the same sources, they lead to similar results. It is not a case of Shi’ite subservience to a predominant Mutazilite influence because the Twelver Shi’ite theologian was conscious of his requirements in support of his doctrine, which revolves around the issue of the Imamah in Jalil al-Kalam and Daqiq al-Kalam alike. In addition, this study will also identify the real origins of the idea of limiting the imamate to twelve imams, ending with the consideration of the early Imamite scholars through which they established their arguments against their opponents in their writings and debates. This is all the more important since the titles of the Shi’ite Imami writings and from what is quoted in their debates on the issue of Imamate, do not point to the imamate of only twelve imams, as the history of the Imami Thought depicts and which starts with the period of the Minor Occultation, which lasted about 70 years from 260 to 329 AH. KeywordsImami Shiʻites, Jalil al-Kalam, Daqiq al-Kalam, Major Occultation

Art is defined as the expertise to disclose or express ideas and thoughts a esthetics, including the ability and imagination to realize the creation of objects or the work atmosphere capable of inflicting a sense beautiful. Art is diverse and most of it always questionable in terms of Islamic law. In general, the art divided into two: first, sculpture, painting and drawing. And second, sound art. The main problem in sculpture, painting and drawing is if the object of animate beings, because on the one hand there are numbers of hadith that prohibit making images that are either raised or incurred and three dimensions. While on the other hand it has been commonly done in the community, especially in the natural environment that is fertile and rich with a variety of animals created by God as our State that inspired the artists. In addition, the sculpture on the side can be an expression of sheer beauty, it also has benefits for lessons and so on. Furthermore, sound art is a universal cultural phenomenon, practiced by many nations. In the time of the Prophet himself has been known to sing and play music. In terms of general principles of religious teachings that sound art including mu'amalat dunyawiyyah category. Restrictions on the arts (sculpture, painting, drawing, and sound) for their prudence of Muslims. Prudence was intended that they do not fall to the things that are contrary to the values of Islam which is the focal point at that time. Art as an aesthetic manifestation of the spirit of monotheism and not a waste of money but the art necessary for the improvement of human life, promotion of the dignity and the dignity and refining the soul and the mind. If so the purpose of art, then it is possible that the skill and sunnah favor, not against it.

تناول هذا البحث بالدراسة واحدة من أهم معضلات العالم الإسلامي وهي الاعتداء على رموزه من خلال سب نبيها محمد  والاستهزاء به، فكان من الواجب أن يكون هناك بحث موضوعي يرد ويسدد ويوجه مسار مواجهة هذه التعديات، فجاء هذا البحث موضحا أحد أساليب مواجهة الدعوة في القديم والحديث، مبينا مخالفتها للنظم والمعايير الأخلاقية والذوق الحضاري، وبيان حكمها ليس في التشريع الإسلامي فقط، وإنما في الدساتير والمواثيق الدولية. وقد خلصت الدراسة إلى بيان أساليب الرد في الصدر الأول من الإسلام، وكذلك  زمن الصحابة رضي الله عنهم، والعصر الحاضر، منتهية باقتراح خطة حكيمة لصد هذا العدوان.*****************************************************This research studies one of the main problems of the Muslim world which is the attack on its symbols by insulting and mocking the Prophet Muhammad (s.a.w.). There is an urgent need of an objective research on this subject that should respond, correct, and direct the course of facing these attacks. This research focuses on one of the methods used in both old and new propagation, explaining how it is in conflict with the ethical system and standards and civilizational decency, and elaborating its ruling which is not only in Islamic law, but also in the international covenants and conventions. The study includes discussion of the methods of rebuttal as found in the early history of Islam, during the time of ØaÍÉbah, and the present era, proposing a wise plan to repel this aggression.

Relevance of the study. The evolution and the very phenomenon of the Salzburg Festival go hand in hand with the history of music and theatre, the philosophy of art, and the global musical infrastructure of the 20th and early 21st centuries. On the one hand, it is their fair reflection; while on the other hand, it is an integral part of their development. That is why studying and understanding the role and place of the Salzburg Festival is essential for understanding contemporary musical culture in a current historical perspective.Relevance of the study is attributable to the fact that, for the first time in Ukrainian historical musicology, the development and implementation of the idea of holding the Salzburg Festival are considered, indirect relations between the festival ideologists and the Ukrainian cultural space at the turn of the 19th and 20th centuries are discovered, and the century-old history of the main European music and theatre forum is systematized.Main objective of the study is to introduce the phenomenon of the Salzburg Festival as a historical and cultural integrity in the space of the Ukrainian musicological discourse, as well as to outline and systematize a one hundred-year path of the main music and theatre forum in Europe.Methodology of the study includes the use of historical, culturological, and systemic approaches.Results and conclusions. The study revealed that at the stage of shaping the idea of the festival in Salzburg at the beginning of the twentieth century, there were two fundamental visions of its implementation, namely, “Mozart-oriented” and “general theatrical”. They both entered the gene code of the Salzburg Music and Theatre Forum with varying interpretations of its concept and repertoire policy at each phase of its existence. The change of priorities in its fundamental triad, that is, drama — opera — concert, during forum varying periods is also traced.The hundred-year journey of the Salzburg Festival may be divided into three main stages: 1) the development and search of self-identity (1920–1954); 2) “stabilization” and formation of international prestige (1955–1990); and 3) “modernization” and expansion of cultural horizons (from 1991 until today). Each of them is well integrated into history of Western European music and culture of the 20th and early 21st centuries.

The existence of guardians in the implementation of marriage contract has been explained in Islamic law in a clear and detailed manner. Guardian for a woman becomes one of pillar in the implementation of the marriage contract, and has a systematic sequence that starts from the main one and moves sequentially to the one after, if the one above is considered ‘uzur. But the primacy of the existence of the guardian is not utilized maximally in the perception of the Acehnese people. So that most people tend to represent the implementation of the marriage contract to other people such as pious people or marriage registration officers. The parental guardian prefers to care for his guardian rights to others even though basically there is no obstacle that hinder him. The problem is the practice law of tawkil marriage in the tradition of Aceh people according to Islamic law review. The results of the study shows that the public perception of the implementation of wakalah (tawkil) marriage is based on an understanding about the ability to be brave in the implementation of the marriage contract. But their understanding is based on habits that occur in the traditions of society, not based on the results of scientific studies. Indeed, the practice of tawkil or wakalah marriage that occurs in Acehnese society does not conflict with religious law, but the implication is the erosion of the erosion of the existence of guardians and the parental guardian in a very memorable contract in the history of a human life.

The Messenger of Allah (PBUH) was easy to give his marriage dowry in keeping with the Qur'an.The history of The Islamic Dowry preserved the Qur'an from its beginning to the present has witnessed an interesting development of the study.The dowry of the qur'an's preservation of the marriage practiced by people today is driven by the lack of conformity with the history that occurred at the time.From previous backgrounds, the author is more studying through a historical approach to discovering developments that have taken place since the beginning of the Qur'an.'The results of this study show that the payment of a dowry from the Qur'an is currently witnessing the development of the meaning of dowry on the one hand, which is actually happening and the bottom now in society today is not limited to concern with the elements of rightsonly women, but increased attention to other aspects as well as the circumstances of the interest of the rightsTherefore, islamic law in its historical review is valid for all time and place. Keywords: RightsWomen: Marriage Dowry: History: Memorizing the Qur'an.

Pakistan occupies an uncertain and paradoxical space in debates about secularism. On the one hand, the academic consensus (if there is any), traces a problematic history of secularism in Pakistan to its founding Muslim nationalist ideology, which purportedly predisposed the country towards the contemporary dominance of religion in social and political discourse. For some, the reconciliation of secularism with religious nationalism has been a doomed project; a country founded on religious nationalism could, in this view, offer no future other than its present of Talibans, Drone attacks and Islamist threats. But on the other hand, Pakistan has also been repeatedly held out as a critical site for the redemptive power of secularism in the Muslim world. The idea that religious nationalism and secularism could combine to provide a path for the creation of a specifically Muslim state on the Indian subcontinent is often traced to the rhetoric of Pakistan's founder, Muhammad Ali Jinnah. But debate among Muslim League leaders specifically on the relationship of religious nationalism with secularism—and indeed on the nature of the Pakistani state itself—was limited in the years before partition in 1947. Nevertheless, using aspects of Jinnah's rhetoric and holding out the promise of secularism's redemptive power, a military dictator, Pervez Musharraf, was able to secure international legitimacy and support for almost a decade.

AbstractIn L’Immanence des vérités, Alain Badiou rewrites the Platonic allegory of the cave. As the book’s structure reveals, Badiou’s central claim is that truths are absolute, for they are constituted by the dialectic between finitude and infinity, the consequence of which lies in the creation of the œuvre. Although love is often affected by individual difference, family, money, and social norms, philosophy calls for a rupture with these instances of finitude, awakening us to the truth that love is open to the possibility of infinity embodied by contingent encounter, amorous declaration, and the faithful construction of the Two. Badiou calls for subjectivization of this possibility in the form of the amorous œuvre, through and beyond the Lacanian impasse of the sexual non-relationship. This article supplements Badiouian love with Lacanian psychoanalysis by developing five points. First, the binary framework “Lacanian finitude vs Badiouian infinity” can be misleading. Second, Badiou himself regards the unconscious and the analytic discourse as inscribed by the dialectic between finitude and infinity. Third, Lacan allows us to recognize that the œuvre and the waste are not opposed, but rather supplementary to each other. Fourth, for both Lacan and Badiou, love constitutes the interlacing of the non-relationship and the Two. Fifth, the Badiouian amorous absolute must deal with the real of the absolute as the fusional One and thus, can be supplemented by the Lacanian problematic of the sexual relationship in its fantasmatic form of the One. Based on these points, this article elaborates such concepts as the amorous labor, the dialectic between œuvre and waste, and the artisan of love.
