General Elections are the embodiments of the mandate stipulated in the 1945 Constitution of the Republic of Indonesia Article 1 paragraph (2) which affirms that "sovereignty is in the hands of the people and carried out according to the Constitution". The Formulation Document that will be formulated in the research are: (1) What is the violation in the general election? And (2) What is law enforcement in general election. The method used in this study is normative legal research, normative legal research methods or library law research methods are methods or procedures that are used in legal research by examining existing library material. Election violations constitute acts prohibited by the Election Law against election organizers resulting in the imposition of sanctions for violations. The enactment of Law Number 7 Year 2017 on General Elections provides for different types of violations, disputes, criminal offenses and electoral disputes. The crime of elections is a criminal offense punishable by a particular punishment based on the criminal justice system. The purpose of election is to carry out popular sovereignty and the realization of the political rights of the people to produce leaders who will occupy important positions in the government.

Election or local election is a way of channeling the rights of every principle community, which means that the right to vote and vote is contained in his constitutional rights as citizens. In article 28 letter D of the Republic of Indonesia Republic of 1945 which reads that "every citizen has the right to have the same opportunity in government". The sound contained in the article contains the understanding that the State guarantees each of its citizens to obtain the rights to sit in government either as People's Representatives, regents, Mayors, Governors, or even become a President. The method used in this study is normative juridical legal research which uses a statutory approach. The issue raised by the author is How the Human Rights Perspective of Legislative Candidates in Organizing Elections and How Comparative Legal Arrangements for Former Legislative Candidates Examined From Law Number 7 of 2017 Concerning General Elections With Regulation of the Election Commission Number 20 of 2018 Regarding Nominating Members Regional Representative Council, Provincial Regional Representative Council, Regency / City Representative Council. In terms of the implementation of elections need to be held honestly, fairly and democratically based on the spirit of Democracy that has been carried out so far so as to create leaders and representatives of the people who side with their people. Speaking of Human Rights, everyone has the same rights before the State and applies to former corruption convicts who have or have the same political rights as other citizens guaranteed by the constitution.

This study aims to analyze the need to establish a special election court which has the authority to solve various election law cases in order to realize elections with integrity; and analyzing the formulation of election special justice in order to realize the integrity of the election. The research method used is the method of normative legal research and the implementation of this research collects data from various sources in order to get an answer to the issues that have been formulated. The results of the study shows that  the purpose of the need for the formation of special judicial elections; First, to meet the growing demands of increasingly complex justice in society and more election law enforcement so as to realize the integrity of the elections; Second, To handle the election law cases quickly and simply so as to obey the integrity of the election. Formulation; First, the election special justice to be able to work quickly and simply in handling election law cases, domiciled at the central and provincial level, then entering the District Court or the High Court; Secondly, the Guidelines for the election special judicial law shall be based on Supreme Court Regulation Number 4 Year 2017 on Procedures for the Settlement of Administrative Offenses of the General Elections in the Supreme Court. Penelitian ini bertujuan untuk menganalisis perlunya membentuk peradilan khusus pemilu yang mempunyai kewenangan menyelesaikan berbagai perkara hukum pemilu agar terwujud pemilu yang berintegritas; dan menganalisis formulasi pembentukan peradilan khusus pemilu dalam rangka mewujudkan integritas pemilu. Metode penelitian yang digunakan ialah metode penelitian hukum normatif dan pelaksanaan dari penelitian ini mengumpulkan bahan hukum dari berbagai sumber guna mendapatkan suatu jawaban atas pokok-pokok permasalahan yang telah dirumuskan. Hasil penelitian menunjukkan bahwa tujuan perlunya pembentukan peradilan khusus pemilu; Pertama, Untuk memenuhi tuntutan perkembangan akan keadilan yang semakin kompleks dalam masyarakat dan lebih penegakan hukum pemilu sehingga mewujudkan integritas pemilu; Kedua, Untuk menangani perkara hukum pemilu dengan cepat dan sederhana sehingga mewudkan integritas pemilu. Formulasi; Pertama, Peradilan khusus pemilu agar bisa bekerja cepat dan sederhana dalam menangani perkara hukum pemilu, berkedudukan di tingkat pusat dan provinsi, selanjutnya masuk pada Pengadilan Negeri atau Pengadilan Tinggi; Kedua, Pedoman beracara pada peradilan khusus pemilu berdasarkan pada Peraturan Mahkamah Agung Nomor 4 Tahun 2017 tentang Tata Cara Penyelesaian Pelanggaran Administratif Pemilihan Umum Di Mahkamah Agung.

The fact shows that 70 percent wide Indonesia is the sea. In geographic regions of the Unitary State of the Republic ofmainland only around 1.9 million kilo square meters, while the sovereignty of the sea consists of 3.1 million square kilometersand sea exclusive economic zone (ZEE) 2.7 km or 70 percent ofthe area of the archipelago in the form of the sea. The numberof large and small island as much as 17.500 island. A series of the island stretches from the east to the west as far as 6,400 km and almost 2,500 km from north to south. The potential for Coordinating Minister of Maritime law enforcement authorities recently have a work program be peneguhan maritime sovereignty, resource utilization, the infrastructure development and innovation development and maritime technology. The Program stresses that the maritime must be well managed to useful to the welfare of the people. The real form of the government in the form of maritime buildingutilization of maritime zones, treat maritime area, optimize the potential of waters environment, anticipation of evil in the seaand to optimize the performance of the national marine council. Various problems in the maritime governance circumventedAnalisis Manajemen Berbasis Poros Maritim by maintaining the sovereignty of the sea, in cooperation with the state adidaya, encouraged maritime industry, and take advantage of the waters as the lifeblood of the national economy.

<p><em>The implementation of the regional head general election in the context of the election of the Regent and Deputy Regent in Badung Regency in 2020 then recorded the first history in the implementation of the regional head general election simultaneously in Bali Province, namely the determination of one candidate pair as the only participant participating in the regional head general election held in Badung Regency in 2020. This is certainly interesting to analyze so that in this paper it will be analyzed and described the relationship between elections with integrity and the determination of a single candidate in the general election for the regional head of Badung Regency in the simultaneous regional head elections in 2020. This writing uses normative legal research methods. Where in this paper, we use statutory studies and literature to analyze the determination of a single candidate in the regional head elections in Badung Regency in the context of the election of the Regent and Deputy Regent in 2020. The results of the analysis carried out were the determination of one candidate pair in the general election of the Regent and Deputy Regent in Badung Regency by the KPU of Badung Regency has been following the basic legal provisions of the implementation of regional head elections and the determination of one candidate pair in the regional head general election for the election of regents and deputy regents in Badung Regency in 2020 and has fulfilled the principles of elections with integrity, namely the general election of the head regions must continue to be implemented even though there is only one pair of participants participating in the regional head election competition so that the political rights of citizens to be able to elect their leaders based on the principles of democracy are fulfilled the elected leader is expected to be able to carry out the task us and its obligation to prosper and protect its people.</em></p><p><strong>Keywords</strong>: <em>Election for regional heads, Election with Integrity, One Candidate Pair, Democracy</em></p>

Tujuan penulisan karya ilmiah ini adalah untuk mengkaji pengaturan terkait kepemilikan tanah di Indonesia oleh orang asing melalui perjanjian nominee dan upaya penegakan hukumnya. Metode penelitian yang digunakan ialah metode penelitian hukum normatif dengan menggunakan pendekatan peraturan perundang-undangan dan konseptual. Hasil dari penulisan karya ilmiah ini ialah penegakan hukum terhadap praktek kepemilikan tanah oleh orang asing melalui perjanjian nominee dapat dilakukan oleh kejaksaan selaku organ negara yang mewakili kepentingan publik, baik melalui sarana perdata maupun pidana. Hal ini perlu dilakukan guna melindungi tanah Indonesia dimiliki oleh orang asing dan guna mendukung upaya negara mewujudkan tugas konstitusionalnya, yakni menguasai tanah bagi sebesar-besarnya kesejahteraan rakyat tanpa harus memberikan ketidakadilan bagi Warga Negara Asing. The purpose of writing this scientific paper is to examine regulations related to land ownership in Indonesia by foreigners through nominee agreements and law enforcement efforts. The research method used is normative legal research methods using statute and conceptual approaches. The result of writing this scientific paper is that law enforcement against the practice of land ownership by foreigners through nominee agreements can be carried out by the prosecutor as the state organ representing the public interest, both through civil and criminal means. This needs to be done in order to protect Indonesian land owned by foreigners and to support the state's efforts to realize its constitutional duties, namely to control the land for the maximum welfare of the people without having to give injustice to foreign citizens.

AbstractLaw No.10 of 2016 concerning the Election of Governors, Regents and Mayors has included criminal provisions in Chapter XXIV, of course very much more complete when compared to the criminal provisions stipulated in the Criminal Code concerning crimes against carrying out obligations and rights which are classified certain acts, but the Criminal Code is deemed no longer relevant due to the increasingly complex problems in terms of the enforcement of criminal elections and post-conflict local elections. The essence of law enforcement itself can be interpreted as an act of implementing certain legal means to impose legal sanctions to ensure compliance with a rule. Esensi dari penegakan hukum itu sendiri yang bisa dimaknai sebagai tindakan menerapkan perangkat sarana hukum tertentu untuk memaksakan sanksi hukum agar menjamin pentaatan terhadap suatu aturan. Corruption is committed by state officials, law enforcement and other related parties. Various efforts have been made by the government in preventing and eradicating corruption in Indonesia, but the efforts that have been made have not yet gotten optimal results. The fundamental weakness in eradicating corruption in Indonesia is the formulation of the main criminal sanctions in the form of criminal threats that are facultative, uncertain or must be. So that the corruptors are never deterred or afraid. In the future, the legislators need to reformulate the provisions of Article 2 paragraph (2) of the Republic of Indonesia Law Number 31 of 1999 as amended to Law of the Republic of Indonesia Number 20 of 2001 concerning Eradication of Corruption. Various criminal law policies still need to be carried out by the state in order to eradicate corruption to achieve the expected results. This type of research in this paper uses the type of normative legal research. The type of approach is in the form of a legal approach related to corruption. There are two legal materials used, namely primary legal materials and secondary legal materials, with legal material collection techniques used in the form of library studies. The analysis technique used is descriptive, interpretation, evaluation and argumentative techniques. The research in this paper intends and aims to examine and analyze the facts and phenomena of corruption that are stated in specific legislation concerning criminal sanctions (capital punishment) for corruptors in Indonesia. Moreover, corruption is qualified as an extraordinary crime so it needs extraordinary handling as well.

The General Elections Commission (KPU) is an independent state institution directly regulated in Article 22E of the 1945 Constitution of the Republic of Indonesia. Its position as an independent state institution affirms that the KPU is not under the influence of the DPR and the government in carrying out its duties and authorities. Article 9 Sub-Article a of Law Number 10 Year 2016 (Regional Head Election Law) stipulates the requirement of the KPU to consult the DPR and the Government in drafting and enacting KPU regulations and technical guidelines for each election stage in forums of hearings whose decisions are binding. The Constitutional Court through Decision Number 92/PUU-XIV/2016 finally canceled the word "binding" it; the existence of the word "binding" is considered contrary to the Constitution and interfere with the independence of the Commission. The research concludes, first, the independence of KPU as an organizer of election is one of the requirements for the realization of free and fair election. Secondly, the juridical implication in Decision 92/PUU-XIV/2016 confirms that the binding word in Article 9 sub-paragraph a of the Regional Head Election Law does not have binding legal force, so that the spirit and independence of KPU as an election organizer can be maintained. Abstrak Komisi Pemilihan Umum (KPU) merupakan lembaga negara yang independen yang diatur secara langsung dalam Pasal 22E UUD NRI Tahun 1945. Posisinya sebagai lembaga negara independen menegaskan bahwa KPU tidak berada di bawah pengaruh DPR dan pemerintah dalam menjalankan tugas dan wewenangnya. Pasal 9 huruf a Undang-Undang Nomor 10 Tahun 2016 (UU Pilkada) mengatur keharusan KPU untuk berkonsultasi dengan DPR dan Pemerintah dalam menyusun dan menetapkan peraturan KPU dan pedoman teknis untuk setiap tahapan pemilihan dalam forum rapat dengar pendapat yang keputusanya bersifat mengikat. Mahkamah Konstitusi melalui Putusan Nomor 92/PUU-XIV/2016 akhirnya membatalkan kata ‘mengikat’ tersebut, karena bertentangan dengan Konstitusi dan mengganggu independensi KPU. Penelitian ini menyimpulkan, pertama, independensi KPU sebagai lembaga penyelenggara pemilu merupakan salah satu syarat bagi terwujudnya pemilu yang bebas dan adil. Kedua, implikasi yuridis dalam putusan 92/PUU-XIV/2016 menegaskan bahwa kata ‘mengikat’ dalam Pasal 9 huruf a UU Pilkada bertentangan dengan UUD NRI Tahun 1945 dan tidak memiliki kekuatan hukum yang mengikat, sehingga marwah dan independensi KPU sebagai lembaga penyelenggara pemilu dapat terjaga.

Abstract: This article discusses about a Islamic political jurisprudence’s point of view againts campaign for president and vice president election. It is carried out based on Law No. 42 year 2008 concerning with the election of president and vice president. The general election campaign is a sovereign right of the people to produce democratic government based on Pancasila and the Constitution of the Republic of Indonesia (UUD) 1945. The implementation of the general election campaign has a positive effect that is beneficial for the candidates and for the publics to know the candidates they would choose to be a leader. In Islamic political jurisprudence’s perspective, the implementation of the general election campaign for president and vice president can realize the political rights of individuals associated with the right to nominate and the right to occupy a certain post. All of the people and citizens are entitled to gain a guarantee of their human rights (Hurriyah al-shakhsiyyah) before the law and government.Keywords: Campaign, general election, president, Islamic political jurisprudence.

This thesis addressed the issue of election criminal law enforcement in the era of simultaneous general election in 2019. Based on data released by The General Election Supervisory Agency (Bawaslu) there were 2,724 reports and findings of alleged violations of election crimes, which continued with the investigation of 582 cases, closed at the investigation stage there were 132 cases, then closed at prosecuting 41 cases, and ajudicated by the court in 319 cases. Meanwhile, based on the Indonesian Legal Roundtable (ILR) data from the whole cases in electoral crime, 170 cases or 53% were sentenced to conditional or probation. The method of this research is used normative legal research methods (normative juridical). Data research compiled based on suited laws and regulations through statutory approach, case approach, historical approach, comparative approach, and conceptual approach. Furthermore, normatively the data is analyzed based on applicable regulations as positive legal norms by interpreting and constructing statements contained in documents and applicable laws. The results of this study are to reveal and analyze the law enforcement applied in handling election crimes that occurred in simultaneous general elections in 2019. Analyzing the formulation of criminal law in tackling more effective general election crimes for the future through the formulation definite regulations, fair, not multi-interpreted and attend to all parties in equal rights of each individual before the law in order to establish a general election which honest and fair as well as legitimate
