The paper briefly outlines legal framework of activities run by the modern Russian state for physical safekeeping cultural heritage sites, one of key form of which is making zones of protected natural landscape. The authors trace a graduately process of mainstreaming issues concerning preservation historical and cultural heritage sites and integration of these constructions into a structure of economic, social and cultural development of regions of the country. Researchers analyze a set of current problems in sphere of preservation and state protection of cultural heritage sites (such as lack of monetary funds and skilled workforce for repair and restoration, fulfilling research tasks, etc. Also, the article reviews ongoing programs for preservation cultural heritage sites located in the Russian capital, Moscow.

The article presents an overview of the theoretical and practical approaches of domestic and foreign authors to the using historical and cultural heritage sites for tourist purposes for the development of regional tourism. Most scientists define cultural heritage sites as one of the most important conditions for the development of cultural and educational tourism. Further development of this territory is provided by strategic planning, state policy, the creation of a regulatory and legal framework, the development of specialized state programs, attraction of investments, creation of a specialized infrastructure, and implementation of a competent marketing policy. The article also presents the limiting factors of the using cultural heritage sites in the Russian Federation on the example of Kaliningrad region. Within the study the authors examine institutional capacities and state instruments for the restoration of cultural heritage objects with the aim of including in a regional tourism product. The authors develop authorial methodology of systematizing cultural heritage sites used for tourist purposes. The criterion for ranking cultural heritage sites is the degree of their preservation, accessibility and functional purpose. This methodology has been tested on cultural heritage sites in the city of Kaliningrad functionally related to fortifications. But it can be used in scientific research and in practice for ranking and other categories of cultural heritage sites of the regions of the Russian Federation.

Тhe article provides an overview of the typical requirements of the FAO Glavgosexpertiza of Russia when examining the results of engineering surveys and project documentation, in terms of ensuring the safety of cultural heritage sites (hereinafter — the CHS). The FAO Glavgosexpertiza of Russia requires: 1) provide information on the absence (or presence) of restrictions on development activities (CHS, located in the registry of the Russian Federation , identified CHS, objects with signs of CHS, protective and guard zones of the CHS) in the territory of conducting development activities; 2) provide information on the boundaries of the territory for which information on the absence of restrictions on development activity is provided; 3) in the case of restrictions on development activity related to the availability of the CHS — to provide the boundaries of protective and guarding zones of CHS within which development activities agreed by the relevant state body of the CHS; 4) provide information on the boundaries of protective and guarding zones of the CHS, within which the relevant state body of the CHS is allowed to carry out development activities, subject to a number of conditions specified in the project documentation for the preservation of the CHS. Typical problems encountered by survey organizations are also described, trying to satisfy the requirements of the FAO Glavgosexpertiza of Russia: 1) the need to obtain information about the CHS not only from the regional state authorities exercising state protection of the CHS, but also from the federal and sometimes municipal authorities; 2) discovering of the СHS and objects with signs of the CHS, after the state historical and cultural expertise has established their absence; 3) the need and ways to ensure the safety of the CHS in the conduct of development activities that do not involve earthwork and even construction work; 4) lack of understanding in what boundaries of the territory it is necessary to establish the presence (or absence) of HS; 5) the need to correct the boundaries of land allocation after the discovering of HS.

PurposeThe purpose of this study is to affirm that it is possible to segment visitors of cultural heritage into homogeneous groups according to a series of characteristics to detect the variables that have statistical significance to identify visitor clusters.Design/methodology/approachFour case studies were selected, where a total of 500 questionnaires were made to visitors. The authors proceeded with cluster analysis using SPSS software to differentiate visitor segments. Four groups of visitors were first identified and which have subsequently been reduced to three, according to several factors.FindingsThe main contributions of this paper are: (1) the segment to which each one of the determinants of the cultural tourism product is dedicated; (2) the variable object of the analysis, i.e. the formation of visitor segments; and (3) the inclusion of less studied variables such as type of accommodation contracted, treatment offered in the museums or entrance price.Research limitations/implicationsThe analysis has been developed in different museums, with different management models, in a specific place. However, the results are generalizable to other places and to other institutions that manage cultural heritage. The implications are management strategies for a sustainable cultural development in institutions of tourism and heritage.Practical implicationsFrom a practical point of view, the results are useful for cultural managers, travel agencies, tour operators, tourism companies or political offices, among others, because they generate new ideas and strategies focused on maximizing the use of the resources of cultural institutions.Social implicationsFor both local and non-local agents, the knowledge of the factors that make up the groups of visitors in the heritage sites represents a strategy in aspects of marketing, promotion and distribution, thus generating capacities for the different intermediaries, and the possibility of negotiating lower prices with better benefits. It is also possible to create new products destined for other publics.Originality/valueThe study is original because this has not been published.

The problem of criminal law protection of the cultural heritage of mankind is one of the most relevant in modern criminal law. Law enforcement practice has difficulties in qualifying the destruction or damage of cultural property. Most often, this is due to the definition of a set of crimes while encroaching on both religious feelings and cultural values. The urgency of solving this problem is growing due to the threat of destruction of cultural values due to man-made and natural disasters, as well as as a result of anthropogenic activities. These circumstances determine the relevance of the study of the problems of social conditionality of criminal liability for destruction or damage to cultural heritage sites, cultural values. The purpose of the article is to analyze the factors of social conditionality of criminal liability for criminal offenses in the field of protection of cultural values, the task of the article is to characterize the types of social harm as the basis of factors of social conditionality of these offenses. The article examines the factors of social conditioning of criminal liability for criminal offenses in the field of protection of cultural values, gives a characteristic of the types of social harm as the basis of the factors of social conditioning of these offenses. The article proves that the destruction or damage of cultural heritage objects, natural complexes, cultural values cause harm, is expressed not only in the direct loss of unique objects and objects that accumulate the centuries-old spirit of history, the foundations of material and spiritual culture, but also personify the absolute beauty and perfection of human talent and abilities, but also in the destruction of the very centuries-old spirit of the historical and cultural development of mankind, therefore, the harm from damage to this or that historical monument is necessarily reflected in all the above areas. It is concluded that the destruction or damage of cultural heritage sites are characterized by encroachment on public morality, which is expressed in the active influence of destruction or damage of cultural heritage sites included in the single state register of cultural heritage sites, identified cultural heritage sites , natural complexes, objects taken under state protection, or cultural values on cultural, historical, archeological, scientific bases of public life.

Статья посвящена исследованию степени соответствия современной политики российского государства в сфере образования, процессов, происходящих в региональных университетах, политико-правовым основам многонациональной Российской Федерации, заложенным в Конституции, других важнейших документах, определяющих принципы её государственно-территориального устройства. Эти основы официально гарантируют российским народам и регионам всестороннее социокультурное, образовательное, научно-технологическое развитие. Целью работы является всесторонний анализ просчётов деятельности российского государства в образовательной сфере в постсоветский период, приведших к проблемам, не позволяющим региональным университетам сегодня решать возлагаемые на них обществом функции, а также поиск путей их решения. Процесс реализации данной цели определил следующие задачи: проанализировать степень соответствия постсоветской политики российского государства в образовательной сфере провозглашённым политико-правовым основам государственного устройства РФ, гарантиям социокультурного развития российских народов; выявить взаимосвязь результатов современных реформ в системе высшего образования с объективными функциями региональных университетов РФ; раскрыть позитивный потенциал региональных университетов в решении социально-экономических, социокультурных проблем регионов и народов РФ, сохранении и укреплении её евразийской цивилизационной сущности; исследовать негативные последствия постсоветских реформ, отразившихся на состояние дел в региональных университетах, наметить пути решения возникающих проблем; показать важность учёта этнокультурного компонента в системе образования многонациональной РФ, определяющего личностные и профессиональные качества подрастающих поколений, способствующего достижению межнационального согласия и стабильности в российском обществе. The paper is devoted to the study of the degree of compliance of the modern policy of the Russian state in the field of education, the processes taking place in regional universities with the political and legal foundations of the multinational Russian Federation, laid down in the Constitution, and other important documents that determine the principles of its state-territorial structure. These foundations officially guarantee the Russian peoples and regions comprehensive socio-cultural, educational, scientific and technological development. The purpose of the work is a comprehensive analysis of the miscalculations of the activities of the Russian state in the educational sphere in the post-Soviet period, which led to problems that do not allow regional universities today to solve the functions assigned to them by society, as well as the search for ways to solve them. The process of implementing this goal defined the following tasks: to analyze the degree of compliance of the post-Soviet policy of the Russian state in the educational sphere with the proclaimed political and legal foundations of the state structure of the Russian Federation, guarantees of the socio-cultural development of Russian peoples; to identify the relationship of the results of modern reforms in the higher education system with the objective functions of regional universities of the Russian Federation; to unleash the positive potential of regional universities in solving the socio-economic, sociocultural problems of the regions and peoples of the Russian Federation, preserving and strengthening its Eurasian civilizational essence; investigate the negative consequences of post-Soviet reforms on the state of affairs in regional universities, outline ways to solve emerging problems; show the importance of taking into account the ethnocultural component in the education system of the multinational Russian Federation, which determines the personal and professional qualities of younger generations, which contributes to the achievement of interethnic harmony and stability in Russian society.

Цель статьи – определить правовой статус и особенности государственной охраны объектов культурного наследия, созданных для увековечения событий военной истории, а также принадлежащих к произведениям монументального искусства. Исследование выполнено на материалах ведомственного архива управления государственной охраны объектов культурного наследия Краснодарского края, использованы национальные стандарты Российской Федерации, акты федерального и регионального законодательства. Изучены проблемы, связанные с правоприменительной практикой в отношении братских могил воинов и отдельных памятников, содержащих в своем составе военную технику, тиражированные монументы и обелиски из листового железа. Определено, что в каждом конкретном случае юридический статус и особенности государственной охраны рассмотренных монументов могут быть установлены с опорой на нормативно-техническую документацию (национальный стандарт), в большинстве случаев содержащую достаточно точные определения этих объектов. The aim of the study is to determine the status and peculiarities of the state protection of cultural heritage objects, which were created in order to perpetuate military history and are works of monumental art, within the framework of the current Russian legislation. The materials used in the article mainly relate to the regulatory framework for the protection of monuments in Krasnodar Krai. The study is based on documents from the departmental archive of the regional Office of State Protection of Cultural Heritage Objects of Krasnodar Krai, on national standards of the Russian Federation, and on acts of federal and regional legislation. The study uses historical legal, formal legal, and comparative legal methods, as well as methods of interpretation of law and logical methods. The authors examine the novelties of the Russian legislation affecting the establishment of protective zones around the monuments of architecture and urban construction and note that the acts of Krasnodar Krai also prescribe the arrangement of such zones for monuments containing burials and monuments of monumental art. The authors formulate questions related to the law enforcement practice in relation to the mass graves of soldiers and to individual monuments containing military equipment, replicated monuments, and obelisks made of sheet iron. The authors analyze the national standard of the Russian Federation, “Cultural Heritage Preservation. Terms and Definitions”, and give examples of checks for compliance with the terms in the standard at individual objects of cultural heritage. The analysis of the status of monuments containing military equipment is based on methodological recommendations published in the 1980s. They prescribed state protection for monuments made at a high artistic level from durable materials, but in practice these requirements were rarely met. The authors conclude that, along with samples of military equipment, works of architecture or sculpture created in honor of specific historical events, including guns or transport-combat vehicles installed on pedestals, are subject to state protection. It is the presence of an architectural base that allows classifying such objects with the term “monument”. In each specific case, the legal status and features of the state protection of the monuments considered in the article can be established based on the regulatory and technical documents (national standard) that contain sufficiently accurate definitions of these objects.

The object of this research is the Palaces of Culture in Leningrad built in the 1920’s – 1930’s. Among all object the author highlights the separate newly built extant Palaces of Culture in the style of constructivism, which are the monuments of cultural heritage. The subject of this research is the questions of state protection of the indicated objects and their maintenance. The article examines the existing conservation zones and territories of the cultural heritage sites; current state of the Palaces of Culture; problems of maintenance; and questions of modern functional profile of the buildings. The author studied the literary sources, analyzed iconographic materials and existing regulatory documents in the area of preservation of architectural heritage, conducted visual observation. The goal of this research lies in determining the current state of the Palaces of Culture in Leningrad of the early XX century alongside the key issues pertinent to state protection of the objects. The results may be valuable for comprising preservation orders for architectural heritage of the XX century, as well as development of restoration and reconstruction projects of the monuments of constructivism. The author concludes on the flawed system of state preservation of the cultural heritage of the XX century, and makes recommendation with regards to its solution.

The subject of this research is the peculiarities of the historical processes of establishment and development of the system of state protection of historical and cultural heritage in the largest Siberian region – Krasnoyarsk Krai. The author explores the period of institutional development of the system in form of designated institutions since its establishment in the mid-1980s to the present. The object of this research is the system of administrative arrangement and control of the heritage protection authority in Krasnoyarsk Krai. Detailed analysis is conducted on the content of official documents, resolutions and executive orders of the government of Krasnoyarsk Krai, which served as the basic sources on the history of the organization of state protection of historical sites in the region. The author determines the peculiarities of functioning of the system of state protection of cultural heritage sites in Krasnoyarsk Krai, depending on its place in the time-varying administrative hierarchy of regional government. The research is based on the analysis of administrative transformations in the sphere of state protection of heritage through outlining gradual historical stages in the development of control (subordination) system of the cultural and historical l heritage protection authorities in Krasnoyarsk Krai The obtained conclusions lie in the peculiarities of current functioning of the system of state protection of heritage in Krasnoyarsk Krai. This article is first to trace the history of development of the system of state protection of historical and cultural heritage from the perspective of its hierarchical status in administrative governance of the region. It is indicated that the division of the state protection of monuments into an independent structure with separate authority increases the role and significance of the branch of state protection of cultural heritage sites in the region.

From military necessity to individual responsibility – the “Al Mahdi” case as a caesura in the criminal punishment of the destruction of cultural property on an international levelIn April 2012, the Islamist group Ansar Dine launched an attack on the UNESCO World Heritage sites in Timbuktu, Mali. Besides illustrating the political and religious backgrounds that led to this action, the purpose of this paper is to highlight the historical development of the international legal framework for the protection of cultural heritage, including the trial against Ahmad Al Faqi Al Mahdi, who was in charge of the Timbuktu attacks. As will be shown, the case has the potential to set a precedent.
