A concept of rights and obligations will work when there is a balance between the two. Malahat theory is an intra doctrinal reform for the realization of humane legal norms. However, in reality, this concept is not easy to implement. It is said that a woman is made as to the subordinate in the family and sometimes there is no justice for her. At this time, women not only play a role as housewives but also help earn money for the family. What becomes a problem is how to reinterpret the equitable distribution of household rights and obligations. This study aims to describe the rights and obligations of husband and wife by maintaining the values of justice. This research is library research that discusses the husband's income for his wife, who is also the breadwinner. The paradigm of the husband is the leader of the household, and the wife is the housewife is something that spurs Muslim feminists to reinterpret. It is because wives are no longer only responsible as housewives, but more than that, they also help make a living in the household. Then, the concepts of justice, equality, ukhuwah islamiyah and mu'asyarah bil ma'ruf must be prioritized for the benefit and the formation of a sakinah, mawaddah wa rahmah in a family. It needs to be reconsidered if we want to make it a new fiqhparadigm.

Marriage aims to form a happy family and everlasting. Marriage requires careful consideration in order to persevere in the long periods of time in a relationship as husband and wife. Indispensable attitude of tolerance and put yourself on the proper role. One example of such marriages, i.e. marriage down the bed. Marriage down bed (Walian tundra) frequently took place in the area of North Buton to the culture. Therefore, researchers are interested in writing a research on the status and validity of the marriage bed down according to customary law. (studies in North buton). In this study the author uses the method of normative legal research i.e. research approach the problems and legal norms in force. Legal norms that apply to that form of positive written legal norms such as the Constitution, laws, government regulations and so on. Research results show that implementation of the marriage walian tondro (down bunks) based on customary law Kulisusu Sub-district in Waode village of Buri North Kulisusu can occur if the following: a) the already existing agreement of husband and wife when the wife is still alive, that when I died (wife) then you (the husband) must be married with the sister of girs as a substitute for the mother of our children and this should be known to be mutually agreed by both parties in defense. In the sense that there must be a will from the wife. b) after it is accepted then the two sides will carry out walian tondro (mate's bed). C) Covenant of marriage anniversary match existing Covenant of marriage (islam). D) wedding reception. There are several reasons underlying the onset of mating walian tondro (down bed) so that the wife can provide replacements for descendants as the legitimate successor of the family.

In Islamic law, a marriage contract is not only a civil matter but also a very strong sacred bond that is worth of worship. Therefore, marriage must be maintained properly to realize the sakinah mawaddah wa rahmah family, but when it is in a sacred bond, there are some couples who are reluctant to fulfill their responsibilities and demand right that are not theirs so that the sakinah family will be difficult to be actualized. This study aimed to determine the understanding of husband and wife about rights and responbilities, and a significant relationship between the rights and obligations acomplishment of husband and wife in realizing a harmonious marriage or sakinah family. This research was normative-empirical legal research in the form of analytical prescriptive which was supported by primary and secondary data. Data collection was obtained through library research, documentation, interviews, and observation. Based on the research was conducted, it found the results: First, husband and wife understand that the position of wife and husband in the household are the same, but they have different rights and obligations, although on the other hand the community understands that the position of the wife in the family is under the husband, they understand it from fiqh salf which states that the wife must uphold her husband with an honor and glory. Second, the concept of Islamic marriage teaches that the rights possessed by husband and wife are balanced with the obligations burdened on them, a husband or wife has balanced obligations. Third, to build a harmonious, peace and peaceful family, they can be performed with developing the Islamic teachings, fostering the mutual respect, coaching the efficient living attitudes, and training a self-awareness from each married couples. Abstrak: Dalam hukum Islam akad perkawinan bukan hanya perkara perdata semata, melainkan juga ikatan suci yang sangat kokoh yang bernilai ibadah. Untuk itu perkawinan harus dipelihara dengan baik sehingga akan terwujudnya keluarga sakinah mawaddah wa rahmah, namun ketika telah berada dalam ikatan suci, ada pasangan yang enggan memenuhi kewajiban dan penuntutan hak yang diluar haknya maka keluarga sakinah sebagaimana harapan akan sulit terealisasi. Penelitian ini bertujuan untuk mengetahui pemahaman pasangan suami istri tentang hak dan kewajiban suami istri, dan hubungan yang signifikan antara pemenuhan hak dan kewajiban suami isteri dalam mewujudkan perkawinan yang harmonis atau perwujudan keluarga sakinah. Penelitian ini adalah penelitian hukum normatif-empiris dalam bentuk preskriptif analitis yang didukung oleh data primer dan sekunder. Pengumpulan data melalui studi pustaka, dokumentasi, wawancara, dan observasi. Berdasarkan penelitian yang dilakukan ditemukan hasil: Pertama, Suami istri memahami bahwa kedudukan istri dan suami dalam rumah tangga sama, namun memiliki hak dan kewajiban yang berbeda, meskipun disisi lain masyarakat memahami bahwa kedudukan istri dalam keluarga berada di bawah suami, hal ini mereka pahami dari pemahaman fikih salaf yang menyebutkan bahwa istri harus menjunjung tinggi suaminya dengan kehormatan dan kemuliaan. Kedua, Konsep pekawinan Islam mengajarkan bahwa hak-hak yang dimiliki oleh suami maupun isteri adalah seimbang dengan kewajiban yang dibebankan kepada mereka,seorang suami atau isteri memiliki kewajiban-kewajiban yang seimbang. Ketiga, untuk mewujufkan keluarga yang harmonis, sakinah dan penuh kedamaian dapat di lakukan dengan cara Pembinaan penghayatan ajaran agama Islam, Pembinaan sikap saling menghormati, Pembinaan sikap Hidup Efisien, dan Pembinaan sikap suka mawas diri dari masing-masing pasangan suami isteri. Artikel ini mengelaborasi hukum keluarga Islam dengan prinsip mubadalah yang bertujuan untuk meminimalisir praktik dominasi, subordinasi dan bahkan kekerasan dalam keluarga. Sehingga sangat perlu mengangkat topik tentang relasi gender suami istri dalam keluarga untuk “membuka mata” akan pentingnya relasi yang sadar gender. Melalui kajian ini, diharapkan mampu mempertahankan akar hukum keluarga Islam yang ramah gender sehingga tidak akan ada lagi praktik dominasi dan subordinasi dalam kehidupan rumah tangga. Penelitian ini menggunakan metode kepustakaan (library research) dengan mengkaji berbagai macam sumber literatur yang berkaitan dengan topik relasi gender dalam keluarga sekaligus memadukannya dengan pendekatan feminis. Berdasarkan hasil penulusuran dari berbagai sumber referensi dijelaskan bahwa pola relasi suami istri yang baik itu adalah berdasar pada prinsip Al- Mu’asyarah bi Al- Ma’ruf. Hal tersebut akan terwujud jika kedua belah pihak yaitu suami istri saling memahami sekaligus menjalankan hak-hak dan kewajibannya secara resiprokal dan proposional, sehingga akan tercipta keselarasan. Tidak ada dominasi antara suami istri karena keduanya adalah saling melengkapi. Selain itu, keberadaan prinsip mubadalah dalam Hukum Keluarga Islam merupakan sebuah keniscayaan untuk mewujudkan tatanan hukum yang ramah gender dalam keluarga Islam. [This study elaborates on Islamic family law with the principle of mubadalah which aims to minimize the practice of domination, subordination and even violence in the family. Moreover, the discussion also reveals the importance of gender-awareness relations in the family life. Through this study, it is expected to be able to maintain the root of Islamic family law in the gender-friendly relation point of view. So, there will be no more practices of domination and subordination in the domestic life. This research uses the library research method by examining various sources of literature related to the topic of gender relations in the family and also involves the feminist approach. The results show that the pattern of an ideal relationship between husband and wife is based on the principle of Al-Mu'asyarah bi Al-Ma’ruf. It can be realized if the husband and wife can understand each other and at the same time carry out their rights and obligations proportionally and reciprocally, thereby the harmony can be realized. There is no domination between husband and wife because both are complementary. In addition, the existence of the principle of mubadalah in Islamic Family Law is a necessity to realize and optimize a gender-friendly legal order in the Islamic family.]

In Islamic law, pre-wedding photos have not been regulated in detail. However, pre-wedding photo activities have become commonplace by the community. It becomes a problem when pre-wedding is currently done with an intimate scene, usually the prospective bride uses sexy clothes and is also not accompanied by her mahram when doing pre-wedding photos. Even though there have been many fatwas and studies on the limits of permissibility and prohibition in the pre-wedding procession.The results show that the pre-wedding procession that is carried out by the community in terms of poses, clothes, and also assistance in accordance with Islamic law, the law is permissible. However, it often happens in the community to take photos before the marriage contract with scenes as if they are legally husband and wife and the bride's family knows without prohibiting, directing, and guiding them according to Islamic teachings. In this case the role of the family is very important, we as parents must understand the basis of religious knowledge and how to instill religious values in our children since childhood is the key to this problem dilemma.

AbstractPurpose of this study was to describe the meaning of ezer kenegdo and to know position and role of women in the family. The research method used is qualitative research methods (library research). The term of “ ezer kenegdo” refer to a helper but her position withoutsuperiority and inferiority. “The patner model” between men and women is uderstood in relation to one another as the same function, where differences are complementary and mutually beneficial in all walks of life and human endeavors.Keywords: Ezer Kenegdo; Women; Family.AbstrakTujuan penulisan artikel ini adalah untuk mendeskripsikan pengertian ezer kenegdo dan mengetahui kedudukan dan peran perempuan dalam keluarga. Metode yang digunakan adalah metode kualitatif library research. Ungkapan “ezer kenegdo” menunjuk pada seorang penolong namun kedudukannya adalah setara tanpa ada superioritas dan inferioritas. “Model kepatneran” antara laki-laki dan perempuan dipahami dengan hubungan satu dengan yang lain sebagai fungsi yang sama, yang mana perbedaan adalah saling melengkapi dan saling menguntungkan dalam semua lapisan kehidupan dan usaha manusia.Kata Kunci: Ezer Kenegdo, Prerempuan, Keluarga.

This paper examines the role of parents as a source of character education for early childhood. This study was conducted using the library research method. The results of this study indicate that the role of parents is a determining factor for children's development, both physically and mentally, is the role of both parents as the first and main educators for children who are born until they are adults. In the process of forming knowledge, various parenting styles conveyed by parents are very important. Education in the family plays a very important role in developing the character, personality, cultural values, religious and moral values ​​, and simple skills of children. The role of parents in influencing the character of children is no longer borne by the mother only. The role of the father in shaping the character of the child is very large. Fathers are still obliged to participate in maintaining interactions with their children, such as inviting them to talk, joke, and play.

Nafkah merupakan salah satu daripada hak isteri yang perlu ditunaikan. Hukum ini telah termaktub di dalam Al-Quran dan sebagaimana yang diketahui oleh semua muslim, salah satu kewajiban seorang suami itu adalah menyediakan nafkah buat isterinya baik dalam  tempoh  perkawinan  maupun  pasca perceraian.  Namun,  mutakhir  ini,  banyak kasus yang melibatkan perilaku suami yang mengabaikan nafkah isteri pasca perceraian. Bahagian Sokongan Keluarga (BSK) merupakan pihak berwenang yang mampu mengatasi dengan sebaik mungkin segala permasalahan berkaitan dengan pemberian nafkah. BSK memberi peluang kepada mantan isteri untuk membuat tuntutan nafkah jika suami gagal atau enggan membayar nafkah sekaligus mengembalikan hak isteri. Pertanyaan yang diajukan dalam permasalahan ini adalah bagaimana peran BSK dalam menjamin terpenuhinya  nafkah isteri pasca perceraian dan bagaimana efektifitasnya (BSK) terhadap masalah penegakan nafkah isteri pasca perceraian. Penelitian ini bertujuan untuk mengetahui tentang peran (BSK) dalam masalah pemenuhan nafkah isteri pasca perceraian. Penelitian dalam skripsi ini adalah yuridis empiris yaitu kajian lapangan (field research) dan yuridis normatif yaitu kajian kepustakaan (library research). Adapun Metode pengumpulan data yang digunakan penulis dalam skripsi ini adalah observasi, wawancara dan telaah dokumentasi. Hasil penelitian yang diperoleh, bahwa peran BSK dalam masalah pemenuhan nafkah isteri pasca perceraian berjalan secara efektif karena BSK memantau dan menangani masalah ketidakpatuhan mantan suami terhadap perintah nafkah Mahkamah Syariah melalui pembentukan Unit Khidmat Nasehat dan Perundangan, Unit Penguatkuasaan dan Pelaksanaan Perintah dan Unit Pengurusan Dana. Keberadaan BSK telah menjadi tempat rujukan dan   memberikan bantuan kepada mantan isteri. Berdasarkan hal tersebut, dapat difahami bahwa pokok permasalahan dalam penyelesaian masalah pengabaian nafkah apabila mantan suami memahami  hal  berkaitan  agama  Islam  serta  mengetahui  hak  dan  tanggung  jawab terhadap isteri pasca perceraian.Kata Kunci: Bahagian Sokongan Keluarga (BSK) dan Nafkah Isteri Pasca Penceraian Living in one of the rights of wives that need to be shown. This law has been contained in the Koran and as it is known by all Muslims, one of the obligations of a husband is to provide a living for his wife both in the period of marriage or post-divorce. However, these cutting-edge, many cases involve the behavior of husbands who neglect the living wives post-divorce. The Family Support Division (BSK) is the authority who can cope with the best possible problems relating to the provision of the living. BSK allows the former wife to make a living claim if the husband fails or refuses to pay the living while returning the right of the wife. The question posed in this issue was the role of BSK in guaranteeing the fulfillment of the postpartum wife and how effectiveness (BSK) has been to the problem of establishing a divorce post. The study aims to find out about the role (BSK) in the issue of fulfilling wives after divorce. The research in this thesis was empirical, i.e. field research and normative juridical (library research) study. The methods of data collection used by the authors in this thesis are observations, interviews and documentation study. The results of the research obtained, that the role of BSK in the problem of fulfillment of wives post-divorce runs effectively because BSK monitors and addresses the problem of non-compliance of ex-husband against the order of Sharia court The establishment of the Advisory and Legal Unit, enforcement Unit and the execution of the Order and fund Management unit. The existence of BSK has been a referral place and provides relief to the former wife. Based on this, it can be understood that the subject matter in solving the issue of living if the former husband understands the matter related to Islam and knows the rights and responsibilities of the post-divorce wife.

The equality of gender roles between men and women is a problem / polemic due to differences in gender roles. Social agreements place women to be regulated by men in life. This study discusses subordination of women in short story of Kompas newspaper on 2017. This is important to understand because understanding about subordination of women can be used as a standard of behavior to achieve harmonious and democratic community life. This type of research is descriptive qualitative with content analysis strategies. The research data was obtained from short story documents published in the Kompas newspaper in July 2017 to December 2017. The sampling technique used was purposive sampling. Data collection techniques use library research techniques. Data validity uses theory triangulation. The results showed that the subordination of women in Kompas short stories in 2017 in the form of a decision to determine the number of children was a man's decision and the decision of a girl's mate was under a man's decision as the head of the family (patriarchal culture).

The high divorce rate in Indonesia, including among Christian families, has in recent years been a struggle together. Divorce itself is the mouth of a variety of pressures faced by Christian families that are not properly resolved. Not a few Christian families have a vulnerable resilience due to their inability to manage conflicts that occur. On the other hand, the Church must recognize that it has an ethical and theological responsibility to maintain the resilience of the family members of its congregation. However, the fact is that most churches do not have a programmed mission to nurture husband and wife members of their congregations in order to maintain family resilience. In fact, many churches do not have documented teaching material for cultivating Christian families. This article is a summary of development research that seeks to create a design for Christian husband and wife formation materials that can later be used by church leaders for the survival of the family of church members. The research method used is Research and Development (R & D), which is used to produce certain products, and test their effectiveness. In this research, the design of Christian husband and wife guidance materials for the family resilience of church members is produced.

Islamic civilization had ever got a doctor on the medical fields known as Rhazes to the West, he was labelled as “al-mulḥid” due to his controversial thoughts on prophetic concept. The doctor was born in Al-Rayy on 250 H/ 864 AD, he as the writer of “al-Ḥāwī Fī al-Ṭibb” did not feel content of the treatment on human disease that was relying on techniques or certain methods of treatment alone, yet it was to reach the senses of adequacy. He believed that medication treatments required morals in which a doctor should attentively mind a patient. Therefore Al-Rāzī decided to do such a noble thing by composing a conscientious book entitled “Akhlāq al-Ṭabīb” as a treatise to his students. This study was conducted through a qualitative research that applied the methods of library research. The object of this study is al-Rāzī’s thoughts about the moral concept of doctors based on his work entitled “Akhlāq al-Ṭabīb” and this work is used as the primary data source along referrals of other works about al-Rāzī which will be analysed using the paradigm of Amin Abdullah, namely integration-interconnection. This study aims to briefly dissect apropos the primal foundation of al-Rāzī's thought which produced the moral concept of doctors in an era that still was arrantly early long before the existence of medical ethics as it is in the current era. Furthermore, this study intends to appeal Abū Bakr al-Rāzī's view on physician morals and how should a doctor provide thoughtful ministration of the patient. This study reveals that within the essences of al-Rāzī himself had the theocentric paradigm and the anthropocentric paradigm then those were accumulated at once; ergo the epistemological roots of al-Rāzī's thought lead to religion, science (medical sciences) and philosophy. Through a good elaboration of science, philosophy, and religion, in the concept of tawakkal and good character (akhlāq) towards poor people who suffered from diseases, al-Rāzī had laid some -which were not applied to the whole- the moral basics of doctors far ahead of existing legal and legal norms in the current era which can be explored in his book.   ABSTRAK Peradaban Islam telah menyaksikan hadirnya seorang doktor dalam bidang perubatan yang dikenali hatta ke dunia Barat sebagai Rhazes. Dia dilabel sebagai "al-mulḥid" disebabkan kontroversi pemikirannya tentang konsep kenabian. Doktor tersebut lahir di Al-Rayy pada 250 H / 864 M. Sebagai penulis "al-Ḥāwī Fī al-Ṭibb", dia tidak berpuas hati dengan perawatan penyakit manusia yang hanya menggunakan teknik atau kaedah perawatan tertentu sahaja. Baginya ia juga harus berkaitan dengan akhlak. Al-Rāzī meyakini bahawa dalam memberikan khidmat rawatan, doktor memerlukan kepada moral di mana doktor harus memberikan sepenuh perhatian kepada pesakit. Hal ini membawa kepada penyusunan sebuah buku yang berjudul "Akhlāq al-Ṭabīb" sebagai risalah bagi para pelajarnya, satu keputusan dan tindakan mulia oleh al-Rāzī. Kajian ini dilakukan melalui kajian kualitatif dengan menerapkan kaedah kajian perpustakaan. Objektif kajian ini adalah pemikiran al-Rāzī tentang konsep moral doktor berdasarkan karyanya yang berjudul "Akhlāq al-Ṭabīb" dan karya ini sebagai sumber data primer, di samping rujukan karya-karya lain tentang al-Rāzī, dan akan dianalisa menggunakan paradigma Amin Abdullah, iaitu integrasi-interkoneksi. Kajian ini bertujuan untuk membezakan secara ringkas landasan pemikiran al-Rāzī yang menemukan konsep moral doktor di era terdahulu, jauh sebelum adanya etika perubatan seperti pada zaman ini. Seterusnya, kajian ini juga bertujuan untuk menyingkap pandangan Abū Bakar al-Rāzī tentang moral seorang doktor dan bagaimana seseorang doktor harus memberikan layanan sepenuh perhatian terhadap pesakit. Kajian ini menemukan bahawa di dalam intipati al-Rāzī terhimpun paradigma-paradigma teosentris serta paradigma antroposentris; akar epistemologi pemikiran al-Rāzī bermuara pada agama, ilmu (ilmu perubatan) dan falsafah. Melalui penjabaran yang baik dari sains, falsafah, dan agama, dalam konsep tawakkal dan peribadi yang baik (akhlāq) terhadap orang-orang miskin yang mengidap penyakit, al-Rāzī telah meletakkan beberapa -di mana tidak diterapkan pada keseluruhan - dasar-dasar moral doktor jauh lebih awal dari aturan dan norma hukum yang ada pada era kini, di mana hal itu dapat dieksplorasi dalam bukunya.
