Procedural rules for marriage recording have led to speculation that marriage records are only considered more administrative requirements. So that up to now under-age marriages are still often found among the public. The purpose of this study is to show the urgency of a marriage record for those bound by marriage. The type of research used is library research and descriptive analysis that describes objectively the rules of marriage recording by analyzing using the theory of maqāṣid ash-syarī'ah as a methodology approach to the philosophy of Islamic law. Based on the results of the study, the rules for recording marriage are a product of Islamic law reform that is at the forefront of the present. Marriage registration is a renewal of Islamic law as a new form of ijtihad towards witnessing in a marriage. By registering the marriage civil rights of the parties concerned will be guaranteed and secure. A marriage that is carried out may not be enough with a testimony according to existing marriage conditions. The logical consequence of the development of the developing period is also evidence that determines the validity of marriage. Features of Jāsir system theory udah Audah is six, namely the character of cognition, overallness, openness, interrelated hierarchy, multidimensionality, and intentions. The whole feature of Jāsir udah Audah is applicative which can realize the idea of the rules of marriage registration as a legitimate condition for determining a marriage.

Ideologi khilafah merupakan sebuah ideologi yang kerap kali diinterpretasikan sebagai ideologi yang cukup radikal. Umumnya ideologi khilafah menyoroti isu-isu politik yang bertentangan dengan syariat Islam. Namun, kali ini ideologi khilafah juga menyoroti isu sosial, yaitu LGBT. LGBT merupakan isu yang kontroversial secara global. Sementara ideologi khilafah merupakan sebuah paham yang konsepnya bertentangan dengan negara Indonesia.  Penyebaran ideologi khilafah sudah dilarang oleh pemerintah Indonesia. Namun eksistensinya masih hadir dalam rupa yang baru, yaitu pada sebuah buletin bernama KAFFAH. Kajian ini akan mengungkapkan bagaimana LGBT direpresentasikan dalam perspektif ideologi khilafah. Data dalam penelitian ini berasal dari artikel tentang LGBT pada media Kaffah, edisi 025 yang dirilis pada 26 Januari 2018. Selanjutnya data dikaji secara kualitatif dengan metode analisis deskriptif. Penelitian ini menggunakan pendekatan teori Transitivitas sebagai teori yang menyatakan bahwa bahasa merupakan representasi dari pengalaman manusia. Transitivitas ini berfokus pada tiga komponen, yaitu proses, partisipan, dan sirkumtan. Berdasarkan uraian Transitivitas, diketahui bahwa dalam perspektif ideologi khilafah, LGBT bukan hanya direpresentasikan sebagai masalah sosial, tapi juga sebagai implikasi dari tidak adanya Undang-undang yang bersumber dari hukum Islam yang secara eksplisit dapat menjerat LGBT. The khilafah ideology is an ideology that is often interpreted as a fairly radical ideology. Generally, the ideology of the khilafah highlights political issues that are contrary to Islamic law. However, the Khilafah ideology also highlights social issues, namely LGBT. LGBT is a controversial issue globally. While the khilafah ideology is a concept that is contrary to the Indonesian state. The Indonesian government has banned the spread of the khilafah ideology. But its existence is still present in a new form such as a bulletin called KAFFAH. This study aims to describe how LGBT is represented in the perspective of khilafah. The data of this study is a KAFFAH bulletin article, 025 editions, which released on January 26, 2018. Furthermore, the data were analyzed qualitatively by descriptive analysis methods. This study uses the Transitivity theory approach as a theory which states that language is a representation of human experience. The Transitivity focuses on three components; process, participants, and circumstance. Based on the description of Transitivity, LGBT is not only represented as a social problem but also as an implication of the absence of laws that originate from Islamic law which can explicitly ensnare LGBT.

This article is a library research on the granting of rights to stepmothers in the decision of the Sidoarjo Religious Court Number: 0763/Pdt.G/2018/PA.Sda. The research data are collected using documentation techniques and are analysed using descriptive analysis techniques and using a deductive mindset that is by outlining the decision of the Sidoarjo Religious Court which is then reviewed from the perspective of maslahah mursalah. The panel of judges in determining the right of gift to stepmothers in the Sidoarjo Religious Court's decision, based on article 41 letter (a) of Law Number 1 of 1974 jo. article 105 and article 156 letter (a) Compilation of Islamic Law and the proposition in the book Bajuri juz II. In addition, a willingness from the Defendant who is the biological father of the child to give the right of gift to the Plaintiff's Reconstruction is a point that is included as consideration by the panel of judges. In Islamic law which is examined from the theory of maslahah mursalah, the judge's consideration to establish the right of hadanah to the stepmother in the Sidoarjo Religious Court's ruling is in accordance with the purpose of the hadanah namely to prioritize the interests and benefit of the child so that later he or she can grow into a good person under the care of an appropriate person, even though the child is not a biological child of the Reconvention Plaintiff, the Reconvention Plaintiff is in fact more feasible and competent to have the right of hadanah.

Corruption in the public and private sector has become a major problem to the government. Corruption is a serious problem that has become a topic of debate lately, especially in the mass media. Several negative effects will arise as a result of this corruption problem. The main objective of this paper is to analyse the prevailing corruption in land administration. Thus, the trend of corruption in land administration is deeply rooted and it could jeopardize public confidence in the institution of land office. This paper aims to identify the factors of the problem of corruption, recommendations and solutions to curb these crimes from occurring and to identify whether Malaysian Anti-Corruption Commission (MACC Act 2009) is able to provide solutions to the problems of the crime. The library research and content analysis method are being used in this study. The finding of this research shows that there are several factors of corruption have been identified occurring in the land administration. The MACC Act 2009 appears to have a lot of loopholes in the effort to curb the problem of corruption. This study will highlight some of the proposed recommendations according to Islamic perspective to ensure the interests and rights of all parties involved.   Keywords: corruption, land administration, Malaysian Anti-Corruption Commission Act 2009, recommendations and solutions according to Islamic law.   Rasuah dalam sektor awam dan swasta telah menjadi satu masalah utama bagi kerajaan. Rasuah merupakan gejala serius yang sering menjadi topik perbincangan sejak akhir-akhir ini terutamanya dalam media massa. Di samping itu juga, pelbagai kesan negatif yang akan timbul akibat daripada masalah rasuah ini. Objektif utama penulisan ini di buat adalah untuk melihat gejala rasuah yang berlaku dalam pentadbiran tanah. Justeru itu, trend jenayah rasuah dalam pentadbiran tanah yang semakin meningkat amatlah membimbangkan kerana ia boleh menggugat kepercayaan orang ramai terhadap institusi pejabat tanah. Kertas kerja ini bertujuan untuk mengenal pasti punca masalah rasuah, beberapa cadangan penambahbaikan dan jalan penyelesaian bagi mengekang jenayah ini dari terus berlaku. Perbincangan ini turut mengupas Akta Suruhanjaya Pencegahan Rasuah Malaysia 2009 (ASPRM 2009) adakah mampu memberi penyelesaian kepada permasalahan jenayah ini. Kajian kepustakaan dan kaedah analisis kandungan digunakan dalam kajian ini. Hasil kajian mendapati terdapat beberapa punca masalah rasuah yang telah dikenal pasti berlaku dalam pentadbiran tanah dan ASPRM 2009 turut dilihat masih longgar dalam usaha untuk mengekang masalah rasuah ini. Penulisan ini akan mengutarakan beberapa cadangan penambahbaikan menurut perspektif Islam dalam menjamin kepentingan dan hak-hak semua pihak yang terlibat.   Kata kunci: rasuah, pentadbiran tanah, Akta Suruhanjaya Pencegahan Rasuah Malaysia 2009, cadangan dan penyelesaian menurut undang-undang Islam.

Digital document is a relatively new form of evidence, particularly for use in the Malaysian Syariah courts. This scenario contrasts with civil courts, which started using digital documents in court proceedings as early as the 1950s. The use of the digital document as evidence is intended to strengthen other methods of proof further. However, the Syariah courts are still less exposed to a new proofing method because there are no specific provisions according to Islamic law to allow it. Not only that, but Syariah law practitioners are also rarely exposed to cases related to the use of digital documents. Therefore, this qualitative study will analyse the admissibility of the digital document as evidence under Islamic law through a systematic analysis. This study uses the PRISMA methodology with the range of data stored on the web at www.scopus.com and http://myjurnal.my, which brings together thousands of scientific writings worldwide. The final screening results found a total of 21 articles that discussed the practice of digital documents as evidence under Islamic law. Furthermore, from the final filter, the researchers found several works of literature that previously discussed the usage of digital documents as evidence in a trial proceeding, which indirectly shows that the Syariah court has begun to accept this type of evidence. It is expected that the results of this study will assist legal practitioners in the Syariah court and become a reference point for researchers, academics and the public in Malaysia.

Bank Negara Malaysia (BNM) had introduced Value-Based Intermediation (VBI) initiatives to help Islamic banks implement a structuralised form of maqasid al-shariah (objectives of shariah (Islamic law)) in their banking operations. Thus, questions were raised by the public on whether or not Islamic banking institutions in Malaysia had been achieving maqasid al-shariah in their banking operations prior to VBI. This paper aims to discuss the real concept of maqasid al-shariah that should be realised in Islamic banks and investigate whether Islamic banks had truly been achieving maqasid al-shariah in their banking operations before the introduction of VBI. Library research is conducted to obtain information on maqasid al-shariah and the qualitative methodology is adopted to gain information from three bankers representing three Islamic banks in Malaysia via semi-structured interviews. The researchers found that the fundamental concept of maqasid al-shariah in Islamic banks includes the protection of religion, life, intellect, progeny and wealth in human life through the products and services offered by the banks. The Islamic banks were found to have developed their products and services to achieve maqasid al-shariah even before VBI was introduced by BNM. However, with VBI, a proper framework in achieving maqasid al-shariah has been developed.

Participants from across Canada came to celebrate CCMW’srenowned presence throughout the nation as well as to discuss issuesrelated to the conference: “Engaging Muslim Women in Civic and SocialChange.” The conference was officially opened with the reading of theQur’an in Arabic, English, and French, followed by the Girl Guides ofCanada, Muslim Chapter, singing the Canadian national anthem. AbstrakPenghayat Kepercayaan masih mengalami diskriminasi, khususnya dalam penghormatan hak-hak sipilnya. Hal ini berakar dari “perbedaan” yang lahir dari pengakuan negara atas agama dan perlakuan berbeda kepada “agama” dan “kepercayaan”. Pada Pemerintahan Joko Widodo-Jusuf Kalla salah satu agenda prioritas adalah memprioritaskan perlindungan terhadap anak, perempuan dan kelompok masyarakat termajinalkan, serta penghormatan HAM dan penyelesaian secara berkeadilan terhadap kasus-kasus pelanggaran HAM pada masa lalu menjadi momentum tepat untuk penegakan HAMnya. Pertannyaannya, implementasi penghormatan Hak Asasi Manusia bagi penghayat kepercayaan di Kota Bandung. Tulisan yang didasarkan pada penelitian bersifat deskriptif analisis dengan pendekatan yuridis normatif pada tataran implementasi (khususnya Kota Bandung), para penghayat kepercayaan tidak mengalami kendala dalam memperoleh layanan kependudukan dan catatan sipil. Namun demikian masih terdapat penolakan masyarakat umum terhadap pemakaman bagi para penghayat kepercayaan di tempat pemakaman umum. However, there is still a general public rejection of the funeral for the seeker of confidence in the public cemetery. The legal system or the rules of “Mbaham” tribe customs in Fak-Fak town Papua and Islamic legal system headed for the adopted-children and biological children about the inheritance can be compared, because both of these rules can be different systems and can also be the same, especially in determining the rights of each child's portion. It also refers to a notary whose position has specific tasks to do the agreement of inheritance when the heirs want the services of a notary. The main problems of the research as follows; one, how the comparison of the adopted-children's and the biological children’s rights in inheritance according to “Mbaham” tribe customary law and Islamic law as well as the role of the public notary in the creation of the certificate. Second, what is the equality of the rights of biological  children and adopted-children in the inheritance according to the customary law of Mbahan tribe and Islamic law. Third, what is the difference of the rights of biological children and adopted children in the inheritance according to the customary law of “Mbaham” tribe and Islamic law. This research used a juridic empirical approach, with the specification research of descriptive analysis. The type and source of data which were used, namely primary and secondary data and the techniques of data gathering was the primary, secondary, and tertiary data. This research also used qualitative analysis to analyze the data. The results of this research showed that, Islamically the system was Individual, where the inheritance became the property of the class who has been defined in the provisions of Islamic law based on bilateral kinship. Being in the customs of “Mbaham” tribe was not necessarily because it could accept Islamic law as the guideline, but sometimes, it differed in accordance with custom. For the role of the public notary can be used in the manufacture of the agreement of inheritance when the heirs want to disburse the funds stored in the bank. The consequences of the law which was happened headed for the adopted-children and biological children was both still get each inheritance, but all were depended on the provisions within the follow, whether the customary law or Islamic law. The notary could give advice and help the beneficiary in the making of inheritance agreement.Keywords: Comparison; Inheritance; Notary

The emergence of new problems or problems in the community that really need legal clarity, all of which have not been answered in either the Qur'an or the Hadith, in connection with the cessation of revelation and the death of the Prophet Muhammad who acted as a mediator between revelation and the reality that lived at that time. The renewal of Islamic law is the solution, the purpose of this paper is to find out the concepts of Islamic law reform and figures who contribute to the renewal of Islamic law. The type of research is descriptive qualitative with library research, namely research that is directed and focused on the study and discussion of library materials that have to do with the problem being studied, Overall, the renewal of Islamic law in Indonesia runs rather slowly compared to other Muslim countries, especially in the Middle East, North Africa, India and Pakistan. However, the realization of the marriage law number 1 of 1974, government regulation number 9 in 1975, Government regulation number 10 of 1983, government regulation number 28 of 1977 concerning the ownership of land, and the realization of the compilation of Indonesian Islamic law in 1991 were the dynamics of renewal of Islamic legal thinking that must be grateful, as for the characters and the ideas are: 1) Hasbi Ash-Shiddieqy (Indonesian Jurisprudence); 2) Hazairin: Indonesian National School; 3) Munawir Syadzali: Reactualization of Islamic Law; 4) Ibrahim Hosen: Making Nash Qat'i fun; 5) Ali Yafie and Sahal Mahfuz: Social Jurisprudence.

The purpose of this study was to find out the legal basis for divorce due to husband and wifeconflict and to find out the judge’s consideration in granting a divorce suit in case Number 2612 /Pdt.G / 2017 / PA.Bks). This research is library research with a normative juridical approach, usingthe descriptive analysis method. The results of this study are that due to the dispute, Plaintiff feelsuncomfortable in his household relationship with Defendant. Therefore, judges realize legal protectionfor Indonesian citizens, especially women, namely in Law Number 23 of 2004 Article 1 Paragraph (1),Compilation of Islamic Law Article 132 Paragraph (1) and Government Regulation of the Republic ofIndonesia Number 7 of 1975 Article 20 Paragraph (1) concerning the implementation of Law Number7 of 1974 concerning Marriage. From the findings data, it is analyzed that the judge’s decision ingranting the lawsuit is because the lawsuit submitted has met the formal and material requirements aswell as the facts that were revealed in the trial.
