This research discusses an interdisciplinary study of Covid 19 excesses that is currently affecting the world, including Indonesia. There were cases of stigma and rejection of corpse infected by Covid 19 that occurred in Banyumas, Lampung, Gowa, South Sulawesi, and Semarang. The theory used as an analytical tool is Stanley Cohen's theory of moral panic to understand the background of community actions, and subsequently uses the social fiqh theory to reinforce the building of an argument for scientific response to the case. The method used in this research is library research by making effective data obtained from reliable online news, journals, and books that can be accounted for. The results of this study are: (1) The perspective of Stanley Cohen's moral panic theory explained that the case of the rejection of the corpse of Covid 19 was triggered by excessive public panic and anxiety until "social / health panic" is closely related to the term "moral panic" in Cohen's theory. This gives the consequence of giving stigma and discrimination of Covid 19. (2) The perspective of social Fiqh with the application model of Madzhab Qauli, the act of refusing a corpse infected with Covid 19 is “a wrong way" in Islamic legal norms. This claim of Islamic law is considered to be in harmony with the maqashid syairah which is understood from Abdul Majid Najjar's thoughts about the maqasid hifdzu al karamah al insaniyyah.

The results of the research conclude that the substance of the circular letter is relevant to the principle of maqāṣid al-syarī’ah which is the core philosophy of the formation of Islamic law in presenting the benefit of mankind in the world and the hereafter, both from the aspect of maqāṣid al-kulliyyah (universal) and maqāṣid al-juz'iyyah (partial) especially maqāṣid in obeying a leader. Therefore, the emergence of the phenomenon of counter attitudes from some people and even preachers towards the policy should not occur.

AbstractIslamic Law is one of the broadest and most comprehensive systems of legislation in the world. It was applied, through various schools of thought, from one end of the Muslim world to the other. It also had a great impact on other nations and cultures. We will focus in this article on values and norms in Islamic law. The value system of Islam is immutable and does not tolerate change over time for the simple fact that human nature does not change. The basic values and needs (which can be called maṣlaḥa) are classified hierarchically into three levels: (1) necessities (Ḍarūriyyāt), (2) convenience (Ḥājiyyāt), and (3) refinements (Kamāliyyāt=Taḥsīniyyāt). In Islamic legal theory (Uṣūl al‐fiqh) the general aim of legislation is to realize values through protecting and guaranteeing their necessities (al-Ḍarūriyyāt) as well as stressing their importance (al‐ Ḥājiyyāt) and their refinements (taḥsīniyyāt).In the second part of this article we will draw attention to Islamic norms. Islam has paid great attention to norms that protect basic values. We cannot explain all the Islamic norms that relate to basic values, but we will classify them categorically. We will focus on four kinds of norms: 1) norms (rules) concerned with belief (I’tiqādiyyāt), 2) norms (rules) concerned with law (ʿAmaliyyāt); 3) general legal norms (Qawā‘id al‐ Kulliyya al‐Fiqhiyya); 4) norms (rules) concerned with ethics (Wijdāniyyāt = Aḵlāqiyyāt = Ādāb = social and moral norms).

Through the istislahi approach, that Islamic law strongly condemns all demonstration activities that cause harm to religion, soul, mind, descendants and property. On the other hand, he strongly supports all demonstration activities that uphold the five maintenances (Maqasid al-khamsah). The law is fardu kifayah. Turning away from that obligation is the same as carrying oneself That demonstrations are not at all motivated by passion or personal tendencies, let alone to cause damage to the earth. Abstract ‘Landscape’ and ‘ritual’ have been largely discussed in the social and human sciences, although their inter-relatedness has gained little scholarly attention. Drawing on earlier studies of ritual and landscape, as well as the authors′ own ethnographic works, ‘ritual landscape’ is suggested here as a useful analytical tool with which to understand how landscapes are produced, and how they, in their turn, produce certain types of being. ‘Ritual landscape’ recognises different modalities of agency, power-relation, knowledge, emotion, and movement. The article shows how the subjectivity of other-than-human beings such as ancestors, earth formations, land, animals, plants and, in general, materiality of ritual contexts, shape landscapes. We argue that ways of perceiving landscape includes a number of material and immaterial aspects indicated by ways of moving through landscapes and interacting with different human and non-human subjects that come to inhabit the world, creating relations and producing agentive ensembles and complexes.
