MODERN INTERPRETATION OF "COMPETENCE" CONCEPT AS THE HIGHER CORPUS OF THE UKRAINE STATE SERVICE

The article highlights the results of the current study of the modern interpretation of the concept of "competence" in relation to the higher civil service corps. It is established that in Ukraine the notion of "competence" is defined as the combination of knowledge, skills, and practical skills, personality qualities or the ability of a person to use special knowledge, skills and abilities and personal qualities within the limits of powers determined. At the same time, there is a mismatch between the competences of the mas-ter's level of higher education and the requirements for persons who are applying for the post of senior civil service, as well as these requirements and key indicators of the evalua-tion of the results of the service activity. International standards indicate that the modern interpretation of the concept of "compe-tence" is based on the activity approach: as demonstrated the ability to apply in practice that knowledge and skills, which affect the quality and in a manner that will lead to quality improvement. That is, the competence of employees, in particular, the senior civil service, should be demonstrated during their activities on the positions and contribute to the im-provement of the quality of public administration. It is proved that further research should relate to the activity approach in applying the concept of "competence" and scientifically grounded proposals as to the definition of the components of competence of senior civil service officials and the criteria for evaluating their activities.

In this scientific article the main elements of game theory are analyzed, the achievements of domestic and foreign scientists devoted to the consideration of such theory are investigated. The expediency of involving in the practical activity of the civil service in the system of judicial authorities effective methods used in the field of business and consisting in the use of game technologies, which have proven their effectiveness in terms of providing quality services. It is focused on the fact that game theory can play a key role in the decision-making process, however, it is important to strictly adhere to the limits of its application. Possible conflict situations in the work of civil servants of the justice system are formulated and it is investigated that in conflict conditions each so-called participant of the game makes his course, i.e. chooses his strategy, as a result of which the relevant conflict situation is outlined and a set of strategies of all players. Some examples of the use of elements of game theory are given and the content of certain types of strategies is revealed. In particular, a strategy is described, which is denoted by the term "screening". Taking into account the definition of ways to modernize the civil service, the need to include in standardized training programs for civil servants of the justice system category "B" training course, which will include the basic principles of game theory for their active use in conflict, skills to compromise in relationships with visitors to the court - recipients of court services, selection of the right strategy, consideration of theoretical and game modeling of personnel management tasks, focusing on the ability to obtain and timely provide the necessary information to create a new civil service in the judiciary that meets international standards.

Актуальность статьи связана с поиском новых способов и методов повышения эффективности борьбы с преступностью, оперативного раскрытия преступлений, а также с набирающим популярность среди криминалистов направлением «криминалистического мышления», овладение навыками которого будет способствовать наиболее полноценному и объективному расследованию уголовных дел. Проблемным в настоящее время является недостаточное качество следствия и необходимость повышения когнитивных способностей следователей (дознавателей). Задачей исследования являлось выявление факторов, влияющих на развитие и формирование криминалистического мышления следователей. Цель работы - провести анализ составных частей процесса становления следователя и особенностей его практической деятельности, влияющих на когнитивные способности с точки зрения криминалистики, путем изучения и сравнения имеющихся материалов по данной тематике. Анализу подвергнуты личностные качества следователя, особенности образовательного процесса и влияние опыта на результаты работы, а также факторы, сопутствующие следственной деятельности (организация труда, уровень стресса, нагрузки и т. д.). Результат проведенного исследования выражен в определении проблемных факторов, влияющих на формирование криминалистического мышления следователя (дознавателя) и возможных путей их преодоления, важности такого мышления, которое остается знанием, постоянно сориентированным в сторону практики. The relevance of the article is related to the search for new ways and methods to improve the effectiveness of the fight against crime, the prompt detection of crimes, as well as the trend of «forensic thinking», which is gaining popularity among criminalists, mastering the skills of which will contribute to the most complete and objective investigation of criminal cases. Problems at present are insufficient quality of investigation and the need to improve the cognitive abilities of investigators (inquirers). The task of the study was to identify factors that influence the development and formation of forensic thinking of investigators. The purpose of the work is- to analyze the components of the process of formation of an investigator and features of his practical activities affecting the cognitive abilities in terms of forensics by studying and comparing existing materials on this topic. The analysis is subjected to the personal qualities of an investigator, the peculiarities of the educational process and the impact of experience on the results of work, as well as factors associated with the investigative activity (organization of work, stress and stress levels, etc.). The result of the study is expressed in the definition of problematic factors affecting the formation of forensic thinking of an investigator (inquirer) and possible ways to overcome them, the importance of such thinking, which remains knowledge, constantly oriented towards practice

This chapter begins with a series of examples that illustrate the power wielded by unelected state officials. This power includes not only discretion but also control over the policy process, as well as the ability to bring pressure to bear upon elected officials. The exercise of this administrative power, far from being an imperfection in the system, contributes a great deal to the quality of public decision-making. But it raises a difficult normative question concerning how unelected officials can wield power in a way that is consistent with the commitment to political neutrality of the permanent civil service and to the more general principles of democratic legitimacy that govern liberal-democratic states. A contrast is drawn between this position and the one defended by Pierre Rosanvallon.

The article analyzes conceptual foundations, views and ideas concerning the essence of expert prevention. The relationship between the concepts of «prevention» and «prevention», which is in contact with each other, is investigated, because one of the main problems of the criminal investigation of the phenomenon of expert prevention is the ambiguity of both scientific understanding and the practical application of the corresponding conceptual-categorical apparatus. It is emphasized that the essence of expert prevention is the influence of the relevant subjects on crime through the use of special professional knowledge. That is, to the subject of forensic examination, should include studies of circumstances on the basis of which can be and should be developed scientific, organizational and technical measures of preventive nature. Proven that among the tasks of preventive nature, which can be solved by the staff of judicial-expert institutions, the development of aimed at forecasting in criminalistic aspects of circumstances contributing to the commission of crimes, taking into account the possibilities of certain types of expert research, should occupy an important place. It is proved that the preventive activities of forensic institutions of Ukraine should be carried out: in the production of examinations in specific criminal, administrative or civil cases; by summarizing expert, as well as forensic investigative practices; in the process of research on expert prevention; by providing on the basis of special knowledge of scientific and practical assistance to government agencies and public organizations in identifying circumstances conducive to the commission of crimes. In order to improve the quality of expert-preventive activities, the staff of the forensic institutions of Ukraine should pay maximum attention to the promotion of preventive activities among representatives of law enforcement and law enforcement agencies. On the basis of the analysis, the author’s definition of expert prevention is given: the activity of a forensic expert based on the laws and by-laws of normative legal acts, aimed at revealing the circumstances contributing to the commission of a crime, and the development of measures for their elimination with the use of special knowledge.

The civil service is a structural entity endowed with a certain amount of competence and authority necessary for the implementation of the tasks assigned to it. An analysis of the effectiveness of the public administration sector indicates a clear relationship between the activities of civil servants and the performance of government bodies. The quality of the work of the authorities has a significant impact on the effectiveness of the implementation of government programs. Modern conditions for reforming the civil service require civil servants to have such qualities as: education, upbringing of civil servants, their professionalism, driving motives for entering and passing the civil service. It becomes obvious that the lack of these qualities among civil servants reduces the effectiveness of the implementation of government initiatives. The article presents the results of research on the moral and ethical problems of the development of the state civil service at the level of the country and a separate region.

The purpose of this article is to study theoretical approaches to the definition of the concept of public service. The author has researched a significant list of Soviet and modern legal literature devoted to topical issues of the institute of public service. The main concept of this article is that the institute of public service is considered by us from the standpoint of consistency. The author's definition of the concept of "public service" is proposed. In addition, the article presents various concepts of understanding the concept of "public service". At the same time, the author draws attention to the fact that there is no unified normative establishment of the legal concept of "public service" in the domestic legislation. If  connected  with  the  public  administration,  service  is  the  quality  of bureaucrat service to the community. The word quality has many different and varied definitions ranging from the conventional to the more strategic ones. The conventional definition  of quality usually illustrates the direct characteristics of a product, of which there are five indicators of public service, namely Reliability marked the proper service and correct; The tangibles are characterized by the adequate provision of human resources and other resources; Responsiveness, characterized by the desire to serve consumers quickly;  Assurance, marked the level of attention to ethics and moral  in  providing  services,  and  empathy,  which  mark  the  level  of willingness to know the wishes and needs of consumers.

The problematic issues related to the definition of public administration as one of the forms of exercising state power are considered. The level of how the quality of public administration processes affects the functioning of the state system and its key mechanisms is analyzed. An important emphasis is placed on the fact that the most useful of the successful practices of public administration in developed countries can be adopted for the state system of Ukraine. Modern problems and ways of their effective solution at different levels of state and local administration are actualized. The analysis of the basic structural elements of qualitative public administration, the level of their influence on processes of realization of the state-power powers within functioning of the state system is offered. For example, it explains whether transparency and impartiality do have a significant impact on the efficiency of public administration. The efficiency (effectiveness) of various, "non-traditional" ways and means of realization of public-administrative activity is established. The conclusions of both leading scholars are analyzed, and the author's assessment of the extent to which the adoption of strategies and tactics of management activities borrowed from other areas of socially useful activity are useful for the field of public administration. First of all, this applies to the sphere of private business. Penekanan penting ditempatkan pada fakta bahwa praktik administrasi publik yang paling berguna dan yang berhasil di negara maju dapat diadopsi untuk sistem negara Ukraina. Masalah modern dan cara penyelesaiannya yang efektif di berbagai tingkat administrasi negara bagian dan lokal diaktualisasikan. Analisis elemen-elemen struktural dasar administrasi publik kualitatif, tingkat pengaruhnya terhadap proses realisasi kekuatan-kekuatan negara dalam fungsi sistem negara ditawarkan. Misalnya, menjelaskan apakah transparansi dan ketidakberpihakan memang memiliki dampak signifikan terhadap efisiensi administrasi publik. Efisiensi (efektivitas) dari berbagai, "non-tradisional" cara dan sarana realisasi kegiatan administrasi publik didirikan. Kesimpulan dari kedua cendekiawan terkemuka dianalisis, dan penilaian penulis tentang sejauh mana penerapan strategi dan taktik kegiatan manajemen yang dipinjam dari bidang lain dari kegiatan yang bermanfaat secara sosial berguna untuk bidang administrasi publik. Проанализирован уровень влияния качества процессов государственного управления на функционирование государственной системы и ее ключевых механизмов. Важный акцент делается на том, что именно полезного из успешных практик функционирования публичного администрирования в развитых странах можно перенять для государственной системы Украины. Актуализируются современные проблемы и пути их эффективного решения на разных уровнях государственного и местного управления. Предлагается анализ основных структурных элементов качественного публичного администрирования, уровень их влияния на процессы реализации государственно-властных полномочий в пределах функционирования государственной системы. Например, объясняется, действительно ли прозрачность и беспристрастность оказывают значительное влияние на эффективность публичного администрирования. Устанавливается эффективность (действенность) различных, «нетрадиционных» способов и средств реализации публично-административной деятельности. Анализируются выводы как ведущих ученых, так и предлагается авторская оценка того, в какой степени для сферы публичного администрирования полезно заимствование стратегий и тактик осуществления управленческой деятельности. ABSTRACTMany contentious elections end in disputes about alleged fraud, irregularities, and malpractices. How do we know when these claims are valid and when they are false complaints from sore losers? This article describes a new dataset developed by the Electoral Integrity Project. Based on a survey of election experts, the research provides new evidence to compare how national contests around the world are meeting international standards of electoral integrity. The questionnaire includes 49 key indicators clustered into 11 stages of the electoral cycle, as well as generating an overall summary Perception of Electoral Integrity (PEI) 100-point index. The evidence displays high levels of external validity, internal validity, and legitimacy. The PEI datasets allow researchers to gauge the perceived quality of elections worldwide. This study summarizes the PEI’s research design, compares the quality of elections around the globe, and illustrates how electoral integrity is linked with both democracy and development.

This paper tackles staff problems of contemporary public administration. It starts with an analysis of the dependence between the efficiency of administration and the effi ciency of public servants in administration, whose efficiency depends on the level and quality of their qualifications. The analysis was carried out in three perspectives (i) with regard to the whole public administration of the State, (ii) with regard to the State and government central administration and (iii) with regard to regional public administration, on the example of the Lower Silesia region. It was assumed that the quality of the staff in administration is related to and depends on the legislation regulating the recruitment for public administration offices. The relevant provisions determine the choices made in the recruitment process and the subsequent creation of career paths. However, unstable and poor legal provisions have a negative impact on the quality of public administration personnel, which is manifested in poor performance, high employment fl uctuations and a diminishing interest among the younger generation in a career in public administration. This, in turn, may distort the natural generation exchange of administration staff in the future. As can be seen from the statistical analysis conducted in respect of the numbers of public administration employees and the fluctuation among them, as well as the demographic structure examined with regard the gender, age and length of employment, the initially assumed hypothesis of the negative consequences of the inconsistent legislative policy governing the regulations of the public administration staff. The sociological picture illustrating the attitudes among the members of the society to public administration confirms the hypothesis of the poor condition of public administration and a loss in confi dence in its activities or actions. The main reason for the current situation is that the constitutional principle of the neutrality of civil servants is realised only by orders that prohibit combining civil service with political activity, but do not limit or reduce the strong and direct influence exercised by political parties on the legal regulations within public civil service or the policies of appointing candidates to key administrative positions in (not only government) offices.
