V. E. Yuzhanin made a great contribution to the development of the domestic theory of criminal and penal law, raised sensitive issues related to serving a sentence of imprisonment. The article focuses on the main scientific works of Professor V. E. Yuzhanin. The purpose of the studyis to analyze the main penitentiary ideas of the scientist, identify the most significant of them, assess the professor's contribution to the development of the domestic penal law science. The methodological basis of the research was formed by the analysis, synthesis, induction, system-structural, formal-logical and historical methods. As a result of the work carried out, it was found that the penitentiary ideas expressed in the works of V. E. Yuzhanin made a significant contribution to the development of the domestic legal science. Special attention should be paid to the conclusions of the scientist regarding the definition of the goals and nature of criminal punishment and practical recommendations related to increasing the efficiency of the execution of criminal punishments, first of all, punishment in the form of imprisonment, proposals for changing the approach to assessing the personality of a convict, which underlies the distribution of convicts in correctional institutions, as well as within them and ensuring a stricter isolation of criminal leaders. The data obtained as a result of the study can be taken into account when organizing the work on modernization and determining the most optimal ways and directions for the development of the domestic penal system and penal legislation, and used in the educational process of higher educational institutions of the Federal Penitentiary Service of Russia. The penal system cannot be characterized as the evidence that does not require explanations and justifications. Like any other open system it is influenced by many external and internal factors. The degree and nature of this influence cannot always be known and explained by means of analytics of a theoretical level. Not all problematic issues can be presented in a practical way. A large heuristic potential lies in the methodological tools of the philosophical level, which according to the authors of the article did not receive wide use in understanding the essence of phenomena and processes reflecting the activities of the penal system. The philosophy of the penitentiary law is the metaphenomenal basis for activities in the penal sphere. The article discusses the traditional problems of the penal system, which can be investigated using philosophical and legal tools. Attention is drawn to the need to form the criminal-legal outlook of the Russian Federal Penal Service staff and an integrated legal thinking that is impossible without mastering the philosophical level of knowledge of law. No science can do without philosophical grounds since their role consists in shaping the interpretative schemes necessary for understanding the essence of knowable phenomena. The purpose of the article is to substantiate the need to introduce into the educational process the discipline “Philosophy of penal law” or to consider questions of the philosophy of penal law in the framework of other disciplines traditionally included in the curricula of higher educational institutions of the Federal Penal Service of Russia. Among the problematic issues that accompany the activities of the penal system, which can be most fully considered in the framework of philosophical and legal approaches, should be called the transition from the punitive function of the penal policy to protective and humanitarian; the necessity of moralizing penal law; dual penal legal policy; penal security; the limits of liberalization of penal policy, etc.

The article provides a theoretical analysis of Part 1 of Article 82 of the Criminal Code of the Russian Federation, which defines the regime in correctional institutions of the Russian penal system. It is noted that this definition does not correspond to the achievements of modern penitentiary scientific thought about the regime. In particular, it is emphasized that the regime cannot provide conditions for serving a sentence, since it includes these conditions. Also, the regime cannot ensure the protection of convicts, supervision over them and separate maintenance of different categories of convicts, since, on the contrary, the latter are the means of ensuring the regime. According to the authors of the article, the legislator incorrectly uses the phrase regime of detention of convicts, meaning regime of serving a sentence, since they are different legal phenomena. It is noted that the most optimal definition of the regime is presented in the theoretical model of the general part of the new Criminal Code of the Russian Federation, prepared by a group of authors, but the authors also subjected this definition to some adjustments.

The organization of the subject-spatial environment is one of the necessary elements for the successful formation of the educational process, including in institutions of additional education. Currently, researchers pay attention to the importance of the subject-spatial component of the educational environment. To develop a comfortable, creative interior, it is necessary to develop a system for assessing the compliance of this component with modern design requirements. Within the framework of the article, a possible variant of universal criteria for evaluating recreation areas in leisure and educational institutions is proposed, the results of which reveal the existing contradictions and shortcomings, as well as provide a choice of a conceptual solution for subsequent project development.

Introduction. The article analyses the essence of marketing management of company activity as a scientific category through the theoretical analysis of the terms content. These terms determine it. They are presented in the works of foreign and Ukrainian authors. On the basis of the research it has been proved that universities need systematic development of consumers to improve their marketing and general increase of functioning efficiency on the market of educational services. Purpose. The article aims to develop the theoretical approaches and practical recommendations which concern the role and main tasks of marketing management of company activity. Method (methodology). The directions of improvement of higher educational institutions marketing management on the basis of consumers’ development have been determined. It has been done considering the method of systematic and structural analysis, method of causal and effect analysis, method of synthesis and argumentation. Result. The development of conceptual model of marketing management, as well as the author's definition of "marketing management" and "development of consumers" have become the results of research.

The article analyzes the current problems of monitoring the activities of institutions and bodies that execute criminal sentences. In accordance with the Conception of the penal system of the Russian Federation development until 2020 one of the most important activities of the penal system is to create the necessary conditions for monitoring the activities of institutions and bodies that execute sentences. For this purpose it is required to ensure transparency in the activities of the penal system on the basis of wide involvement of civil society institutions in the process of execution of criminal sentences. The need for public control is also indicated by international regulations on the treatment of prisoners, primarily the Standard Minimum Rules for the Treatment of Prisoners and the European Prison Rules. At the same time at present the problems of public control are not sufficiently developed, in particular, the limits of the controlling influence on the penitentiary system by the public are not defined, there is no specific list of subjects of public control in this area, their powers are not defined. Based on the analysis of international regulatory legal acts Russian legislation, the activities of correctional institutions in the field of public control over the activities of institutions and bodies that execute sentences, the authors have prepared a number of recommendations to improve the current legislation and practice of its application. The article focuses on the need to carry out inspections by organizations that are not dependent on the prison system. For this purpose it is proposed to involve various public organizations, including non-governmental, as well as ombudsmen for human rights, for the rights of the child. It is important to expand cooperation with the media. The results of the article can be used in the educational process in the study of legal disciplines as well as for further researches in this area.

Throughout history, human society have encountered various problems for which there have been some tentative solution while others have continued along with the development of the society in different quantitative and qualitative forms. One of the long-standing problems in Kurdistan region is the process of education which has a deep-rooted history in the region and it manifests itself in different forms at different intervals without being radically resolved. The researcher, an experienced educator, who has spent four decades in the process, possesses first-hand knowledge on the process and thinks that the problems are becoming more and more serious. The reasons for this sharp downfall are numerous and various. One key reason, for instance, is that the educational institutions, including the universities, annually graduate thousands of students who cannot become active members of the society and fail to invest and practice their skills and knowledge in the scientific fields. The reason, however, lies in the fact that the educational centers put more emphasis on the theoretical aspects of learning rather than the practical ones. Thus, the present study is assumed to be a scientific attempt seeking to delimit the various facets of the educational process by referring to the pragmatic philosophy (emphasis on the value of hard work and seeking knowledge); i.e., the thought that is workable, practical and implementable, since the educational process represents not only a preparation for a lifelong career but the life itself as well. The study consists of three sections. The first is the general framework where the problem, the goals, the scopes of the study with the definition of key terms has been stated. In the second section the researcher have outlined the second section   of the study including, analyses of pragmatism program and review of the previous studies and literature. The third section covers three main topics: the educator, the student, and the program). The conclusions and the list of references are given at the end of the study.

Based on the analysis and comparison of the concepts «occurrence» and «phenomenon» in philosophy and pedagogy, the pedagogical profile is substantiated as a phenomenon that differs from occurrence by comprehension, analysis, generalizations, and conclusions. It has been substantiated that the phenomenon in pedagogy is an occurrence that: 1) has its own history, 2) is clearly defined, and 3) its existence has an impact on the subjects of the pedagogical process and the development of pedagogical science. It has been proved that the problem of pedagogical characteristics was developed by the leading domestic educators and psychologists of the middle of the XIX — the second half of the XX century. It has been emphasized that the pedagogical profile has been used in the educational process since the beginning of the twentieth century. It has been concluded that, like every scientific pedagogical phenomenon, the pedagogical profile is subject to operationalization and a holistic study with the definition of the subject, object, chronological boundaries, carrying out of the historic and graphical search, coverage of the contribution of scientists — teachers and psychologists — in its development, a comprehensive analysis of the structure, content and the use of characteristics in educational institutions in different historical periods. The author's definition of pedagogical profiles as a phenomenon that appeared in the second half of the nineteenth century and was further developed theoretically and methodically by teachers and psychologists O. Lazursky, S. Rubinstein, B. Baev, V. Sukhomlinsky, and others; it is a kind of text in which the value judgments about a pupil are substantiated; it has a structure of the text-reasoning, in which the traits of character and the personality of the pupil are indicated, the arguments are concrete facts of life, the behavior of the pupil, obtained as a result of a long systematic study of the pupil through observation and special research, and the conclusion — pedagogical recommendations, advice on further work with the pupil.

The purpose of the research is to analyse the experience of organising the educational process and daily life of the Land Gentry Cadet Corps of the Russian Empire. The article deals with the issues related to the definition of the role of Land Gentry Cadet Corps, which it played in the training of command personnel (officers and non-commissioned officers) for the Russian army and in the development of the military school of the Russian state during this period. Scientific novelty of the work lies in the approach to the study of the educational process in the cadet corps from the point of view of accounting and use of their experience to being in connection with the revival and development of specialised aircraft, artillery and other military schools in modern Russia. Based on the studied archival and other sources, the author focuses on the role of heads of military educational institutions in instilling high moral qualities and professional knowledge in cadets. Some previously unpublished archival sources are being introduced into scientific circulation for the first time.

The objective of this abstract was to determine the features of the using of the imitational technologies in the educational process of labor protection specialists. The theoretical (scientific literature analysis, modeling of specific situations, synthesis and comparison, evaluation and synthesis of collected facts) and empirical (observation, questioning, testing, questioning, conversation, problem solving, game interaction) analyzing methods were used as the main ones. The features of the active teaching methods using were determined. The experience of their implementation in the educational process is discussed. It is proved that the interpersonal interaction of students in the process of vocational training contributes to very many important things. Such things are: the effective formation of skills for emergencies forecasting at military and construction objects, social and educational institutions, industrial enterprises of various forms of ownership; the development of life strategies in order to minimize these destructive influences; the development of adequate measures to prevent possible emergencies etc. The experience of the «Accident at the enterprise» simulation technology using is discussed. An algorithm is proposed which consists of the next stages for the implementation of educational technology: the definition of a goal; the necessary material and equipment selection; the familiarization with the simulation problem content; the normative base of business activity studying; the creation of the investigation expert accident commission; an analysis of the materials received and the investigation of the root causes that led to an accident; the reveal of the officials who committed violations; the development of recommendations for elimination of the revealed violations; summing up and issues discussing. It is important to take into account that the simulation training technologies are the most effective when students acquire future professional activity experience, and analyze the possible variants of activity in the industrial, educational and social spheres. The author notes that the studying of the essential training technologies simulation features provided an opportunity to determine the main advantages of their use in the practice of future labor specialists training.

Introduction: the article considers issues related to the training of students at higher education organizations of the Federal Penitentiary Service of Russia. The type of training under consideration involves the use of simulation training tools to form and develop specific professional skills and qualities, enhance the practical orientation of training, and help students acquire and use practical skills. Aim: to show the prospects for building a practice-oriented model for educational process on the basis of generalization of the experience of using simulation tools in the process of training students at higher education institutions of FSIN Russia. Methods: theoretical analysis of literature and normative legal acts on the problem under consideration; synthesis and generalization; comparative legal method, empirical method, description, interpretation. Results: the analysis of the use of simulation tools in the training of students at higher education organizations of FSIN Russia contributes to the formation of universal, professional and special competencies required for the service in the departments of institutions and bodies of the penal system. Conclusions: the use of training grounds, training workplaces, training work routes, with the use of AR and VR technologies as well, will allow students to form a clear algorithm of actions when performing official duties, and teaching staff of higher education organizations of FSIN Russia – to create situations as close as possible to reality and to the conditions of correctional institutions. A practice-oriented approach to training contributes to high-quality training and optimizes professional adaptation of young officers to the service in the penal system.
