Padang Restaurant is one of the ethnic restaurants in Indonesia from Minangkabau. The existence and "brand" of Padang Restaurant has been very well known in the territory of Indonesia and even in several neighboring countries such as Australia, Singapore, Malaysia and other countries. Padang cuisine, with its taste and variety, is currently in great demand by the wider community. Unlike the canteen, cafe or restaurant, where visitors are given a menu and order the desired food, at the Padang restaurant, when visitors sit, they will be served a whole selection of side dishes available with small plates. After serving then the customer just takes what he wants from the dish table. The problem that can then arise is the food that has been served, but not eaten by visitors. The food will be brought back and served to another table. Not infrequently the food that is still on the visitor's table is pulled back to serve at another table. In addition, food storage is also done in an open place so that visitors can come. These things will certainly bring cleanliness problems. For visitors who are very concerned about cleanliness, of course they will feel uncomfortable seeing the food that has been served at another table and then served on the table. Or see the food served brought from an open place. Service Excellence at the restaurant not only increases the company's profit but can also improve the image of the restaurant. When guests or consumers are satisfied with the service in their restaurant they will promote their satisfaction in the restaurant. Service Excellence is service to consumers to improve service in a company. Service Excellence in Restaurants is a service to consumers to provide satisfaction in the form of excellent service to the restaurant products. Excellent service is very important not only to get big profits but this service must be fulfilled by every company. To provide Service Excellence in the right restaurant, every employee must get training or training so that they are truly able to work well and professionally. A restaurant employee must be able to provide services to consumers whoever they are. Not only employees who are in front but all members of the company must also be able to provide the best service.

The mechanisms of professional selection of young graduates in the labour market remain an open debate and involve all stakeholders: students, educational system, companies and administrations. These mechanisms play a crucial role in the future performances of an institution or a company, as the selection of the wrong candidate can ruin an organization. In contrast, the right candidate can take the organization to new heights. The interview presents a short interaction that may reflect the candidate knowledge and skills; however, there are many other hidden facets such as personality traits that are difficult to measure only by interviewing. Today, many countries already use personality testing during the recruitment phase. Our objective through this work is to determine the possible links between the personality of future young employees and their performance within the company. To achieve this objective, we carried out a comparative study of the different personality tests used in the recruitment process.

Abstract Selection of appropriate funding sources for company assets is one of the most important decisions taken by a company. The right capital structure and in particular the relevant relationship between own and external sources of financing have a significant impact on the financial results. The purpose of this paper is to analyze the use of own resources in the funding of assets in the dairy industry in the Podlaskie Province in 2010-2012. The information included in the financial statements of the surveyed companies, as well as secondary data included in the studies of the CSO, was used in the paper.

<p><em>Abstrak</em> – <strong>CV. Gajah Mungkur adalah salah satu perusahaan yang bergerak di bidang bordir kain. Perusahaan ini mengalami pasang surut penjualan produknya selama dua tahun terakhir. Untuk itu dalam penelitian ini menggunakan strategi seperti analisis SWOT sebagai pendekatan perusahaan menghadapi persaingan bisnis penjualan serta pendekatan dinamika sistem dalam memberikan rekomendasi terhadap keputusan atau kebijakan perusahaan terkait nilai omset penjualan dan nilai profit perusahan yang dipengaruhi oleh faktor ketidakpastian (uncertainty). Berdasarkan hasil pengolahan ANP dengan software Super Decisions, didapatkan bahwa alternatif strategi yang tepat bagi perusahaan CV. Gajah Mungkur untuk melanjutkan proses bisnisnya yang lebih baik adalah dengan cara memberikan promo diskon dan melakukan pemasaran secara online. Berdasarkan analisis output hasil simulasi skenario, bahwa bila perusahaan menerapkan skenario diskon harga produk sebesar 5% perusahaan akan mendapatkan penambahan jumlah penjualan sebanyak 139.258 unit. Kemudian bila perusahaan menerapkan skenario diskon produk sebesar 10% perusahaan akan mendapatkan penambahan jumlah penjualan sebanyak 151.918 unit. Selanjutnya adalah bila perusahaan menerapkan skenario diskon produk sebesar 15% perusahaan akan mendapatkan penambahan jumlah penjualan sebanyak 164.577 unit. Selain itu bila perusahaan menerapkan pemasaran secara online, bila perusahaan menerapkan promosi online salah satunya di online shop shopee maka perusahaan akan mendapatkan penambahan jumlah penjualan sebanyak 174.533 unit.</strong></p><p><em>Abstract</em> - <strong>CV. Gajah Mungkur is one of the companies engaged in fabric embroidery. This company has experienced ups and downs in the sales of its products as per the data for the last two years. For this reason, this study uses strategies such as SWOT analysis as a company approach to dealing with sales business competition as well as a system dynamic approach in providing recommendations on company decisions or policies related to the value of sales turnover and the value of company profits which are influenced by uncertainty factors. The results of this study are based on the results of ANP processing with Super Decisions, it was found that the right alternative strategy for CV. Gajah Mungkur, to continue its better business process, is by providing discount promos and marketing online. Based on the output analysis scenario simulation results, that if the company applies a 5% discount on product price scenarios, the company will get an additional sales volume of 139,258 units. Then if the company applies a product discount scenario of 10%, the company will get an additional sales number of 151,918 units. Furthermore, if the company applies a product discount scenario of 15%, the company will get an additional sales number of 164,577 units. Besides, if the company implements online marketing, if the company implements online promotions, one of which is the online shopee, the company will get an additional sales number of 174,533 unit.</strong></p><p><strong><em>Keywords - </em></strong><em>SWOT, ANP, System Dynamics Simulation</em><em>.</em></p>

В настоящей статье предпринята попытка исследовать отдельные проблемные аспекты института потерпевшего в российском уголовном процессе. В этих целях подвергнуты анализу правовые нормы, регламентирующие его процессуальный статус. Раскрываются отдельные пробелы уголовно-процессуального законодательства в сфере защиты законных прав и интересов потерпевшего. Автор акцентирует внимание на том, что совершенствование уголовно-процессуального законодательства в части расширения правомочий потерпевшего по отстаиванию своих нарушенных преступлением прав следует продолжить. На основании проведенного исследования действующего законодательства в части регламентации прав потерпевшего от преступления предлагается расширить перечень получаемых им копий постановлений, указанных в п. 13 ч. 2 ст. 42 УПК РФ. Автор предлагает включить в перечень указанной законодательной нормы право получения потерпевшим копии постановления об избрании конкретного вида меры пресечения, избранного в отношении подозреваемого (обвиняемого). Для создания действенного механизма защиты интересов потерпевших от преступления юридических лиц предлагаем ч. 9 ст. 42 УПК РФ изложить в следующей редакции: «в случае признания потерпевшим юридического лица его процессуальное право в уголовном процессе осуществляет представляющий его профессиональный адвокат». This article attempts to investigate certain problematic aspects of the institution of the victim in the Russian criminal process. For this purpose, analyzed the individual norms governing his procedural status. Separate gaps of the criminal procedure legislation in the sphere of protection of the legal rights and interests of the victim are disclosed. The author emphasizes that the improvement of the criminal procedure legislation in terms of the extension of the victim’s authority to defend his rights violated by the crime should be continued. On the basis of the study of the current legislation regarding the regulation of the rights of the victim of a crime, it is proposed to expand the list of decisions received by him, referred to in paragraph 13, part 2 of article 42 Code of Criminal Procedure. The author proposes to include in the list of the indicated legislative norm the right to receive the victim a copy of the decision on the selection of a specific type of preventive measure, selected in relation to the suspect (accused). To create an effective mechanism for protecting the interests of legal entities victims of a crime, we offer part 9 of art. 42 of the Code of Criminal Procedure of the Russian Federation shall be reworded as follows: «if a legal entity is recognized as a victim, his procedural right in criminal proceedings is exercised by the professional lawyer representing him».

For 30 years, forage ryegrass breeding has known that the germplasm may contain a maternally inherited symbiotic Epichloë endophyte. These endophytes produce a suite of secondary alkaloid compounds, dependent upon strain. Many produce ergot and other alkaloids, which are associated with both insect deterrence and livestock health issues. The levels of alkaloids and other endophyte characteristics are influenced by strain, host germplasm, and environmental conditions. Some strains in the right host germplasm can confer an advantage over biotic and abiotic stressors, thus acting as a maternally inherited desirable ‘trait’. Through seed production, these mutualistic endophytes do not transmit into 100% of the crop seed and are less vigorous than the grass seed itself. This causes stability and longevity issues for seed production and storage should the ‘trait’ be desired in the germplasm. This makes understanding the precise nature of the relationship vitally important to the plant breeder. These Epichloë endophytes cannot be ‘bred’ in the conventional sense, as they are asexual. Instead, the breeder may modulate endophyte characteristics through selection of host germplasm, a sort of breeding by proxy. This article explores, from a forage seed company perspective, the issues that endophyte characteristics and breeding them by proxy have on ryegrass breeding, and outlines the methods used to assess the ‘trait’, and the application of these through the breeding, production, and deployment processes. Finally, this article investigates opportunities for enhancing the utilisation of alkaloid-producing endophytes within pastures, with a focus on balancing alkaloid levels to further enhance pest deterrence and improving livestock outcomes.

InCentros Ltd and Erhvers-og Selskabsstyrelesen (hereinafter Centros),1 the European Court of Justice ruled that it is contrary to Article 52 (now Article 432) and Article 58 (now Article 48) of the EC Treaty for the authorities of a member State (in casu Denmark) to refuse to register a branch of a company formed under the law of another member State (in casu the United Kingdom) in which it has its registered office, even if the company concerned has never conducted any business in the latter State and intends to carry out its entire business in the State in which the branch is to be set up. By avoiding the need to form a company there it would thus evade the application of the rules governing the provision for and the paying-up of a minimum share capital in force in that State. According to the Court, this does not, however, prevent the authorities of the member State in which the branch is to be set up from adopting appropriate measures for preventing or penalising fraud, either with regard to the company itself, if need be in co-operation with the member State in which it was formed, or with regard to its members, where it has been determined that they are in fact attempting, by means of the formation of a company, to evade their obligations towards creditors established in the territory of the member State of the branch.

Abstract The authors present the issues and challenges related to the changes in status of a company and its impact on competitiveness. Status changes of companies, mostly mergers and acquisitions of companies, are one of the ways in which capital owners and management direct economic activities with the aim of maximizing profits. In order to make the right and justified decision, in terms of achieving the economic interests of the company, it is essential to know the laws and regulations in this area. This paper should provide answers on various questions which will be presented to decision makers in every company, considering status changes. Bearing in mind that the question of status changes often associated with an international element, the authors will pay special attention on the EU legislation and current legal framework in the Republic of Serbia.

Zur flexiblen und schnellen Umsetzung von passgenau individualisierten, oft branchenübergreifenden Wertangeboten und der Absicherung des Kundenzugangs wird es zukünftig wettbewerbsentscheidend sein, sich im richtigen Business Ecosystem – also der Gruppe von Akteuren die interagieren müssen, um ein entsprechendes Wertangebot zu realisieren und den entsprechenden Kundenzugang haben – zu bewegen und dieses mitzugestalten. Der Beitrag beschreibt das grundsätzliche Vorgehen zur Identifizierung und Auswahl relevanter Business Ecosystems sowie deren strategische und operative Einbindung in ein Unternehmen. &nbsp; The ongoing digitization leads to new and converging product benefits and more efficient processes. In connection with a change in needs it also leads to a change in user behaviour and understanding of the benefits for customers. For the flexible and fast implementation of customized, individualized, often cross-industry value propositions and the safeguarding of access to customers, it will be crucial in the future to act and help to shape the relevant business ecosystems (group of actors that need to interact in order to realize a value proposition or to have access to customers). The article describes the basic procedure for identifying and selecting relevant business ecosystems and their strategic and operational integration into a company.

The need for environmentally compliant processes and materials in the Painting Industry grows more pressing every day. As the need for these processes grows, so grows the confusion regarding the selection and implementation of these new methods and materials. In the past, price and traditional procedure were the only criteria by which a material was procured. Speed and compliance with Original Equipment Manufacturer specification governed how things were done on the shop floor. With the advent of the environmental regulations, processes are being examined all across the globe. In many of the larger companies, the chief environmental officer has as important a role as the comptroller or Chief Financial Officer. Environmental managers are often not chemists or line painters, and typically, the environmental manager is skilled only in the policies of waste disposal, spill clean up, or remediation. The methods whereby a company can minimize the generation of hazardous waste remain less familiar. Often the examination of possible alternate techniques and materials are left for the last minute, or are conducted by personnel who are unfamiliar with how to make changes work. This is usually a recipe for failure in the implementing of anything new. This paper will suggest methods for selection of alternative products and processes in a clear and organized manner. Salient discussion points will be: 1. Process Examination 2. Material Selection 3. Steps For Successful Implementation 4. Possible Impediments 5. How to Avoid Risky Alternatives It will focus on procedures that will assist in the decision making process, and hopefully be of use in the choosing of environmentally sound equipment, chemicals, and methodologies.
