Abstract: This article discusses the analysis of the prohibition of analogy in the Draft Bill. The majority of the experts of jurisprudence against analogy. The author does not agree with the ban on using the analogy in the Draft Bill, but justifies the analogy with the record, the judge must be competent and with integrity. If the judge is unable to make analogy, then he could use self-interpretation to find a legal decition. The argument of usage of analogy is to seek substantial justice for the people without setting aside the individual’s rights, because by using the analogy, the rule of law will remain unfulfilled. It is because the crime, in its various forms, is still contrary to morality even though it is not written, and even if the crime has an impact to the public. In Islamic law, the method of qiyâs compiled by Imam Shafi’i in may be used as a good analogy, because qiyâs method has been tested by producing many laws. Keywords: Analogy, draft bill, the criminal code.

The online National Counting System (Situng) is one of a series of election organizer activities in fulfilling the principle of openness to the public. Improving the quality of service in the General Election aims to increase public trust in the implementation of elections. According to Nunkoo, the principles of transparency and knowledge must be possessed by activity organizers in an effort to increase public trust. Research with this quantitative method looks at how much influence the online national counting system (situng) information (study of the 2019 Election results) has with a study on the people of Medan City. The findings in this study indicate that the process of transparency and increasing knowledge of the people of Medan City has significantly shaped Public Trust in the 2019 Election. The act of transparency has a bigger effect than increasing knowledge of online counting. Given the large role of transparency in shaping public trust in Medan City, this activity needs to be further enhanced to provide a better understanding to the public. And it does not rule out that online situng can increase public knowledge in the electoral field. This study examines the political motives of the plan to expand the new autonomous region in Papua. This is because the expansion of new autonomous areas is not always purely for the welfare of the people but is very closely related to political interests, namely power, and position. This study used qualitative research methods. The data used in the form of secondary data was obtained through reputable media and documents in journals. Next, the data is sorted to form a systematic framework. To analyze the research data, Nvivo plus 12 was used. From the analysis, it was described, and a conclusion was drawn. The study results indicate that the political motives for the plan to expand the new autonomous region in Papua are very material-intensive, namely the interests of the political elite, both central and local, to obtain rewards, position, and power. There is a narrative in the ideological incentive motive that regional expansion is for the public interest, namely providing services, developing infrastructure, increasing human resources, and alleviating poverty. However, in reality, some of the ongoing divisions in Papua have not yet impacted the Papuan people.
