The purpose of the scientific paper is to characterize the correlation between the conceptual content of the principle of justice and the concept of reforming the labor legislation under the draft law of Ukraine «On Labor» with determining the prospects of future labor law of Ukraine. The author emphasizes that labor law rules, like no other branch of law, should be based on justice. This justice, once acquired at the cost of human life, has become so commonplace and commonplace that labor law rules are taken for granted and contain absolutely unnecessary elements that can be changed, eliminated, ignored… But in reality, all of these are important. and the necessary elements of a single interconnected mechanism, the core of which is justice. It is noted that the disappearance of at least one element of this mechanism means that justice is fading, and is therefore inadmissible in labor law. It is concluded that the draft Labor Law is an attempt to replace the principle of justice with the right of the strong, and therefore it is alien to the modern world and national consciousness and has no potential for reforming the labor legislation of Ukraine.

Provisions of the labor legislation were updated by the right of the employer for creation of works councils. The research of structures of non-trade union workers’ representation has special importance for Russian labour law scholarship. This is mostly so because of low efficiency of trade union representation in Russia that is still structurally influenced by centrally-planned economy’ traditions. System of works councils is a fairly complicated institution of labor law, as their activities are closely linked not only to the organization of labor, but also to the economy as well as the sociological aspects of human resource management. The multidimensional inwardness of works councils attached to this institution of labor law special significance, as consequence of their functioning must become strengthening of social dialogue at the level of the organizations and the separated structural divisions, while setting a consensus not only between the parties opposing interests in relation to a particular issue, but also creating a foundation for continuing cooperation in a spirit of cooperation. Creation of works councils is seeking to reinforce social solidarity, more equitable distribution of income between different social classes and sections of the population, increase employees’ interest in the affairs of the company. As part of the dynamic development of social and labor relations non-trade union workers’ representation becomes a key element in the development processes of industrial democracy, having a basis of workers’ participation in administrative decisions in the enterprise, directly affecting their interests, which allows the use of flexible forms of management of the organization, by providing workers the right to information and consultation.

Abstract Increased use of forging tools in mass production causes their increased wear and creates pressure to design more efficient renovation process. Renovation is complicated because of the identification of cracks expanding from the surface to the core material. Given that the production of forging tools is expensive, caused by the cost of tool steels and the thermo-chemical treatment, it is important to design forging tool with its easy renovation in mind. It is important to choose the right renovation technology, which will be able to restore the instrument to its original state while maintaining financial rentability. Choosing the right technology is difficult because of nitrided and heat-treated surface for high hardness and wear resistance. Article discusses the use of non-destructive method of detecting cracks taking into account the size of the cracks formed during working process.

The author has researched one of the directions of the modern formation and development of the rule of law state related to the improvement of various branches of law and the relevant legislation in the field of labor law. Among the most important features of applying the rest time is the correct definition and use of its legal regulation in respect to the employees of the National Police of Ukraine, which will allow the police officers to fully fulfill the tasks assigned to them by the state and society. The subject of the right to rest is everyone who works, and therefore everyone who has the right to work. The labor legislation of Ukraine does not define the concept of the rest time. It is opposed to the concept of “working time”. All the time beyond of working hours is considered to be the rest time. Having analyzed the current labor legislation of Ukraine, we state that labor law norms in regard to the types of rest are also applied to the police officers, taking into account the specificity of their activity, which is regulated by a special law. While analyzing scientific literature, regulatory base and international legal acts the author has established and revealed the types of rest time of the employees of the National Police of Ukraine. Inviolability of mission premises is not only one of the core provisions of the VCDR, but represents a long established rule of diplomatic law. At the same time, the absolute inviolability stipulated in Article 22(1) can lead to conflicts with the need to protect public safety and human life, resulting in a dilemma for the receiving States which then have to determine whether one interest must overrule the other. This chapter provides a detailed analysis of the difficulty, reviews scholarly debate in this field and examines relevant incidents and their evaluation. It pays particular attention to the controversy concerning the application of the right of self-defence. But the author also explores solutions to the dilemma and suggests the employment of administrative measures to resolve the practical problems encountered in situations of this kind.
