<strong>Abstrak:</strong> <strong>Hukum Acara Islam: Analisis <em>Kitâb al-Qâdhî ila al-Qâdhî </em>dalam Literatur Hukum Islam. </strong>Telah jamak diterima di sementara kalangan ilmuwan bahwa hukum Islam tidak memiliki prosedur, dan memiliki jejak akar kemunculannya pada sistem yang dikenal dalam sistem hukum sekuler. Esai ini menganalisis asal usul gagasan prosedur hukum dengan menelusuri konsep awal yang ditemukan dalam <em>genre</em> <em>Kitâb al-Qâdhî ilâ al-Qâdhî</em> yang tergabung dalam literatur hukum <em>fuqaha'</em> atau ahli hukum Islam. Penelitian ini adalah penelitian kualitatif dengan menganalisis materi hukum pada surat hakim kepada hakim lain yang ditemukan dalam karya-karya berbagai ulama hukum Islam. Temuan penelitian ini mengimplikasikan bahwa meskipun ada penyederhanaan beberapa ilmuwan pada hukum pembuktian Islam, ada diskusi yang sangat kompleks tentang masalah ini dalam karya ulama hukum Islam. Selanjutnya, catatan sejarah hukum pembuktian dalam Islam ini telah menjadi bagian integral dari praktik sosial dan hukum pada masa awal, yang sejarahnya dapat dianggap sebagai konsepsi awal hukum pembuktian dalam Islam.<br /><strong><br />Kata Kunci</strong>: Hukum Islam, prosedur, bukti, dokumenter, sejarah hukum<br /><strong></strong><br /><strong>Abstract:</strong> It has been commonly accepted amongst some scholars that Islamic law lacks of procedure and that it had indebted greatly to the system known in the secular system of law. This essay attempts to analyze the origin of the idea of the law procedure by tracing the very early concept found in the genre of <em>Kitâb al-Qâdhî ilâ al-Qâdhî </em>(a letter form one judge to another judge) incorporated in the legal literature of <em>fuqahâ’</em> or Islamic jurisprudents. The study is a qualitative research by in depth analysis on legal materials on the letter of a judge to another judge found in the works of various Islamic law scholars. The finding of this study implies that despite the over-simplication of some scholars on the Islamic law of evidence, there exist a very complex discussion of the issue in the works of Islamic law scholars. It is conceivable to assert that this historical record of law of evidence in Islam had become an integral part of the social and legal practices of the early time that could be regarded as the early inception of law of evidence in Islam.<br /> <br /><strong>Keywords</strong>: Islamic law, procedure, evidence, documentary, legal history

In Islamic law of evidence, there are several forms of evidence commonly used by courts to establish facts. In today’s era, a form of evidence called forensic evidence has also emerged. A question then arises, what is the appropriate legal basis for acceptance of this forensic evidence in the Islamic law of evidence. This paper focuses on the evolution of the Islamic law of evidence and investigates the position of forensic evidence in Islamic law from sources such as the Quran, the Prophet’s traditions, and the practices of the Companions of the Prophet. In addition, this study also looks at the experience of the Malaysian Syariah Courts in terms of how forensic evidence is dealt with in hearing family law cases. The research design of this study is content analysis. Data were obtained by document analysis, including books, papers, journals, case reports, and other records relating to the role of forensic evidence. The methods used to interpret the data for this qualitative research are analytical and deductive. As a result, it can be said that forensic evidence is not an unfamiliar matter in the Islamic law of evidence. In fact, forensic evidence has been relied on by the Syariah Courts of Malaysia in making several decisions for certain cases in order to ensure that justice is upheld in society.

This article examines the production and analysis of fiqh by surveying Islamic legal scholarship. It highlights the implications different analytic approaches bring to the study of fiqh as both doctrine and literary genre. Starting with an overview of debates about legal reform in the context of “modernity,” the article proceeds to an analysis of philology as a disciplinary frame and its limits. The article then turns to studies of philology in conversation with history and the perceived demise of philology in the British and North American academy. Thereafter, the article explores fiqh as a genre Fiqh of legal literature that informs interpretive approaches in the social sciences, including the literature on Islamic law and anthropology and the fatwa as a site of legal practice in contrast to fiqh. Finally, it looks at fiqh as the object of critique and offers suggestions for future research.

AbstractCommunities with all their cultures have quite strong sociological roots. Culture that results from social interaction makes a distinctive value in that society. The forerunner of culture is an important aspect in the social framework. Research on this aspect of culture uses ethnographic studies. In its implementation ethnography emphasizes the existing aspects of culture. This is an important feature of ethnographic studies. As ethnographic qualitative research conducts in-depth analysis of the culture under study. On the other hand, there is a fairly close link between ethnography and society and culture as a result of their creativity. Therefore, this linkage needs to be applied positively, where it is necessary to use ethnographic studies as an alternative form of conducting research on culture in the community.Keywords: Ethnography, Culture, Society AbstrakMasyarakat dengan segala kebudayaannya memiliki akar sosiologis yang cukup mengakar kuat. Kebudayaan yang dihasilkan dari interaksi sosial menjadikan nilai distingsi tersendiri dalam masyarakat tersebut. Cikal bakal kebudayaan merupakan aspek penting dalam kerangka sosial kemasyarakatan. Penelitian akan aspek kebudayaan ini menggunakan studi etnografi. Dalam implementasinya etnografi menekankan pada aspek kebudayaan yang ada. Hal inilah menjadi ciri penting dari studi etnografi. Sebagai penelitian kualitatif etnografi melakukan analisa secara mendalam terhadap kebudayaan yang diteliti. Disisi lain, terdapat keterkaitan yang cukup erat antara etnografi dengan masyarakat dan kebudayaan sebagai hasil kreatifitasnya. Oleh sebab itu, keterkaitan tersebut perlu diaplikasikan secara positif, di mana perlunya menggunakan studi etnografi sebagai bentuk alternatif dalam melaksanakan penelitian tentang kebudayaan di masyarakat.  Kata Kunci: Etnografi, Kebudayaan, Masyarakat

This study seeks to uncover the MUI fatwa from the progressive aspects of Islamic law. Fatwa is the mirror of the dynamics of Islamic law in responding to the development of society. The set of MUI fatwa, in addition to functioning as a reference source of religious guidance, are also a historical record that is a source of social history. Fatwa ideally is always dynamic and paying attention to the dynamics of reality in society. Results of this study indicate that in general the MUI fatwa still had not moved from the tradition of jurisprudence, MUI fatwa is more nuanced as the social control and social engineering.

Chapter 4 investigates Dutch, English, and French smugglers who traded with Venezuelan subjects. Historians know very little about the social composition and trading methods of early modern smugglers. An in-depth analysis of hundreds of cases finds that these enigmatic figures came mostly from foreign colonies close to Venezuela including Curaҫao, Martinique, and Jamaica, but also from farther afield, in some cases. Most traders were part of small, multinational, multilingual, and multiracial crews. Although they were outsiders to Venezuela, these contrabandists maintained close contacts on shore who influenced how they conducted business. Smugglers were savvy and adaptable to local market conditions, customs, languages, and coast guard operations. Particularly important to the strategic intelligence of smugglers were Sephardic Jewish trading networks well versed in Iberian cultural traditions. Such contacts produced a smuggler’s craft that combined deception, force, bribery, and Spanish judicial savvy. At times the historical record indicates the presence of more elaborate and wealthy merchant conglomerates. Yet illicit exchange in the early modern maritime world offered egalitarian and entrepreneurial opportunities for small-time captains willing to trade on their own account. Counterbalancing potential profits were the inherent hazards of coastal violence, wartime privateering, coastguard patrols, exile, and forced labor.

Limitations of action designate extent of time after an event, as set by statutes of limitations, within which legal action can be initiated by a party to a transaction. No event is actionable outside the designated time as same is rendered statute-barred. This study aims to provide an insight into application and significance of Limitations Act 1950 and Limitation Ordinance 1952 to Islamic banking matters in Malaysia as well as Shariah viewpoint on the issue of limitation of action. In conducting the study, a qualitative research methodology is employed where reported Islamic banking cases from 1983 to 2018 in Malaysia were reviewed and analysed to ascertain the application of those statutes of limitations to Islamic banking. Likewise, relevant provisions of the statutes as invoked in the cases were examined to determine possible legislative conflicts between the provisions and the rule of Islamic law in governing the right and limitation of action in Islamic banking cases under the law. The reviewed cases show the extent to which statutes of limitations were invoked in Malaysian courts in determining validity of Islamic banking matters. The limitation provisions so referred to are largely sections 6(1)(a) and 21(1) Limitations Act 1953 and section 19 Limitation Ordinance 1953, which do not conflict with Shariah viewpoint on the matter. This study will prove invaluable to financial institutions and their customers alike in promoting knowledge and creating awareness over actionable event in the course of their transactions.

This article is motivated by the fact that the existence of the Street Vendor (PKL) profession is a manifestation of the difficulty of work and the lack of jobs. The scarcity of employment due to the consideration of the number of jobs with unbalanced workforce, economically this has an impact on the number of street vendors (PKL) exploding ... The purpose of being a street vendor is, as a livelihood, making a living, looking for a bite of rice for family, because of the lack of employment, this caused the number of traders to increase. The scarcity of jobs, causes informal sector migration job seekers to create an independent spirit, entrepreneurship, entrepreneurship, with capital, managed by traders who are true populist economic actors. The problems in street vendors are: (1) how to organize, regulate, empower street vendors in the cities (2) how to foster, educate street vendors, and (3) how to help, find capital for street vendors (4) ) how to describe grief as a Five-Foot Trader. This paper aims to find a solution to the problem of street vendors, so that cases of conflict, cases of disputes, clashes of street vendors with Satpol PP can be avoided. For this reason, the following solutions must be sought: (1) understanding the causes of the explosions of street vendors (2) understanding the problems of street vendors. (3) what is the solution to solving street vendors in big cities. (4) describe Street Vendors as actors of the people's economy. This article is qualitative research, the social paradigm is the definition of social, the method of retrieving observational data, in-depth interviews, documentation. Data analysis uses Interactive Miles and Huberman theory, with stages, Collection Data, Display Data, Data Reduction and Vervying or conclusions.

Penelitian ini bertujuan untuk mengetahui metode Program Fajar Indah yang ada di Radio Citra Progo dalam meningkatkan pemahaman keagamaan masyarakat, mengetahui klasifikasi da’i pengisi program Fajar Indah, serta pesan dakwah dari program Fajar Indah. Penelitian ini menggunakan penelitian kualitatif dengan metode deskriptif. Pengumpulan data dalam penelitian ini menggunakan teknik observasi, wawancara dan dokumentasi. Analisis data digunakan penafsiran logika yang dihubungkan dengan konteks Komunikasi Penyiaran Islam. Hasil penelitian menunjukan bahwa Radio Citra Progo dalam program Fajar Indah menggunakan metode ceramah dengan pembawaan da’i yang santai ketika siaran. Adapun klasifikasi da’i dalam siaran dakwah ini, dapat dilihat dari wawasan keilmuan penyiar dalam menguasai Al Quran dan Hadist sebagai sumber hukum Islam dan kedisiplinan untuk menjalankan tugas sebagai da’i penyiar radio. Dalam siaran Program Fajar Indah terdapat pesan dakwah berupa materi Aqidah untuk meningkatkan kepercayaan masyarakat kepada Allah, mengimani rukun Iman dan rukun Islam, serta materi Akhlak yang diperintahkan oleh Allah dan dicontohkan oleh Nabi Muhammad SAW, materi Ibadah yang menyampaikan tatacara beribadah kepada Allah meliputi hukum pernikahan, hukum bertetangga, shodaqoh, sholat, puasa dan menyampaikan materi tentang hari-hari besar umat Islam. This study aims to determine the methods of the Beautiful Fajar Program on Radio Citra Progo in improving people's religious understanding, knowing the classification of preachers for the Fajar Indah program, and preaching messages from the Fajar Indah program. This study uses qualitative research with descriptive methods. Data collection in this study uses observation, interview and documentation techniques. Data analysis used the interpretation of logic connected with the context of Islamic Broadcast Communication. The results showed that Citra Progo Radio in the Fajar Indah program used a lecture method with a relaxed nature when broadcasting. The da'i classification in this da'wah broadcast, can be seen from the broadcaster's scientific insights in mastering the Qur'an and Hadith as a source of Islamic law and discipline to carry out their duties as radio broadcast preachers. In the broadcast of the Fajar Indah Program there is a da'wah message in the form of Aqeedah material to increase public trust in God, faith in the pillars of faith and pillars of Islam, as well as moral material ordered by God and exemplified by the Prophet Muhammad, the material of worship which conveys the procedure of worship to God including marriage law , neighborly law, shodaqoh, prayer, fasting and delivering material about the Muslim holidays.

This paper is discusion the polygamy is still a controversial problem, although much discussed and examined. The difference of opinion among scholars make this problem continues to potentially raises the agree and disagree. Even though it has been regulated in Act Number 1 of 1974 concerning marriage and the compilation of Islamic law (KHI), this does not necessarily make the problem of polygamy is complete. Not a few perpetrators of polygamy choose married under the hand or by sirri. This research uses qualitative approach by implementing thematic interpretation method (maudhu'i) to obtain a comprehensive understanding about polygamy in the Qur'an. The Data obtained through the study of a library research by sharing the data that comes from the various verse of the Qur'an, hadith, book fiqh, research results, books and the news in various media outlets in order to complete the interpretation of the verses of polygamy. Based on the results of this research it is known that the verses of the Qur'an gives a very tight restrictions for those who want to in polygamy. Justice that the conditions of polygamy is not only were quantitative but also qualitative research. In the context of historical-socio, the command of polygamy is intended as a form of the solution to avoid injustice to orphans women. Even if polygamy still want to do, should the husband marrying the widows who have lighten the orphan.
