When are we somewhere and when are we not? When is it “here”, when is “now” and when is it not? In everyday life, this question can usually have a clear answer. But we all know the state of mind - if not from elsewhere, then from school - when we are physically present somewhere, but in fact our minds are elsewhere we are in a completely different place in spirit, being busy with something else. We can barely remember what happened in the classroom, later we are left with only what caught our attention at that time, what we were really busy with at the time. One might think that in architecture it may not even be worth addressing this issue, the situation seems so clear: here is a definite place with specific geometric features and history, shaped and formed by the mysterious “genius loci”, and now is our age, the present in which we live. According to the common opinion today, good architecture expresses its own age and its own time, catching the spirit of the place. However, it is enough to think only of the Gothic cathedrals to see the very partial validity of this view. In cathedrals, the purpose of the now and here is exactly to serve, display, illustrate the time and place of the not-now and not-here.Összefoglaló Mikor vagyunk valahol, és mikor nem? Mikor van itt, mikor van most és mikor nem? A mindennapi életben e kérdésre általában egyértelműen válaszolunk. De mindnyájan ismerjük azt a lelkiállapotot - ha máshonnan nem, hát az iskolából -, amikor fizikailag valahol vagyunk, de valójában egészen máson jár az eszünk, lélekben egészen máshol vagyunk, mással vagyunk elfoglalva. Alig emlékszünk arra, hogy mi történt ott akkor az órán, később csak az marad meg bennünk, ami akkor figyelmünket lekötötte, ami akkor valójában foglalkoztatott. Azt gondolhatnánk, hogy az építészetben talán nem is érdemes foglalkozni ezzel a kérdéssel, olyan egyértelműnek látszik a helyzet: az itt, egy meghatározott hely sajátos geometriai tulajdonságokkal és történelemmel, amelyet a titokzatos „genius loci” alakít, formál, a most pedig a mi korunk, a jelen, amelyben élünk. Mai általánosan elterjedt vélekedésünk szerint a jó építészet a hely szellemét megérezve saját korát, saját idejét fejezi ki. Elég azonban csupán a gótikus katedráli- sokra gondolnunk ahhoz, hogy belássuk e vélekedés nagyon is részleges érvényességét. A katedrálisok- ban a most és itt célja éppenséggel a nem most és a nem itt idejének és helyének szolgálata, megjelenítése, szemléltetése.

The article is devoted to the problem of the evolution of the modern hero and types of heroes in the modern Uzbek literature of neo-realism. The poetics of neo-realism marked by a combination of descriptive concreteness and object precision with expressive and lyrical often-symbolized words; characterized by a weakening of narrative connections by strengthening the lyrical beginning and in-depth psychologism. Neo-realism in Uzbek literature, while possessing national features, in terms of poetic and stylistic orientation, is fundamentally different from neo-realism in Russian and Western literature. The works of A. Yuldashev and U. Khamdam are the bearers of this line in Uzbek prose. Along with the synthetic nature of the texts of these writers, there is a feature that unites them all — the desire of prose writers not to paradox, but to reality. The purpose of this article is to consider the philosophical perception reflecting the state of mind of modern man through the prism of the perception of the literary hero in the Uzbek literature of the XXI century. Ulugbek Hamdam in the stories «Камень», «Река души моей» (“The Stone", “The River of My Soul”) with the help of conventionality and signs-symbols, as well as building the work on the basis of functional relationships, builds his author’s concept on the material of everyday life. Abdukayum Yuldashev in the stories «Пуанкаре», «Близнецы» (“Poincare”, “Twins”) having a rich style arsenal, also works at the interface of realism and neo-realism. The article attempts to analyze the main features in the typology of the hero in the stories of U. Hamdam in the context of the traditions of new realism.

In the present paper the traditional and customary perspectives on the concept of Mens Rea are challenged and a new definition of the same is put forward. The challenge is based on the idea that the concepts in criminal law need evolution in order to keep their function and practicality. Such an evolution demands such a condition wherein, while granting the characteristics of adaptability with the contextual conditions and principles of criminal law, the maintenance of the same is ensured. The mens rea is customarily defined as ‘culpable state of mind of the accused when committing an offence under criminal law and ‘rebellion intent’ under Islamic Jurisprudence. Both definitions of the concept have the capability to undergo evolution and, thus, a new definition of the same is envisaged herein as such that the mens rea constitutes ‘the culpable linkage of mind with the forbidden conduct’. Two changes are observable in the new definition compared with the existing one: first, the ‘state of mind’ is replaced with ‘linkage of mind’; second, the interpretation of the term ‘culpable’ as an independent constituent shall differ as per the common sense and the contextual conditions. The new definition grants dynamism to the concept and resolves the problems long associated with the definition of the mens rea under the criminal law.

This article considers the politics and aesthetics of the colonial Bildungsroman by reading George Moore's often-overlooked novel A Drama in Muslin (1886). It argues that the colonial Bildungsroman does not simply register difference from the metropolitan novel of development or express tension between the core and periphery, as Jed Esty suggests, but rather can imagine a heterogeneous historical time that does not find its end in the nation-state. A Drama in Muslin combines naturalist and realist modes, and moves between Ireland and England to construct a form of untimely development that emphasises political processes (dissent, negotiation) rather than political forms (the state, the nation). Ultimately, the messy, discordant history represented in the novel shows the political potential of anachronism as it celebrates the untimeliness of everyday life.

The author proves that the successful stability of independent Slovenia contributed to a number of factors, existing since its being incorporated in the SFRY. The factor, uniting the state has become the common goal – the aspiration to join the EU. The process of the European integration contributed to the modernization of a number of spheres, in particular social, cultural and economic ones. The global financial and economic crisis has revealed the turmoil in the economy of the state and its leadership was forced to gradually reduce a significant part of social privileges for the population. This caused the tension in the society and reduced the level of the national unity, having a negative impact on people’s wellbeing. However, since 2014, the Prime Minister M. Cherar has been trying to restore people’s trust in the state. The situation is getting better; indicators of trust in government are increasing, which also points to state capacity and political regime stability in Slovenia. Abstract: This paper highlights similarities and different features of the category of kinesics “hand gestures”, its frequency usage and acceptance by different individuals in two different cultures. This study shows its similarities, differences and importance of the gestures, for people in both cultures. Consequently, kinesics study was mentioned as a main part of body language. As indicated in the article, the study kinesics was not presented in the Kyrgyz culture well enough, though Kyrgyz people use hand gestures a lot in their everyday life. The research paper begins with the common definition of hand gestures as a part of body language, several handshake categories like: the finger squeeze, the limp fish, the two-handed handshake were explained by several statements in the English and Kyrgyz languages. Furthermore, this article includes definitions and some idioms containing hand, shake, squeeze according to the Oxford and Academic Dictionary to show readers the figurative meanings of these common words. The current study was based on the books of writers Allan and Barbara Pease “The definite book of body language” 2004, Romana Lefevre “Rude hand gestures of the world”2011 etc. Key words: kinesics, body language, gestures, acoustics, applause, paralanguage, non-verbal communication, finger squeeze, perceptions, facial expressions. Аннотация. Бул макалада вербалдык эмес сүйлѳшүүнүн бѳлүгү болуп эсептелген “колдордун жандоо кыймылы”, алардын эки башка маданиятта колдонулушу, айырмачылыгы жана окшош жактары каралган. Макаланын максаты болуп “колдордун жандоо кыймылынын” мааниси, айырмасы жана эки маданиятта колдонулушу эсептелет. Ошону менен бирге, вербалдык эмес сүйлѳшүүнүн бѳлүгү болуп эсептелген “кинесика” илими каралган. Берилген макалада кѳрсѳтүлгѳндѳй, “кинесика” илими кыргыз маданиятында толугу менен изилденген эмес, ошого карабастан “кинесика” илиминин бѳлүгү болуп эсептелген “колдордун жандоо кыймылы” кыргыз элинин маданиятында кѳп колдонулат. Следовательно, здесь было упомянуто понятие “кинесика” как основная часть языка тела. Как указано в статье, “кинесика” не была представлена в кыргызской культуре достаточно хорошо, хотя кыргызский народ часто использует жестикуляцию в повседневной жизни. Исследовательская работа начинается с общего определения “жестикуляции” как части языка тела и несколько категорий жестикуляции, таких как: сжатие пальца, слабое рукопожатие, рукопожатие двумя руками, были объяснены несколькими примерами на английском и кыргызском языках. Кроме того, эта статья включает определения слов “рука”, “рукопожатие”, “сжатие” и некоторые идиомы, содержащие данных слов согласно Оксфордскому и Академическому словарю, чтобы показать читателям их образное значение. Данное исследование было основано на книгах писателей Аллана и Барбары Пиз «Определенная книга языка тела» 2004 года, Романа Лефевра «Грубые жестикуляции мира» 2011 года и т.д. Ключевые слова: кинесика, язык жестов, жесты, акустика, аплодисменты, паралингвистика, невербальная коммуникация, сжатие пальца, чувство восприятия, выражение лиц.

Unexpectedly, one of the marking features of democratization in Niger has been the rise of a variety of Islamic discourses. They focus on the separation between religion and the state and, more precisely, the way it is manifested through the French model of laïcité, which democratization has adopted in Niger. For many Muslim actors, laïcité amounts to a marginalization of Islamic values and a negation of Islam. This article present three voices: the Collaborators, the Moderates, and the Despisers. Each represents a trend that seeks to influence the state’s political and ideological makeup. Although the ulama in general remain critical vis-à-vis the state’s political and institutional transformation, not all of them reject the principle of the separation between religion and state. The Collaborators suggest cooperation between the religious authority and the political one, the Moderates insist on the necessity for governance to accommodate the people’s will and visions, and the Despisers reject the underpinning liberalism that voids religious authority and demand a total re-Islamization. I argue that what is at stake here is less the separation between state and religion than the modality of this separation and its impact on religious authority. The targets, tones, and justifications of the discourses I explore are evidence of the limitations of a democratization project grounded in laïcité. Thus in place of a secular democratization, they propose a conservative democracy based on Islam and its demands for the realization of the common good.

In the article the author mentions some modern publications on this issue in the era of Alexander I and Nicholas I in connection with the description of the travelling theme in the context of everyday life history. As an example of the Russian Province, the article considers Smolensk Governorate which was located at the crossroads of routes from Europe to the center of Russia through Baltic, Belarusian and Ukrainian Provinces. On the basis of the materials of the State Archive of the Smolensk region (GASO) from the funds of the Chancellery of Smolensk Governor, the Smolensk Oblast Duma, metric books of Roman Catholic Church in Smolensk and published memoirs (Eugene Hess’ diary and E. Montulé’s notes) the author of the article reconstructs foreign hotel owners’ biographies (S.I. Chapa, D.K. Nolchini, V.I. Gaber), masters of carriage business (D.I. Graf, K.B. Weber), a city coachman, the owner of a coffee house (H. Podrut). All these people were united by their origin (they came from European countries) and their involvement (due to their professional activities) in servicing travelers who found themselves in the Russian Province. Life circumstances and development of their own business forced them to settle far away from their homeland; most of them became citizens of the empire, having connected themselves with Russia forever. In the article it is underlined that foreigners’ involvement in «tourist business» of the considered epoch testifies not only to the benefit of their business activity, but also to the importance of the psychological factor – the very possibility of meeting with compatriots and representatives of other European countries.

This chapter examines the law of contract in France and discusses the milestone reform of French contract law. While this new legislation introduces a fresh equilibrium between the contracting parties and enhances accessibility and legal certainty in contract, it does not radically change the state of the law in this area. In addition, it does not strongly impact the traditional philosophical foundations of the law of contract. The reform, in short, looks more like a tidying up operation rather than a far-reaching transformation of the law. Therefore, the chapter argues that it is questionable whether the new law, which was also intended to increase France's attractiveness against the background of a world market dominated by the Common Law, will keep its promise.

This paper develops an account of core criminal terms like ‘murder’ that parallels Williamson’s account of knowledge. It is argued that while murder requires that the murderer killed, and that they did so with a certain state of mind, murder cannot be regarded as the conjunction of these two elements (the action, the actus reus, and the associated mental element, the mens rea). Rather, murder should be seen as a primitive notion, which entails each of them. This explains some of the problems around criminal attempt. Attempted murder cannot be seen simply as involving the state of mind of murder minus success; rather, it has to be seen as a self-standing offence, that of attempting to commit the murder.
